We have prepared the attached resolution of Site Development Plan Approval for your
review and consideration. This resolution contains the following unique conditions [#3.a
(3)(a)through(3)(f)J:
• The Applicant shall provide a zoning requirements and conformance table for the
trailers on the plan.
• The Applicant shall show all the required setback lines and measurements on the
plan.
• The Applicant shall show compliance with Section 240-27.LF of the Town Code.
• The Applicant shall show-compliance with Section 240-27.LK of the Town Code.
• The Applicant shall revise the plan to include a note as follows: "All utility
connections, including temporary connections, shall be underground."
• The Applicant shall revise the plan to include the site inventory, the list of storage
equipment, and the hours of operation for the Site.

RE: TECH AIR TEMPORARY SITE PLAN-
RESOLUTION OF SITE DEVELOPMENT PLAN APPROVAL
At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess
County,New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls,New York
on the 7 day of 200$at 7:00 PM.
The meeting was called to order by Chairman Victor Fanuele and upon roll being
called,the following were:

The followi g resolution was moved by . and seconded

REAS, the Town of Wappinger Planning Board has received the application of
Tech Air (the "Applicant") on behalf of Lou Paggiotta (the "Property Owner") for
temporary site plan approval to set up a 1,038-square foot tennporary office, storage area,
and nine(9)parking spaces(the"Project" or"Proposed Action"); and
WHEREAS, the Applicant proposes to utilize 0.53 acres of the 1.3-acre property
which is known as tax lot 6157-04-644025 on the Town of Wappinger tax maps and is
located on the corner of the intersection of Osborne Hill Road and Smithtown Road in the
Highway Office(HO)zoning district(the"Property" or"Site"); and
WHEREAS, the Applicant has submitted the following sheets of pians prepared by
Wayne A. Neckles,Hopewell Junction,New York:
1. Sheet 2 of 3 "Temporary Site Plan," dated February 14, 2008, with latest revision
dated March 18, 2008.
2. Sheet 3 of 3 "Proposed Site Lighting" dated March 27, 2008; and

WHEREAS, the proposed business hours for the temporary office operations are 7
am to 5:30 pm Monday through Friday and 8 am to 12:30 pm on Saturdays for gas transfer
operations; and 9 am to 5:30 pm Monday through Friday and 9 am to 12:30 pin. on
Saturdays for sales operations; and
WHEREAS, the Applicant will utilize five (5) other storage trailers as shown on the
above mentioned plans; and
WHEREAS, the storage trailers will be used to store some of the inventory,
acetylene gas, non flammable gas, oxygen tanks and empty tanks; and
WHEREAS, the Applicant has signed a lease agreement with the Property Owner to
utilize the Subject Property; and
WHEREAS, the Applicant will remove all office and storage trailers along with the
chain link fence, temporary power and other improvements and will return the Site to its
presently existing condition after eight(8)months; and
WHEREAS, the Project is an Unlisted Action with respect to SEQR and WEQR;
and
WHEREAS, the: Planning Board is familiar with the Site and all aspects of the
Project and is satisfied that the Project will comply with the Zoning Law including without
limitation the Site Development Plan, Parking and Performance Standards of Articles iX, X
and XI respectively of the Zoning Law as well as other applicable laws and regulations
subject to the conditions below.
NOW,THEREFORE,BE 1T RESOLVED,AS FOLLOWS:
1. The Planning Board hereby adopts and incorporates as findings and determinations
the recitations and statements set forth above as if fully set forth and resolved herein.
2. Pursuant to State Environmental Quality Review regulations, the Planning Board
hereby adopts a Negative Declaration on the grounds that the proposed action will
not result in any significant adverse environmental impacts since any construction
and land disturbance associated with the development will be controlled and
mitigated through proper drainage and erosion control.
3. The Planning Board hereby grants Site Development Plan Approval to the Project to
set up a 1,038-square foot temporary office, other trailers, storage areas, and nine
(9) parking spaces on a portion of the 1.3-acre property in accordance with the

provisions of Articles IX, X, and XI of the Zoning Law subject to the following
conditions and modifications:
a. The following shall be fulfilled prior to the issuance of a Building Permit in
conjunction with this site plan or any permission for site improvements being
issued to the Project:

Collector that all taxes due on the Subject Property have been paid in
full.
(3) The Applicant shall amend the above mentioned U to the
satisfaction of the Town Planner as follows:
(a)' The Applicant shall provide a zoning requirements and
conformance table for the trailers on the plan.
(b) The Applicant shall show all the required setback lines and
measurements on the plan.
{c The ,Applicant shall show compliance with Section 244--27.1.F
of the Town Code which states that "sales trailers shall meet
the minimum setback requirements from all existing streets
abutting the perimeter of the Subject Property and shall
maintain twice the minimum required setback from any
residential property abutting the property on which they are
\ located."(This property abuts a residential property.)
d) The Applicant shall show compliance with Section 240-27.LK
of the Town Code which states that "construction or a sales
trailer shall be provided with all required utility connections,
including but not limited to electricity, telephone service, and
shall meet all requirements of the New York State Uniform
Fire Prevention and Building Code. All utility connections,
including temporary connections, shall be underground."
(e) The Applicant shall revise the plan to include a note as
follows: "All utility connections, including temporary
connections, shall be underground."

{f) The Applicant shall revise the plan to include the site
inventory, the list of storage equipment, and the hours of
operation for the Site.
b. The following conditions shall be satisfied prior to the issuance of a
Certificate of Occupancy:
(1) The Applicant shalt fulfill all of the conditions of, and shall complete
all improvements required in accordance with this Resolution of Site
Development Plan Approval.
(2) Certified "as-built" drawing(s) shall be submitted to the Town Zoning
Administrator.
(3) . Water supply and sanitary sewage services shall be approved,
constructed, inspected and in operation in accordance with the
requirements of the Dutchess County Health Department as required
by Section 240-27.l.L of the Town Code,
4. In accordance with the Town's Schedule of Fees, the Applicant shall be
responsible for the payment of all application review fees incurred by the Planning
Board in the review of this Project which are in excess of the application review
fees paid by the Applicant to-date. Such fees shall be paid within thirty (30) days
of the notification to the Applicant that such fees are due. If such fees are not paid
within this thirty (30) day period and an extension therefore has not been granted
by the Planting Board,this Resolution shall be rendered null and void. Refunds of
any remaining funds within the escrow account for the applications will not be
made until six(6) months after the issuance of the Certificate of Occupancy for the
Project.
5. In accordance with Section 240-27.1.1 of the Zoning Law, a construction or a sales
trailer shall be removed from the property and the Certificate of Occupancy
therefor shall expire two (2) years from the date of issuance of a Certificate of
Occupancy therefor. In no case shall a construction or a sales trailer be permitted
for more than two (2)years, unless otherwise extended by the Town Board.
6. In accordance with Article IX of the .Zoning Law, unless otherwise extended by the
Planning Board for good cause shown, this Site Development Plan Approval shall
expire and become void one (1) year from the date of the adoption of this Resolution
if an application for a Building Permit has not been made, or three (3)years from the
date of the adoption of this Resolution if construction in conformance with the
approved Site Plan has not been completed, if the construction is not prosecuted with

reasonable diligence, or if the premises has been substantially vacant or inactive for
more than three (3)years.
7. The continued validity of any Building Permit or Certificate of Occupancy issued in
accordance with the approved site plan shall be subject to continued conformance
with such approved Site Development Plan.
8. The Planning Board Chairman shall endorse a copy of this resolution certifying its
correctness. The Applicant shall also sign a copy of this resolution after it has
been initially endorsed by the Chairman acknowledging his receipt of a copy of the
resolution. When all of the conditions set forth in the conditions above have been
satisfied, six (6) sets of the above referenced plans, revised as necessary, shall be
submitted for endorsement by the Planning Board Chairman, certifying that the
plans comply with the terms of this resolution, at which time, the Chairman shall
also endorse this resolution in the space provided below, certifying that the
applicant has complied with the above conditions of approval and that the issuance
of a building permit is authorized for the improvement set forth in this Project.
One (1) set of the endorsed plans will be returned to the Applicant, one (1) set will
be retained-by the Planning Board, and one (1) set each will provided to the Town
Building Inspector, Town Engineer, Town Highway Superintendent and Town Fire
Inspector.
9. The Applicant. must return for approval from the Planning Board if any changes to
the endorsed plans and/or this resolution of approval are subsequently desired.
The question of adoption of the foregoing resolution was duly put to a vote on roll call,
which resulted as follows:
