Dear Mr. Porter:
Thank you for your letter of July 24, 1970, in-which you
describe the method of fabrication to be employed for the structure
for which you submitted plans with your application for a building
permit. I understand that this will be the first structure to be
erected on the 27 lots you have purchased in the Ye Olde Apple
Orchard development.
Because our Ordinance, by definition, classifies this type
of structure as a mobile home, and mobile homes are permitted
only in approved trailer parks, I shall have to deny your
application for a building permit.
You have a right to appeal my decision to the Zoning Board
of Appeals, and if the Board were to reverse my decision I could
issue your building permit, provided that the plans$ as submitted,
meet the requirements of the New York State Building Code.
You do not mention in your letter whether you intend to use
the same model structure for the remaining 26 lots which you own,
of if you plan on carrying out the designs as originally presented
in a brochure to the Town Board.
I enclose the formal notice of denial and copies of Notice of
Appeal for your information. 1
