Subject : Application of David D. Watkins for a Special Use Permit
to estabs_isha Public Stable with an indoor Riding Ring
and Stalls on his property located on Brown Road, in
the Town of Wappinger .
At the April 19th, 1976 meeting, the Planning Board of the
Town of Wappinger adopted the following resolution:
WHEREAS, the Town of Wappinger Planning Board has received an
application from David D. Watkins for a Special use Permit for the
construction of a public stable with indoor riding ring and stalls
on his property located on Brown Road, in the Town of Wappinger,
and
WHEREAS, a public hearing was held on said application at the
Town Hall, mill Street, Wappingers Falls, New York, on Monday,
December lst, 1975, and
WHEREAS, the Town of Wappinger Planning Board reviewed said
application and referred it to the Dutchess county Department of
Planning for recommendation in accordance with Section 239-1 and 239-m
of General Municipal Law and a recommandaLion was received from them
dated October 29th, 1975 and a revised report dated December 12th, 1975 .
NOW, THEIREFORE, BE IT RESOLVED THAT the.,,'I-Iown of Wappinger
Planning Board approves the site plan entitled "David Watkins, Towns
of Wappinger & East Fishkill, Dutchess County, New York" , prepared
by Richard G . Barger, P.E. & L.S, , and dated 11/11/75 .
IT IS, THEREFORE , RECON MENDED TEAT a special Use Permit be
issued subject to the following conditions :
1 . No more than twenty horses shall be kept on the premises .
2 . Horse shows shall be limited to the inhabitants of the
premises . Uo other horse show, rodeos or similar events shall
be permitted.
3 . There shall be no commercial tack shop on the premises .
4 . There shall be no sale of food or beverages except vending
machines for soft drinks .

5 . Restroom facilities shall be installed subject to the
approval of the .Dutchess County Department of Health_ Use
of the private residence's facilities shall be excluded,
0 . All feed shall be stored inside a permanent building with
all feed grains kept in dry rodent proof rooms and/or containers.
7. All manure ;shall be collected daily and kept inside permanent
buildings in covrl;�!red, watertight, rodent and fly proof steel or
reinforced concrcte .cozltainers . All manure shall be removed from
the premises on a'weekly basis and disposed of in accordance .
with methods approved by the Dutchess County Department of Health_
8_ Adequate and safe gates and fencing at least four feet high
shall be installed and maintained to contain the horses within
the stables and corral or exerc.ise areas. Open grazing shall
not be permitted.
Adequate buffer zones shall bel provided to keep the horses,
stables and manure storage areas at least 100 feet from Sprout
Creek, at least 100 feet from buildings used .for human habitation
and at least 100 feet from streets and highways.
9 Stables shall be kept dry, cleaned .daily and sprayed
periodically to prevent the breeding of flies and insects.
Such spraying shall be in accordance -with recommendations from
the Dutchess County Cooperative Extens on .Service_ To reduce
odors, stalls shall be limed and manure`,and bedding shall be
treated with superphosphate in accordance with recommendations
from the Dutchess County Cooperative Extension Service_
10. Fire control facilities for the barns, buildings and other
facilities shall be approved by the district fire chief. . Such
facilities shall include but not be limited to:
A. Sand bucketsat the doors to the stables_
B. "No Smoking" signs at all entrances to the stables with
effective enforcement.
C. Adequate water hoses and faucets properly .located so that
water can be suppliedto all areas of the stables_

At. the Januory 7.9`i-h. 1976 meeting, Dasa Harvey Miller proposed
the :to i lowing :resolution on the application. of David D. Watkins
which has been granted an area variance by the Zoning Board of
Appeals, whereas,
1. The applicant has not delineated the specific primary use
of his property in the application which currently has in our
opinion an existing principal use of a non.--conforming multi--
family dwelling with accessory uses of additional residences
plus a stable. Whereas, our Zoning ordinance in Sections 421
and All states that only one principal use can be maintained,
on the property and the addition of the—proposed stable
is contrary to our interpretation of those sections of the
Zoning Ordinance.
2 . If in fact the applicant is asp>:s".ng for a stable expansion
of a commercial nature he must ask for a rezoning of the
