RE: Wedgewood Heights - 40 Lots - Diddell Road - Preliminary Approval
Dear Mr. Scheinberg:
At the August 26th, 1985 meeting of the Town of Wappinger Planning Board, a
motion was made by Mr. Keller to adopt the following resolution:
TENTATIVE APPROVAL IS HEREBY GRANTED to Stanley Scheinberg, Canterbury Associates,
for subdivision entitled, " Preliminary Plan of Subdivision for Wedgewood Heights,
Towns of LaGrange & Wappingers, County of Dutchess", prepared by William E. Eustance,
P.E. , and dated July 10th, 1985, subject to the following conditions:
Within twelve months of this tentative approval, the applicant is authorized to submit
an application for approval of a subdivision plat in accordance with Article II, § 22,
Article III, § 30, and Article IV of the Subdivision Regulations. In addition, the
application must meet the requirements of the Town of Wappinger Zoning Ordinance. In
addition, the following improvements, reservations, changes and requirements are
pre-requisite to the approval of the plat.
1. Approval of the Dutchess County Department of Health shall be obtained on water supply
and sewage disposal prior to final approval.
2. Curb cuts shall be obtained from the Town of Wappinger Highway Superintendent prior
to the issuance of building permits.
3. Approval of the road plan and profile and drainage plan and profiles shall be obtained
from the Engineer to the Town prior to the signing of the plat. The Conservation Advisory
Council shall be given the opportunity to review these plans prior to the approval of
the Engineer to the Town.
4. Drainage flow patterns shall be indicated on the individual plot plans. For any
surface waters that enter upon properties of other persons, the applicant shall obtain
letters from the same permitting such discharge.
5. The following improvements shall be required:
A. All storm water shall be conveyed by pipe to natural drainage courses.
B. Standard street signs will be required at each intersection and temporary signs
shall be installed during construction.
C. Street specifications shall be those presently in effect at the time of start of
construction.
D. No open stream will be allowed unless permission in writing is obtained from the
Town of Wappinger Highway Superintendent.

6. The Fire Prevention. Bureau shall review the plan and submit any recommendations that
they may have prior to final approval. The Fire Prevention Bureau shall also review
the proposed street names to prevent similarities.
7. Recreation land as indicated shall be dedicated to the Town and the deed to this
parcel shall be accepted by the Town Board prior to the signing of the plat. : Monuments
shall be installed at the- angle points on the boundry lines of the recreation area or
a Recreation fee of $500.00 per lot on the final plat shall be paid in lieu-of land
contribution prior to the signing of the plat, while awaiting a decision from the
Recreation Commission.
8. Inspection fees for sewer lines, water lines, and storm drainage lines shall be paid
prior to the signing of the plat.
9. Downstream drainage fee of $200.00 per lot on the final plat shall be paid
prior to the signing of the plat.
10. Lowest opening of all houses (windows, doors, garage doors, crawl space-, etc.) shall
be at least two feet above the finished road grade unless waived by the Town of Wappinger
Highway Superintendent and/or the Engineer to the Town.
11. All footing drains and roof leaders shall be piped into the storm drainage system
if specified by the Town of Wappinger Building Inspector.
12. Prior to the issuance of any building permits, a bond of sufficient amount: for the
road, drainage and street trees and in a form approved by the Attorney to the, Town shall
be approved and accepted by the Town. Amount of said bond is to be determined by the
Highway Superintendent and the Engineer to the Town and shall be approved by ;the Town
Board.-
13. For each lot an application shall be made for a grading permit which shall; meet the
Soil Erosion & Sediment Control Ordinance requirements, including submission of a plan
showing design and materials and at least a month by month schedule.

14. Five copies of the filed map shall be required for Planning Board distribution. Said
copies shall be required from the County Clerk's Office.
15. All lot lines and dimensions shall conform with the zone that the Subdivision is in.
16. In subdivisions with underground utilities, the developer shall contact, Central
Hudson, the New York Telephone Company, the Town franchised Cable TV Company :and the
Town Board to negotiate an agreement whereby Cable TV facilities will be installed with
underground utilities. Should these negotiations be unsuccessful, the developer or .
the applicant shall provide a statement indicating why an agreement to provide Cable TV
service could not be reached prior to the signing of the plat.
17. Street names shall be provided in accordance with the requirements of the Town of
Wappinger Subdivision Regulations or as determined by the Town of Wappinger Planning
Board.

18. Approval is subject to compliance with the Engineer to the Town's letter dated
August 216th, 1985.
19. Approval is subject to the approval of the Town of LaGrange.

RE: WEDGEWOOD HEIGHTS SUBDIVISION
Gentlemen:
There is presently a proposed subdivision before both
the Town of LaGrange and Town of Wappinger Planning Boards, proposed
for 40 lots on Diddell Road. Approximately 10 of those lots are
located in the Town of LaGrange.
The Wappinger Planning Board has requested the applicant
to submit a plan which would have the lot lines conform to the
Town Line. This results in lots which are triangular in shape
in many instances, mostly in the Town of Wappinger. The LaGrange
Planning Board feels that these odd shape lots should be avoided
if possible and recommends that the two Town Boards consider
the possibility of negotiating a Town Line adjustment to avoid
this.
Please advise this Planning Board if you would be
willing to consider this, or any other comments or recommendations
you may have. We would appreciate a response in time for our
May 2nd meeting.
