Resolution Introducing Local Law No. 5 Of 2019 For The Purpose Of Amending The
Zoning Map In Chapter 240, Zoning, Of The Wappinger Town Code In Connection With
The Rezoning Petition Known As Red Cedar Arborists & Landscapers, Inc./Swenson
Ed Shepherd of 195 New Hackensack Road came to ask why this re-zone is going through. He
complained of noise as a result of this project and potential traffic. He appealed to the board to
remedy the noise. He refused the offer to re-zone his property. He objected to not being notified
despite the fact that there is no requirement to notify him. He said the form was not filled out
properly. He objected to the Town law that does not require notifications be sent to all those
effected in the rezoning.
Steve Relyea owner of the project explained that a burm would be put up to mitigate noise.
Planning is not completed. More of these issues would be heard at the planning board.

VI.Discussions
1. Wappingers Falls Hydroelctric - Sarah Bower
Sarah Bower addressed the board explained the situation at the Wappingers Falls Hydroelectric
plant. She indicated that the 110 year old pipe suffered a collapse and they are sourcing the steel
to repair it. They will replace two hundred feet of pipe and should be back in service in 2
months.
They can now sell to customers of the town at a 10% discount. Attached is a photo of the turbine
room.
2. Chelsea Dock Repair - Frazier
Steve Frazier explained that the dock has not been installed because of the retaining wall which
supports the 6 ft. high retaining fence has fallen apart through the winter. There is a risk of fence
falling on the walkway. Ownership of the retaining wall is in question. Attorney Horan
explained it is not clear where the end of Front Street is. Supervisor Thurston asked Mr. Frazier
for a remedy and recommendation cost to repair the wall for better launching. Councilman Beale
suggested looking into the marina next to the town dock regarding additional options.
3. Robinson Park Issues - Thurston
The issue of speeding was addressed to come up with ideas and recommendations on how to
proceed at the July 8th meeting and also to look into safety issues, fences, etc... Mr. Lamondo
added that he wants a short term solution. He suggested two speed bumps.
4. Web Site Rollout - Cavaccini
Mr. Cavaccini addressed the board with an overview on the new Town website. He went
through some of the new features, links, and webpages of the site. The new domain will be
'townofwappinger.ny.gov' replacing the 'town wappinger.us' domain. Councilman Beale
suggested emergency alerts that can be put on the website.

VII.Resolutions
1. Motion To: Start the RFP bidding process for the Bathroom, Walkway, and Septic System at
Inspiration Field
The estimate is $204,000 for bathroom walkway, and septic.

RESOLUTION: 2019-95
Resolution Authorizing Repairs To Field Surface At Inspiration Field
WHEREAS, cracks have developed in and below the surface of Inspiration Field and need to be
repair to insure the safety of the players and other using the field; and
WHEREAS, the Supervisor of Buildings and Grounds and the Engineers to the Town have
obtained a quote to make the needed repairs to the field which are described in the attached quote from
Copeland Coating & Sport Surfaces; and
WHEREAS, Supervisor of Buildings and Grounds advises that the appropriations made in the
adopted 2019 Budget are insufficient to pay for the needed work and recommends that a budget transfer
be made to perform the work;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby accepts the quote from Copeland Coating & Sport Surfaces to
make the necessary repairs to the field in the amount of $15,000.00.
2. The Town Board accepts the contract offer to repaint all the existing field markings at a
cost of $2,500.00.
3. The Town Board hereby authorizes the following budget line transfers for the needed
work:

4. The Town Board approves a contract with Copeland Coating & Sport Surfaces as set

Resolution Authorizing Refund Of Escrow For Rezoning To Jusomi Holdings, LLC
WHEREAS, JUSOMI HOLDINGS, LLC filed a petition to the Town Board seeking to
rezone a property that it owned; and
WHEREAS, on February 24, 2017, JUSOMI HOLDINGS, LLC posted an initial escrow
ltants; and
WHEREAS, on July 10, 2017, the Town Board adopted Local Law 5 of 2017 that
granted the petition and rezoned the property; and
WHEREAS, JUSOMI HOLDINGS, LLC requested that the Town return the escrow
balance; and
WHEREAS, the Town Comptroller has audited the escrow account and has verified the
amount due to JUSOMI HOLDINGS, LLC.
NOW, THEREFORE, BE IT RESOLVED:
The Town Board hereby authorizes a return of the consultant review escrow for the rezoning
petition in the amount of Two Thousand Six and 25/100 Dollars ($2,006.25) to JUSOMI
HOLDINGS, LLC.

Resolution Appointing Seasonal Laborers In Buildings And Grounds Department
WHEREAS, in its 2019 Budget, the Town Board funded Seasonal Laborer positions in the
Buildings and Grounds Department to assist with the repairs and maintenance of Town Buildings

WHEREAS, the Rules of the Dutchess County Department of Human Resources authorizing the
appointment of seasonal employees by the Town as a temporary appointment for a limited
duration; and
WHEREAS, the Supervisor of Buildings recommends the appointment of Matthew Murphy as a
seasonal worker;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby appoints Matthew Murphey as Seasonal Laborer effective April
23, 2019 who shall be compensated at $15.00 per hour out of budget line A.7110.0103.
2. The appointment is subject to the approval of the Dutchess County Department of Human
Resources and is further subject to Civil Service Law and the Rules of New York State
and the Dutchess County Department of Human Resources.
3. All necessary documentation for the appointment shall be filed with the Dutchess County
Department of Human Resources.

Resolution Acknowledging Receipt Of Additional Pave-NY Funding
WHEREAS, the 2019 Budget for the Town of Wappinger anticipated $220,000.00 as revenue
from Consolidated Highway Aid from New York State DOT in budget line 3501.000-DB; and
WHEREAS, the Town Board appropriated $220,000.00 for permanent paving of Town
Highways in budget line 5112.400-DB (Improvements-CHIPS Program) based upon this anticipated
revenue; and
WHEREAS, by letter dated April 26, 2019, the New York State Department of Transportation
advised that the State has appropriated to the Town of Wappinger $196,515.00 in CHIPS funding and
$44,856.50 in PAVE NY Funding for a total of $241,371.50; and
WHEREAS, the aid from New York State is $21,371.50 more than originally budgeted by the
Town Board; and
WHEREAS, CHIPS funds and PAVE NY aid may be used for permanent paving and other
limited items; and
WHEREAS, the Town Board wishes to increase the appropriation for permanent paving by
$21,371.50 to utilize the additional state aid;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby authorizes the following budget amendments to reflect the additional
revenue:

Whereas Robert Gray formerly of Morris Associates and currently CPL was appointed by the
town in 2008 as engineer to the town and has served honorably in this capacity and,
Whereas Robert J Gray engineer to the town has served under four town supervisor
administrations and offered great guidance to the Town of Wappinger and,
Whereas he has provided engineering services and counsel for significant projects such as which
is short list of many many hundreds, e.g. New York City DEP waterline, renovations of the
emergency services building Martz Field Pavilion, roof replacement, underground electric
Carnwath Farms and countless others and now,
Therefore be it resolved that Robert J Gray engineer to the town has resigned from CPL
engineering services will no longer be serving as engineer to the town and now,
Therefore be it further resolved the town board reluctantly acknowledges the resignation of
Robert J Gray from CPL as the engineer to the town for 11 years for serving our community with
great distinction and dedication and wishes him many years of happiness in this next chapter of a
