Resolution Authorizing Grant Of Temporary Easements To Dutchess County In
Connection With The Rehabilitation Of Portions Of Old Hopewell Road
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on July 8,
2019.

The following Resolution was introduced by Councilman Beale and seconded by
Councilwoman Bettina.
WHEREAS, Dutchess County is acquiring certain property rights for the Rehabilitation of Old
Hopewell Road (CR 28) Project (PIN #8755.44); and
WHEREAS, Dutchess County is requesting temporary easements over certain Town owned
parcels along Old Hopewell Road shown as Map 35, Parcel 37; Map 54, Parcel 57 and Map 62,
Parcels 65 & 66; and
WHEREAS, the Temporary Easements shall be in place from June 14, 2020 to June 14, 2023;
and
WHEREAS, the value of said Temporary Easements are de minimis due to their small size and
short-term duration;
NOW, THEREFORE, BE IT RESOLVED:
The Town Board hereby acknowledges that it received an acquisition brochure and it waives its
right to an appraisal of the temporary easements.
The Town Board hereby donates the temporary easements to Dutchess County to accomplish the
Rehabilitation of Old Hopewell Road (CR 28) Project (PIN #8755.44) which is for the benefit of
the taxpayers of the Town.
The Town Board hereby authorizes the Town Supervisor to execute the annexed Statement of
Donation and the three (3) Temporary Easement Acquisitions.
The Town Clerk is directed to prepare a Certified Copy of this Resolution which shall be
provided to Matthew Davis of the Dutchess County Department of Public Works together with
the original documents.
The foregoing was put to a vote which resulted as follows:
