Gary Lindstrom sent an email as he watches the board meeting remotely. It read:
Town of Wappinger Board -
The following is my input for the public comment portion of the water and
sewer public hearing to be held tomorrow, October 15, 2019.
The water and sewer charges should be calculated in a different manner.
They should better reflect usage to make them fair for all and to promote
conservation.
With the current system, if I use half as much or twice as much water my
bill will be the same (billed at the current high minimum charge) and all
users are billed the same for sewage no matter the usage. I use things like
a water saver shower head and a front loading clothes washer, but there is
no incentive for me, or others, to conserve.
The billing for both should have a base amount to cover fixed costs and a
variable amount based on usage. An example of this is how Central
Hudson bills for electric service with one amount for delivery and another
amount for usage.
The Town already has all of the necessary data to implement this. The
fixed amounts include bonding costs, infrastructure repair, operation and
maintenance and for sewer, the cost would also include the sewage
disposal fee (Tri-Muni). The Town knows these costs as well as water
usage per individual customer and sewage can be tied into the quantity of
water used per customer (this is done in other places).
It is not that I disagree with the overall amount needed for water and sewer,
I just do not feel that the current system of charging is equitable and it does
not promote conservation.

Attorney Horan and Highway Superintendent Bettina addressed to Drainage Districts. They
explained that many developments were not created with drainage districts. There was a general

3. Town Financial Update - Fredrick Awino
Comptroller Awino addressed all the revenue lines in the three General Funds. The details are

Highway Superintendent Bettina handed out a document to the board, but not to the town clerk

7. Motion To: Accept the Recommendation of The Spook Hill Grant Committee
Randy Ross appeared before the board to speak on behalf of the Spook Hill Grant. He explained
that this park will be the only park in the area with outdoor exercise equipment. There will be
between 9 and 13 stations. He said, "We were a little disappointed with the county on the
$100,000." The $100,000 does not have to be matched but it can only be used for the parking
and the access. The recreation equipment should cost $85,000 for the padding and equipment.
The track should cost $15,000. Randy has a list of about 20 different organizations that can
donate the funds.

WHEREAS, the Town CAP Assessor has prepared a Certificate of Base Percentages,
Current Percentages, Current Base Proportions and Certificate of Adjusted Base Proportions for
the 2018 Assessment Roll for submission to the New York State Office of Real Property

WHEREAS, the Town CAP Assessor has attested to the accuracy of the aforementioned
Certificate which has been prepared pursuant to RPTL Article 19 and shall be used for the levy
of taxes on the 2020 Assessment Roll, a copy of said Certificate is attached hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby accepts and adopts the base percentages, current
percentages and current base proportions as set forth in the Certificate, a copy of which is

WHEREAS, the Town Assessor prepared proposed Benefit Assessment Rolls for all
Special Improvement Districts and Special Improvement Areas in the Town of Wappinger,
assessed on a benefit basis, for Fiscal Year 2020 and said proposed Benefit Assessment Rolls
were filed with the Town Clerk as required by Town Law § 239; and
WHEREAS, in accordance with Town Law § 239, the Town Board duly noticed and
held a Public Hearing on October 15, 2019, to hear and consider any objections to said Benefit
Assessment Rolls within the Town for use in Fiscal Year 2020; and
WHEREAS, all interested persons were given the opportunity at the Public Hearing to
challenge or contest such benefit assessment determinations; and
WHEREAS, the Town Board has reviewed the proposed benefit assessment rolls within
the Town for use in Fiscal Year 2020 and has determined that they were prepared in proper
order.

WHEREAS, on September 23, 2019, the Town Board, pursuant to and in accordance with the
provisions of Sections 198 and 202-a of the Town Law and other applicable provisions of law, scheduled
a Public Hearing on the Proposed Capital Budgets and Proposed O&M Charges Water/Sewer Rates and
Rents for Special Districts and Special Improvement Areas for Fiscal Year 2020; and
WHEREAS, the Town Board conducted a Public Hearing on October 15, 2019 at 7:30 p.m. and
all parties in attendance were permitted an opportunity to speak on behalf or in opposition to the proposed
Capital Budgets and proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and
Special Improvement Areas for the fiscal year 2020; and
WHEREAS, the Town Board has taken into consideration the comments made by the public at
the Public Hearing.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. Pursuant to and in accordance with the provisions of Sections 198 and 202-a of the Town
Law and other applicable provisions of law, the annexed detailed statement of the Capital Budgets and
O&M Charges Water/Sewer Rates and Rents for Special Improvement Districts and Special Improvement
Areas of the Town of Wappinger is hereby approved and adopted as the Capital Budgets and O&M

Resolution Authorizing Use Of Cash Deposit Held In Escrow To Be Used For Top Course
Paving In All Angels Heights Subdivision
WHEREAS, on November 17, 2014, the Town of Wappinger Planning Board conditionally
approved a final subdi
& Miller, Engineering & Land Surveying, PC, dated September 15, 2008; and
WHEREAS, by Resolution 2016-265, the Town of Wappinger Town Board accepted a
performance agreement secured by a cash deposit of $107,427.60 to be held in escrow to ensure
the construction of all public improvements within the approved subdivision including the
roadway which have been offered for dedication to the Town; and
WHEREAS, road and drainage improvements have been made on the road in the All Angels
Subdivision known as Padasana Court, however, the final top course paving remains to be
completed as well as other items; and
WHEREAS, the lots on Padasana Court have been developed and the residents of the homes
have requested that the Town facilitate the completion of the road so that it may be dedicated to
the public; and
WHEREAS, R.J.A. HLD. INC has requested and consented that the escrow being held by the
Town may be released to the paving contractor for the expense of installing a top course of
paving on Padasana Court and making any necessary improvements to the road;
WHEREAS, the paving contractor has provided an estimate of $64,150.00 for the cost of the
work which is required and there are sufficient escrow funds available for the paving;
NOW, THEREFORE, BE IT RESOLVED:
1. The Town Board hereby authorizes the release of sufficient escrow funds from the
account established for the All Angels Heights Subdivision, in an amount not to exceed
$80,000, for expenses related to the top course paving of Padasana Court, including
country curbing and catch basin risers as required by the approved construction plans.
2. Payment from the escrow account is contingent upon satisfactory completion of the work
evidenced by the inspection and approval of the Engineer to the Town and the
Superintendent of Town Highways.
3. R.J.A. HLD. INC and its paving contractor shall provide a voucher, an itemized invoice
of the work done, and a waiver and release to the Town, in a form acceptable to the Town

Attorney, for the paving work as a condition to payment.
4. After completing the necessary paving, R.J.A. HLD. INC. shall remain obligated to
complete all other requirements for dedicating the subdivision improvements to the
Town, including but not limited to providing as built drawings, a maintenance bond and
other necessary improvements identified in the approved construction documents.

WHEREAS, on or about December 30, 2004, Airport Drive Properties, LLC (hereinafter the

escrow to reimburse the costs of the Town of Wappinger Planning Board consultants for their

WHEREAS, the Applicant has requested that the unused balance of the Escrow Account be
returned; and
WHEREAS, the Town Comptroller has audited the escrow account and has verified the amount
due to the Applicant and the Planning Department has confirmed that a refund can be made;
NOW, THEREFORE, BE IT RESOLVED:
The Town Board hereby authorizes a return of the unused balance of the Planning Escrow in the
amount of Three Hundred Thirty-two and 50/100 Dollars ($332.50) to Airport Drive Properties,
