Resolution Authorizing Refund Of Subdivision & Site Plan Review Escrow Held For Airport Drive
Properties Llc (Account No. 04-5098/3094)
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on October 15, 2019.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll being called, the
following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by Councilwoman
Bettina.
WHEREAS, on or about December 30, 2004, Airport Drive Properties, LLC (hereinafter the “Applicant”)
deposited Twenty-three Thousand Five Hundred Dollars ($23,500.00) to be held in escrow to reimburse the
costs of the Town of Wappinger Planning Board consultants for their review of the Applicant’s Subdivision and
Site Plan Applications before the Board; and
WHEREAS, the review of the applications have been completed; and
WHEREAS, the Applicant has requested that the unused balance of the Escrow Account be returned; and
WHEREAS, the Town Comptroller has audited the escrow account and has verified the amount due to the
Applicant and the Planning Department has confirmed that a refund can be made;
NOW, THEREFORE, BE IT RESOLVED:
The Town Board hereby authorizes a return of the unused balance of the Planning Escrow in the amount of
Three Hundred Thirty-two and 50/100 Dollars ($332.50) to Airport Drive Properties, LLC which is the amount
remaining in escrow account 04-5098/3094.
The foregoing was put to a vote which resulted as follows:
