Re: Atlantic Richfield Rezoning Request
The Dutchess County Department of Planning has revie"ed subject referral within
the framework of General Municipal Law. Upon a review and field inspection tho
Department finds:
1. The applicant, Atlantic Richfield Company, is requesting a rezoning of
a .6, acre parcel on the west side of Route 9 and south of an existing
ARCO service station on the corner of New and Old Route 9 from HB -2 to
HB -1.
2. The rezoning request appears to be the first in a series of requests for
variances to the Zoning Ordinance. The next request would have to be a
lot size variance and then a front yard variance to do away with the 75
foot setback and separate entrance and exit drive requirements. The
Board should be aware in its decision of the future use of this land and
the negative precedents that would be set by such a series of variances,
if granted.
3. It should also be noted that the applicant purchased both the present
service station property and the subject parcel as one parcel in March
of 1968. At the present time the parcel not used by the service station
is being treated as a separate lot.
4. The proposed use of the parcel must be considered in subject rezoning
request. The construction of a used car lot in this location is, in
our opinion, ill-advised. The subject proposal would create serious
problems relating to traffic movements into and out of the proposed lot.
In addition, it would signal the beginning of a strip roadside develop-
ment along the Route 9 corridor negating its purpose as a major traffic
thoroughfare.
It is desirable, in our opinion, to maintain the standards established by the
Zoning Ordinance for this section of the Route 9 corridor in the interests of
the future development of the Town and of the highway corridor. Therefore,
the Dutchess County Department of Planning recommends that subject application
be denied.

Regarding the rezoning request of Atlantic Richfield Company
and/or Gladia Corporation, the Town of Wappinger Planning Board
at its March 20, 1972 meeting recommended that this request be
denied.
The Planning Board recommended that this request be denied
on the basis that even with the rezoning there is still inadequate
acreage to meet the HB -1 requirements and,therefore, a variance
would be necessary in order to make use of the land. Under these
circumstances the Planning Board finds the rezoning to HB -1 to be
an unsatisfactory solution to the problem.
