prepared by John E. Railing, P.E., L.S., and dated October 14, 1985 subject to the
following condition:
1. Downstream drainage fee of $ .15 a square foot for newly constructed roofed
areas and areas covered with impervious material shall be paid prior to the issuance
of a buidling permit.

In accordance with the provisions of General Municipal Law (Article 12B.
Sections 239-1 and 239-m), the Dutchess County Department of Planning has
reviewed subject referral with regard to pertinent intercommunity and
countywide considerations. Upon analysis, this Department makes the following
findings.
Subject property, comprising 5. 5 acres of land, is located on the west side of
All Angels Road, approximately 60iO feet south of the Route 376 - All Angels
Noad intersection. The property is located in a residential zoning district
(R-40).
This application would rezone: this property to an Airport Industry Zone
(AI -2A). Permitted uses in the Airport Industry Zone include offices,
laboratories, manufacturing, motels, restaurants and similar uses.
The Town Development Plan recommends that this property and adjacent
properties be used for low density residential uses at a density of one
dwelling unit per acre. The existing zoning of the site reflects this policy.
There is no airport industry zoning along All Angels Road at this time; nor is
there any non-residential zoning on this road het en Route 376 and Widmer
Road.
The site Is located in proximity to Runway 33 of the Dutchess County Airport.
Any use of this site would be impacted by the noise of aircraft that might u
this runway. The subject site is within both the "clear"' zone and the
"approach" zone of this runway. Insofar as possible, all construction shoul
be kept out of the: "clear" zone. I

In view of the above findings, the Dutchess County Department of Planning
recommends -that, prior to a Town Board decision on this zoning amendment, the
zoning pattern for this area as a whole be examined. Rezoning of the area on
a lot by lot basis does not allow a comprehensive review of this sensitive,
and developing, area of the Town. A review of the general area is Important
because of the ongoing Airport Master Plan revision process and the potential
impact on adjacent roadways. After completion of such an analysis, the
decision in this matter should be based upon local study of the facts.
The Dutchess County Department of Planning does not presume to base its
decision on the legalities or illegalities of the -facts or procedures
enumerated in subject zoning action.

We are hereby submitting a letter of summary regarding our
request for re -zoning:
Our reason for wanting to stay in the general location is:
We have outgrown our present location (which we do not own)
Locates us basically where we are now, being ideal to
service our clients in Beacon, Fishkill, Wappingers and
Poughkeepsie.
The land is owned by Mrs. Edna VanVoorhis, located on
the west side of All Angels Hill Road, boardered on the
north by Alexanders Trailer Park (632'), on the south side
by Kotowski (621') and on the west by Brescia (2001). The
east is boardered by All Angels Hill Road (775'). This
land now has a boarder of trees on the north and west sides
that we do not intend to remove. It lies under the flight
path for run -way 33. The FAA has disallowed residental
building on this property but has given us approval for our
proposed type building and business function provided we
follow certain specifications spelled out by them - height
and location on the property and color of roof.
This parcel contains 5.23 acres (227,382.2 sq. ft.)
Our proposed building is 80x140 sq. ft.
The building will have three functions:

Shop Area
Warehouse Area

Our intent is to house our equipment and material in the
warehouse portion to protect them .from the weather. The
building will have a loading dock at the rear for deliveries

We will have parking for the office to accommodate twenty
cars. Roadways of approximately 460' all blacktop. Our fleet
of vehicles include six pick --ups (driven by foreman) , four 3/4
ton racks (left on job site) , four lj ton rack/dump (left

the VanVoorhis property.
The parcel in„question is on .the west side of All Angels
Hill Road between the Katowski'property and Alexanders Trailer
Park, and in line with.runway 33 approach.

a letter from them regarding our request which is enclosed.

Dear Mr. .Versace:
We are asking you to accept the attached as added material
in our request for rezoning of a parcel of the vanvoorhis property
on the west side of All "lingeles Hill iZoad.
Mr. spera, Supervisor of .,airports for the FA,, is forwarding
a letter saying they would "discourage family dwelling" on the
parcel because run --way 33 approach is directly overhead. This
would make a 24 hour occupancy not practical due to noise,dis-
comfort, etc.
Mr. whited, Dutchess County Commissioner of Aviation is also
willing to give us a letter to.the same affect. Brad is obligated
to first have the County attorney's.permission. unfortunately I
did not ask for these letters in time for our meeting of the 16th.
This land now draws tax for the town and school as a working
farm.' The land is seperate from the actual farm and twill not
hurt the farTis income as only two crops of hay were taken from
it last year'-, some 58D bales.
As an area to house a -co nstruction office and shop, the
town and school district will benefit by a higher tax rate.being
levid. We as a construction firm wanting to stay in the town
of Wappingers and perferably not far from our present location
would be very appreciative if the re -zoning were granted.
We are maintaining a respectable place of business, one
that we feel is not an eye sore to its neighbors but an asset to
the community. Our business isnot one that has a continuous
stream of traffic in and out all day, nor do we expect to employ
more then fifteen at the site. At present we have two excutives,
three'secretari.es,.two estimators and one expediter in the office.
lie are hoping to increase this to one more office person and two
shop men. Naturally this depends on additional space. The space
.we have now, fortunately we have out -grown and we feel our
location has played a very big part in our success. -Ne have and
are doing business at Poughkeepsie and Bast Fishkill I.B.M sites,
Fairchild, County Airport, Town of Wappingers and Dutchess County
facilities both in Beacon and Poughkeepsie.
The parcel of land is bordered by Yotowski on the south,
Brecisa on the west, Akexanders Trailer Park to the north and
All Angeles Hill Road on the east. A building of 40' -wide

by 120' long will satisfy our needs. it would have one over-
head door for emergencies and the office portion facing All
Angeles hill Road. Our loading and unloading of materials
would be done behind the building (down in the natural valley
on the.property). This would always give a neat and clean
apperance from All Angeles Hill Road. The rear and sides of
the property are lined with trees now, which make a natural
buffer to the neighbors. The hill at the rear will not be
touched adding to this buffer. I might add the elevation of
this hill is only 20'. below the ceiling glide path for run-
way 33.
The property as it stands is only attractive for "Farm"
purposes. The 5.2 acres cannot produce enough income to pay
the current tax but put to a more useful purpose such as we
are requesting will be a benefit to all concerned.
The VanVoorhis farm was part of this town before the
Airport restrictions and Town zoning came to being, morally,
serious consideration should be given our request with the
facts you have. The re --zoning will allow us to become a
permanent fixture in OUR Town.

The Planning Board has considered the two requests for re-
zoning memtioned in your letter and has decided to make the
following recommendations:

The board reviewed the facts concerning this site at the

stream of traffic in and out all day, nor do we expect to employ

The parcel of land is bordered by Kotowski on the south,

by 120' long will satisfy our needs. It would have one over
head door for emergencies and the office portion facing All
Angeles Hill Road. Our loading and unloading of materials
would be done behind the building (down in the natural valley
on the property). This would always give a neat and clean
apperance from All Angeles Hill Road. The rear and sides of
the property are lined with trees now, which make a natural
buffer to the neighbors. The hill at the rear will not be
touched.adding to this buffer. I might add the elevation of
this hill is only 20' below the ceiling glide path for run-
way 33.
The property as it stands is only attractive for "Farm"
purposes. The 5.2 acres cannot produce enough income to pay
the current tax but put to a more useful purpose such as we
are reauesting will be a benefit to all concerned.
The VanVoorhis farm was part of this town before the
Airport restrictions and Town zoning came to being, morally,
serious consideration should be given our request with the
facts you have. 'she re -zoning will allow us to become a
permanent fixture in OU, Town.

We are interested in purchasing a piece of property from
hers. VanVoorhis located on the west side of All Angeles Hill
Road in Wappingers Falls, N.Y. Our intention is to locate our
construction office and shop on this property. The building
although not finalized at this time will be one story, approxi-
mately 40' wade and 80' - 104' Long, with a gable roof. We
anticipate the pitch to be 4/12 and the eave height no more then
131. This would make the highest point 19'8" from ground el-
evation of 174'.
1 am enclosing the forms Mr. Whited (Dutchess County Comm.
of Aviation) assisted me in filling out, along with a sketch of
our proposed building and a site plan. :e took our information
from the Dutchess county Airport "obstruction Chart X286"
published February of -1982.

cation as we are anxious to proceed with applications to the
town and obtain various approvals. Our plan is to, hopefully,
start construction in late December or early January.

permit, A credit of $200.00 shall be given for previous
payment at the time of subdivision approval.
7. The Fire Prevention Bureau would like to see a minimum
of two parking spaces (no parking - fire zone) at the front
entrance.for emergency equipment. The Bureau shall also be
given an opportunity to review the building plans prior to
the issuance of a building permit.
8. A swale with rip --rap shall be provided from the
southeast corner of the building and the lower parking lot
over the steep embankment to the discharge point_

questing it be rezoned to general business. The parcel lies
directly in the,flic(nt path of run -way 33 of the Dutchess County
AirT-)ort. The current zoning allows only residential construction.
we think it is a fair statement to make that no potential home
owner is going to build a home in the path of run -way 33 with a
ceiling elevation height of 216. This fact makes the land un-
attractive to !t-40 but, on the other hand, ideal for us.
we are a general contracting firm currently located on Rte.
376 in the Torres i�uilding. V7e commenced our business in jikiy
of '82 and now find we have out -grown this site.
'The location has been very convenient for us and has de-
finitely aided in our success. We certainly wish to stay in the
Town of v.lappingers and to continue to be an asset to our town.
�e have made application to the FAA for site approval and
are enclosing a copy of this for your information. Vie have not
decide(! on the actual length of the building, awaiting your
general anprovai. We do know that access to the building for
personnelandl deliveries will be at the rear. rho building will
house a carpentry shop, material storage and our company offices.
The building will be a reflection on our company and will be one
both the town and ourselves will be proud of.
