Wappinger, held at the Town Hall, 20 Middlebush Road, Wappingers
Falls NY on the lith day of May 1993.
The meeting was called to order by Chairman Keller, and upon roll being called
the following were:

The following resolution was offered for adoption by Mr. Parsons who moved this
adoption, seconded by Mr. Musto to wit:
WHEREAS, in accordance with the Town of Wappinger Zoning Law as last revised,
GREYSTONE HOUSE Inc. by Richard E. Swanson, Agent
has submitted to the Planning Board an application to amend a previously
approved (August 12, 1983) SPECIAL USE PERMIT under the provisions of Section
430 of the Zoning Law, in the following manner:
Change condition 1 to state "1. The facility shall house no more than 55
handicapped individuals residentially and no
more than 4 respite residents with two live in
personnel."
Change condition 9 to state "9. The facility shall be permitted to affix an
identification sign in accordance with Town
Zoning Law."

The Planning Board has identified this action as a TYPE I action, declared

WHEREAS the Board does not intent to act contrary to such report, and

WHEREAS, the requirements of the Town of Wappinger Zoning Law and this Board's
regulations have been met except as noted below, and
1?1HEREAS Section 432 of the ZONING 1AW require the following findings for the
application:
432.1 (in harmony with appropriate & orderly development of the district)
432.2 (will not hinder or discourage appropriate use of adjacent lands)
432.3 (not more objectionable than use permitted by right)
432.4 (adequate & screened parking; safe entrance & exit), and
WHEREAS all approved SPECIAL USE PERMITS are subject to Section 450 of the
Zoning Law (Site Plan Approval).
NOW THEREFORE BE IT RESOLVED that
1. The Board finds that the proposed changes requested will not materially
change the application previously approved on August 12, 1983
2a The Board finds that the proposed use, as amended, and as shown on the
submitted site plan will be in harmony with the appropriate and orderly
development of the district within which it is located.
3. The Board finds that the location, nature and height of buildings, walls,
fences and plantings on the site are such that the use will not hinder or
discourage the an development and use of adjacent land and buildings.
4. The Board finds operations in connection with this permit will not be more
objectionable to nearby properties than would be the operations of any
permitted use not requiring a special use permit.
5. The Board finds that the parking areas are of adequate size for the use,
properly located, suitably screened from adjoining residential uses, and with
the entrance & exit drive laid out for maximum safety

BE IT FURTHER RESOLVED that, based upon these findings,
the application of GREYSTONE HOUSE Inc. for amendment of a previously granted
Special Use Permit in the following manner:

BE APPROVED subject to the conditions listed below, and that the ZONING
ADMINISTRATOR be and hereby is authorized to convey this Board's approval of
said application upon compliance by the applicant with the terms herein:

BE IT FURTHER RESOLVED that unless a building permit has been issued within 360
days of the date of this resolution, this approval will be null and void. AND

DECLARATION OF PARKING COVENANT
THIS DECLARATION made this / 7"day of May, 1993, by
Greystone Programs, -Inc., formerly named Greystone House, Inc.,
(hereinafter "Declarant") for the benefit of the Town of
Wappinger, a municipal corporation having its office at 20
Middlebush Road, Wappingers Falls, New York 12590 (hereinafter
"Town" ) .
W I T N E S S E T H:
WHEREAS, the Planning Board of the Town of Wappinger on
May 3, 1993 adopted a resolution granting site plan approval for
an eleven (11) Bed Intermediate, Care Facility, a respite/day
program and offices on premises owned by Declarant, located on
Wheeler Hill Road in the Town of Wappinger, County of Dutchess,
State of New York, and designated as Tax Map Parcel 19-6057-03--
487186, and more particularly described in Schedule "A" attached
hereto, which site plan, dated May 1, 1991, last revised March
19, 1993, is on file in the office of the Town Zoning
Administrator; and `
WHEREAS, Declarant acknowledges that the total number of
parking spaces required is one hundred fourteen (114), and
WHEREAS, Declarant, pursuant to 5473.6 of the Town Zoning
Law, requested a waiver of the immediate construction of eighteen
(18) of the required one hundred fourteen (114) parking spaces;
and
WHEREAS, the Town Planning Board granted said waiver,
subject to the condition that the eighteen (18) additional
parking spaces be constructed by Declarant in the event that need
for such additional parking spaces is demonstrated by the Board.
NOW, THEREFORE, Declarant, for itself, its successors and
assigns, declares that the real property described above shall be
held, transferred, sold, conveyed and occupied subject to the
following covenants:
1. Declarant shall, following issuance of a certificate of
occupancy for the approved building and use and upon request by
the town Zoning Administrator, count and record the number of
occupied parking spaces between the hours of 2:00 p.m. and 4:00
P.M. for six (6) consecutive Tuesdays following such request and
submit to the Zoning Administrator a copy of its record.
Declarant shall not be obligated to survey occupied spaces on
more than two (2) of the last six (6) Tuesdays of any calendar

2. If the Zoning Administrator determines, based on the record
provided by Declarant, that, on average, more than 95% of the
parking spaces were occupied, he shall so notify the Planning
Board.
3. Declarant shall attend a meeting of the Planning Board at
its request to review the findings of the Zoning Administrator
and consider whether further information is necessary concerning
a need for additional parking capacity. If the Planning Board
determines additional parking spaces are necessary, Declarant
shall be afforded thirty (30) days to offer any evidence it deems
appropriate.
4. After consideration of all reports and evidence presented to
it, the Planning Board shall determine the number of additional
parking spaces, if any, to be constructed. Such number of
additional parking spaces shall not exceed eighteen (18) and
shall be constructed by Declarant in the area designated on the
site plan for additional parking spaces. Submission of an
amended site plan or application shall not be required, and
Declarant shall not be required to pay any fees or costs, except
for the Planning Board's reasonable professional review fees
incurred in connection with the review and consideration of the
need for construction of additional parking spaces.
5. Declarant shall complete construction of the additional
parking spaces and drainage improvement(s) within six (6) months
of the Planning Board's determination or within six (6) months of
a commencement date established by the Planning Board if seasonal
conditions prevent earlier construction.
6. In the event the Declarant fails to comply with the Planning
Board's determination to construct additional parking spaces and
drainage improvement(s), Declarant will surrender its Certificate
of Occupancy and if the Certificate of Occupancy is not so
surrendered,the Town shall revoke the Certificate of Occupancy.
In the event it is necessary for the Town to commence enforcement
or to defend any actions undertaken pursuant to this declaration,
Declarant shall pay the reasonable expenses including
professional fees (including attorneys, planning and engineering)
at the rate of the then applicable retainer rate in existence
between the Town and said professional. In the event Declarant,
disagrees with any determination made by the Planning Board
regarding the construction of additional parking spaces,
Declarant may commence an action within thirty (30) days of the
filing of said Written decision of the Planning Board in the town
Clerk's Office pursuant to Article 78 of the Civil Practice Law
and Rules. A copy of said decision shall immediately be mailed
by the Planning Board to Declarant. Notwithstanding the
foregoing, if the Declarant substantially prevails in an action
commenced pursuant to Article 78 CPLR arising from any subsequent
determination made by the Planning Board pursuant to this
Declaration, as stated above, the Declarant shall not be
responsible for payment of the town's professional fees with
respect to the issues decided in the Article 78 proceeding.
7. Each week's violation shall be deemed to be a separate
violation.

This approval is contingent upon the applicant modifying the appropriate site
plans sheets to show:
1) Title on all sheets should include "Second Amended Site Plan„
2) The following note pertaining to the waiver of construction of the 18 parking
spaces"
"The Planning Board, under the provisions of Section 473.6 of the Zoning Law
waives the construction of the 18 parking spaces, shown crossed -hatched on the
plan. Such parking shall be constructed, upon request of the Planing Board,
under the provisions of the DECLARATION OF PARKING COVENANT dated ,
between the Board & the applicant, which agreement is filed in the Dutchess
County Clerks Office in Liber page on ."

BE IT FURTHER RESOLVED that unless a building permit has been issued within 360
days of the date of this resolution, this approval will be null and void. AND
BE IT FURTHER RESOLVED that mitigating measures as specified in Part III of the
Environmental Assessment Form, and approved by the Planning Board following the
SEQRA review, shall be implemented as part of the site plan and a C.O. shall not
be issued until all mitigating measures so specified have been complied with.
BE IT FURTHER RESOLVED that this approval is contingent upon:
A) Submission of fees as per town requirements in the form of separate checks
made payable to the Town of Wappinger:

C) The following additional conditions;
1. Approval of the Dutchess County Dept. of Health on water
supply and sewage disposal shall be obtained prior to endorsement
of the site plan
2. Approval of Town Highway Superintendent shall be obtained for
entrance and exit prior to endorsement of the site plan.
3. Downstream drainage fee of $ .15 a square foot for newly
constructed roofed areas and areas covered with impervious
material shall be paid prior to the issuance of a.certificate of
occupancy.
4. An erosion control plan shall be approved by the Engineer to
the Town prior to approval in accordance with the requirements of
the Town of Wappinger Soil .Erosion & Sediment Control Ordinance.
5. An application shall be made to the Zoning Administrator for a
grading permit under the provisions of the Soil Erosion &
Sediment Control Ordinance which requires submission of a plan
showing design and materials and a month by month schedule
detailing proposed improvements. Such permit shall be obtained
prior to any alteration of the site.
5. A drainage plan shall be approved by the Engineer to the Town
prior to endorsement of the site plan.
7. A copy of the building plans shall be supplied to the Fire
Prevention Bureau for their review prior to the issuance of a
building permit.
S. The Eire Prevention Bureau shall inspect the premises prier
to the issuance of a Certificate of Occupancy.
9. Any signs to be located on the premises and/or building shall
comply with the requirements of the Town of Wappinger Zoning Laza
10. Adequate screening shall be required for the refuse enclosure
as determined by the Planning Board.
11.. Site lighting shall be submitted and reviewed by the Zoning
Administrator prior to endorsement of the site plan to insure
that there will be no glare onto roadways and/or adjacent
residential areas.
12. Landscaping shall be required as determined by the Planning
Board.
13. A certified, "as -built" plan shall be submitted and approved
by the Planning Board prier to the issuance of a Certificate of
Occupancy.

FINAL AMENDED SITE PLAN APPROVAL to Greystone House for a site plan entitled,
"Proposed Site Plan, ICF/DD Community Residence, Suzanne MaGuire Pavilion, Wheeler
Hill Road, Town of Wappinger, Greystone House, Inc.", prepared by Dennis A. Suras,
Architect, and dated 6/30/86, and subject to the following conditions:
1. A certified, as built plan shall be submitted and approved by the Planning
Board prior to the issuance of a Certificate of Occupancy.
2. Upon completion of all requirements set forth in the action approving the site plan,
6 copies of the site plan shall be submitted for the Planning Board Chairman's
signature.
3. In any of the areas where there are steep slopes, proper guardrail protection
shall be provided.
