COMMENTS - Current Meeting:
Bridget Gannon from the Grinnell Library appeared to present the benefits of the Library. Her
printouts are attached at the end of the minutes under the Communications section. The library
will host the people conducting the census. Website is Grinnell-Library.org.
3. Motion To: Authorize $7,900 for the Removal of 17 Trees next to the Martz Field Tennis
Courts
Steve Frazier explained an algae problem on the tennis courts at Martz field next to the tennis
courts. The nearby Pine trees are shedding sap and needles on the courts and are effecting the
courts. He feels that the best solution id to take the trees down. $8,500 and $7,900 for Baisley
are the two bids. No documentation was provided to the Town Clerk for filing in these minutes.

RESOLUTION: 2020-43
Resolution Appointing Maintenance Laborers In Buildings And Grounds Department
WHEREAS, in its 2020 Budget, the Town Board funded Full-Time Maintenance Laborer
positions in the Buildings and Grounds Department to assist with the repairs and maintenance of
Town Buildings and Grounds; and
WHEREAS, the Rules of the Dutchess County Department of Human Resources authorize the
appointment of certain employees by the Town as a temporary appointment for a limited
duration; and
WHEREAS, the Supervisor of Buildings recommends the appointment of two Maintenance
Laborers.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby appoints Tyler Lloyd as Maintenance Laborer who shall be
compensated at $18 per hour out of budget line A.7110.0113.
2. The Town Board hereby appoints Jeth Graziano as Maintenance Laborer who shall be
compensated at $18 per hour out of budget line A.7110.0114.
3. The above appointments are subject to the approval of the Dutchess County Department
of Human Resources and is further subject to Civil Service Law and the Rules of New
York State and the Dutchess County Department of Human Resources.
4. The above appointments are subject to a probationary term of not less than eight nor
more than twenty-six weeks in accordance with the rules of the Dutchess County
Department of Human Resources.
5. The Town Board hereby temporarily appoints Kevin Dubois as Maintenance Laborer
who shall be compensated at $18 per hour out of budget line A.7110.0110 to fill in for a
laborer who is currently unavailable to work, possibly a temporary employee.
6. All necessary documentation for the appointment shall be filed with the Dutchess County
Department of Human Resources.

WHEREAS, the Town of Wappinger employs numerous people to carry out the
functions of Town government and yearly establishes the salary scale for each of said
employees; and
WHEREAS, the Town Board hereby establishes the salary/wage scale for employees not
covered under Union Contract as hereinafter identified.
NOW, THEREFORE, BE IT RESOLVED, as follows:

RESOLUTION: 2020-45
Resolution Appoving Shared Services Contract with Dutchess County
WHEREAS, in 2019, the Governor and members of the State Legislature enacted a state
budget including a provision that mandated the County Executive lead a panel comprised of all
city, town and village executives in the creation of a county wide shared services property tax
savings plan; and
WHEREAS, through the course of 2019 that plan was formulated to save taxpayer
dollars by reducing costs; and
WHEREAS, one of projects included in that plan was for the utilization of a County
Procurement Specialist which includes the purchase of County provided procurement assistance
by municipalities; and
WHEREAS, it has been determined that there would be administrative cost savings with
avoiding workloads, such as: the creation of bids, RFPs, and quote documents specifications,
moderating the bid process, evaluating bid/RFP/quote responses and the tabulation of results; in
addition, there could also be significant savings in cooperative purchase agreements and
piggybacking off other municipal and state contracts; and
WHEREAS, the Procurement Specialist Services are outlined in the proposed agreement
with Dutchess County; and
WHEREAS, the scope of services in the agreement includes:
assist in the writing and preparation of request for bids and proposals;
post prepared requests for bids and proposals in newspapers on the
internet;
assist in the evaluation of vendors, bids and proposals to assure they meet
specifications; and
WHEREAS, the Town would be responsible to pay a fee to Dutchess County for their
services in the amount up to $60 per hour; and
WHEREAS, the Town is authorized to enter into a Shared Services Agreement with the
County for central purchasing services pursuant to New York State General Municipal Law
§119-o; and
WHEREAS, Dutchess County Legislature has authorized the County Executive to
execute the Shared Services Agreement.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution if fully set
forth and adopted herein.
2. The Town Supervisor is hereby authorized to execute an Agreement for the
Specialist Services in accordance with a proposed contract from Dutchess County in
substantially in the same form as the annexed hereto.

LICENSE AGREEMENT
THIS AGREEMENT made this day of January, 2020 by and between the TOWN OF
WAPPINGER, a municipal corporation, having its principal offices at the Town Hall, 20
Middlebush Road, New York, on behalf of the Fieldstone Conservation Park District, hereinafter
called the "LICENSOR", and KENNETH STEPHENS & MARGARET STEPHENS,
having a principal residence at 43 Fieldstone Loop, Wappingers Falls, New York 12590
hereinafter called "LICENSEE."
W I T N E S S E T H :
WHEREAS, LICENSOR is the owner of an approximately 0.25 acre parcel located in
the Town of Wappinger, New York, County of Dutchess, State of New York known as

6257-10- Property is a part and parcel of the Fieldstone
Conservation Park District, a Park District formed pursuant to Article 12 of the Town Law; and
WHEREAS, LICENSEE, is the owner of a parcel located at 43 Fieldstone Loop, Town
of Wappinger, County of Dutchess, State of New York and more specifically identified as Tax
Map No.: 135689-6257-10-336742 which parcel is located adjacent to the Town owned Property.
WHEREAS, LICENSOR desires to accommodate the request of LICENSEE to make
non-exclusive use of the Property; and
WHEREAS, LICENSEE has historically maintained the Property on behalf of the
LICENSOR including general landscaping and it is in the best interest of the residents of the
Town of Wappinger to allow the non-exclusive use by LICENSEE upon the terms and
conditions hereinafter set forth;
NOW, THEREFORE, in consideration of the mutual promises, covenants and conditions
hereafter set forth, the parties agree as follows:
1. LICENSOR hereby grants to LICENSEE and LICENSEE hereby accepts from
the LICENSOR a license to make non-exclusive use of the Property, subject to the terms and
conditions hereinafter set forth. The license granted hereby is subject and subordinate to the

existing rights of others to use and occupy the Property in accordance with the rules and
regulations of the Fieldstone Conservation Park District and any other rules, regulations or laws

established by the Town Board of the Town of Wappinger on behalf of the Fieldstone
Conservation Park District. LICENSEE specifically acknowledges and agrees that the licensed
area shall at all times remain a public park and open to the general public.
2. Said non-exclusive license shall be limited to the privilege of maintain the
property consistent with general landscaping (i.e.: mowing, gardening and minor hard
landscaping), subject to the limitations set forth in paragraph 16 hereinbelow. Any
improvements not consistent with general maintenance shall require shall be submitted to the
Town Board for review and approval.
3. The term of this license shall commence upon the execution of this agreement and
shall expire without further notice by either party to the other at midnight, December 31, 2023,
and shall be renewed year by year thereafter unless two (2) months notice is given by either party
prior to the end of any such year, unless sooner terminated as herein provided, or unless the
LICENSOR by ten (10) days' notice in writing shall terminate the license, when and if, in its
sole judgment, it deems that such termination is necessary by operation of law, or pursuant to the
terms of this agreement, or it deems that the licensed premises is required in the interests of the
residents of the Town or for another Town purpose or purposes.
4. In consideration of the privilege granted pursuant to this license agreement,
LICENSEE shall assume all responsibility during the term of this license for maintenance,
repair and upkeep of the licensed area so as to keep the licensed area in good and safe condition,
including but not limited to any reasonably required repairs. LICENSOR
efforts to give notice to LICENSEE of any such work proposed to be performed, but
LICENSOR shall not bear any liabili
5. LICENSEE's obligation to observe and perform all of the terms, covenants and
conditions of this license shall survive the expiration or the termination thereof.
6. LICENSEE shall procure at LICENSEE own cost and expense all permits and
licenses made necessary by the intended use of the licensed area.
7. LICENSEE shall not sell, mortgage, rent, assign, or parcel out the license hereby
granted, or any interest therein, or allow or permit any other person or party to use or occupy any
part of the premises, building or spaces, covered by this license for any purpose whatsoever
without first obtaining the written consent of the LICENSOR, nor shall the license be
transferred by operation of law, it being the purpose and spirit of this instrument to grant this
license and privilege personally and solely to the LICENSEE herein named.
8. LICENSEE shall keep the licensed area clean and neat at all times.

9. LICENSEE hereby expressly waives any and all claims for compensation for any

commotion or riot, or any act of God, and LICENSEE hereby expressly releases and discharges
LICENSOR, its agents, officers, and employees from any and all demands, claims, actions and
causes of action arising from any of the causes aforesaid and agrees to hold them harmless
therefor, including attorney's fees, if any.
10. LICENSEE assumes all risk in the operation of this license and agrees to comply
with all federal, state and local laws and regulations and orders of the LICENSOR affecting the
licensed premises in regard to all matters.
11. LICENSEE expressly agrees to defend, indemnify and hold LICENSOR, its
agents, officers, and employees harmless from any and all claims for loss, damage or injury to
person or property, whatever kind or nature arising from the operation of this license, or from the
negligence or carelessness of employees, agents, representative or contractors of LICENSEE,
and LICENSEE expressly agrees to defend and indemnify LICENSOR, its agents, officers, and
employees of any recoveries against them, individually and/or jointly, arising from same.
12. LICENSEE shall at its own cost and expense take out and maintain such public
liability insurance as will protect LICENSEE (including agents and sub-licensees, if any) and
LICENSOR from any claims for personal injuries, including death, arising out of, incurred or
caused by the exercise of rights created herein or otherwise arising out of this
license. The policies shall provide coverage of a combined single limit of ONE MILLION
($1,000,000.00) DOLLARS per occurrence and shall name the Town of Wappinger as an
"additional named insured" thereof, and shall be delivered to the LICENSOR. Each policy and
certificate shall have endorsed thereon: "No cancellation of or change in this policy shall become
effective until after ten (10) days notice by registered mail to the Town Supervisor of the Town
of Wappinger, Town Hall, 20 Middlebush Road, Wappinger Falls, New York." If, at any time,
the said policy shall be or become unsatisfactory to LICENSOR as to form or substance or if a
company issuing such policies shall become unsatisfactory to LICENSOR, LICENSEE shall
promptly obtain a new policy, submit the same to LICENSOR for approval and submit
certificate thereof as hereinabove provided. Upon failure of LICENSEE to furnish, deliver and
maintain such insurance as above provided, this license may, at the election of the LICENSOR,
be forthwith declared suspended, discontinued, or terminated. Failure of LICENSEE to take out
and/or maintain or the taking out and/or maintenance of any required insurance shall not relieve
LICENSEE from any liability under the license, nor shall the insurance requirements be
construed to conflict with the obligations of LICENSEE concerning indemnification.
13. Should LICENSOR, in its sole judgment, decide that LICENSEE is not
operating the license herein granted in a satisfactory manner, then LICENSOR may terminate
this license, by notice sent by Certified Mail, Return Receipt Requested, effective ten (10) days
from mailing, as though it were the time provided in this license. All rights of LICENSEE
herein shall be forfeited without any claims for damages, compensation, refund of LICENSEE's

investment, if any, or any other claim whatsoever against LICENSOR. The ten day notice to
terminate this agreement shall include a statement of the conditions which have caused the notice

to be issued and LICENSEE shall have seventy-two (72) hours from the receipt of the notice to
cure the condition and require the termination to be withdrawn. The forty-eight hour cure period
shall be strictly enforced regardless of the nature of the condition to be cured.
14. Where provision is made herein for notice to be given in writing, the same may be
given by mailing a copy of such notice to LICENSEE by registered mail, or certified mail,
addressed to the address hereinabove or such other address as shall be filed with LICENSOR, or
by delivering a copy of said notice to LICENSEE or the manager of LICENSEE, or any other
person in charge of licensed premises.
15. This license cannot be changed orally. No term of this agreement shall be
construed against the LICENSOR by virtue of the fact that counsel for LICENSOR has drafted
the agreement.

I.SUMMARY
1.1Summary
This report has been prepared for theWildwoodSewer District regarding
the proposed improvements associated with the connection to Tri-
MunicipalWastewater Treatment Facility, and related improvements.
This Map, Plan and Report was prepared in accordance with the
provisions of Town Law §202-b for Increase or Improvement of Existing
Facilities. ATown of Wappinger Resolution for funding this
improvement isincluded in Appendix Aof this report.
The proposed improvements would include demolition of the existing
Wildwood WWTF and construction of a new pump station, force main
and gravity sewer connections from the Wildwood WWTF site to the
existing Village of Wappingers Falls collection system. The Village
collection system connects to a Tri-Municipal pump station that conveys
wastewater to the Tri-Municipal WWTF.The Town of Wappinger and
the Village of Wappingers Falls applied for and obtained an
Intermunicipal (IMG) Grant from NYS EFC for up to 40% of the grant
eligible costs for this project. This grant is expected to reduce the
overall capital costs associated with the proposed improvements.
The breakdown of capital costs for the proposed improvements are
shown in Appendix Cof this report. These costs include all the legal,
engineering and other such administrative costs for capacity within the
Tri-Municipal treatment system. The total estimated capital costs for all
of the proposed improvements would be approximately $5,566,000.It is
proposed to have the Town of Wappinger reserve excess capacity for
future use, which will be paid through the General Fund. Reserving this
excess capacity will result in a cost reduction of approximately
$1,922,000 to the Wildwood Sewer District. Assuming thatthe 40%
grant was applied to all of the project costs, the total capital costs for all
of the Improvements would be reduced from $5,566,000 to
approximately $3,340,000 and the total capital costs for the Wildwood
Sewer District would become $1,418,000.
For a 30-year bond with an assumed interest rate of 4%, the total
estimated annual cost increase for a typical single family residence with
1 benefit unit would be approximately $232, including the grant
reductions. If grant reductions are not included,then the cost increase
would be approximately $595.

The total annual user costs for a typical residential user with the grant
reductions would be $780($548 + $232), while the total annual user
costs for a typical residential user without grant reductions would be
$1,143($548 + $595).
1.2Recommendations
It is recommended that the Town Board review and accept the findings in
this Map, Plan and Report for improvements in the District as set forth in
Town Law §202-b.

II.INTRODUCTION
2.1Background
The original Map, Plan and Report for the WildwoodSewer District is
on file with the office of the Town Clerk. The existing wastewater
treatment facility is located off New Hackensack Road in the Town of
Wappinger and is reported to be onthe order of 50 years old.
The Wildwood Wastewater Treatment Facility (WWTF) currently
operates under SPDES permit No. NY0037117, with a monthly average
permitted discharge of 0.1 million gallons per day (MGD). Based upon
flowrecords, it is reported that there are Infiltration and Inflow (I&I)
issues within the existing collection system, as there are times when the
flows exceed the monthly average permitted discharge limit. The
records also indicate that the existing facility has issues consistently
meeting the existing SPDES effluent ammonia limits.
The facility was recently informed by the New York State Department of
Environmental Conservation (NYSDEC) that the proposed SPDES
Permit renewal would include new effluent discharge limits for the
facility, requiring the discharge location to meet intermittent stream
standards. As the existing facility cannot meet these proposed
discharge limits, the Town of Wappinger requested consideration of
relocating the existing effluent discharge location from the existing
tributary of the Wappinger Creek to the Wappinger Creek itself. This
may result in the discharge limits remaining at the current levels, which
could be met by the existing WWTF. The NYSDEC has noted that in
addition to a modification to the SPDES permit, the project will also
require a Protection of Waters –Stream Disturbance permit. In August
2019, a NYSDEC inspection report letter was received noting flows
above the permitted levels.The initial recommendations noted in the
letter willtake time to apply for and implement, will require an
environmental evaluation to be completed, and will be subject to review
and approval of the NYSDEC. If implemented, this recommendation
may only provide a short-term solution, as the potential existsfor
Wappinger Creek to be reclassified in the future and the Wildwood
WWTF is nearing the end of its useful life. The recent average flows for
2018-2019 have also now exceeded the permitted discharge values. As
a result of this, The Town of Wappinger performed an evaluation of
long-termalternatives for the Wildwood Wastewater Treatment Facility.

An Engineering Report prepared in July 2017 and revised in September
2019recommended replacement of the existing Wildwood wastewater
treatment facility (WWTF) with a connection to a WWTF owned and
operated by the Tri-Municipal Sewer Commission, a governmental entity
that services the Town of Wappinger, Village of Wappingers Falls and
Town of Poughkeepsie. This would include demolition of the existing
Wildwood WWTF and construction of a new pump station, force main
and gravity sewer connections from the Wildwood WWTF site to the
existing Village of Wappingers Falls collection system. The Village
collection system connects to a Tri-Municipal pump station that conveys
wastewater to the Tri-Municipal WWTF.The Town of Wappinger and
the Village of Wappingers Falls applied for and obtained an

associated with the completion of these improvements.
This analysis will be completed noting the estimated costs with and
without the IMG grant.

3.1Service AreaBoundary
The Wildwood Sewer District serves a total of three hundred thirty eight
(338) parcels, consisting of two hundred thirty (230) single family
residential homes, one (1) duplex residential parcel, one (1) triplex
residential parcel, one (1) converted residence, three (3) parcels each
with six 1-bedroom apartments per parcel, two (2) Town owned vacant
parcels, along with a one hundred (100) unit apartment complex
consisting of 28 one (1) bedroom units and 74 two (2) bedroom units. A
map andparcel list oftheWildwood Sewer District is included in
Appendix B of this report.
3.2Benefit Units and BenefitAnalysis

3.3Recommended Improvements
The proposed improvements would include the installation of a new
pump station located near the current plant headworks. The station
would be designed for average day flows from Wildwood as well as
providing excess capacity for potential additional future flows. This
would be done in conjunction with I&I improvements to the collection

system, including slip-lining of the existing collection facilities, in order
to support the original design flowrates. Force mainswould be installed
from the pump station to a gravity sewer connection located at the
Woodhill Green Condominiums parcel. Gravity sewer main would be
installed from the Woodhill Green Condominiums to the proposed
connection to the Village of Wappingers Falls gravity main located along
North Meiser Avenue. The existing gravity main within the Village of
Wappingers Falls connects to a Tri-Municipal pump station that conveys
wastewater to the Tri-Municipal WWTF. The Tri-Municipal pump
station and WWTF are owned and operated by the Tri-Municipal Sewer
Commission, which is a governmental entity that services theTown of
Wappinger, Village of Wappingers Falls and Town of Poughkeepsie.
The pump station would be threevacuum primed pumps rated at 300
gpm and a 6 foot diameter precast concrete wet well with float controls
and alarm conditions. An emergency generator would be provided as a
source of backup power for the pump station.
Approximately 3,330 feet of six inch (6”) diameter dual PVC force main
and 1,040 feet of eight inch (8”) diameter PVC gravity sewer would be
required to connect from Wildwood into the existing manhole located on
North Meiser Avenue within the Village of Wappingers Falls. It should
be noted that the 8” gravity sewer portion has been designed with excess
capacity to allow for future connection of the Woodhill Green
Condominiums. It is estimated that Wildwood will utilize approximately
50% of gravity sewer main, pump station and force maincapacity, while
the remaining excess capacity may be applied in the future to Woodhill
Green or other parcels within the Town of Wappinger.
The Town of Wappinger will construct, own and operate the new
Wildwood pump station, force main and gravity sewer. The Town of
Wappinger will also be responsible for the demolition of the Wildwood
WWTF.

IV.PROJECT COSTS
4.1Capital and O&M Costs
The breakdown of capital costs for the proposed improvements are
shown in Appendix Cof this report. These costs include all the legal,
engineering and other such administrative costs as well as the buy in
costs for capacity within the Tri-Municipal treatment system. The total
estimated capital costs for all of the proposed improvements would be
approximately $5,566,000, as shown in Appendix C.The Town of
Wappinger has previously authorized up to $6,212,000 in bonding for
the Wildwood Sewer District Improvements, as noted in Appendix A of
this report.
The total estimated capital costs include a line item for gravity sewer
main, which includes excess capacity to allow for future connection of
the Woodhill Green Condominiums. The total estimated costs include
line items for a pump station and force mains, which also includes excess
capacity for future potential connections of other parcels within the
Town of Wappinger. It is estimated that the Wildwood Sewer District
will utilize approximately 50% of the available gravity sewer main,
pump station and forcecapacity, so the Town of Wappinger will reserve
the remainingcapacity for future use, which will be paidthrough the
General Fund.Reserving this excess capacity will result in a cost
reduction of approximately $1,922,000 ($2,687,332x0.5 x 1.1x1.3) to
the Wildwood Sewer District, which would be paid for by the Town of
Wappinger through the General Fund.
Assuming that the40% grant was applied to all of the project costs, the
total capital costs for all of the Improvements would be reduced from
$5,566,000to approximately $3,340,000(Total Grant of $2,226,000).
Ifthe 40% grant was applied solely to the Wildwood Sewer District,the
total capital costs for the Wildwood Sewer District would become
$1,418,000($5,566,000-2,226,000-$1,922,000).
The current estimated 2019O&M costs for the Wildwood Sewer District
are reported to be $136.97/quarter for a typical single-family residence,
which would equate to an annual O&M cost of around $548 for a typical
parcel within Wildwood. The 2019 O&M rates for the United
Wappinger Sewer District are reported to be $127.51/quarter for a typical
single-family residence, and it would be assumed that similar rates would

apply for the Wildwood connection. There will also be an O&M charge
for the use of the Village of Wappingers Falls collection system facilities
and it is estimated that the additional cost would be approximately $9.50
perquarter for atypical single-family residence. This would result in the
total combined O&M costs being approximately the same as for the
current Wildwood Sewer District and would also equate to an annual
O&M cost of around $548 for a typical parcel within Wildwood.
Based upon the results in Appendix C of this report, for a 30-yearbond
with an assumed interest rate of 4%, the total estimated annual cost
increase for a typical single family residence with 1 benefit unit would be
approximately $232including the grant reductions. If grant reductions
are not included, then the cost increase would be approximately $595.
The total annual user costs fora typical residential user with the grant
reductions would be $780($548 + $232), while the total annual user
costs for a typical residential user without grant reductions would be
$1,143($548 + $595).
