2020-76 2020-76 Resolution Authorizing The Settlement Of The Tax Certiorari Proceedings Regarding Riverbend At Wappingers Falls, LLC And Riverbend At Wappingers Falls Ii, L.L.C. At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on March 9, 2020. WHEREAS, there is now pending in the Dutchess County Supreme Court tax certiorari proceedings commenced in 2015, 2016, 2017, 2018 and 2019 by Riverbend at Wappingers Falls, LLC and Riverbend at Wappingers Falls II, L.L.C. regarding parcels of real property located at 80 Sterling Drive, Grid No. 6158-19-721014 and 101-249 Beacon Lane, Grid No. 6158-20- 779013 seeking reductions in the 2015, 2016, 2017, 2018 and 2019 tax assessments; and WHEREAS, the Petitioners have agreed to withdraw the Petitions for 2015, 2016, 2017, 2018 and 2019 requesting reductions for said tax assessments; and WHEREAS, the Assessor and Special Counsel to the Town have recommended a settlement of these tax review proceedings; now, therefore be it RESOLVED, that the Town Board of the Town of Wappinger hereby approves a settlement on behalf of the Town of Wappinger of the tax review proceedings for the years 2015, 2016, 2017, 2018 and 2019 as it pertains to: 80 Sterling Drive (Grid No.: 6158-19-721014) Year Original Total Reduction in Final Assessment Assessment Assessment 2015 $13,500,000 -0- $13,500,000 2016 $13,500,000 -0- $13,500,000 2017 $13,500,000 -0- $13,500,000 2018 $14,040,000 -0- $14,040,000 2019 $14,040,000 -0- $14,040,000 101-249 Beacon Lane (Grid No.: 6158-20-779013) YearOriginal Total AssessmentReducti on in AssessmentFinal Assessment 2015 $7,000,000 -0- $7,000,000 2016 $7,000,000 -0- $7,000,000 2017 $7,000,000 -0- $7,000,000 2018 $7,280,000 -0- $7,280,000 2019 $7,280,000 -0- $7,280,000 ; and be it further RESOLVED, that the 2020, 2021, 2022 and 2023 assessments of the aforementioned parcels on the assessment rolls of the Town of Wappinger for 2020, 2021, 2022 and 2023 shall be established as follows: Property Assessed Value 80 Sterling Drive $13,500,000 (6158-19-721014) 101-249 Beacon Lane $6,900,000 (6158-20-779013) ; and be it further RESOLVED, that the Town Supervisor, Town Assessor and Craig M. Wallace, Esq., Special Counsel to the Town of Wappinger, are hereby authorized to take all action necessary and appropriate to effectuate the terms of this Resolution.
