1. Comptroller Revenue Update
Comptroller Awino updated all the revenue steams to the 3 general funds. Two significant
favorable streams were the mortgage refinancing revenues that are currently at 146% of budget,
and rental of real property. Highway Chips funding is at 80% of what was required or $222,740.
The $266,000 of AIM funding is still at risk.
REVENUE UPDATE
Rental of real property received $215,394 out of a budget of
$195,000 representing 110.46% of total budget. Jan- Nov
2020. Increase of $20,394
Fines and forfeited bail. Received Jan through September of
$100,162.50 out of a budget of $252,000 representing 39.75%
of total budget. July report Missing
Mortgage tax revenue of $660,040 for Jan through October
2020 reported by D.C. This represents 146% of total budget of

Resolution Adopting Final Benefit Assessment Rolls For Special Improvement Districts
And Special Improvement Areas For Fiscal Year 2021

WHEREAS, the Town Assessor prepared proposed Benefit Assessment Rolls for all
Special Improvement Districts and Special Improvement Areas in the Town of Wappinger,
assessed on a benefit basis, for Fiscal Year 2021 and said proposed Benefit Assessment Rolls
were filed with the Town Clerk as required by Town Law § 239; and
WHEREAS, in accordance with Town Law § 239, the Town Board duly noticed and
held a Public Hearing on October 26, 2020, to hear and consider any objections to said Benefit
Assessment Rolls within the Town for use in Fiscal Year 2021; and
WHEREAS, all interested persons were given the opportunity at the Public Hearing to
challenge or contest such benefit assessment determinations; and
WHEREAS, the Town Board has reviewed the proposed benefit assessment rolls within
the Town for use in Fiscal Year 2021 and has determined that they were prepared in proper
order.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby adopts the
Benefit Assessment Rolls as prepared by the Assessor subject to any corrections made by this
Board, as the final benefit assessment rolls for the Special Improvement Districts and Special
Improvement Areas in the Town of Wappinger for Fiscal Year 2021.

WHEREAS, a Resolution was duly adopted by the Town Board of the Town of
Wappinger introducing a proposed
Repealing the Existing Provision
of adoption by the Town Board; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News and
the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was held on September 28th, 2020 and all parties in
attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed
Local Law or any part thereof; and
WHEREAS, the Town Board determined that the proposed Local Law is a Type II

action pursuant to 6 NYCRR § 617.5(c)(20) and is otherwise exempt from environmental
review; and

WHEREAS, said Local Law has been on the desks of the members of the Town Board
of the Town of Wappinger for at least seven (7) days exclusive of Sunday prior to the adoption
of this Resolution.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby adopts the Local Law entitled,
a copy of which is attached
hereto and made a part of this Resolution; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to enter said Local
Law in the minutes of this meeting into the Local Law book for the Town of Wappinger and
shall file the Local Law with the Secretary of State of New York as provided by law; and
BE IT FURTHER RESOLVED, that this Local Law shall become effective
immediately upon filing with the Secretary of State as provided by law.

Application
WHEREAS, the Town of Wappinger is participating in the 2021 Dutchess County Community
Development Block Grant Consortium; and
WHEREAS, the Town Board conducted a public hearing on November 9, 2020 to receive input
from citizens and groups regarding the Dutchess County Community Development Block Grant;
and
WHEREAS, an application has been prepared in accordance with the concerns of our community.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby approves the 2021
application to the Dutchess County Community Development Block Grant Program for the Town
of Wappinger, including the certifications therein; and

RESOLUTION: 2020-168
Resolution Adopting Town Of Wappinger Workplace Violence Prevention Program
WHEREAS, the Town of Wappinger is committed to the safety and security of our employees; and
WHEREAS, New York State Labor Law §27b and 12 N.Y.C.R.R. 800.6 requires the Town to adopt
a Workplace Violence Prevention Program to prevent and minimize the hazards of workplace
violence to public employees; and
WHEREAS, the Town Board desires to adopt the attached written TOWN OF WAPPINGER
WORKPLACE VIOLENCE PREVENTION PROGRAM to satisfy the requirements of 12
NYCRR §800.6(g);
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The Town Board hereby adopts the Town of Wappinger Workplace Violence Prevention
Program which is annexed hereto and shall be made a part of the minutes of this Meeting.
2. The Town Clerk is directed to file a certified copy of this resolution together with the
annexed Town of Wappinger Workplace Violence Prevention Program.
3. The Town Board directs that every employee of the Town shall be provided with a copy of
the Town of Wappinger Workplace Violence Prevention Program and they shall sign a form
that they have received and reviewed a copy of said policy.
4. Any prior Town of Wappinger Workplace Violence Prevention Program is hereby
superseded.
5. The Town of Wappinger Workplace Violence Prevention Program shall take effect
immediately.

WHEREAS, on October 26, 2020, the Town Board, pursuant to and in accordance with
the provisions of Section 106 of the Town Law and other applicable provisions of law, accepted
the Preliminary Budget, by Resolution No. 2020-164; and
WHEREAS, in accordance with Resolution No. 2020-164, a Public Hearing on the
Preliminary Budget was held on November 5, 2020 at 7:00 p.m. and all parties in attendance

were permitted an opportunity to speak on behalf or in opposition to the proposed Annual

provisions of Section 109 of the Town Law and other applicable provisions of law, the annexed
detailed statement of expenditures and revenues of the Town of Wappinger is hereby approved
and adopted as the Annual Budget of the Town of Wappinger for the fiscal year beginning
January 1, 2021; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to enter the
Annual Budget adopted herein in the minutes of the Town Board; and
BE IT FURTHER RESOLVED, that the Town Board further directs that the amounts
identified in the Annual Budget adopted herein shall be appropriated.

Parks and Recreation
§171-1 Legislative intent.
It is the intent of this Chapter to protect the rights of all residents of the Town of Wappinger so as
to enjoy to the fullest extent possible parks and recreation areas located within the Town of
Wappinger.
§171-2 Designation of Parks and Recreation Areas.
A. The Town of Wappinger hereby establishes the following Town owned properties as
Official Park And Recreation Areas of the Town of Wappinger:

3) Carnwath Farms Historic Site & Park
4) Castle Point Park
5) Chelsea Boat Ramp

§171-3 General Park Rules and Regulations Applicable to All Parks and Recreation Areas.
The following rules and regulations shall apply to all parks in the Town as well as to Undeveloped
Recreation Areas:
A. Town parks and recreation areas shall be opened for public use between sunrise and sunset
unless other open hours are posted at any park.
B. Properly licensed dogs, wearing a license tag and vaccinated against rabies pursuant to the
laws of the State of New York and Town of Wappinger and restrained by a leash or other
restraint not exceeding six feet in length, may be brought into a park, except in no event
shall dogs or other animals be allowed to enter any playground, ballfield, basketball court,
handball court, tennis court, or other area posted as off-limits by the Town. Nothing in this
paragraph shall be construed to prohibit persons with disabilities from bringing service
animals into a park as authorized by federal, state, or city law.
C. It shall be the duty of each dog owner or each person in possession, custody or control of a
dog to remove any feces left by his/her dog on any public area in any Town park.
D. No person shall cut, deface, injure, remove or disturb any tree, shrub, building, fence, bench
or any other structure, apparatus or property; or pick, cut or remove any shrub, brush or
flower; or mark or write upon any building, fence, bench, signs or other structures.
E. No profane or abusive language shall be used in any Town park.
F. No persons shall sell or offer for sale any goods unless a permit to do so has been issued by

G. No persons shall paste, post, paint, print, nail or attach or affix by any means whatsoever any
handbill, poster, notice, sign, advertisement, sticker or other printed material upon any curb,
gutter, flagstone, tree, lamppost, public utility pole, public garbage bin, bus shelter, bridge,
fence, barrel, box, traffic control device, traffic stanchion, traffic sign (including pole), tree
box, tree pit protection device, bench, traffic barrier, hydrant, or upon the ground, however,
that this section shall not apply to any handbill, poster, notice, sign, advertisement, sticker or
other printed material so posted by or under the direction of the Town Board, or by or
under the direction of any Town Department, or pursuant to a franchise, concession or
revocable consent granted by the Town Board.
H. No alcoholic beverages shall be permitted in the park area except during activities sponsored
by the Town that permit alcoholic beverages.
I. No smoking in any park.
J. Betting or gambling of any type is prohibited.
K. Organized baseball games will be permitted only on diamonds set aside for this activity.
Playing catch and other similar activities are permitted in other areas of the park provided
that there is no risk of thrown or batted balls hitting other park users.
L. Hitting golf balls is prohibited, except in designated areas.
M. No persons shall erect any recreation or play equipment in any park unless a written permit
to do so has been issued by the Town.
N. All fires, including those in grills, fire pits and fireplaces, are prohibited except for fires in
grills, fire pits and fireplaces provided by the Town for that purpose in a Park Facility.
O. The possession, ignition or discharge of fireworks, sparking devices or incendiary devices is
prohibited.
P. No camping without a written permit from the Town.
Q. No firearms, air guns, bows and arrows or any dangerous weapons are permitted, except that
firearms lawfully in possession, if holstered or cased, may be carried through a Town park.
R. No hunting or trapping.
S. Throwing or leaving refuse in or on a Town park, other than in receptacles there provided
for trash, is prohibited.

T. No unlicensed motorized vehicles, including motorcycles, motorbikes, snowmobiles,
minibikes, all-terrain vehicles, etc., shall be operated or parked in a Town park area outside

designated roadways or designated parking areas. Licensed motor vehicles are only permitted
on drives and parking areas.
U. No vehicles shall be operated in a Town park at a speed in excess of 15 miles per hour,
unless a lower speed limit is posted.
V. No overnight parking of motor vehicles in any park area.
W. Privately owned boats, rafts or other artificial means of support on water shall be only
allowed entry upon waters in designated areas.
X. No swimming in any park.
Y. No persons shall enter upon any ice in any park.
Z. No entertainment or exhibition of any kind shall be given without a written permit from the
Town.
AA. No person shall throw stones or other projectiles.
BB. No persons shall ride a horse or pony in any park.
§171-4 Closing of parks.
The Recreation Director, Supervisor and Town Board may close the park facilities whenever, in
their judgment, such action is deemed necessary or desirable for the protection of health or safety of
persons entitled to use such facilities.
§171-5 Regulations for Specific Parks.
Notwithstanding §171-3 above, the following rules and regulations specific to certain parks shall be
applicable. If the rule or regulation contained herein shall conflict with §171-3 above, this section
shall control:

§171-6 Park Rental regulation.
Any request for the use of a Park and Recreation Area shall be made pursuant to the following
Regulations:
A. Request for use of Park and Recreation facilities may be made up to one year in
advance of an event but no later than two (2) weeks prior to the intended date of use and is subject
to approval of the Recreation Director.
B. Persons wishing to reserve Town facilities for specific use shall first apply at the
Recreation office or online on the approved application form with all requisite documentation.
Applications shall be approved or denied by the Recreation Director. Denial of use may be appealed
to the Town Board.
C. The Recreation Director may set reasonable conditions upon any approval to use a
Town Facility.
D. The fee for use of certain Town Facilities shall be set by separate Resolution of the
Town Board which may be amended from time to time.
E. Adult supervision is required for any activity involving persons less than 18 years of
age. There shall be a minimum of one adult per each 10 persons less than 18 years of age.
F. All organizations, private parties in excess of 100 people, or any request that involves
the serving of alcohol must provide the following documentation to the Recreating Director
upon application:
(1) A current valid certificate of insurance naming the Town of Wappinger, 20
Middlebush Road, Wappinger Falls, NY 12590 as additional insured for the date(s) applied.

(2) Comprehensive general liability limits of at least $1,000,000 per

occurrence/$2,000,000 aggregate.
(3) Request shall not be processed unless all requisite documentation is provided
at time of application.
G. Persons applying for use of Town lands must provide a signed hold harmless
agreement.
H. The Recreation Director shall have the responsibility to resolve all scheduling
conflicts involving the use of park facilities.
§171-7 Penalties for offenses.
Any person committing an offense against any provision of this chapter, or any rule or regulation
made pursuant thereto, shall, upon conviction thereof, be guilty of a violation punishable by a fine in
the amount set forth in Chapter 122, Article V, § 122-20U of the Code or by imprisonment for a
term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense
against the provisions of this chapter shall constitute, for each day the offense is continued, a
separate and distinct offense hereunder.
§ 171-8 Enforcement.
This chapter may be enforced by any police agency having jurisdiction within the Town of
Wappinger.
§171-9 Posting.
A. Signs shall be conspicuously posted at the regular entrances to Town Parks to provide notice
of the park hours and other restrictions established by this Chapter. The failure to post signs,
or the failure to include the prohibited conduct on the sign shall not be a defense against a
violation of this Chapter and proof of posting a sign shall not be required to establish a
violation of this Chapter.
B. A person who enters or remains within a park after regular hours shall be deemed to have
ccordance with
Article 140 of the Penal Law for Burglary and related offenses.

2021 Municipal Application Instructions
General Instructions
The following instructions relate to Community Development Block Grant (CDBG) municipal activities. They
work in concert with the following documents to insure consistency between programs:

These documents should be reviewed when developing and implementing any activity.

Eligibility Determination One of the most important things to remember is that the Community
Development Block Grant (CDBG) is designed to assist with the development of projects that primarily benefit
low and moderate-income residents. Information on eligibility is available on Table A, page 2.
Eligible Applicants Any municipality which is a member of the 2021 CDBG Urban County Consortium.
Number of Applications - Only one (1) application may be submitted, except that a second application may
be submitted for an eligible housing activity. Housing activities require a separate application.
Funding Maximums- There is no guarantee an application will receive the maximum amount requested.

APPLICATION PROCESS
The County uses a two-step application process:
Step 1 - Submit eligibility information via the LOI feature in the Dutchess County Grant Portal. After signing
into the portal, click the blue APPLY button in the upper right to start the process. Applicants must complete
this process by Friday, November 13, 2020 so the County has time to review and approve eligibility. Applicants
will only be able to proceed to the application once the LOI has been approved by the County.

Step 2 You will be able to complete the application via the EDIT APPLICATIONlink which will appear once the
LOI is approved by the County. The application and attachments must be submitted via the grant portal
by Tuesday, December 1, 2020 at 4:00 p.m.
Required Public Hearing
Municipalities must hold a public hearing to solicit project ideas PRIOR to submitting the
application. The purpose of the hearing is to provide residents, particularly low- and moderate-
income residents, an opportunity to suggest projects for CDBG funds. To ensure this requirement
is met, municipalities should schedule a public hearing early in the application process. After the
public hearing (at the same or subsequent meeting) the municipality must consider potential
projects, select a project, and pass a resolution approving the application prior to submission.
Applications submitted without a public hearing are ineligible and will be rejected.
For joint applications, each municipality must hold a public hearing and pass a resolution.
Municipalities are required to invite representatives from any proposed projects to the hearing.
A copy of the public notice and authorizing resolution must be submitted with the application. The
County has provided a sample resolution.

The County has an obligation to address all the priorities over the Plan period. The County reserves the right
to fund activities as necessary in order to meet this objective.
CDBG POLICIES AND PROCEDURES
The CDBG Program has detailed Policies and Procedures. Below is a summary of the several important items:
Implementation and Architectural/Engineering Costs - Activity implementation and engineering costs for
consultants will be limited to 20% of the activityMunicipal personnel are not
eligible to be reimbursed for activity implementation.
Start Date Activities may not begin or incur costs prior to March 1, 2021 (beginning of the program year).
Completion/Expenditure Deadline Activities allocated funds under this application must be completed and
all funds expended by October 31, 2022 (twenty (20) months from the beginning of the program year).
Environmental Reviews The County must conduct an environmental review under the National
Environmental Policy Act (NEPA) and the municipality must ensure compliance with the NYS Environmental
Quality Review Act (SEQRA). Activities may not begin construction until the environmental review is complete.
City of Beacon Annual Allocation - The City of Beacon receives 15% of the annual CDBG allocation after the
activities with
the exception of maximum grant award and number of applications submitted.
Public Service Activities Up to 15%
administrative expenses, may be set aside for public service activities. If a public service agency is applying
for a construction activity, that is considered a municipal activity and must be sponsored by the municipality in
which the activity is located. Parties interested in non-construction public service activities should apply
directly to the CDBG Public Service or Agency Partner Program using the APG/CDBG Public Service Application.
Procurement Requirements - All activities are subject to Federal and County Procurement Policies and
Procedures. This generally includes public bidding and prevailing wages. More detailed guidance is available

APPLICATION REVIEW
Applications are reviewed for completion. Applications that lack required items or contain technical errors will
be notified by email and given ten (10) calendar days to correct the error. Documentation of public hearing is
the one document that cannot be submitted after the application due to HUD regulations. Failure to submit
the missing items by the deadline will result in ineligibility.
Theapplication process is competitive and based on the below considerations. A site visit and staff
evaluations are conducted. Preliminary staff recommendations are presented to the Community
Development Advisory Committee (CDAC). The CDAC reviews the recommendations, and requests additional
information if necessary. CDAC funding recommendations are sent to the County Executive for final approval.

2. Does the activity address a HUD National Objective (Low/Mod Benefit)?
If the activity does not meet these first two criteria it is ineligible.
Questions 3 through 14 aid in further evaluation and development of funding recommendations.
3. Does the proposed activity meet a priority of the Consolidated Plan?
4. Does the activity benefit a substantial number of low to moderate income persons?
5. Is the estimated completion time for the activity realistic and allow for completion by the deadline?
6. Does the proposed activity build on previous investments or is it part of a larger development plan?
7. Does the municipality have outstanding CDBG funds?
8. Does the activity represent an innovative approach to a problem?
9. Is the activity , Analysis of Impediments to Fair Housing and
other County Plans such as Directions, Centers and Greenspaces Guide, and the PDCTC Metropolitan
Transportation Plan Moving Dutchess?
10. Is the activity a cooperative effort from two or more municipalities?
11. Has the municipality leveraged other sources of funds? Are they secure?
12. How is the municipalit organizational capacity; was the administration of previously activities positive?
13. Is the activity cost effective? Are costs in line with comparable activities?
14. Has the municipality taken action to affirmatively further fair housing?
Housing projects will have the following additional questions:
15. Are the development and construction costs in line with similar projects?
16. If the applicant has received HOME or CDBG funds in the past, were those projects completed in a timely
fashion and with quality workmanship? Has the applicant maintained the projects in an appropriate
manner and complied with all rental/sale price and income regulations?
17. Is the municipality where the project is located supportive of the project? Specifically, is it likely to receive
the necessary planning and zoning approvals?
