Applications Pursuant To Covid-19 Emergency Eviction And Foreclosure Prevention Act
Of 2020
At a Reorganization Meeting of the Town Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on
January 11, 2021.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll
being called, the following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by
Councilwoman Bettina.
WHEREAS, Subpart D of the COVID-19 Emergency Eviction and Foreclosure
Prevention Act of 2020 (Laws of 2020 Chapter 381) requires the Town of Wappinger to
automatically extend to the 2021 assessment roll, the renewal of the exemptions received on the
2020 assessment roll pursuant to sections 467 and 459-c of the real property tax law, relating to
persons age sixty-five and older and for certain persons with disabilities and limited income,
except where the Town Board adopts a resolution setting forth procedures to permit the Assessor
to require a renewal application where the Assessor has reason to believe that the owner may no
longer qualify for the exemption; and
WHEREAS, the Town Board believes that it is important for the Town to maintain
accurate assessment rolls so it is necessary to grant authority to the Assessor to require renewal
applications where there is reason to believe that the property owner no longer qualifies for
exemptions received on the 2020 assessment roll pursuant to sections 467 and 459-c of the real
property tax law;
NOW THEREFORE, BE IT RESOLVED that the Town Assessor shall make available
renewal applications through postal mail or electronic means in order for eligible recipients to
file renewal applications in the event that such eligible recipient determines his or her income
has changed in a manner that would grant him or her a greater exemption than what was present
on the 2020 assessment roll; and
BE IT FURTHER RESOLVED, that the Assessor for the Town of Wappinger may
require a renewal application if he believes that an owner that qualified for the 2020 exemption
has since changed their primary residence, added another owner to the deed, transferred the
property to a new owner, or is deceased; and
BE IT FURTHER RESOLVED, that the Assessor cannot require eligible recipients to
recipients to appear in person to file a renewal application for any reason; and
BE IT FURTHER RESOLVED, that this Resolution shall be effective immediately.
