Resolution Authorizing Attendance At The 2021 Association Of Towns Annual Meeting
WHEREAS, the Town Board of the Town of Wappinger has annually authorized
members of the Town Board, Planning Board, Zoning Board of Appeals, Town Clerk and certain
employees of the Town of Wappinger to attend the New York State Association of Towns
Annual Meeting and Educational Conference in New York City; and
WHEREAS, the Town Budget for Fiscal Year 2021 includes educational expense line
items for various Town departments; and
WHEREAS, the Town Board of the Town of Wappinger has determined the purpose of
attendance at the Conference to be primarily educational and requires all attendees to attend a
minimum of four (4) hours of daily educational seminars and to provide proof of such
attendance; and
WHEREAS, due to the Covid-
conference is being held virtually; and
WHEREAS, the Town Board hereby authorizes payment of the registration for the
virtual conference;
WHEREAS, the Town Board seeks to appoint a delegate and an alternate delegate to the
conference on behalf of the Town of Wappinger; now, therefore
BE IT RESOLVED, that the Town Board hereby authorizes and approves the following
elected officers, appointees and employees of the Town to attend the 2021 New York State
Association of Towns Meeting and Educational Conference : Town Supervisor, Members of the
Town Board, Town Clerk, Deputy Town Clerk, Members of the Planning Board, Members of the
Zoning Board of Appeals, Zoning Administrator, Planning and ZBA Secretary, Comptroller to
the Town, Chief Clerk to the Justice Court, Town Justices, Superintendent of Highways and
Confidential Secretary to the Town Supervisor; and

Comptroller
WHEREAS, pursuant to Town Law §29(10-a), the Town Board may authorize the
Supervisor to submit a copy of the annual update report to the State Comptroller (required by
General Municipal Law §30) to the Town Clerk in lieu of preparing an annual financial report
accounting for all monies received and disbursed by him, together with certificates of the bank or
trust company where Town monies are deposited which show the amount of such monies on
deposit; and
WHEREAS, the information included in the report under General Municipal Law §30 is
reports results in a duplication of efforts; now, therefore
BE IT RESOLVED, that the Town Board hereby authorizes the Supervisor to submit a
copy of the annual financial update document for the Town of Wappinger, required by General
Municipal Law §30, to the Town Clerk in lieu of the report of the Supervisor required by Town
Law §29(10); and
BE IT FURTHER RESOLVED, that the Supervisor shall file the copy of the annual
financial update document for the Town of Wappinger with the Town Clerk within 60 days after
the close of the fiscal year, or within such additional time that is granted by the State Comptroller
pursuant to General Municipal Law §30; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to cause notice of the
filing of such report to be published within 10 days after receipt thereof in a form approved by
the State Comptroller, in the official newspapers of the Town; and
BE IT FURTHER RESOLVED, that this authorization, pursuant to Town Law
§29(10-a) shall continue from year to year unless it shall be rescinded by further action of the
Town Board.

Resolution Authorizing The Use Of A Mechanical Check Signing Device
BE IT RESOLVED, that the voucher order checks of the Town of Wappinger may be
signed with a facsimile signature of the Supervisor of the Town or, in the absence or
unavailability of the Supervisor, the facsimile signature of the Deputy Supervisor, as reproduced
by a mechanical check-signing device or machine provided that the safeguards specified by the
manufacturer and inherent in the operations of such device are properly observed; and
BE IT FURTHER RESOLVED, that the Town Clerk shall file a certified copy of this
Resolution with all banking institutions which are depositories of the monies and funds of the
Town of Wappinger as soon as practicable after the adoption of this Resolution, for the purpose
of indicating authority for the use of such facsimile signature; and
BE IT FURTHER RESOLVED, that the Supervisor or Deputy Supervisor of the Town
of Wappinger be and is hereby authorized and empowered to take all steps which may be
necessary and proper to acquire a mechanical check-signing devise for use in conformity with
this Resolution.

BE IT RESOLVED, that the banks listed below, all located and authorized to do
business in the State of New York (hereinafter
depositories of the Town of Wappinger:
Putnam County Savings Bank
M&T Bank
Tompkins Mahopac Bank
Rhinebeck Bank
Citizens Bank
TD Bank
JP Morgan Chase
Trustco Bank
Ulster Savings Bank
; and
BE IT FURTHER RESOLVED, that until further order of the Town Board of the Town
of Wappinger, the maximum amount that may be kept on deposit at the aforementioned Banks at
any one time is Twenty Million Dollars ($20,000,000.00); and
BE IT FURTHER RESOLVED, that the Town Supervisor of the Town of Wappinger is
hereby authorized to execute and deliver all security and custody agreements relating to the
pledge of collateral by the Bank as security for the deposit of public funds by, and the investment
of public funds of, the Town of Wappinger government and the custody of such collateral and
investments all in such form as may be approved by any such officers, such approval to be
evidence of the execution of any such agreement; and
BE IT FURTHER RESOLVED, that the Town of Wappinger is authorized to accept an
Eligible Surety Bond as security for the deposit of public funds by the Town of Wappinger,
having such terms and conditions as shall be approved by resolution of the Town of Wappinger
or as set forth in the investment policy adopted by the Town of Wappinger; and
BE IT FURTHER RESOLVED, that the Banks are hereby appointed as an agent of and
custodian for the Town of Wappinger to hold collateral pledged by the Banks as security for
deposits of public funds by the Town of Wappinger and to hold investments of the Town; and
BE IT FURTHER RESOLVED, that the following officers of the Town of Wappinger
be and hereby are, and each of them hereby is, authorized to open accounts or otherwise to
conduct business with the aforementioned Banks and to deposit any of the funds of the Town of
Wappinger in the Banks either at its head office or at any of its branches:

Such officers are also authorized to give any and all instructions to charge accounts of the Town
of Wappinger which they have opened with the aforementioned Banks. Any one or more of

products or services relating to the accounts or other Bank services, including, but not limited to,
wire and other funds transfers products, night deposits, safe deposit boxes and direct deposit of
payroll, in whatever form as may be approved by that officer; and
BE IT FURTHER RESOLVED, that until further order of the Town of Wappinger, any
funds of the Town of Wappinger deposited in the aforementioned Banks or placed with the
Banks for investment are subject to withdrawal, transfer or charge at any time and from time to
time, electronically or otherwise, upon checks, authorizations, letters or other instruments,

orders, items or instructions for the payment or transfer of money when made, signed, drawn,

BE IT FURTHER RESOLVED, that the Banks are hereby authorized to pay any such
check, authorization, letter, or other instrument, order or item or execute any such instructions or

other holder without inquiry as to the circumstances of issues, withdrawal, transfer or charge or
the disposition of the proceeds, even if drawn to the individual order of or paid to any signing
person, or payable to the Banks or others for his or her account, or tendered in payment of his or
her individual obligation, and whether drawn against an account in the name of the Town of
Wappinger or in the name of any officer or agent of the Town of Wappinger as such, and, at the
option of the Banks, even if the account shall not be in credit to the full amount of such
instrument, withdrawal, transfer or charge; and
BE IT FURTHER RESOLVED, that the Banks, as designated depository of the Town
of Wappinger, be and hereby are requested, authorized and directed to honor all checks,
authorizations, letters, or other instruments, orders, items or instructions for the payment or
transfer of money when made, signed, drawn, accepted, endorsed or given in the Town of
Wappinger name on its account(s) (including but not limited to those drawn to the individual
order of or paid to any person or persons whose name or names thereon as signor or signers
thereof or who deliver such instructions) when bearing or purporting to bear the facsimile
signature(s) of any one of the following:

and the Banks shall be entitled to honor and to charge the Town of Wappinger for all such
checks, authorizations, letters, or other instruments, orders, items or instructions regarding the
payment or transfer of money, regardless of by whom or by what means the actual or purported
facsimile signature or signatures thereon may have been affixed thereto if such facsimile
signature or signatures resemble the facsimile specimens from time to time filed with the Banks
by the recording officer or other officer of the Town of Wappinger; and
BE IT FURTHER RESOLVED, that the Town Supervisor of the Town of Wappinger is
authorized to open one or more accounts with the Banks for the provision of investment
advisory, custodial and other investment services on behalf of the Town of Wappinger (the
Wappinger with respect to the Account; and
BE IT FURTHER RESOLVED, that the following officers of the Town of Wappinger
are authorized to instruct the Banks, in writing, orally, electronically or by means of telex, TWX,
facsimile transmission, bank wire or other teleprocess, regarding any notices, instructions or
requests made by the Town of Wappinger in accordance with any security agreement with the
Banks, and the establishment, modification or replacement of investment objectives for the
Account, the purchase, sale, transfer or other disposition of funds or property held in the
Account, the transfer of funds or property into the Account, and any other matters concerning the
Account:

authorized to certify to the Banks the names of the present officers of the Town of Wappinger

them, if any, together with specimens of their signatures, and in case of any change of authorized
persons or of any holder of any such office or holders of any such officers, the fact of such
change and the name of any new officers and the offices respectively held by them, if any,
together with specimens of their signatures; and the Banks be and are hereby authorized to honor
any checks, notes, drafts, bills of exchange, acceptances, undertakings, authorizations, letters, or
other instruments, orders, items or instructions or agreements or other documents signed by any
new officer or officers in respect of whom it has received any such certificate or certificates or
by any such person with the same force and effect as if said officer or said officers or person
were named in the foregoing resolutions; and
BE IT FURTHER RESOLVED, that the Banks be promptly notified in writing by the
Town of Wappinger Clerk of any change in these resolutions, such notice to be given to each
office of the Banks in which any account of the Town of Wappinger may be maintained or from
which any product or service affected by such change is provided to the Town of Wappinger,
and that until it has actually so received such notice in writing it is authorized to act in pursuance
of these resolutions, and that until it has actually received such notice and has had a reasonable
opportunity to act upon such notice, it shall be indemnified and saved harmless from any loss
suffered, claim or liability incurred by it in continuing to act in pursuance of these resolutions,
even though these resolutions may have been changed; and
BE IT FURTHER RESOLVED, that the Town Clerk be, and is hereby directed to give
notice of adoption of this Resolution to each of the aforementioned banking institutions.

in the Town of Wappinger, Dutchess County, New York, and having a general circulation in the
Town, and being a newspaper entered as second-class mail matter, be and the same hereby is
designated as the official newspaper of the Town; and
BE IT FURTHER RESOLVED, that the Poughkeepsie Journal, published in the
County of Dutchess and having general circulation within the Town of Wappinger, Dutchess
County, New York, be and is hereby designated as an additional newspaper for the publication of
Town Notices when, and if, so directed by the Town Board; and
BE IT FURTHER RESOVLED, that the Town Clerk be and he or she is hereby

Resolution Designating The Time And Place For Holding Town Board Meetings For The
Calendar Year 2021
BE IT RESOLVED, that the Regular Monthly Meetings of the Town Board of the Town
of Wappinger shall be held at 7:00 PM, at the Town Hall, 20 Middlebush Road, in the Town of

Wappinger, Dutchess County, New York, in the evening of the second (2) and fourth (4)
Monday of each month, or at such other place or time within the Town of Wappinger as the
Town Board shall from time to time designate; and
BE IT FURTHER RESOLVED, that when a regularly scheduled Town Board meeting
occurs on a holiday, the meeting will be held on the following Tuesday such as on Tuesday
October 12 for Columbus Day, or at such other time as the Town Board shall designate; and
BE IT FURTHER RESOLVED, that the meetings of the Town Board, including any
adjourned or rescheduled meetings shall be posted in Town Hall on the Town bulletin board and
on the Town website. The Town Clerk is directed to take whatever steps are necessary to have
such Town Board meetings accurately reflected on the Town bulletin board and Town website;
and
BE IT FURTHER RESOLVED, that the months of July, August, November and
December will have only one meeting of the Town Board; specifically July 19, August 23,
November 15, and December 13.

Resolution Establishing Petty Cash Funds For Various Offices
WHEREAS, pursuant to Town Law §64 (1-a), the Town Board is authorized to establish petty
cash funds for any Town officer, head of a department or office in the Town, for payment, in
advance of audit, of a properly itemized or certified bill for materials, supplies or services
furnished to the Town for the conduct of its affairs and upon such terms as set forth in Town
Law § 64 (1-a); now, therefore
BE IT RESOLVED, that the Town Supervisor, Town Justice Court, and the Town
Recreation Department are hereby authorized and directed to establish a petty cash fund, in a
sum not to exceed Five Hundred Dollars ($500.00) for each such petty cash fund; and
BE IT FURTHER RESOLVED, that the Town Receiver of Taxes is authorized to open
a petty cash fund in a sum not to exceed One Thousand Dollars ($1,000.00); and
BE IT FURTHER RESOLVED, that the Town Clerk is authorized to open a petty cash
fund in a sum not to exceed One Hundred Fifty Dollars ($150.00); and
BE IT FURTHER RESOLVED, that all such disbursements made from petty cash
funds and the audit of such funds shall be made in accordance with the express provisions, terms
and conditions of Town Law § 64 (1-a).

Establishing Pay Scale For Seasonal Recreation Department Employees In The Town Of
Wappinger
WHEREAS, the Town of Wappinger Recreation Department employs seasonal
employees necessary to provide the various recreation programs which are funded by the Town.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.

Applications Pursuant To Covid-19 Emergency Eviction And Foreclosure Prevention Act
Of 2020
WHEREAS, Subpart D of the COVID-19 Emergency Eviction and Foreclosure
Prevention Act of 2020 (Laws of 2020 Chapter 381) requires the Town of Wappinger to

automatically extend to the 2021 assessment roll, the renewal of the exemptions received on the
2020 assessment roll pursuant to sections 467 and 459-c of the real property tax law, relating to
persons age sixty-five and older and for certain persons with disabilities and limited income,
except where the Town Board adopts a resolution setting forth procedures to permit the Assessor
to require a renewal application where the Assessor has reason to believe that the owner may no
longer qualify for the exemption; and
WHEREAS, the Town Board believes that it is important for the Town to maintain
accurate assessment rolls so it is necessary to grant authority to the Assessor to require renewal
applications where there is reason to believe that the property owner no longer qualifies for
exemptions received on the 2020 assessment roll pursuant to sections 467 and 459-c of the real
property tax law;
NOW THEREFORE, BE IT RESOLVED that the Town Assessor shall make available
renewal applications through postal mail or electronic means in order for eligible recipients to
file renewal applications in the event that such eligible recipient determines his or her income
has changed in a manner that would grant him or her a greater exemption than what was present
on the 2020 assessment roll; and
BE IT FURTHER RESOLVED, that the Assessor for the Town of Wappinger may
require a renewal application if he believes that an owner that qualified for the 2020 exemption
has since changed their primary residence, added another owner to the deed, transferred the
property to a new owner, or is deceased; and
BE IT FURTHER RESOLVED, that the Assessor cannot require eligible recipients to
recipients to appear in person to file a renewal application for any reason; and
BE IT FURTHER RESOLVED, that this Resolution shall be effective immediately.

Resolution Authorizing Contract For Installation Of A Lighting System At Route 376
Roundabout
reconstruct State Highway 8093, Route 376 with the construction of a roundabout at its
intersection with All Angels Hill Road and New Hackensack Road in the Town of Wappinger;
and
WHEREAS, the Town desires to have a lighting system installed on or along the
highway; and
WHEREAS, the Town of Wappinger and the NYSDOT recognize that if such lighting
system is constructed, the Town of Wappinger shall maintain, repair and energize the lighting
WHEREAS, NYSDOT has prepared an Agreement for Installation, Maintenance, Repair
and Energizing of Lighting System for State Highway Identified as 8093 which is annexed
hereto; and
WHEREAS, the Agreement provides that the cost of installing the lighting system shall
be paid by State Share but future maintenance, repair and electricity shall be paid by the Town;
and
WHEREAS, the Town Board has reviewed the Agreement and believes that it is in the
best interest of the Town to execute such Agreement;

Resolution Adopting Town Of Wappinger Covid-19 Telecommuting Policy
WHEREAS, the Town of Wappinger is committed to the health and safety of our employees and
residents in this time of pandemic; and
WHEREAS, allowing Town staff to work remotely creates social distancing in the workplace while
still maintaining the delivery of services to the taxpayers; and
WHEREAS, when Town employees telecommute it is important to maintain time and attendance
records to comply with applicable state and federal laws as well as establishing accountability for
suitable work performance; and
WHEREAS, the Town Board has determined that it is in the best interest of the Town to adopt a
COVID-19 Telecommuting Policy to set forth the applicable procedures and expectations for
telecommuting during this public health emergency;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The Town Board hereby adopts the Town of Wappinger COVID-19 Telecommuting Policy
which is annexed hereto and shall be made a part of the minutes of this Meeting.
2. The Town Clerk is directed to file a certified copy of this resolution together with the
annexed COVID-19 Telecommuting Policy.
3. The Town Board directs that every employee of the Town shall be provided with a copy of
the Town of Wappinger COVID-19 Telecommuting Policy and they shall sign a form that
they have received and reviewed a copy of said policy.
4. The Town of Wappinger COVID-19 Telecommuting Policy shall take effect immediately
and may be amended by resolution of the Town Board.

Resolution Authorizing Installation Of Street Lighting At Intersection Of Shamrock Hills
Drive And Old Hopewell Road
WHEREAS, Old Hopewell Road is a heavily travelled highway in the Town of Wappinger and
its intersection with Shamrock Hills Drive is poorly lit; and
WHEREAS, it is necessary to install street lighting at the intersection to provide drivers
at night visibility of vehicles entering into the intersection; and
WHEREAS, the locations of the proposed street lights are outside the boundaries of any
lighting district established in the Town of Wappinger; and
WHEREAS, pursuant to the authority granted by Town Law §64(19), the Town Board
may contract for street lighting on highways in the Town; and
lighting within its service area pursuant to a Tariff Approved by the New York State Public
Service Commission; and
WHEREAS, CHGE has provided the attached Street Lighting Authority Order which sets
forth the rental costs for the street lights and poles; and
WHEREAS, the Town Comptroller has advised that a budget modification is required to
pay for the rental fees for the new lights;
NOW, THEREFORE, BE IT RESOLVED, as follows:
The Town Board hereby accepts the terms of Street Lighting Authority Order No. H7-03018
which provides for a monthly rental fee of $46.52 for two LED luminaires plus the cost of
electricity and authorizes the Supervisor to sign the Street Lighting Order on behalf of the Town;
and
BE IT FURTHER RESOLVED that the Town Board hereby authorizes the following
budget line transfers for the rental of the Street Lighting & electric service:

RESOLUTION: 2021-31
Resolution Authorizing Agreement For Dial-A-Ride Services With Dutchess County
WHEREAS, the Town has previously entered into Agreements with Dutchess County to
provide a joint service transportation system for senior citizens and handicapped individuals; and
WHEREAS, said Agreement has been amended and extended from time to time; and
WHEREAS, Dutchess County has presented a proposal to the Town to provide such
transportation service for calendar year 2021 as set forth in a proposed Extension and
Amendment Agreement, a copy of which is attached hereto; and
WHEREAS, the Town desires to enter into said Agreement for calendar year 2021, on
the terms and conditions as set forth in the Agreement; now, therefore
BE IT RESOLVED, that the Town Board hereby accepts the terms and conditions set
forth and contained in the Agreement and agrees to pay the annual sum of Fifty-Seven Thousand
Seven Hundred Thirty Dollars ($57,730.00) for a transportation service system for senior citizens
and handicapped individuals, payable in quarter-annual payments as contained in the Dial-A-
Ride Transportation 2021 Municipality Payment/Service Schedule (Exhibit B-4); and
BE IT FURTHER RESOLVED, that the Town of Wappinger hereby approves the Dial-
A-Ride Extension and Amendment Agreement, in effect for calendar year 2021 and retroactive
to January 1, 2021, in the form annexed hereto and authorizes and directs the Supervisor to
execute the Agreement by and on behalf of the Town of Wappinger and to provide a fully
executed copy of the Agreement to the Town Clerk when received.

WHEREAS, the Petitioner submitted to the Town a written Petition pursuant to Article 12 of the
Town Law requesting the establishment of a proposed Water District extension to be known as
together with a map, plan and report accompanying the same and addendum thereto, have been
filed in the office of the Town Clerk and are available for public inspection; and
WHEREAS, said map, plan and report include a map showing the boundaries of the proposed
Extension, a general plan to serve said Extension, and a report of the proposed method of operation
thereof, and were prepared by ROHDE, SOYKA & ANDREWS, competent engineers duly
licensed by the State of New York; and
WHEREAS, the boundaries of said Extension shall be as shown in Exhibit A attached hereto and
incorporated herein; and
WHEREAS, the improvements proposed for said Extension consist of the purchase and installation
of water mains, valves and hydrants, including original equipment, machinery, apparatus,
appurtenances, and incidental improvements and expenses in connection therewith, all as more fully
described in the map, plan and report hereinbefore described; and
WHEREAS, the maximum estimated cost of said improvements is $228,000, and
WHEREAS, the cost of said improvements shall be paid by the owner of the properties therein and
no serial bonds of said Town shall be issued therefor; and
WHEREAS, the cost of the buy-in fee to the UWWD for the property is $73,500 in accordance
with §236-6 of the Town of Wappinger Code; and
WHEREAS, the estimated cost of hook-up fees to the typical property in said Extension is $15,000,
and there are no residential properties in the Extension; and
WHEREAS, the estimated cost of said Extension to the typical property therein is $2,743.00 in the
first year in which operation, maintenance, debt service and other charges and expenses are to be
paid and there are no residential properties in the proposed Extension; and
WHEREAS, a detailed explanation of the manner by which were computed said estimated costs of
hook-up fees and first-year costs to the typical property has been filed in the office of the Town
Clerk where the same are available during regular office hours for examination by any person
interested in the subject manner thereof; and
WHEREAS, said Extension and the establishment thereof has been determined to be an Unlisted
Action pursuant to the regulations of the New York State Department of Environmental
Conservation promulgated pursuant to the State Environmental Quality Review Act, and the Town
of Wappinger Town Board acting as lead agency in a coordinated review has determined will not
result in a significant environmental effect by its resolution dated August 24, 2020; and

Resolution Authorizing Surveys For Standby Generators For United Wappinger Sewer
District
WHEREAS, the United Wappinger Sewer District Operator CAMO Pollution has recommended
that backup generators be installed at the Kent Road and Sherwood Heights pump stations to
provide emergency electrical supply so that sewer service is not interrupted in the case of a power
outage; and
WHEREAS, site surveys are required to ensure that the generators and security fencing are installed
on municipal property; and
WHEREAS, the Engineers to the Town CPL have submitted a proposal for survey services dated
November 18, 2020 at a cost of $8,300 for both sites;
WHEREAS, the work proposed is a professional service which is not subject to competitive
bidding;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby approves the attached proposal of CPL for survey services in the
amount of $8,300.
2. The Town Board hereby authorizes payment of the services in an amount not to exceed
$8,300 from the unallocated, unappropriated fund balance of the United Wappinger Sewer
District.
3. Payments under the contract shall be paid on vouchers submitted and reviewed as required
by law.

Section 1. Regular Meetings of the Town Board
1. Regular Meetings of the Town Board shall be held on the second and fourth
Monday of each month.
a. The Annual Reorganization Meeting shall be scheduled by Resolution of
the Town Board during the prior December
b. The first regularly scheduled Town Board Meeting, which is to take place
on the second Monday of each month, will be deemed the Town Board
Workshop Meeting.
c. Meetings scheduled for the second and fourth Monday of each month shall
be held without prior written notice to the Board Members.
2. In the event that a Regular Meeting date falls on a legal holiday, as recognized by
the State of New York, the Town Board shall reschedule the date of such meeting,
by Motion or Resolution, at a previous Board Meeting.
3. The time and place of a Regular Meeting date may be changed, or may be
cancelled, by the affirmative vote of three (3) members of the Town Board.
Cancellation of any Regular Meeting must occur at a duly constituted Board
Meeting. Except for cause, there shall be at least one Regular Town Board
Meeting conducted each calendar month. The Supervisor may cancel any Regular
or Special Meeting because of inclement weather conditions or other emergency
4. A quorum of a Town Board shall consist of three (3) Board Members present.
5. The Committee of the Whole meeting of the Town Board shall be held as needed.
a. Any Committee of the Whole meeting relating to Agenda items to be
placed on the next ensuing Town Board Meeting must be held at least five
(5) days prior to such Town Board Meeting.
Section 2. Special Meetings
1. Calling a Special Meeting
a. Special Meetings of the Town Board may be called by the Supervisor at
any time.
b. Upon the written request of two (2) Town Board Members, the Supervisor
shall, within ten calendar days of receipt of such request, call a Special
Meeting of the Town Board.

2. Notice for Special Meetings
a. The Supervisor shall, by email or fax, notify the official newspapers, and
any other media that he sees fit, of the date, time and place of the Special
Meeting being called, as well as a list of the items to be discussed at such

Meeting, at least forty-eight (48) hours prior to the start of the Special
Meeting.
b. A Special Meeting cannot be held until each Town Board Member has
been duly served with a notice of such Special Meeting, as provided in
these Rules, or the Town Board Member(s) has executed a Waiver of
Notice for such Special Meeting.
c. The Supervisor shall give each Town Board Member and the Town Clerk
written notice of the date, time and place for the Special Meeting, as well
as a list of the items to be discussed at such Special Meeting, no later than
2 business days prior to said Special Meeting by fax, email or personal
delivery. If notice is by any means other than personal delivery, follow-up
confirmation of receipt, by phone call, must be obtained.
d. A fax transmittal confirmation report, email send receipt or affidavit of
personal service shall be sufficient proof of notice and must be filed with
the Town Clerk at least four (4) hours prior to the start of the Special
Meeting.
e. Town Board Members shall provide the Town Clerk with accurate
delivery address information, including fax number (if applicable), email
address and physical location for personally delivered items to be mailed.
It is each Town Board Members responsibility to notify the Town Clerk of
changes to such information.
f. Town Board Members may name one (1) designee to receive notice of a
Special Meeting by fax, email or personal delivery. The name(s),
address(es), email address and fax number (if applicable) must be
submitted, in writing, to the Town Clerk. If no designee has been named,
notices of a Special Meeting shall be served only upon the Town Board
Member, as herein provided.
Section 3. Meeting Agenda
1. The Agenda shall be prepared jointly by the Supervisor and the Town Clerk.
2. The order of the Agenda shall be set by the Town Clerk.
3. The Agenda for a Regular Town Board Meeting shall be closed at 1:00 PM, five
(5) business days prior to the date of such Regular Meeting.
4. The Agenda for a Special Town Board Meeting shall be closed at 1:00 PM, two
(2) business days prior to the date of such Special Meeting.
5. Except in the case of an emergency, items may be added to the Agenda of any
Regular or Special Town Board Meeting, provided that such items are listed as
dded to the Agenda. Such
items are to be considered open for discussion and possible action. If the item
fails to be added by unanimous consent, it is to be placed on the next regularly

scheduled Meeting.
6. No items shall be placed on the Agenda or considered by the Town Board, other
Agenda item has been delivered to the Town Clerk prior to the closing of the

7. Notwithstanding the foregoing, claims served on the Town or its employees may
be added to the Agenda of any Regular Meeting at any time up to the
commencement of the scheduled Meeting. The Town Clerk shall notify the Town
Board of the receipt of such claims, which shall be referred to the Attorney to the
Town for appropriate action.
8. In the event that an item has been placed on the Agenda for which no
documentation has been made available by the time prescribed, the Supervisor
and Town Clerk shall, together, automatically remove the item from the Agenda.
9. Once an item has been properly added to the Agenda, supporting documentation
may be added up to the time of the Meeting
10. Discussion items are exempt from documentation, but no action may be taken on

11. No later than four (4) business days prior to a scheduled Regular Town Board
Meeting, the Town Clerk shall, by mail, email, fax, or personal delivery, provide
copies of the Agenda, together with documentation for all submitted Agenda
items, to the Town Board Members in accordance with Section (2); Paragraph (2);
sections (d) and (e) of these Town Board Rules.
12. No later that two (2) business days prior to a scheduled Special Town Board
Meeting, the Town Clerk shall, by email, fax, or personal delivery, provide copies

Section 4. Conduct of Meeting
1. The Supervisor shall be the Presiding Officer and shall chair each Meeting of the
Town Board. In the event that the Supervisor fails to appear at the time fixed for
such Town Board Meeting, the Deputy Supervisor, or in his/her absence, the
Town Clerk, shall call the Meeting to Order. If the Meeting is Called to Order by
the Deputy Supervisor or Town Clerk, the Town Board, by a vote of at least three
(3) of its Members, shall select a Member to serve as both Presiding Officer and
Temporary Chairman for said Meeting. If the Supervisor arrives after such
Meeting has commenced, he/she shall immediately assume the duties of both
Presiding Officer and Chair of the Meeting.
2. The Town Clerk, Supervisor or Deputy Supervisor shall determine the presence of
absence of a quorum of the Town Board, as set forth in Section 1; Par. 4 of these
Rules. In the event that a quorum is lacking, the person presiding over said
Meeting shall follow the following procedure precisely:

b. Roll Call
c. Salute to the Flag

speaking. Substantive Business shall not continue in the absence of a quorum.
4. All voting shall take place via viva voce

Board Member, including those that are absent, by Ward order, starting with the

2. Adoption of the Agenda
a. As previously stated in Section (5); paragraph (1); subparagraph (d) of these
Town Board Rules, the Town Board shall adopt the Agenda by a majority
vote.
b. The Supervisor, or in his/her absence, the Deputy Supervisor, or, in their
absence, the Town Clerk, may with the consent of the majority of the Board
Members present, change the order of the Agenda during any Meeting of the
Board.
c. Items that were previously added to the Agenda may be withdrawn from the
Agenda by the sponsoring Town Board Member without approval from any
other Town Board Members. The withdrawal of such motions is not subject

to debate and shall take place in open session prior to the Adoption of the

Section 6. Executive Session
1. Motions to enter into Executive Session shall take place during an open meeting.

Section 7. Rules of Order

blanks within a certain Resolution, the Board may then vote on said Resolution.
8. These Rules may be amended or rescinded by the affirmative vote of three (3)
Members of the Town Board.
9. These Rules shall remain in effect until new Rules are adopted by the Town
Board.
10. A motion to Adjourn may be made by any Member who shall have been
recognized by the Supervisor or, in his/her absence, the Deputy Supervisor, or, in
their absence, the Town Clerk. Such a motion shall not be recognized during a
roll call or while the Board is engaged in voting. A motion to Adjourn shall be
decided without debate. Unless excused, Members shall not leave a Meeting until
the Supervisor or, in his/her absence, the Deputy Supervisor, or, in their absence,

Section 8. Deputy Supervisor
1. Upon the request of the Supervisor, when the Supervisor is absent or

Deputy Supervisor shall be the Acting Supervisor. During such period, the
Deputy Supervisor shall be vested with all the powers and may perform all the

available to him or her through the Office of the Supervisor. Such clerical

This Agreement, made this / / between:
the New York State Department of Transportation (“NYSDOT”), having its principal office at
50 Wolf Road, Albany, NY 12232, on behalf of New York State (“State”)
and
the Town Board of the Town of Wappinger which is herein referred to as the “MUNICIPALITY”.
WITNESSETH:
WHEREAS, pursuant to Highway Law §10 Subdivision 24, the Commissioner of
Transportation (the "Commissioner"), may at the expense of the state, or using federal funds,
and/or using local funds provide for the installation and or replacement of street lighting
systems, provided the Commissioner deems it practicable to perform such work for such
Municipality/Sponsor in connection with the performance of any work of construction,
reconstruction or improvement under the Highway Law; and
WHEREAS, the COMMISSIONER proposes to reconstruct a State Highway pursuant to
the New York State Highway Law, such highway being identified as 8093, Route 376 at All
Angels Hill Road, New Hackensack Road Intersection Improvements, Dutchess County within
the geographical jurisdiction of the MUNICIPALITY and geographical jurisdiction of the Town of
Wappinger in Dutchess County; and
WHEREAS, the MUNICIPALITY desires to have lighting system installed on or along
such highway within the geographical jurisdiction of the MUNICIPALITY; and
WHEREAS, it is recognized by the MUNICIPALITY and the COMMISSIONER that if the
MUNICIPALITY desires to have lighting system installed on or along such highway within the
geographical jurisdiction of the MUNICIPALITY, the MUNICIPALITY shall maintain, repair and
energize such lighting system at its own expense; and
WHEREAS, the MUNICIPALITY by Resolution No. __________ adopted at the Town
Board of the of the MUNICIPALITY meeting held on the __________ day of __________, 2021,
approved the installation, maintenance and energizing of said lighting and has provided such
Resolution hereto, and has further authorized _____________________ to execute this
Agreement on behalf of the MUNICIPALITY; and

WHEREAS, the Town Board of the Town of Wappinger and the COMMISSIONER are
desirous of identifying the respective responsibilities of the parties with regard to the highway
lighting system;
NOW, THEREFORE, in consideration of the mutual promises and benefits moving to the
parties, it is agreed as follows:
ARTICLE 1: DOCUMENTS FORMING THIS AGREEMENT. The parties agree that the
Agreement consists of the following:
a. Agreement: This document, entitled “Agreement for Installation, Maintenance, Repair
and Energizing of Lighting System for State highway identified as” PJ-LOC \[See
above\];
b. Schedule "A" - Description of Project, funding and deposit requirements;
c. Appendix “A” - Standard Clauses for New York State Contracts;
d. Appendix A-1: Supplemental Title VI Provisions (Civil Rights Act);
e. Municipal Resolution(s): duly adopted resolution authorizing this agreement and the
appropriate municipal office to execute the Agreement and undertake the project on
the terms and conditions set forth herein.
ARTICLE 2: PROJECT RESPONSIBILITIES.
2.1 The COMMISSIONER shall provide for the furnishing and placing of the following
items in connection with a lighting system on the above-mentioned highway and identified in the
contract documents for this transportation project:
a. Underground duct system, including conduit, pull boxes, handholds, and drainage
pockets.
b. Ducts, pull boxes, and anchor bolts on structures.
c. Foundation for light standards, concrete pads and meter boxes.
d. Light standards and bracket arms.
e. Luminaries, lamps, wiring, photo-electric switches, switches and ballasts and all
other components necessary to complete the lighting system.
All of the above-identified items shall be and continue to be the property of the State of New
York.
2.2 Upon completion of construction of the above identified highway project, the
MUNICIPALITY shall, at its own expense, maintain the lighting system installed under such
highway project within the geographical jurisdiction of the MUNICIPALITY. Such maintenance
shall include, but not be limited to:
a. Repair of equipment which may be damaged from any cause whatsoever.
b. Replacement of equipment which may be non-functioning or damaged from any
cause whatsoever, such replacement material to be of equal character to the original
equipment.
c. Payment for delivery and supply of the electric current for the lighting system during
the customary night hours \[dusk to dawn\] of each day of the year, at no cost or
obligation to the STATE.
d. Should MUNICIPALITY choose to install lighting attached to a utility pole(s) belonging
to Utility Company, the STATE shall not be involved and MUNICIPALITY shall make
appropriate Pole Attachment Agreement and payment arrangements with the
respective Utility Company.

ARTICLE 3: TERM OF AGREEMENT.

3.1 This Agreement shall commence upon the 30
day of April, 2022, and shall
th
expire upon the 29day of April, 2047 (the date twenty-five (25) years thereafter). The
MUNICIPALITY shall continue to maintain and energize the lighting system for the period of its
useful life or until such time as the COMMISSIONER, at his/her discretion, in agreement with
MUNICIPALITY, determines that such lighting and/or the maintenance of such lighting system is
no longer warranted or desired for such State HAI \[for: Highway, Arterial, or Interstate: choose\],
and sets forth action to remove such lighting system at the MUNICIPALITY’s expense.
3.2 The MUNICIPALITY agrees not to assign, transfer, convey, sublet or otherwise
dispose of this Agreement or any part thereof, or its right, title, or interest therein, or its power to
execute this Agreement to any person, company or corporation without COMMISIONER’s
written consent. MUNICIPALITY shall express their desire to change the terms of this
Agreement in writing to the COMMISSIONER, except as herein provided by Municipal
Resolution attached hereto.
3.3 The COMMISSIONER herewith extends his/her consent to the MUNICIPALITY
to establish a lighting district to transfer the MUNICIPALITY’s cost for repair, maintenance of the
lighting system, and to ensure that payments are made to Utility Company for delivery and
supply of energy.
ARTICLE 4. TERMINATION OF AGREEMENT.
4.1. Prior to the expiration of the Agreement, the MUNICIPALITY shall review the
Agreement and determine whether it desires to continue maintaining said lighting system. If at
any time after the useful life of the lighting system the MUNICIPALITY, in its discretion,
determines that it does not desire to maintain said lighting system, it shall notify the
COMMISSIONER or his/her representative in writing.
4.2. During the duration of this Agreement, where the MUNICIPALITY has no desire
to maintain the lighting system, and / or discontinues payment for the energizing of the lighting
system covered in this Agreement, said fixtures will be removed by the STATE at the expense
of the MUNICIPALITY, unless the STATE has funds available to maintain, repair and energize
said lighting system, and the COMMISSIONER, in his/her discretion, determines that such
lighting system is warranted or desired for such State Highway. Upon written notification by the
COMMISSIONER of the removal cost, the MUNICIPALITY shall, within 90 days of the receipt of
such written notification from the COMMISSIONER, reimburse the STATE the amount specified.
The cost of removal includes but is not limited to review and upgrading of roadway delineation
features, including pavement markings, and any and all penalties, fees and/or other costs for
unamortized fixtures which the STATE is required to pay the Federal Government.
ARTICLE 5: REMEDIES
5.1. Should the MUNICIPALITY, within the term of this Agreement and without the
prior written consent of the COMMISSIONER, discontinue the repairs and maintenance, and/or
discontinue payment for energizing the lighting system covered in this Agreement, which results
in the STATE being required to make payment to the Federal Government, as a penalty or
otherwise, the MUNICIPALITY, upon written notification by the COMMISSIONER of such
requirement to pay, shall reimburse the STATE the amount of such required payment within 90
days of the receipt of such written notification from the COMMISSIONER.

5.2. Further, it is expressly understood that the MUNICIPALITY shall indemnify and
save harmless the STATE from claims, suits, actions, damages and costs of every name and
description resulting from the discontinuance of the repairs and maintenance, and/or
discontinuance of payment for energizing of the lighting system by the MUNICIPALITY.
5.3. The COMMISSIONER or his/her representative may periodically inspect the
lighting system installed under the above-identified Construction Project to ascertain that the
lighting system is being maintained and energized in accordance with the terms of this
Agreement and in condition satisfactory to the COMMISSIONER. The COMMISSIONER shall,
in writing, notify the MUNICIPALITY of any observed deficiencies, listing such deficiencies.
Within thirty (30) days of receipt of such notification by MUNICIPALITY, the COMMISSIONER
or his/her representative shall arrange for a meeting to be held with the authorized
representative of the MUNICIPALITY. At such meeting the COMMISSIONER or his/her
representative and the authorized representative of the MUNICIPALITY shall discuss the means
required to remedy the noted deficiencies. Based on the discussion, and based on the nature of
the required remedial action, a reasonable time limit shall be mutually established by the
COMMISSIONER or his/her representative and the authorized representative of the
MUNICIPALITY for the satisfactory completion of remedial action by the MUNCIPALITY.
5.4. It is recognized by the parties hereto that failure of the MUNICIPALITY to
complete the required remedial actions within the agreed upon time limit may subject the
MUNICIPALITY to certain penalties. If the equipment supplied and installed by the STATE for
the above subject lighting system was done pursuant to a Federally aided and/or Federally
reimbursable contract, and the MUNICIPALITY fails to make the remedial actions within the
agreed upon time limit, no further Federally aided project shall be approved for the
MUNICIPALITY until such time as the said lighting system is restored to the level and condition
required by this Agreement. In addition, failure of the MUNICIPALITY to make such remedial
actions may subject the MUNICIPALITY to loss of State aid for other future municipal contracts.
ARTICLE 6: NOTICE REQUIREMENTS
6.1 All notices permitted or required hereunder shall be in writing and shall be
transmitted either:
i. Via certified or registered United States mail, return receipt requested;
ii. By personal delivery;
iii. By expedited delivery service; or
iv. By e-mail.

6.2 Any such notice shall be deemed to have been given either at the time of delivery
or, in the case of expedited delivery service or certified or registered US mail, as of the date of
first attempted delivery at the address and in the manner provided herein, or in the case of

6.3 The parties may, from time to time, specify any new or different address in the
United States as their address for purpose of receiving notice under this Agreement by giving
fifteen (15) days written notice to the other party sent in accordance herewith. The parties agree
to mutually designate individuals as their respective representatives for the purposes of
receiving notices under this Agreement. Additional individuals may be designated in writing by
the parties for the purposes of implementation and administration/billing, resolving issues and
problems, and/or for dispute resolution.
ARTICLE 7: PROCESSING OF BETTERMENT DEPOSITS AND PAYMENTS
7.1 NYSDOT will install, remove, relocate, replace and/or reconstruct the
MUNICIPAL facilities in accordance with plans and specifications related thereto, as they may
be amended or revised, and subject to such change orders as may be approved by NYSDOT in
connection with its administration of the work and other work under the Construction Contract
for or relating to the work under this Agreement.
7.2 For all Betterment work done by NYSDOT, the MUNICIPALITY shall, prior to the
work being done, deposit in a project escrow account with the Office of State Comptroller the full
amount of the MUNICIPAL share (if any) reflected in the itemized engineer’s estimated cost of
the work to be performed on MUNICIPAL facilities for payments by the Comptroller on account
of Project costs. The excess amount of such deposit shall be reimbursed to the MUNICIPALITY
after project close out, unless Fixed Price Lump Sum project share is established.
7.3 Payments to the Contractor for Betterment work shall be made using State
Comptroller vouchers or requisitions approved by the COMMISSIONER.
7.4 When Betterment work performed on the MUNICIPAL facilities contemplated
herein has been completed, and all payments have been made to the Contractor, the
COMMISSIONER shall determine the additional costs thereof to be borne by the
MUNICIPALITY. Any excess of the deposit shall be returned to the MUNICIPALITY on the
warrant of the State Comptroller or using vouchers approved by the COMMISSIONER; and, in
the event such costs exceed the amount of the deposit, the COMMISSIONER shall send a
written notice to the MUNICIPALITY requesting such extra payment be deposited with the Office
of State Comptroller in a project escrow account. The MUNICIPALITY shall, within 90 days of
receipt of such written notice from the COMMISSIONER, pay the amount of such deficiency to
the Office of State Comptroller, unless Fixed Price Lump Sum project share has been
established.

TOWN OF WAPPINGER
COVID-19 TELECOMMUTING POLICY
Wappinger
will remain operational, and employees are expected to continue with their job duties and
responsibilities as directed. The following guidelines will be reviewed periodically and may evolve to
ensure the health and safety of the Town workforce. These are temporary and only in effect during the
emergency, or unless otherwise extended by the Town. These guidelines do not apply to Court, Town
Clerk, and Highway Departments.
Purpose and Intent
Town employees will still continue to provide services that the community expects and is reliant upon.
In order to continue operations, the intent is for employees to work at their regular locations, however
when that is not possible, and job duties and technology allows, employees will be able to work
remotely.
Telecommuting is a temporary arrangement necessitated by the Telecommuting policy. Telecommuting
may be appropriate for some employees and/or jobs but not necessarily for all staff, and this
determination will be made exclusively by the Town Supervisor. Telecommuting is not an entitlement,
and it in no way changes the terms and conditions of employment with the Town. Any Telecommuting
assignment will be evaluated as frequently as the Department Head/Town Supervisor believes is
necessary and may be discontinued at any time.
This guide outlines key considerations, best practices, and guidance specific to Telecommuting for all
employees of the Town.
Hours Worked
All employees who work when the Town is open, either remotely or on-site, shall be paid for hours
worked at their regular hourly rate of pay.
TELECOMMUTING GUIDELINES
Who May Work Remotely
Permitted situations where Telecommuting may be authorized, assuming the employee is healthy and
able to perform duties:
Employee is healthy but dependent has symptoms, is subject to quarantine by a health
care provider or Health Department, or diagnosis related to COVID-19 that have been
confirmed by a health care professional.

Employee is healthy, but placed under COVID-19 related quarantine by their health care
provider or Health Department.
Employee is at a higher risk for contracting COVID-19 as defined by the CDC (higher risk
groups include being 60 years or older, having an underlying health condition or being
immunocompromised).
Employee needs to provide care to dependents due to COVID-19 related school and/or
daycare closures.
Employee has recently traveled to a high-risk area, as defined by the CDC or may have
some other exposure to COVID-19.
At the discretion of the department head, and with final approval from the Town
Supervisor, additional department and/or employee requests for telecommuting will be
considered.
All requests and considerations for telecommuting will be at the discretion of the department head with
final approval made by the Town Supervisor. The business of the Town will take precedence over
telecommuting work days. Employees may, at the discretion of their immediate supervisor or
Department Head, be called to work at their centrally located worksite on their regular telecommuting
workday, to meet workload or operational requirements.
Any Telecommuting arrangement may be discontinued, at any time, by the Town or at the request of
the employee.
Priorities & Essential Work
The employee and supervisor will evaluate the responsibilities and priorities of the position, considering
impact and feasibility of completing some or all duties remotely. It is likely that many employees either
will not have enough work available remotely to fill their regular work day, or will have demands on
their time, for example child care, that will make it impossible to work their full work day. In those cases,
the employee should submit regular work hours for time actually worked and utilize other leave credit
for the remaining hours.
Technology
At a minimum, an employee needs a computer, internet, and phone access to work remotely. This may
be a Town issued or personal desktop or laptop computer. The Town will not provide technical support
for personal devices, other than support needed to set up remote access.
Equipment and/or service that the Town provides to the employee is Town property and may be
recovered or discontinued at any time and at the sole discretion of the Town. Employees are required
to adhere to all Town policies and procedures while using remote access capabilities. Additionally,
employees are required to take the necessary steps to keep all equipment and/or service used for
remotes access in a safe location and avoid any misuse. No one other than the Town employee is
allowed to access Town documents or utilize Town equipment.

Computer and Internet
To work remotely an internet connection is required and the equipment being used must have a
Security malware installed.
The secure connection provided by the Town gives the remote user access to the applications and data
needed to do their job. There should be no need to download any data to a personal device, and this is
strictly forbidden. This helps to ensure the integrity and confidentiality of the data.
Employees are responsible for following all Town practices and policies to maintain security and protect
confidentiality on a device. The Town will not reimburse for internet or phone expenses incurred, or any
damages you may experience to your personal devices.
Phone
To work remotely, an employee may also need to roll phone calls forward from their work phones to
either a home phone or cell phone. Please refer to landline phone instructions on how to forward
incoming calls.
Home Environment
Department Heads and employees must consider whether the home environment is conducive to
remote work. Factors include the demands of other household members, household construction,
appropriate lighting, seating, and other basic conditions. Expectations should be set with other
household members regarding interactions and availability.
To ensure that employee performance will not suffer in remote work arrangements, the Town requires
employees to:
Choose a quiet and distraction free working space
Dedicate their full attention to their job duties during working hours
Adhere to normal break and attendance schedules
Be accessible to Town personnel by phone and/or email
Maintain Strict confidentiality of Town and/or client information
Pay
All employees who work remotely when the Town is open will be paid for hours worked at their regular

It is expressly understood and agreed that this work arrangement does not create or define the terms of any
contract of employment, whether expressed or implied.
Terms of Arrangement: This telecommuting arrangement shall be in effect for a maximum of four (4) weeks.
Continuation and renewal of said agreement will be evaluated at the end of the stated agreement period.
This agreement is subject to the employee satisfying the following conditions on a continuing basis:
Employee obligations, duties, responsibilities, and terms and conditions of employment are unchanged.
The employee shall perform all job duties at a satisfactory performance level or above.
The employee must comply with all Town policies and procedures while working a telecommuting
schedule.

Hours of Work and Compensation: The employee agrees to be responsible for maintaining the agreed upon hours
of work and is required to keep a detailed record of hours worked on timesheet. Employee pay rates and accrual of
leave time benefits remain unchanged and in accordance with the terms of this agreement the employee will be
compensated for all hours during which work is performed. Employees must get advance authorization for any
hours worked outside of or beyond their normal work schedule. Employees are required to take rest and meal

or other entity any such information and is prohibited from using any such information for personal gain or profit.

described below, are the owners in the aggregate of at least onehalf of the assessed valuation of all
the taxable real property in the proposed district, as shown upon the latest completed assessment
roll of the Town of Wappinger, and the resident owners of the taxable real property aggregating at
least onehalf of all the taxable real property of the proposed district owned by resident owners,
according to the latest completed assessment roll of the Town, hereby petition as follows:
1. That the Town Board extend the boundaries of the United Wappinger Sewer District
UWSDs of Article 12 of the Town Law to include
one (1) parcels of real property which are located in the Town of Wappinger, County of
Dutchess, New York outside of any incorporated village and entirely within the Town of
Wappinger as shown in the Map Plan and Report which is attached as Exhibit A.
2. The proposed valuation of all taxable real property situated in the proposed Extension
Area of the UWSD, as such valuations appear in the latest completed assessment roll
(2020) of the Town of Wappinger is as follows:

5. The map and plans attached to this petition as Exhibit A, show the boundaries of the
proposed district sufficiently to identify the lands as in a deed of conveyance, the source
of the proposed water supply, and a description of the lands, streams, water or water rights
to be acquired therefor, the mode of constructing the proposed water works, and the
location thereof, including reservoirs, water purification or treatment works, water mains,
distributing pipes and hydrants as required by Town Law §192 and these shall be approved
by the Board.
6. The Board shall recognize that the map and plans have been prepared by ROHDE,
SOYKA & ANDREWS, competent engineers, licensed by the State of New York.
7. The Board acknowledges that $228,000 is the maximum amount proposed to be spent in
the construction of the sewer mains and other improvements. All construction work for
the laying out and installation of the improvements within the proposed Extension Area
will be paid for by the undersigned so that no expenses occasioned by the expansion of
the UWSD shall be levied and collected from the several lots and parcels of land within
the district as it currently exists, by assessment or otherwise, and any and all such work
shall be done, undertaken and completed by the undersigned in accordance with the MPR.
8. The Town Board shall apportion the costs of the system according to Town Law §202.
The costs as assessed by the Town Board shall be borne in proportion to the benefit which
each lot or parcel will derive from the system.
9. Upon extension of the UWSD, the buy-in fee for the non-residential property is $73,500
pursuant to §236-6 of the Town of Wappinger Town Code as authorized by Town Law
§202(5).
WHEREFORE, the undersigned Petitioners respectfully request that the Town Board of the
Town of Wappinger establish an Extension Area to the United Wappinger Sewer District hereinabove
proposed and described and that a public hearing thereon be held according to law.
