SMITH Supervisor Telephone: (914) 297-0720 RE: PAYMENT TO RGH CONSTRUCTION FOR WORK AT CASTLE POINT During the early part of Summer, the landfill area at Castle Point was still being worked on and the area set aside for the playground equipment required extensive construction effort. Time now became a very important factor in having the Castle Point Park ready for the opening of our Summer Programs. We were able to acquire the services of RGH Construction and they agreed to come in and perform the needed work and complete this effort in time for the opening of the park. The work was completed and Castle Point playground opened on schedule and we had a successful season. It is now time to pay the bill which is $2,783.74. This exceeds the amount of dollars we can contract for work without having three (3) estimates, We do feel however, that this was an emergency and we had to get the work completed. We request we be able to pay the vendor. The money to pay RGH Construction is covered in our budget A-7110.4. They all indicated their willingness and immediate availability to do the work. With that in mind, I will ask Roger Hummeston and/or Graham Foster to contact Bob Ray of Central Hudson Gas & Electric at 897-6137 and Roger Yensen at 454-7713 48 hours prior to the date that they wish to start the work. Central Hudson and NYNEX will furnish the necessary cable and conduit at no cost to the Town, and will make themselves available to do their necessary work. am also asking Roger Hummeston to contact Dave Buckley of your Department at 486-3600 so that the appropriate inspections can be made. As requested, Dave would like to be on site the first or second day the project is going on. This time frame coincides with the Summer Playground program which this year runs from June 25th to August 12th. In light of the fact that there will be 45 trucks a day going into the park and the bulldozers working leveling the fill, we feel that for the children's safety that the park should be closed until the job is completed. Smith, Supervisor Reference: Castiepoint Recreation Dear Board Members: EG IV ED MAR 18 1997 ELAINE SNOWDEN TOWN CLERK On March 13, 1997, i attended a meeting at the Castlepoint Recreation Site regarding the construction of the electric service on the site. In attendance at the meeting were Graham Foster, Albert P. Roberts, Esq., Ralph Holt and Steve of the Recreation Commission, Joe Hetsler and Tom Eastwood of Central Hudson, and myself. After much deliberation, it was decided to provide service to the recreation parcel underground from an existing pole approximately 1,100 feet north of the site. The trench would be dug adjacent to the existing roadway approximately 24" off the edge of pavement. The ditch would be dug and backfilled by Graham Foster's crew, and the cable would be provided and laid by Central Hudson. Central Hudson will then place the transformer at the north side of the entry rcrad to.the park and from there the Town electricians could do their work. Mr. Foster and Central Hudson will be coordinating this work with the anticipation it will be done this Spring. With the certainty of the electric service evident at this point in time, this /office will proceed with the design of the building. This grant was received in 1994 and we still have not been able to use this grant. Several letters have been sent to the D. C. Planning Board for extensions. We were told all clearances have not been obtained for Central Hudson to install additional poles along River Road and into the Castle Point Park. It seems we have been in this position for some time. Could we please obtain an official Town position on the hold up? Is there anything we can do to help? We hope that the Town will be able to use the grant and we could move forward with our plans for this park. As you also know, we have received approval from another grant to construct rest room facilities at this park. Obviously we don't want to lose that. The water system equipment was delivered to the Town by N & S Supply, Inc., the low bidder. An overhead electric line 1,245 feet in length would be required to serve the Castle Point Park. Smith Reference: Castlepoint Recreation Site Community Development Block Grant for Water Supply Facilities Dear Supervisor Smith & Board Members: As you are aware, the Town of Wappinger received a Community Development Block Grant to construct a sewage disposal system and potable water supply well at the above referenced site. These facilities will service a proposed bathroom facility to be constructed at later date. The construction of the sewage disposal and water supply systems was performed by Blacktop Maintenance Corp. for the low bid amount of $26,543.75. This leaves a portion of the grant monies left unexpended. According to Ms. Laurie Johnson of the Dutchess County Department of Planning, these additional grant monies must be expended by November 30, 1995. Three potential uses have been targeted: A. Providing Electric Service to the Site: The Town Recreation Department requested a proposal from Central Hudson to perform this work, and received a quoted of $3,531.62. According to Ms. Johnson, since this is a public utility work that can not be competitively bid, a proposal from Central Hudson would be sufficient. A copy of the Central Hudson quote is enclosed. B. Well Development and Quality Testing: The original qualitative testing of the onsite bedrock well revealed trace amounts of chloroform (1.9 ug/l) and Toluene 0.4 ug/L). Constance 0. Smith - 3 - September 25, 1995 RE: Castlepoint Recreation Although these levels are not in violation of New York State Drinking Water Standards, we recommend re- developing the well and re -testing it (POC'S-Volatiles, EPA Method 502.2) in order to determine the source of these compounds. The contaminants observed in the water sample may have originated as part of the drilling process. The well driller may have used a' potable water supply that was chlorinated which could have resulted in residual chloroform forming. Also, a very small scale leak or spill of lubricating oils or gasoline used to fuel the engines could cause the observed levels of toluene. In any event, the above steps should aid in determined whether these compounds originated as a result of the drilling process or elsewhere. A well development and testing protocol provided by Chazen Environmental Services was distributed in a Request for Proposal to five (5) local qualified firms (See Enclosed). To date, only one (1) proposal has been returned to this office: Boyd Artesian Well Co., Inc. Notwithstanding the foregoing, the following activities, without limitation, are expressly prohibited: hunting, trapping, bicycling, skateboarding, rollerblading, picnicking, cooking, camping, snowshoeing, and use of any motorized vehicles. It is agreed by the Grantee that the Trail will be located within the Trail Easement Area only and shall not infringe upon any lands of the Government outside the Trail Easement Area. It is further agreed by and between the Government and the Grantee that the Trail to be constructed within the Trail Easement Area is not intended to extend throughout the entire portion of the Trail Easement Area. It is the intention of the parties that this Easement shall run with title to the servient tenement in perpetuity and shall bind and be enforceable by and against the parties, their successors and assigns. The Easement is granted subject to the following conditions and provisions: 1. Grantee shall prohibit, restrict or regulate any uses, including, but not limited to, those specific uses listed above, which Grantee determines to be unsafe or otherwise detrimental to the continued use, vitality, or condition of the Trail or Trail Easement Area, or which the Government determines to be unsafe or detrimental to the Government's Premises, activities or operations thereon. Additionally, the Government shall have the right at any time to restrict the permitted uses of the Trail over the Trail Easement Area to only the activities of hiking, walking, jogging, running, bird watching upon thirty (30) days' written notice to the Grantee, and the Grantee hereby agrees that in such event, Grantee will take all action necessary to post signs and to advise users of the Trail of such restrictions and to enforce such restrictions. 2. No structures of any kind shall be erected, constructed, placed, or installed within the Trail Easement Area, except a chain linked fence, without the written consent of both parties, except, however, that nothing contained in this Grant of Greenway Trail Easement shall be construed to prohibit the placement of underground or overhead utilities within the Trail Easement Area, at the Government's option. The Government shall have no obligation whatsoever to grant consent to the Grantee's construction of any structures within the Trail Easement Area. 3. The Government and the Grantee agree that in creating this easement for public access each party is specifically relying on the protection against liability contained in Section 9-103 of the New York General Obligations Law, and that for such purposes both the Government and the Grantee shall be deemed "owner" or "occupants" of the Trail Easement Area as designated in this Easement, in addition to the Government and its successors and assigns being the owner of the Premises or have such other status provided in Section 9-103 of the General Obligations Law. The parties agree that in the event of any repeal or amendment of Section 9-103 of the General Obligations Law which diminishes its protective effect of the Government, its successors or assigns, with respect to liability for the use of the Trail Easement Area, the Government, or its successor in interest, shall have the option of extinguishing this Easement upon written notice to the Grantee, or its successors in interest. In the event the Government, or its successor in interest, shall elect to extinguish this Easement as herein provided, the Grantee, or its successor in interest, shall cooperate with the Government, or its successor in. interest, in executing any necessary documentation in proper form for recording in the Dutchess County Clerk's Office to extinguish this easement, and the Grantee shall effect recording in the land records of the Dutchess County Clerk at Grantee's expense. The Grantee or its successor in interest shall take all steps necessary to terminate and prevent use of the trail or the trail Easement Area within thirty (30) days of Government, or its successor in interest, mailing or personally delivering written notice of its election to extinguish this Easement, during which thirty (30) day period the Grantee, or its successor in interest, shall continue to maintain all insurance coverage for the Grantee, or its successor in interest, as provided in this easement agreement. 4. That the Government reserves the rights for all purposes across, over, or under the easement area herein described; such rights, however, to be exercised in a manner which will not create undue interference with the use and enjoyment by the Grantee of said easement; provided, that any construction by the Government in connection with the rights so reserved shall be at the expense of the Government. Nothing contained in this Grant of Greenway Trail Easement shall be construed to prohibit the Government from the placement of underground or overhead utilities within the Trail Easement Area. 5. That the trail or other facilities constructed shall be installed, operated, maintained, reconstructed, repaired, and replaced by the Grantee, within the easement area without cost to the Government, under the general supervision and subject to the approval of the Government official having immediate jurisdiction over the property. The Grantee shall replace, repair, restore, or relocate any property of the Government affected or damaged directly or indirectly by the construction, reconstruction, installation, operation, maintenance, and replacement of said facilities all to the satisfaction of the Government official having immediate jurisdiction over the property. 6. Grantee agrees to maintain, at all times during which the trail Easement Area is open for public use, and at Grantee's sole cost and expense, a standard policy of general commercial liability insurance with respect to the entire Trail Easement Area, said policy presently to have a coverage limit not less than $5,000,000.00 and which coverage amount shall be upwardly adjusted upon request of the Government, not more frequently than every five years. Grantee shall at all times cause Grantor to be named as an additional insured on said policy of insurance for any liability arising from use of or acts or omissions with respect to the Trail Easement Area. The Grantee agrees to furnish to the Government, its successors or assigns, a certificate of insurance evidencing the coverage herein provided prior to opening the Trail shall be open to the public. In the event the Grantee, its successors or assigns, shall elect"to close the Trail for any purpose whatsoever, whether temporarily or permanently, the Grantee shall notify the Government, its successor or assigns, in writing, in advance of such close of the Trail. Grantee shall maintain the general commercial liability insurance until thirty (30) days such closure date. 7. When the Trail shall be opened for public use, the following shall apply: (A.) Grantee, in cooperation with the Wappinger Greenway Committee, shall at all times be responsible for performing routine and periodic maintenance of the Trail and Trail Easement Area consistent with generally accepted standards for similar unpaved public recreational trails, at Grantee's sole cost and expense. (B.) The Trail Easement Area and Trail shall be kept in a substantially natural state as currently exists, with only those improvements, alterations, and trail markings needed to provide a safe and inviting path for the public, it being specifically understood and agreed that the trail will not be paved. (C.) . Grantee's regulations for use of the Trail and Trail Easement Area will prohibit motorized vehicles, bicycles, camping, cooking, hunting, trapping, skateboarding, rollerblading, picnicking, and snowshoeing. (D.) Grantee, its successor or assignee, in its sole discretion, shall have the right to suspend public use of the Trail from time to time for maintenance purposes or safety reasons. (E.) This Easement does not convey any right for the general public or the Grantee to establish or use parking spaces on the Premises in order to access the Trail or for any purpose whatsoever. (F.) Grantee shall construct and at all times maintain the trail in a safe and clean condition, shall at all times maintain the Trail in accordance with and consistent with all provisions of this Easement, and shall enforce the rules and regulations for the Trail which its issues pursuant to Paragraph 6(C) above and as consistent with all provisions of this Easement. (G.) Grantee agrees that it will not take any action or perform any activities on the Trail Easement Area, nor will Grantee permit the same by any user of the Trail, which would restrict, interfere with, obstruct, or prevent use of the Trail Easement Area by anyone having pre-existing rights of such use. 8. That no mining operations shall be conducted on the premises described above. No minerals shall be removed therefrom except such as are reasonably necessary incident to the utilization of the described premises for the purpose for which the easement is granted. 9. That the Grantee will indemnify and save the Government harmless from any liability or responsibility of any nature whatsoever arising directly or indirectly from the privileges herein granted. 10. That all right, title, interest, and estate hereby granted shall cease and terminate effective as of the date of written notice from the Government to the Grantee, its successors or assigns, that there has been, (a) a failure to comply with the terms and conditions of the grant, or (b) a nonuse of the easement for a consecutive two-year period for the purpose for which granted, or, (c) an abandonment of the easement. In the event of failure to comply with the terms of this easement, the Government, or its successor in interest, shall give written notice to the Grantee, or its successor in interest, of such failure. Upon such notice being given, the Grantee, or its successors in interest, shall immediately cure such failure so as to comply with the Grantee's duties and obligations set forth in this Easement agreement. In the event of failure of the Grantee, its successors or assignees, to provide proof of insurance as set for herein, or in the event of the existence of a dangerous condition or safety hazard with respect to any part of the Trail Easement Area which may come to the attention of the Government or its successors in interest, the Grantee, its successors and assignees, shall have the obligation to take all steps necessary to immediately suspend public access to and use of the trail and any part of the Trail Easement Area until such failure is remedied. Failure to provide such notice by the Government shall not be deemed a waiver of the Government's rights. 11. That upon termination or forfeiture of the grant, the Grantee shall within a reasonable time thereafter, if so requested by the Government, remove from the land hereinafter described all structures, installations, and appurtenances thereto belonging to Grantee and restore the premises to the satisfaction of the Government. 12. This Agreement may only be amended by written instrument executed by the Grantor and Grantee, or such parties' successors in interest, recorded in the office of the Clerk of the County of Dutchess. 13. This easement shall be governed by the laws of the United States of America and when Federal law is silent, defers to State law, the laws of the State of New York. Move the children's play area from the southwest corner to the northwest corner providing additional distance from the landfill exhaust pipe. 2. Fence in the entire landfill area with a suitable fence that portrays the message, stay out of the fenced area. The findings of the gas leakage coming as late as it has gives us an immediate problem, `out summer program is underway and we have 51 children signed up to be at the camp site daily. Recreation would recommend we do the following: 1. Make ready the playground site in the northwest section of the park. This wold require some bulldozer work to level a section of the ground 35' by 120' so the playground equipment can be installed (slide, swings, monkeybars and basketball hoop.) R.G.H. Construction is providing an estimate for this piece of the work. The bulldozer effort performed will provide an 8" to 10" in depth area. After the equipment has been secured, we will need 100 ton of pea gravel to fill the bulldozed trench. (This is to meet safety requirements.) On Friday night, July 17th, vandals. broke into our storage truck body at the Castle Point Playground. They cut through the metal exterior of the trailer, broke the wood interior and then destroyed playground supplies stored there. The vandals also used these supplies to fuel fires which were set on the cement floor of the pavilion and on top of the steel picnic tables. They also indiscriminately threw the supplies along with broken beer bottles around the playground area and the pavilion. Peggy Roe, Recreation'Secretary was notified of this destruction by the Sheriff's Office on Saturday afternoon at 1:30 and along with Recreation Director Bernie Reimer went to the site to clean up and salvage what supplies they could. Our maintenance crew was notified of the situation early Monday morning to finish cleaning the area and to make sure that all broken glass had been picked up. (The children at the Castle Point Playground were sent to Quiet Acres Playground for the day.) They also secured the truck body and worked on cleaning up the tops of the picnic tables. Attached is a picture of the truck body and a list of the supplies which were lost or damaged which amounted to $240.28. The truck body which we estimated at a value of approximately $500. is a loss. The tables through the efforts of our maintenance crew were cleaned up the best they could and are useable. HOLT, CHAIRMAN RE: CASTLE POINT RECREATION AREA I believe the t;Ime has come to start on the enhancements to our Castle Point facility. We presently have one ball field available and it is in use every night. Even throgghthis very wet Spring, the field has stayed playable, the problem was that the water that collected, made travel over the existing road impossible. We feel that as the land drys out, we should start to move dirt around so that the landfill area is covered adequately (2" to 3") and then leveled and seeded. We also feel that�the existing road be improved and that the actual flow of the road be changed from what was needed when this was a landfill area.to something that would better service a sports complex. These are two very big steps in the development of the Park and would certainly display the Town's good faith and determination to put the facility to the use that it was intended. The area of land to be covered and seeded is approximately 4 acres. The grading of the road and the laying of .bank run gravel will.certainly be a good start. We have other ideas for the park such as a picnic area over looking the Hudson. We have been given a grant of $500.00 to start this effort. We will do the initial planning effort to accomplish this, but its importance at this point is secondary to the two (2) efforts addressed above. We have been able to put together one estimate to give us a feel for the expense we would run into and this estimate was for $35,000. We would propose that the Board allow us to go out to bid these two efforts and that the funding be made available from our Parkland Funds. To satisfy the growing needs.for recreational fields for softball and soccer this facility will help solution the problem. I would be happy to discuss this with you and I eagerly await your answer.
