In accordance with 6NYCRR Part 360, the State's regulations governing closed landfills, groundwater and landfill -generated gasses must be monitored for a period of 30 years after closure (6NYCRR Part 360-2.15). This work has been conducted in accordance with the December 2000, NYSDEC approved, Post -Closure Monitoring and Maintenance (PCMM) Manual, prepared by Paggi, Martin & Del Bene, LLP. In July 2004, Conrad Geoscience requested that the frequency of groundwater monitoring be reduced from quarterly to annually, and that samples be analyzed in accordance with 6NYCRR Part 360 Baseline Parameters. This request was granted by NYSDEC shortly thereafter. Landfill gasses are monitored quarterly. Results of field inspections and sampling are reported to NYSDEC at the completion of services for that quarter, Conrad Geoscience provides landfill gas monitoring at an annual cost of $1,923.00, and annual groundwater monitoring at $2,500.00 per year. The total cost for 2013 services is $4,423.00. The cost to provide post -closure monitoring services, as outlined above, for the remaining post -closure monitoring period (17 years), at current rates, would be $75,191.00 If you have any questions, please do not hesitate to call. Our comments are as follows: A. Comments on the Clay Barrier Layer Pre -Qualification Test Results: 1. Natural moisture content vs. optimum moisture content test results indicate that moisture conditioning of the clay (wetting/drying) may be required to obtain the 2 % wet - 2 % dry (of optimum) in place moisture content. What methods are proposed for field moisture conditioning of clay during construction of the layer? How will this work be coordinated with lab personnel? 2. Why do the direct shear tests note that "Test results do not comply with specifications"? In what way don't they comply? 3. Please provide descriptive information regarding the borrow source and quantity as per the specs (pg. 3.01-2). 4. Please note that the Atterberg Limits test results (liquid limits 20 - 28; plastic limits 18 - 21; and plasticity index of 2 -7) are more indicative of a silt or fine sand rather than a clay material. It should also be noted that the permeability results, while pa�i g, were somewhat borderline, especially #97-1082C (i.e. K20 = 8.4 x 10 cm/sec). 5. Please note the disclaimer on the lab permeability test results. Acceptance of lab permeability test results in no way relieve the Contractor for his responsibility to achieve final, in-place permeability results in conformance with the specifications. 6. Please note that Contractor must construct and achieve satisfactory test results for the Barrier Layer Test Pad prior to the start of construction of the Barrier Layer (pg. 3.01-6, 7). 7. Comments on the Barrier Protection Layer Material Pre -Qualification Test Results: 1. Please provide descriptive information regarding the borrow source and quantity as per the specifications (pg. 4.01-2). 2. Natural moisture content vs. optimum moisture content test results indicate that moisture conditioning of the barrier protection layer material (wetting/drying) may be required to obtain the 2 % wet - 2 % dry (of optimum) in place moisture content. What methods are proposed for field moisture conditioning of the material during construction of the layer? How will this work be coordinated with lab personnel? 3. Please provide information indicating that the proposed material contains no more than 200 rock and conforms to "fine to coarse GW" as defined under the Unified Soil Classification System (pg. 4.01-2). 4. It appears as if your gradation analysis utilizes the "old" specification used for the first bid of the project (i.e. March 97). The gradation analysis was revised for the second bidding of the project (i.e. May 97). Please revise your gradation analysis accordingly and resubmit this item. 5. Please provide the Construction Quality Assurance/Quality Control plan as specified (pg. 10.01-2) prior to the start of construction. 6. The visual description is noted as "recycled soil". Please provide information as to the source, processing and quality of said soil. Please note that the Engineer shall have sole discretion for the suitability of any materials. C. Comments on the Topsoil Laver Material Pre -Qualification Test Results: 1. Please provide descriptive information regarding the borrow source and quantity. 2. As per the specifications, please certify that the topsoil meets either: a. New York State Department of Transportation Specifications, or b. That as per a soil scientist, the topsoil can adequately sustain vegetative growth. 3. The pH test result (7.8) exceeds the specified range of 5.5 - 7.6. 4. Please note that all topsoil is subject to a visual test for foreign or deleterious materials. 5. Please provide the minimum Soil Nutrient Analysis as detailed on page 5.01-5, including description and classification of soils. Christopher Coyle - 3 - November 21, 1997 RE: Castlepoint Landfill D. Miscellaneous Comments: 1. As a clarification, please note that the New York State Department of Environmental Conservation did not tell this office that starting the project now was "inadvisable", as indicated in your cover letter. In our conversations over the past few months, various N.Y.S.D.E.C, personnel have indicated to our office that beginning such a large earth moving project during the winter months could cause them concern especially with maintaining the integrity of the job site, slopes, material, etc., during extended periods of inclement weather. The ultimate decision of the suitability of the weather to perform the work rests with the Town (Engineer). 2. Your submittals for all three materials shall be considered incomplete until such time as all requested information and/or clarifications are submitted to this office for review and approval. 3. This material pre -qualification review is limited to the specific information submitted and does not relive the Contractor of any of his requirements under the Contract Specifications. 'Field verification of all material acceptance criteria shall be the sole responsibility of the Contractor. 4. By copy of this letter, I am transmitting all Pre -Qualification submittals to Mr. Tom Miller of the N.Y.S.D.E.C. for his review. As per a subsequent telephone conversation with the Town Attorney's Office, Mr. Roberts stated that the Bid was received after the deadline specifically outlined in the specifications, and as such was disqualified. Please note that a $35,000.00 certified check submitted as a Bid Security was returned to Amenia Construction immediately following the Bid opening. This office has reviewed all Bids and find them to be in the proper format. With the exception of a few minor errors that do not affect the Bid results, all Bids are mathematically correct. The low Bidder's unit prices appear to be balanced with no anomalies. We would ask that the Town Board discuss the matter at its earliest convenience.
