Re: Castlepoint Landfill
1 had a telephone conversation with Mr. Chris Brown of Conrad GeoScience today regarding
the Castlepoint Landfill. Mr. Brown's firm performs the quarterly gas and groundwater
monitoring of the landfill. Mr. Brown informed me of two things:
1) Gas vent # 7 has been broken (vandalized). This vent is located just south of the gazebo,
in the area where the playground equipment used to be. Apparently, the top elbow of the
PVC pipe has been broken off. We would recommend that the Town forces repair this as
soon as possible to preclude rainwater from entering the gas vent.
2) Mr. Brown has had recent conversations with Mr. Andrew Lent of the NYSDEC regarding
the groundwater testing requirements at the landfill. Based on the recent history of test
results, it appears as if Mr. Lent is willing to consider allowing the Town to reduce its
groundwater testing parameters from the current level (i.e. 3 routine and 1 baseline
sampling per year) to just 1 baseline sampling per year. The gas monitoring would still
need to be done on a quarterly basis. Mr. Brown is going to draft correspondence to the
NYSDEC regarding this matter, and copy the Town.

This letter is written in response to your review comments dated September 27`h, 2000. Please
be advised that the majority of your comments have been previously addressed and transmitted
to various New York State Department of Environmental Conservation (NYSDEC) personnel,
however, this submittal is the first time that all your comments have been addressed under
cover of one letter.
The Post Closure Monitoring and Maintenance Manual (PCMiV111+n has been revised as
follows:
1. The required deed was filed in the Dutchess County Clerk's Office on October 12th,
2000, including the required mapping. We have included the referenced property deed
within the revised PCMMM as Section "N".
2. The description of the proposed future use of the landfilled area has been revised
accordingly. We have included the referenced correspondence from Field Safety Corp.
directly within the revised PCMMM as Pages 3A and 3B.
3. The requested standard operating procedures for collecting and analyzing landfill
decomposition gas data as prepared by Conrad Geoscience Corp. has been included
within the revised PCMMM as page 9-A.
4. Existing monitor well MW -8 was damaged prior to the April, 2000 water quality
monitoring event. The well was replaced (in close proximity) by Well MW -8R,
installed by General Borings, Inc., under the supervision of Conrad Geoscience, Corp.
The monitoring Well Installation Detail and Boring Log have been included within the
revised PCMMM as Pages 11-A and 11-B.

Existing Monitoring Well MW -8 was abandoned in conformance with NYSDEC well
decommissioning standards as follows:
• The steel, surface (protective) casing was removed,
• The subsurface PVC riser pipe was split, and
• The well was pressure grouted from the bottom up to dissipate water and fill all
voids.
5. The "As -Built" Site Plan map has been finalized (including the requested items) and
has been included within the revised PCMMM as Attachment "O".
6. As per your request, we have included all changes directly within the revised
PCMMM, so as to make it a complete, "stand alone" document.

Construction was started in Apnl 1998 and completed in October 1998.. The total construction cost
including Change Orders. was $488,525.00.
The one-year guarantee period runs out on November 4, 1999. Paggi, Martin & Del Bene and the
Department of Environmental Conservation conducted a final inspection on November 4, 1999 and
generated a punchlist of items that the Contractor must complete prior to release of his $14,655.00
retainage (see copy enclosed).
The items that need to be completed consist of repairing areas where the cover has eroded or where
the grass has not taken, as well as cleaning, filling and/or regrading of drainage ditches. As of this
date, Hudson Canyon Construction has performed all remedial work with the exception of regrading the
down gradient ditch.
The Town received a total grant of $274,722.35 from the EQBA, of which $247,250.11 was received on
April 8, 1999.
To receive the 10% EQBA retainage of 827,472.24 the Town must complete certain items necessary
for the Department of Environmental Conservation (New Paltz) to sign off on the project:
1. Submit "As Built" drawings of the final in-place cap system,
I have scheduled our field crew to perform the necessary survey work, and anticipate that
it can be completed by December 17°1, 1999

2. Submit a new. deed for the property indicating the time during which the property was used
as a landfill, with a brief description of the types and amounts of waste contained within it,
and noting that records of the facility are on file with the Department of Environmental
Conservation. This deed must also be filed at the Dutchess County Clerk's Office. The
proposed deed revisions are detailed under Section B of the Post -Closure Monitoring and
Maintenance Manual.
We would recommend that Ai Roberts prepare all necessary legal documents.
3. Submit a Post Closure Operation and Maintenance Manual including a schedule for 30
years of quarterly testing of the major components which are:
a) quarterly visual inspections for damage to cap systems, erosion, Leachate,
vectors, etc.
b) quarterly explosive gas monitoring.
G) quarterly water quality monitoring for 2 down gradient wells (1 rock, '1 overburden)
and 1 upgradient well. These tests must include one quarter of baseline testing
and three quarters of routine testing.
For future budgeting purposes, the Town may wish to solicit bids from hydrogeoiogiclenvironmental
firms for performing the work detailed under Item No. 3 above.
Enclosed for your review and approval is a draft copy of the "Post Closure Monitoring & Maintenance
Manual (PCMMM)" prepared by this office and dated December 3`d, 1999.

These services will be performed by qualified professional firms on an
individual contract basis with the Town of Wappinger subsequent to an
informal bid process. Appropriate names and contact numbers shall be
provided to the New York State Department of Environmental Conservation
(NYSDEC) as they become available.

B. PROPOSED DEED REVISIONS:
The deed for the Castlepoint Landfill shall be revised to indicate:
• The general period of time during which the site was utilized as a landfill
(197_-198_).
• While an exact description of the wastes contained within the site is
unknown, a general statement shall be included indicating that the Town of
Wappinger utilized the site to dispose of items from individual residences
that were collected during Spring cleanup operations and yard wastes.
Available information from Town of Wappinger Highway Department
personnel indicates that metals and tires were separated during these
cleanup operations, and removed from the site for disposal elsewhere. Test
pits excavated by the Town prior to and during landfill closure operations
revealed wastes consistent in nature with such cleanup operations.
All existing records of the facility including all subsurface investigation and
test results have been filed with the N.Y.S.D.E.C.
The deed must reference a map which shall be filed with the Dutchess
County Clerk's Office which clearly indicates the limits of the landfilled
areas within the property boundary.
• The deed must also indicate that the use of the site is restricted pursuant to
the provisions of 6NYCRR Part 360-2.15(k)(9).

C. FUTURE USE OF THE PROPERTY:
Subsequent land use of the landfill area by the Town of Wappinger shall be in
the form of community recreation. The site is designated for predominately
passive recreation activities, but also has provisions for playground activities,
children's summer camp, softball, etc.
Use of the property shall not disturb the integrity of the final cover, liners, or
any other components of the containment systems, or the function of the
monitoring or environmental control systems, unless necessary to comply with
the requirements of Section 360-2.20 of 6 NYCRR Part 360. The N.Y.S.D.E.C.
must approve any disturbance and will do so only if the Town of Wappinger
demonstrates that disturbance of the final cover, liners or other component of
the containment system, will not increase the potential threat to human health or
the environment.

D. SURFACE DRAINAGE:
Final surface slopes range from a minimum of 4% to a maximum of 33% to
promote surface runoff while maintaining slope integrity. Interceptor swales
have been installed upgradient of the landfill mass to prevent surface waters
from draining across the top of the landfill surface. Said interceptor swales
shall be maintained so as to operate continuously and effectively.
The gentle slopes and the grass cover will minimize soil erosion from both
wind and rainfall. In addition, quarterly visual inspections of the site will be
performed to determine if any erosion has taken place. Upon identification, the
necessary remedial erosion control measures will be undertaken,
Said quarterly inspections shall be performed by Town of Wappinger
personnel, or their designated representatives, and the results submitted to the
NX.S.D.E.C. as part of the annual inspection report.

E. SOIL COVER SYSTEM:
The grass vegetative cover overlying the soil cap will be the primary means of
maintaining the integrity of the cap system.
Quarterly inspections will determine if any slumping or subsidence in the soil
cover has occurred. Any changes of an unnatural degree that may occur in the
vegetative cover, any ponding of rainwater on the surface, and any apparent
observation of leachate outcropping to the surface, any signs of soil erosion
such as channeling shall be noted on the quarterly inspection report forms. In
addition, the vegetative cover shall be maintained so as to prevent shrubs and
saplings from growing on the landfill cap and penetrating the cover.
Said quarterly inspections shall be performed by Town of Wappinger
personnel, or their designated representatives, and the results submitted to the
N.Y.S.D.E.C, as part of the annual inspection report.

F. VECTOR ABATEMENT:
The primary method of vector control shall be through the installation of the
soil cap and topsoil cover. Secondarily, post -closure quarterly visual
inspections shall be conducted over the minimum post -closure period to
identify the presence of any vectors which may inhabit the landfill including,
but not limited to, rodents, insects, and birds. Should vectors be discovered
they shall be removed in a manner consistent with the MY.S.D.E.C. and other
recommended guidelines.
Town of Wappinger personnel or their designated representatives shall be
responsible for conducting the quarterly visual inspections and for
implementing any necessary vector control measures. The results shall be
submitted to the N.Y.S.D.E.C. as part of the Annual Inspection Report.
The site inspector shall observe any holes made by burrowing animals or other
evidence of the presence of vectors. If the landfill soil cap has been found to be
damaged it shall be restored to its original specification. Should the landfill
require any additional treatment for rodents, birds, or insect control, Region 3
N.Y.S.D.E.C, personnel, specifically the Pesticide Officer, shall be contacted to
approve any proposed extermination method prior to its implementation,
G. GAS MONITORING:
A soil gas survey was conducted at the Castle Point Landfill on February 13th
and February 15th, 1996. Four soil gas points (GM -1 through GM -4_ and one
monitoring well (PMW-8) were field tested for volatile organic vapors,
methane, and explosive gases.
The soil gas points were constructed with '/z inch or 2" (I.D.) PVC casing sealed
at the top with a rubber stopper. A plastic hose connector was inserted through
a hole in the rubber stopper and connected to a peristaltic pump via a length of
silicon tubing. A rubber stopper assembly was also connected to the other end
of the tubing at the discharge,
The peristaltic pump was used to draw air from the soil gas installation through
the silicon tubing. Air discharging from the soil gas installation was monitored
for organic vapors with an Hnu photoionization detector and for methane, %
LEL and 02 with a GasTech Meter.
To obtain reading from Well PMW-8, a 2 inch rubber cap equipped with a brass
hose connector was fitted on the well. Air readings were monitored by the
same procedures.
Results:
0 Volatile, organic vapor levels were slightly above background levels.
Readings ranged from 0.1 to 0.7 Hnu units.
• There were no detectable readings for % LEL or % gas (Methane)
• 02 levels ranges from 8.75% to 21%
A minimum of four gas vents per acre were constructed in the landfill. Gas
vent design meets the requirements of Part 360 except for depth penetration.
Gas vents penetrate to a depth acceptable to the Department, but not less than
six feet into the waste.

Post -closure explosive gas monitoring and maintenance shall be performed at
least quarterly to insure that:
a. Explosive gas levels do not exceed 25% of the lower explosive limit within
any structures on or off the site (except gas control or recovery system
components);
And
b. The level of subsurface explosive gas does not exceed the lower explosive
limit anywhere along the property boundary.
If monitoring snows these levels are exceeded, N.Y.S.D.E.C, shall be notified
and remedial action, such as the construction of gas cut-off trenches, should be
immediately taken. In addition, this quarterly explosive gas monitoring and
maintenance shall assure that the gas vents are not blocked and that landfill gas
has not damaged the final cover. Post -closure explosive gas monitoring shall
include: subsurface monitoring along a perimeter outside the waste mass but
within the property boundary; monitoring within all onsite and nearby
structures; and inspection of the final cover and surrounding area. Perimeter
subsurface monitoring shall be performed at maximum intervals of 100 feet if a
portable explosive gas detector is used. Monitoring with a portable detector
shall be performed when the ground surface has been wet or frozen for several
days. Monitoring shall be done below the wet or frozen zone. If permanent gas
monitoring wells are constructed for perimeter subsurface monitoring, they
should be located at maximum intervals of 400 feet. Wells should be
constructed to a depth of 75% of the maximum depth of the waste mass below
the surrounding ground surface or to the seasonal low groundwater level,
whichever is higher. The bottom 213 of the wells should be screened.
In addition, post -closure monitoring and maintenance shall include regular
inspection of the landfill final cover and surrounding area for cracks or stressed
vegetation which might indicate the escape of landfill gas. Areas where there
are cracks or where vegetation appears stressed shall be tested with a portable
explosive gas detector. Any areas of the final cover which may have been
damaged should be repaired and steps shall be taken, such as the installation of
additional gas vents, to prevent future damage. Areas around the waste mass
where gas is found to be escaping shall be tested with a portable explosive gas
detector to determine whether they indicate pathways by which explosive gas is
migrating offsite. If so, additional measures shall be taken to prevent offsite
migration. The percentage of explosive gas emanating from gas vents shall be
measured to indicate the effectiveness of the gas vents,
All gas monitoring shall be performed when the atmospheric pressure is low
(below 29.92 inches of mercury). Atmospheric pressure shall be recorded
along with the other monitoring results.
If the landfill is on a property that is sufficiently large as to preclude offsite
migration of landfill gas, then the perimeter explosive gas monitoring
requirements are inapplicable. In order to qualify for omission of the perimeter
monitoring requirements, the distance from the waste mass to the property
boundary must be a minimum of 1,000 feet or adequate onsite barriers to gas
migration must exist. A barrier to gas migration is either: a ravine or
excavation with its base extending as deep as the base of the waster mass, or to
very low permeability soils or seasonal low groundwater, or a surface water that
has flow all year, and which is indicative of groundwater elevation. .
Said gas monitoring shall be performed by qualified professional firms on an
individual contract basis with the Town of Wappinger subsequent to an
informal bid process. Results shall be submitted to the N.Y.S.D.E.C. as part of
the Annual Inspection Report.
MIM
H. GROUNDWATER MONITORING:
The Town of Wappinger upgraded specific aspects of it's initial Landfill
Closure Plan to comply with the Part 360 regulations effective December 31,
1988 in an effort to secure State Assistance under the Environmental Quality
Bond Act (EQBA). Part of this upgrade included installation of two (2)
monitoring wells downgradient of the landfill in an effort to reduce future
environmental monitoring costs. This reduction in the sampling requirements
was detailed in a March 22°d, 1995 correspondence from Alan A. Fuchs, Solid
Waste Engineer — Region 3 to Supervisor Constance O. Smith, which indicated:
"The N.Y.SD.E.C. is willing to reduce the landfill's water quality sampling
requirements if two monitoring wells are added to the monitoring network
which are clearly capable of detecting the landfill's water quality impact. The
proposed water -quality monitoring reduction is to decrease the required
number of sampling locations per sampling event fromfve to three monitoring
wells. The proposed program would include two monitoring wells
downgradient of the landfill and one upgradient monitoring location. "
The Town proposes to perform annual baseline and quarterly routine
monitoring of downgradient wells PMW-8 and PMW-9 and the existing
upgradient production well as indicated on the "As -Built" Plan. Said sampling
schedule would be conducted at this frequency until a minimum of ten (10)
rounds of test results are collected. After that time, and depending on the
results obtained, the Town of Wappinger may request that the N.Y.S.D.E.C.
modify the sampling and analysis requirements pursuant to the Local
Government Regulatory Relief/initiative as follows:
Specific Variance: Post Closure Monitoring I:
The frequency of post -closure groundwater, surface water and leachate
monitoring required by 6 NYCRR Part 360-2.15(i)(4) may be reduced from
annually for baseline parameters and quarterly for routine parameters to
annually for routine parameters and once every five years for baseline
parameters [See 6 NYCRR Part 360-2.11(c) (6)].

Guidance:
This means that the frequency and cost of post -closure testing for
contamination would be significantly reduced. In order to qualify for this
variance, all of the following conditions should be met.
1. Contamination, except for leachate indicators, in down -gradient
groundwater monitoring wells does not exceed the groundwater standard or
background level, whichever is higher, for any contaminant.
2. The landfill is closed and maintained such that no surface leachate is
allowed to discharge from the facility; and,
3. There is no contamination of surface waters once cap construction is
complete.
4. The landfill should not be located over a sole source or primary aquifer,
Based on the post -closure monitoring results, N.Y.S.D.E.C. may require more
frequent monitoring at a later time.
Said water quality monitoring shall be performed by qualified professional
firms on an individual contract basis with the Town of Wappinger subsequent
to an informal bid process. Results shall be submitted to the N.Y.S.D_E.C. as
part of the Annual Inspection Report,

'Practical Quantitation Limits (PQLs) are the lowest concentrations of analytes in groundwaters
that can be reliably determined within specified limits of precision and accuracy by the indicated
methods under routine laboratory operating conditions. The PQLs listed are generally stated to one
significant figure. PQLs are based on 5 ml samples for volatile organics and 1 L samples for
semivolatile organics. CAUTION: The PQL values in many cases are based only on a general estimate
for the method and not on a determination for individual compounds; PQLs are not a part of the
regulation.

LEACHATE COLLECTION SYSTEM:
Leachate control systems have not been designed as part of this landfill closure
plan. The soil cap will prevent rainwater from infiltrating into the landfill mass,
thus restricting potential leachate development. The grading of the site, as
discussed in previous sections, will encourage surface water to flow off the
landfill mass and thus, prevent further leachate from forming.
During the quarterly visual inspections, leachate outcropping will be looked for.
If found, it will be immediately noted and proper engineering control measures
(as approved by the N.Y.S.D.E.C.) shall be implemented.
Said quarterly inspections shall be performed by Town of Wappinger
personnel, or their designated representatives and the results submitted to the
N.Y.S.D.E.C. as part of the Annual Inspection Report.

J. RECORDKEEPING AND REPORTING:
Quarterly visual inspections of the site will be conducted by Town personnel or
their designated representatives for the minimum post closure period following
completion of the landfill closure. These reports will be filed at the Town Hall.
These inspections will include the soil cap and topsoil, venting system, site
drainage, specifically any items such as subsidence of the soil cap, areas of the
erosion, dead or dying vegetation, vandalism, and vectors will be reported
immediately to Town personnel followed by taking of corrective action. In
addition, qualified professional firms will be contracted with to perform
quarterly and annual groundwater quality and gas monitoring following
NN.S.D.E.C. protocols.
An annual report will be submitted to N.Y,S.D.E.C. which contains an analysis
of the groundwater quality sampling, gas monitoring and annual inspection
report by the Town of Wappinger identifying results of the quarterly visual
inspections, and any maintenance necessary during the year.
Copies of all said information shall be available for inspection at the Town of
Wappinger Town Hall.

K. RESOURCE RE UIREMENTS:
Quarterly visual inspections of the soil cap, vegetative cover, site drainage,
venting system, areas of subsidence, erosion, dying vegetation, vandalism and
vectors shall be performed by Town of Wappinger personnel or their designated
representatives.
The Town of Wappinger work force includes staff and equipment sufficient to
perform this work.
Quarterly water quality and gas monitoring shall be performed by qualified
professional firms on an individual contract basis with the Town of Wappinger
subsequent to an informal bid process. The names and contact numbers of said
professional firms shall be provided to the NX.S.D.E.C, as they become
available.

L. CONTINGENCY PLAN:

M. FINANCIAL ASSURANCE CRITERIA:
The Town of Wappinger is in the process of securing bids for quarterly water
quality and gas monitoring services as detailed herein. Upon final acceptance
of a qualified professional firm, the estimated yearly costs to perform the
prescribed work will be submitted to the N.Y.S.D.E.C.
All other work will be performed on a force account basis by Town personnel.
The Town of Wappinger owns and will continue to own the Castle Point
Landfill site, and will be financially responsible for post -closure monitoring and
maintenance.

Dear Mr. Fuchs:
On this date, I had a telephone conversation with Mr. Frank Kelly of your department regarding the
above referenced project. I informed Mr. Kelly that the one year guarantee period between the Town of
Wappinger and the General Contractor (Hudson Canyon Construction) is about to end, and the
Contractor is requesting that the Town release the final retainage. The Town had hoped to have final
approval from your department prior to releasing the final retainage. Mr. Kelly suggested that I formally
request that your department grant final approval via this correspondence.
The following information may prove helpful:
♦ Construction on the Project began in Ap6l,1998, and was substantially completed in October,
1998.
t The final Engineers inspection was conducted on November 4,-1998. Mr. Kelly was present
representing your department. A number of small repair and/or maintenance items were noted
during the inspection ,(see,my correspondence dated November 5, 1998).

♦ The Contractor addressed all items noted during our November inspection, either immediately after
the inspection, or during the Spring of 1999. This office inspected all work.
Engineer's certification of construction compliance was submitted to your office on November 23,
1998. This certification report included all Quality Assurance/ Quality Control (QA/QC) results for
the cap materials and installation.
♦ I conducted an additional inspection of the site on October 4, 1999. In general, the site looked very
good (ie: the grass cover appears very uniform, the drainage swells appear to be in working order,
there was no evidence of leaching, etc). I did observe a few small areas that had been eroded or
where the seeding had not taken hold. I will inform the Contractor that he must repair these small
areas prior to the release of his final retainage.
♦ The one year guarantee period is scheduled to and on November 4, 1999. The Town of
Wappinger would greatly appreciate it if your department could conduct a final inspection prior to
that date.
♦ It should be noted that the Town was awarded grant monies for this project under the
Environmental Quality Bond Act (EQBA). To date the Town has received 90% of these grant
monies from the State. The remaining 10% retainage can not be released to the Town until final
approval is granted from your department. Obviously, the Town would like to close out the job and
receive these finds as expeditiously as possible.

Closure Project. As per Paragraph 2,C of the Town's Contract with the State, the DEC will retain 10%
of the payment ( $27,472.24) until the DEC makes its fin -3l inspection and approves the Project as
complete.
The only remaining punchlist items; to be completed at the site involve establishment and initial

limited to: small areas of erosion and ponding should be completed. The Department is
anticipating receipt of the signed and sealed Professional Engineer's construction Certification

This letter is written to provide the engineering certification of construction in
substantial compliance with the Closure Plan approved by your Department on August
2nd, 1996 as well as Plans and Specifications prepared by this office dated May, 1997
The letter specifically addresses nine areas of technical compliance as follows:
1. Site Rough Grading
2. Installation of Gas Vents
3. Construction Quality Assurance/Construction Quality Control (CQA/CQC)
4. Installation of 18" Clay Barrier Layer
5. Installation of 24" Barrier Protection layer
6. Drainage Swales
7. Extension of Monitoring Wells
8. Installation of Topsoil, Seed and Mulch Layer
9. Additional Cap Area.
1. SITE ROUGH GRADING:
The Contractor performed site rough grading in substantial compliance with
approved plans to assure positive drainage. Slopes were in the 4% (minimum) to
33% (maximum) range. The Contractor's Surveyor performed onsite fieldwork to
verify grades prior to the placement of the clay barrier layer.
2, INSTALLATION OF GAS VENTS;
The Contractor installed sixteen (16) gas vents in accordance with approved plans
and specifications prior to placement of the clay barrier layer.

3. COA/COC:
The Contractor retained the services of Advanced Testing, Inc. to provide testing
services for the project including pre -construction qualification, lab testing and in-
situ testing. All procedures and protocols were in conformance with approved
specifications.
A copy of the test locations and results is enclosed herein for your review and
approval.
4. INSTALLATION OF 18" CLAY BARRIER LAYER:
The Contractor installed the 18" clay barrier in accordance with approved plans and
specifications. The clay was installed in three 6" lifts with each lift being
compacted with a vibratory sheeps foot roller to a minimum 90 percent of the
Standard Proctor density. Grade stakes and the gas vent riser pipes were utilized
for vertical control. In all instances, a minimum of 18" final thickness was
obtained. All pre -construction qualification and insitu compaction and triaxial
permeability tests were in conformance with the approved QA/QC specifications
(see enclosed).
5. INSTALLATION OF 24" BARRIER PROTECTION LAYER:
The Contractor installed the 24" barrier protection layer in accordance with
approved plans and specifications. The material (a mix of sand and gravel) was
installed in three 8" lifts, with each lift being compacted with a vibratory sheeps
foot roller to a minimum of 90 percent of the Standard Proctor density. Grade
stakes and the gas vent riser pipes were utilized for vertical control. In all instances
a minimum of 24" final thickness was obtained. All pre -construction qualification
and insitu compaction tests were in conformance with the approved QA/QC
specifications (see enclosed).
6. DRAINAGE SWALES:
The Contractor installed the drainage swales designed to divert upgradient surface
water away from the landfill site in substantial conformance with approved plans
and specifications.

RE: Castlepoint Landfill
It was noted during our final site inspection of November 4`h, 1998, that there were
several areas where silts and sediments had settled in the drainage swales, as well
as areas that had been scoured by stormwater flow where seeding had not taken
hold. It was re -iterated in my November 5'h, 1998 memorandum to the Contractor
(see enclosed) that he shall be responsible for repairing any such areas in the
drainage swales for a period of one year. The Contractor acknowledged that he
was responsible for this one year maintenance/repair period. This office will
continue to monitor the site during the one year guarantee period to insure
satisfactory completion of the Item. A small area of ponding along the edge of
drive at the top (west) side of the landfill just east of the gazebo is expected to be
addressed as part of plans to place a gravel parking area on a portion of the landfill
(see my memo dated November 5t', 1998).
i, EXTENSION OF MONITOR WELLS:
The Contractor extended the monitoring wells and protective casings in compliance
with approved plans and specifications.
8. INSTALLATION OF TOPSOIL, SEED AND MULCH LAYER:
The Contractor installed the 6" topsoil, seed and mulch layer in compliance with
approved plans and specifications. The topsoil was installed in one 6" lift. Grade
stakes and the gas vent riser pipes were utilized for vertical control. All pre -
construction qualification testing was in compliance with the approved QA/QC
specifications (see enclosed). As with Item 6 above (Drainage Swales), the
Contractor is required to maintain the lawn area for a period of one year. Again,
there were areas noted during our November 4a', 1998 final inspection that will
need "dressing up" which may require topsoil, grading, seeding and/or mulching.
These specific locations were noted in my memorandum dated November 5u', 1998
(see enclosed). This office will continue to monitor the site during the one year
guarantee period to insure satisfactory completion of the Item.
9. ADDITIONAL CAP AREA:
As per our correspondence of June 91h, 1998 and your approval letter of June 12"',
1998, the Contractor extended the landfill cap to cover an additional, unexpected
area of waste located at the northeasterly area of the site. The QA/QC testing for
this area is included in the enclosed test result report. The additional cap area is
also included on the map indicating test locations. In all areas, the minimum clay
layer depth (18") and barrier protection layer depth (24") were maintained,

analytical report for the proposed topsoil from Dr. David York will be forthcoming within the
next week or two.
Assuming that all test results are positive, a September 7, 1998 scheduled date for start of
topsoil and hydroseed operations is acceptable to this office.
By copy of this letter, I am notifying Mr. Frank Kelly of the New York State Department of
Environmental Conservation of the job status and revised date of substantial completion (i.e.
2" d or 3rd week of September).

4. The Contract Minority and Women Owned Business Enterprise Participation Plan,
including the Town of Wappinger Affirmative Action Policy Statement is enclosed herein
as Appendix B.
S. A copy of the Affidavit of Publication reflecting Hudson Canyon Construction, Inc.'s
solicitation of M/WBE suppliers is enclosed herein as Appendix "C".
6. Due to the specific nature of the construction (i.e. the project was essentially a large
earthen fill) opportunities for subcontract work were severely limited. The Contractor
received no response to his advertised solicitation for proposals. A review of a
comprehensive list of local M/WBE Contractors generated by the Dutchess County
Planning Department likewise revealed no applicable subcontract/supplier possibilities.
A copy of this correspondence is being transmitted to Ms. King for her records.

the understanding that it is not a part of the bid and is solely a matter of information for convenience in
comparing the bids at the time of opening.

undersigned shall within five (5) days after date of such mailing, telegraphing, or deiivering of such

It is the policy of the Town of Wappinger that Minority Business Enterprises and Women -Owned Business Enterprises
(MBEs/WBEs) shall have the maximum opportunity to participate in the performance of contracts let by the Town and, that
the implementation of this policy, the Town commits itself to a goal -oriented MBE/WBE program, as more specifically
described herein.
GUIDELINE
1. Administration:
a. The apparent lowest bidder for each contract proposed to be let shall develop and submit to the Town within
seventy-two (72) hours (three (3) working days) following receipt of bids a detailed schedule of MBE/WBE
participation including:
1. The names of MBEs/WBEs proposed to be used as contractors;
2. A general description of the work each is to perform;
3. The dollar value of each proposed contract with an MBE/WBE;
4. Subcontractors to prime contractors shall adhere to participation goals put forth in prime contracts.
Subcontracting shall reflect normal practices followed by the professional and trade elements of the
construction industry..
2. Participation Goai:
a. The optimum MBE participation goal for Town public procurements is 15 %.
b. The optimum WBE participation goal for Town public procurements is 517b.
C. The combined MBEIWBE goal shall be 20%.
3. Notice to ProcMd gn the Part of the ntmct r:
a. Prior to being issued a Notice to Proceed the awarded contractor must have entered into MBEIW13E contracts
as proposed during the bidding process and submitted evidence of same to the Town.

4. Procedures the Prime Contractor Must Fallow:
a. Such positive efforts shall include but not be limited to:
1. Attendance at timely pre-bid meetings scheduled by the Town.
2. Advertising, contracting opportunity for MBEs/WBEs in a newspaper of general circulation. The bid
due date and reasonable MBE/WBE response due date must be specified in the advertisement. The
advertisement must be for specific contracts which are described in reasonable detail;
3. Notifying minority contractor .association(s) located within Dutchess County of the availability of
contracting opportunities (see enclosed "Solicitation Letter"). The notification must be by certified
mail and should be received by the addressee associations in time to permit effective MBE/WBE
participation. The MBE/WBE response due date must be specified in the notifications. The
solicitation must be for specific contracts and the work to be performed must be described as accurately
as possible and in reasonable detail;
4. Where technically feasible, segmenting the work to be contracted to accommodate the size and
capabilities of available minority contractors;
S. Treat MBEIWBE proposals in accordance with generally accepted industry practice;
6. Inform the Town of any changes in its detailed schedule of MBE/WBE participation;
7. Maintain documentation that will demonstrate good faith efforts to retain MBEsIWBEs;
8. Make good faith efforts to replace an MBEIWBE contractor that is unable to perform successfully with
another MBE/WBE;
9. Notify the Town of any suspected instances of companies fraudulently claiming MBE/WBE status.
10. If possible, provide any needed technical assistance to MBEs/WBEs under contract;
11. If possible, aid proposed MBE/WBE subcontractors in obtaining necessary bonding;
12. Design payment schedules to minimize cash flow problems faced by MBEs/WBEs.
13. Recordkeerint;
a. All contractors are required to maintain accurate and complete records to reflect the (1) name of
the MBE/WBE, (2) individual contacted, (3) description of the work to be done, (4) quotation
or proposal received (if any), and (5) description of follow-up actions. In the event an interested
MBEIWBE will not be utilized, the record of contact with that firm should include an
explanation of the reason(s) why the firm will not be used.

b. Contractors will be required to maintain for three (3) years such records as are necessary to
determine compliance with their MBE/WBE obligations and to submit regular reports to enable
the Town to monitor this compliance.
S. Procedure the MBEIWBE Must Follow:

1. The establishment through registration that the company is a bonafide MBE/W13E;
a. MRE/WBE eligibility status shall be reviewed annually by the Town.
b. Veri cation of Business Residence - The MBE/WBE firm shall maintain a business location
designated by full street address and telephone services to the business requesting certification
and contract negotiations.
2. The MBE/WBE shall exhibit an interest in bidding a particular project by attending a pre-bid
conference and/or by responding timely to contractor solicitations for bid quotations prior to the bid
date (see attachments A, B and C herein).
6. Procedures the Town Must Follow:
a. Such positive efforts shall include but not be limited to:
1. Town is mindful of its obligations to adhere to the provisions of Sec. 109 of the General Municipal
Law with respect to the granting of approval of the subletting of contractors by prime contractors;
2. Town shall develop programs which will insure the MBEsIWBEs are informed in the most direct and
noticeable manner of public contracting opportunities;
3. Making available plan holder lists to any association;
4. Making available plans and specifications for review and for estimating purposed by MBEs/WBEs.
7. Sanctions to be Issued by the Town:
a. If the contractor cannot meet the goal, he must document to the Town that he has made all positive efforts to
achieve it. Failure to meet the goal or to document all positive efforts have been made to achieve it may result
in the Town invoking any legal or equitable remedy available to the Town for breach of contract including
withholding future payments under the contract involved. disqualification of the contractor from future
contracting opportunities for a period not to exceed two years; and cancellation of the contract and declaration
of forfeiture of performance bond.

As you are aware, Hudson Canyon Construction, Inc. has been working on the above referenced project
for the last month. In general, the work has progressed smoothly and site inspections by this office have
proved to be favorable.
As outline in our previous correspondence dated May l l's, 1998, this office has identified two areas at
the site that contain waste material and that are located outside of the originally presumed landfill
boundary. Because these areas are outside of the Contract boundaries, any remedial work in the area
would constitute an addition to the Contract and would require a Change Order.
The areas in questions are illustrated on the enclosed plan, and are more particularly described as
follows:
A. Area "A" is located at the northwesterly section of the landfill, along the westerly edge of the
existing entry road, The additional waste in this area was encountered on May 5ffi, 1998 during
construction operations to relocate the entry road as per the Contract Specifications. In order to
remedy the situation, this office instructed the Contractor to excavate the additional waste,
relocate it to the main landfill mass, cover the waster with clean fill, and compact the entire
area. The excavation was then backfilled with 1'/2" crushed stone, covered with clean,
compacted fill. The excavation measured 30 feet long by 24 feet wide by 6 feet deep.
B. Area "B" is located at the northerly section of the landfill along the entry road up to the existing
ballfield fence. This area exhibited leachate bubbling up to the surface during a routine
N.Y.S.D.E,C. inspection. Further exploration work conducted on May 8h, 1998 revealed that
additional waste materials were present in the area indicated on the enclosed plan.
This office has studied two methods of dealing with this extra waste:
The first method would be to excavate the additional waste, relocate it to the main landfill mass.
cover it and compact it. The remaining excavation would then be backfilled with clean compacted
fill. Any leachate encountered would have to be pumped out and hauled to an approved disposal
location.
The second method would be to leave the additional waste in place, cap it with 18" of clay, 24" of
existing, onsite clean material, and topsoil, seed and mulch the entire area.

Because of the risks inherent to the first method (i.e,: Do not know the vertical extents of the waste, do
not know the magnitude of the leachate) and due to the fact that it would involve substantial amounts of
direct content with waste materials, it is the opinion of this office that the second method (capping) will
provide a much more manageable and environmentally sound methods of dealing with the situation.
Additionally, the second method encompasses many more known quantities than the first, and could
provide a substantial cost savings to the Town.
The Wappinger Town Board has authorized this firm to seek approval from your Department to perform
Option ##2 (i.e. in place capping of the additional area).- The Contractor is close to finishing the clay cap
as originally delineated, and would like to begin work on the additional area as soon as possible (i,e. by
the week of June 15`s — 19`h).

This memo is written to reiterate the substance of our recent telephone conversations regarding the
Castlepoint Landfill Closure Project:
1. This office received your May 15t' 1998 lab results submitted for the clay barrier layer, and we
are presently reviewing the results. We will inform you of our findings as soon as possible.
2. Mr. frank Kelly of the New York State Department of Environmental Conservation has
requested additional information be provided regarding your topsoil submittal. As you may
recall, the submittal from Global Recycling included an "in-house" test verifying that grass
would grow in the soil. Mr, Kelly has reiterated his Department's position that the use of
anything other than topsoil as defined under 6NYCRR Part 360-2113 (s) requires "A written
affirmation that the material proposed to replace the topsoil will adequately and continually
sustain the proposed vegetative cover must be provided by a soil scientist, agronomist or
Local Soil and Water Conservation District." (Seepage 5.01-1 of the Contract
Specifications). Please provide said information to this office of your earliest convenience.
3. 1 am awaiting submittal of revised costs for time and equipment for the proposed additional
work at the site (see page GP -6 of the Specifications). Upon submission and review of said
information, I will transmit the necessary Change Order to you for execution.
4. It is my understanding that you are planning to have your surveyor (Joseph Berger, P.E., L.S.
perform additional work at the site upon completion of the interim grading process. I would
suggest that you have Mr. Berger shoot sufficient elevations to insure that the Contract
mandated 4% (minimum) to 33% (Maximum) cross slopes have been achieved.

As you are aware, Hudson Canyon Construction, Inc. has been working on the above referenced project
for the last month. In general, the work has progressed smoothly and site inspections by both this office
and representatives of the New York State Department of Environmental Conservation (N.Y.S.D.E.C.)
have proved to be favorable.
However, this office has identified two areas at the site that contain waste material and that are located
outside of the originally presumed landfill boundary. Because these areas are outside of the Contract
boundaries, any remedial work in the area would constitute an addition to the Contract and would
require a Change Order. As -per -the -Contract -Specifications, additional work -such -as-this may be billed- on a time and material basis, with 15% added for overhead and profit.
The areas in questions are illustrated on the enclosed plan, and are more particularly described as
follows:
A. Area "A" is located at the northwesterly section of the landfill, along the westerly edge of the
existing entry road. The additional waste in this area was encountered on May 5`s, 1998 during
construction operations to relocate the entry road as per the Contract Specifications. In order to
remedy the situation, this office instructed the Contractor to excavate the additional waste,
relocate it to the main landfill mass, cover the waster with clean fill, and compact the entire
area. The excavation was then backfilled with 1'/z" crushed stone, covered with clean,
compacted fill. The excavation measured 30 feet long by 24 feet wide by 6 feet deep. The
approximately cost for this additional work is being determined by Hudson Canyon
Construction, Inc. and will be reported when available.
B. Area "B" is located at the northerly section of the landfill along the entry road up to the existing
ballfield fence. This area exhibited leachate bubbling up to the surface during a routine
N.Y.S.D.E.C. inspection. Further exploration work conducted on May 8a', 1998 revealed that
additional waste materials were present in the area illustrated on the enclosed plan. We would
recommend that the additional waste in this area be excavated, relocated to the main landfill
mass, covered and compacted. The excavation would then be backfilled with clean, compacted
fill. Any leachate encountered would have to be pumped out and hauled to an approved
disposal location.
Please advise this office as to how you would like us to proceed in this matter, at which time we can
prepare the necessary Change Order. Additional work in this are will also require prior approval from
the N.Y.S.D.E.C.

Closure Inspection
Dear Ms. Smith:
This letter is provided to inform you of two inspections conducted on April 29 and 30, 1998 by this
writer from the New York State Department of Environmental Conservation (DEC) at the Castle Point
Landfill. Hudson Canyon Construction, Inc. has begun to rough grade the site and has constructed the
test pad. Advanced Testing Company, Inc. has tested the test pad for compaction and taken samples to
test for permeability. At the site was Mr. Peter Paggi and Mr. Joseph Paggi of Paggi & Martin with
whom a number of issues were discussed. The following is a summation of my observations'and our
discussions.
1. Leachate Pool: As depicted on the enclosed inspection report, a pool of leachate approximately two
feet by three feet in area was observed approximately 100' north of the northeast corner of the landfill
footprint. Where the pool originated from, could not be determined, as there was no flow at the time
of inspection. Mr. Peter Paggi had proposed that this area be removed by excavation and placed inside
the landfill. During the course of excavation, however, it became apparent that disposal of non-exempt
waste had occurred in this area. The waste consisted of plywood boards, logs, rubber hose, and a two
by four. The DEC has directed Paggi & Martin to delineate the extent of the waste by excavation. Any
waste found will be deposited within the landfill footprint. Furthermore, any liquid encountered during
the excavation will be pumped out and hauled to a local wastewater treatment plant. In no case should
any liquid be allowed to migrate off-site.
2. Topsoil Substitute: The March 19, 1998 submittal from Paggi & Martin contained an in house
"test" conducted by Global Recycling meant to verify that the 'Material to be used as topsoil would
sustain vegetation. In order to qualify for this specific variance, a written affirmation from a soil
scientist, agronomist or a local Soil and Water Conservation District must be provided.
3. Filter Fabric: As was discussed with Mr. Peter Paggi, the DEC finds acceptable, the lining of the
gas vent trenches with filter fabric in order to impede fines from migrating into the stone bedding.
4. Tires: A few tires have been noted within the landfill footprint. It is advised that these and any
future tires be removed and disposed of properly. Past experience has shown, that tires will "float"
upward through cover material and consequently interfere with the construction of a landfill cap.

On Wednesday, April 29th, 1998 and Thursday, April 30th, 1998, an area
of puddling was noted outside the documented landfill footprint by Frank
Kelly, Environmental Engineer I of the New York State Department of
Environmental Conservation.
As instructed by Mr. Kelly, we made an excavation in this area and found
that there was buried waste (plywood, lumber, etc.) and discolored/foul
smelling groundwater.
A temporary "fix" to the problem was agreed upon between our office, Mr.
Kelly and the Contractor, Hudson Canyon Construction Corp.,, which
consisted of filling the excavation with 2" stone and fencing the area off.
Mr. Kelly advised our office that he would speak to his superior regarding
what the N.Y.S.D.E.C. is going to want the Town to do to address what
we hope to be an isolated incident.
It should be noted that the footprint of the landfill was determined through
numerous and repeated deep test pit excavations in the presence of
N.Y.S.D.E.C. and mapped and approved. We hope that this area, which is
outside the mapped footprint limits by approximately 150`, is an isolated
area of filling, and not indicative of a general condition.
Obviously, the cost to remediate and bring this area to closure is over and
above the scope of the work presently bid.

On this date, 1 received a telephone call from Mr. Frank Kelly of the New York State Department of
Environmental Conservation. Mr. Kelly informed me that representatives from his Department
inspected the Castlepoint Landfill site on April 15th, 1998. Two concerns were raised.
1. A small amount of groundwater was encountered by the Contractor during topsoil stripping
operations at the northwesterly portion of the landfill.
2. An unspecified amount of debris (concrete; railroad ties, etc.) was encountered at the extreme
southeasterly side of the existing ball fields (not on the landfill.
This office conducted a held inspection of the site with representatives of the Contractor (Hudson
Canyon Construction, Inc:) on April 16, 1998. We would offer the following comments:
The area where groundwater was encountered appears to be limited to the bottom of the bank at
the northwesterly area of the landfill boundary. In discussing the matter with the Contractor, it
was decided that the amount of groundwater did not appear to pose a significant impact and that
it might be possible to disperse the water over the general area and thus somewhat drain the
subgrade and make it ready to accept the fill required for interim grading operations. It was
stressed that in no case should the groundwater be allowed to migrate off site. This office will
continue to monitor the situation, and has informed the Contractor to stop work immediately if
die condition worsens or becomes unmanageable. In such case, a proper means of containing
and dealing Avith the excess groundwater will be devised,
This office would remind the Contractor of his contractual obligation to provide all required
water diversion structures or ditches, sedimentation basins or traps, etc. (See Page 11.01-2), and
proper dewatering (See Page 2.01-10).

2. This office has no knowledge of the source, extent, or composition of the debris evident to the
extreme southeast of the existing ball fields (not on the landfill). We will insist that the
Contractor not place any excess fill generated by his interim grading operations over the debris
in question.

This letter is provided to inform you of an inspection conducted on April 15, 1998 by this writer and
Mr. Andrew Lent, both of the NYSDEC, at the Castle Point Landfill.
Hudson Canyon Construction has begun scraping off the grass cover as the first step in the
construction of the landfill's final cover. Silt fencing and haybales have been placed down gradient of
the existing contours along the southern and eastern boundaries. At the time of the inspection, stone for
the gas venting system was being delivered:
It was observed, that a groundwater seep in the vicinity of the Proposed Gas Vent 3 (PGV-3) had
formed. Frank Rowe (construction supervisor) of HCC was advised to not let the flow leave the
property boundaries. Peter Paggi of Paggi & Martin was called by the writer on April 16, 1998 and
informed of this seep. He stated that he would inspect the area of concern and get back to the
Department with a course of action shortly.
Of secondary concern, was an area southeast of the eastern ball field. It appeared that C&D debris had
been used as fill in this area. The maternal that could be observed is for the most part exempt from
"regulation: However, -non-exempt' C&.D material, (railroad .ties) were noticed mixed in with the fill. It
is requested that the Town remove these articles from this area before any more filling activities occur.
Attached for your information is an inspection sheet briefly describing this writer's observations. As
the construction continues, periodic inspections will be conducted and follow-up letters will be
forwarded to your office. Should you have any questions or comments, feel free to contact me.

above referenced project.
Said Work Plan has been revised to reflect new construction schedule dates, recently updated to avoid
construction during inclement winter months.
As per our recent conversation, I have not revised the previously estimated cost data. It is my
understanding that you will be investigating the matter, and will advise the Town and this office as
to whether or not the cost data may be revised at this time. What I would like to do is to substitute
actual Bid/Contract Prices for these items that were previously estimated costs.

As per our recent telephone conversations, please be advised that the Town of Wappinger is currently
compiling the necessary pre -construction data required for the above referenced project.
Upon review of the Project Schedule agreed to by both the Town and the New York State Department
of Environmental Conservation dated September 16, 1996, it is evident that the milestone dates
previously agreed to are not attainable. Unforeseen delays have been encountered in the bidding -
process, as well as in the material pre -qualification testing process.
It is the opinion of this office that to start construction now (so late in the season) would lead to
problems regarding inclement weather, bank stability, erosion and sedimentation control, etc.
For these reasons we would like to propose utilizing the enclosed newly revised Project Schedule.
The Town of Wappinger remains committed to closing their Castlepoint Landfill in the most timely,
environmentally sound method possible.
Please advise the Town of Wappinger and this office of your feelings on the matter.

As you are aware, this office has been working diligently for some time to
accomplish the closure of the Castlepoint Landfill. Part of our work has
been to actively pursue all available means of State financial assistance.
To that end, our office on December 12, 1995 submitted an application
on behalf of the Town to the New York State Department of
Environmental Conservation (N.Y.S.D.E.C.) for an EQBA 50% matching
grant. On December 21, 1995, the Town was notified that available
funds were not currently sufficient to provide State assistance for their
application.
With the passage of the Environmental Bond Act last fall, and with the
knowledge that a portion of this bond was for assistance in landfill
closures, we again pursued the potential of obtaining financial assistance
for the closure of the Castle Point Landfill..
In our follow-up work, our office had a telephone conversation with Mr.
Dave Blackman of the N.Y.S.D.E.C. pursuant to the above referenced
matter. His comments can be summarized as follows:
1. Our previous application for State assistance submitted
on December 12, 1995 was "tabled" due to insufficient
funds. Since that time, additional monies have become
available for the program via the Clean Water/Clean Air
Bond Act of 1996, and United States Environmental
Protection Agency funds.

The New York State Department of Environmental Conservation, Solid & Hazardous Materials Division, Region 3 has
received Mr. Paggi's letter, on behalf of the town of Wappinger, dated September 11, 1996. The Town requested an.
extension of closure of the Town of Wappinger, Castle Point Landfill to June 30, 1997 and submission of a closure
certification report by August 1, 1997.
The submitted modified schedule for closure of castle Point landfill is acceptable to the Department. The Department
hereby approves the requested extension, due to the reasons indicated in the Town' letter. Closure construction of the final
cover should be completed by June 30, 1997 and closure certification report should be received by August 1, 1997 (as
proposed).
The Department agrees with your proposal to start construction of the landfill on March 31, 1996, but the weather
conditions may not allow you to start construction by the proposed date.

Dear Supervisor Smith:
The New York State Department of Environmental Conservation (NYSDEC) has completed the engineering technical review
of the Final Revised Closure Plan (FRCP), dated July 5, 1996 for Castle Point Landfill, Town Of Wappinger. The FRCP
was submitted pursuant to NYSDEC comments of March 23, 1996.
The FRCP appears to adequately address issues that NYSDEC had previously raised. Therefore, the Department
conditionally approves the FRCP providing that the items listed below are addressed to the satisfaction of the Department
and be submitted within the time frame listed below.
General Variance requirements:
Response to NYSDEC comment #a -1(b) & b-3 of March 23, 1996 is satisfactory, the Town has agreed to submit
the landfill property deed to NYSDEC for approval prior to completion of the landfill closure.
Top Soil Laver variance:
Response to NYSDEC comment #a -2a is satisfactory, the Town has agreed to submit a written affirmation from
a soil scientist, agronomist, or Local Soil and Water Conservation D,istriet, directly after awarding the bid and
prior to start construction of the landfill final cap, that the material proposed to replace "topsoil" can adequately
and continuously sustain the proposed vegetative- cover. A brief description of the material and source should also
be included with this information.
3. Barrier Layer variance:
The variance request to increase the perineability of the barrier layer frorn 10-7 centimeters per second (cm/sec)
to 10' cm/sec is based on the determination that less than 20 residences are located within one mile downgradient
of the Landfill. The Department approves your request provided that the following conditions are met:
a. The compaction must be performed properly by controlling the moisture content, lift thickness, and other
necessary details to achieve satisfactory results. The minimum compacted thickness of the low
permeability clay barrier layer should be 18" and must have a maximum remolded coefficient of
permeability of I x 10' cm/sec,. The project engineer has to ensure adequate compaction of the soil and
attain the desired permeability depending upon the type and size of compaction equipment used and
whether or not the barrier layer and subgrade are of dissimilar materials. An on-site test pad is needed
to conduct trial compaction tests for this purpose.
b. The moisture content of the soil component of the barrier layer system must be maintained within the

range identified in accordance with 360-2.136)(2)(iii) before and during compaction of the soil lift to
ensure that the remolded lift attains a maximum in-situ permeability requirement.
C. The project engineer must include in the construction certification report a discussion of all quality
assurance and quality control testing required in 360-2.130)(3).
d. A test pad must be used prior to construction of the barrier layer, to ensure that the desired optimum
moisture content, density, permeabilit} and compaction of the clay barrier layer will be attained. The
following additional conditions related to (CQA/CQC) and the number of samples tests should be met:
e. The physical properties, the CQAICQC results of the barrier layer using the test pad should be available
on-site, for review by the Department, during construction of the clay barrier layer.
4. Response to NYSDEC comment #4 of March 23, 1996 is satisfactory, the Town has agreed to submit copy of the
complete specifications and construction quality assurance/construction quality control (CQAICQC) requirements
for all materials (including but not limited to barrier layer (BL), barrier protection layer (BPL), gas venting
components, and drainage structures) used in landfill closure, thirty (30) days prior to start of construction
activities.
5. Response to NYSDEC comment #5 of March .23, 1996 is satisfactory, the Town has agreed to submit copy of
the contingency plan prepared by the contractor to NYSDEC for approval prior to its implementation.
Response to NYSDEC comment #6 March 23, 1996 is satisfactory, the Town has agreed to submit a Post -Closure
Monitoring and Maintenance Operations manual prior to completion of construction of the final cover.

Dear Supervisor Smith:
The New York State Department of Environmental Conservation (NYSDEC) has completed the engineering technical
review of the Supplemental Closure Plan (SCP) for Castle Point Landfill, Town of Wappinger. The SCP was
submitted to the NYSDEC in March 18, 1996, as directed by the NYSDEC letter of March 22, 1995 [ref. 5] and CO
[ref. 2] between the Town of Wappinger and NYSDEC (see Case # 3-1432/8707).
It was stated in the CR [ref. 1] that the LF stopped accepting waste (SAW) prior to 1990. During the Department's
meetings with the Town on November, 9, the Town has agreed to submit a SCP which meets the rO-quirements of Part
360 (effective December 31, 1988), As per our meeting, the proposed landfill closure schedule to accomplish ultimate
closure of the landfill by October 28, 1996 is acceptable.
Based on our review and conversation during the meeting held on May 8, 1995, the SCP needs to be modified. There
are certain items in the SCP still outstanding and need to be addressed prior to granting approval of the CP.
Your response to these items',,should be incorporated into a revised closure plan (RCP). The outstanding items are
summarized in Attachment #1.'. 'Attachment #1 includes the Department response to your request for variances from the
topsoil layer, gas venting layer, .,barrier layer, and to reduce the LF post -closure requirements under the Local
Government Regulatory Relief Initiative (LGRRI).
The Department's intent is to work with the Town to resolve these outstanding issues and expedite review and approval
of T-Wappinger (Castle Point) landfill closure project documents, once they are received. The Town's response to the
outstanding items should be received by July 22, 1996.

NYSDEC received your request for variances, as Part of SCP f ref. 6] , to reduce the LF closure requirements under
the LGRRI Mandate Relief Initiative.
Following are the outstanding requirements, related to the variances which need to be addressed through an additional
submittal to the Department. Each variance must meet the general variance requirements and the individual items for
each variance.
1. General Variance requirements:
The two outstanding items are (please refer to ref. 12 for more details):
a. Public notification: Provide documentation indicating that the public has been appropriately notified
about the Town's intent to request the above variances.
b. Deed requirements:
A provision must be included in the property deed indicating the period of time during which the
property has been used as a landfill (the Town should submit copy of the Deed to the Department,
prior to or with the final closure certification report).
2. Toa SoilLaver variance:
You requested a variance to replace a 6" top soil layer, required by 6 NYCRR Part 360-2.13(s), by a 6" top
soil layer capable of sustaining plant growth. The Department grants this variance providing the Town
provides a written affirmation from a soil scientist, agronomist, or Local Soil and Water Conservation District
that the material proposed to replace "topsoil" can adequately and continuously sustain the proposed vegetative
cover. A brief description of the material and source should also be included with this information.
Barrier Layer variance:
The variance request to increase the permeability of the barrier layer from 10-7 centimeters per second (cm/sec)
to 10-5 cm/sec is based on the determination that less than 20 residences are located within one mile
downgradient of the Landfill. The SCP did not include sufficient data -to indicate that this requirement is
met.. The Department will approve this request provided the Town can clearly document that less than 20
residences are located downgradient of the Landfill. In accordance with the Part 360 application requirements,
the request must be signed and certified by the authorized representative of the Town.
4. _Gas Venting Layer variance:
The Department approves your request contingent on: The RCP includes, in addition to the 4 gas vents/acre,
language similar to that found in the LGRRI for post -closure explosive gas monitoring.
S. Post -closure Monitoring Variance:
The Town has agreed in the SCP to postponed this request until sufficient groundwater monitoring data of the
ongoing qualitative testing are collected.
b. Closure Plan:
Due to the changes and revisions of the closure plan, the Town should incorporate all approved closure plan
documents in the RCP which will he used for construction of the landfill final cover. This RCP (one complete
document) should include the recent modified closure plan approved submittal for the Castle Point Landfill.
The RCP should be received prior to construction of the landfill final cover, and no later than July 5, 1996. A
copy of the revised closure drawings and bid documents which include, in addition to the above mentioned
items, satisfactory response to the items listed below.

2. Response to NYSDEC comment #1 of March 22, 1995 [ref. 5] is unsatisfactory. The Site Plan (Fig SP1)
which delineates the LF footprint shows that the LF boundaries are passing through the waste. For
example,(please see the following test pits results:
North boundary:
test pit #25 shows solid wastes (Metal & Plastic) at 2.5 ft,
test pit #30 shows solid wastes (Metal & Plastic) at 1.0 ft,
test pit #32 shows solid wastes (Metal & Plastic), at 2.0 ft,
South boundary:
test pit #25 shows solid wastes (Metal & Plastic) at 1.5 ft,
test pit #25 shows solid wastes (Metal & Plastic) at 2.0 ft,
East boundary:
test pit #1 shows solid wastes (Metal & Plastic) at 8.5 ft
test pit #3 shows solid wastes (Metal & Plastic) at 4.5 ft,
West boundary:
test pit #32 shows solid wastes (Metal & Plastic) at 2.0 ft,
Landfill footprint should enclose the limits of waste (i.e. does not pass through the waste). Based on the above
information, the landfill footprint should be clearly identified and extend beyond the limits of the waste. (i.e.
Fig SPI should be revised).
In addition, At the south boundary of the landfill, waste is located close to the property line of the landfill. It
is essential to key in the cap liner and to install drainage swales, if needed, in natural clean soil. Therefore,
waste relocation should be done to move the waste back north, enough distance to provide the required
separation distance from the property line. Waste relocation should not disturb the natural soil around
monitoring wells #8&9.
The RCP must define exactly the landfill footprint and provide the exact area to be covered. In addition, a
discussion about the type and depth of solid waste relocation and disposal at the landfill south boundary must
be provided.
Final grading and erosion plan, fig GR2, shows existing and proposed swales. Please provide a hydraulic
design, cross sections and engineering drawings for the ditches to carry the designed run-off, under non-
silting/non-scouring conditions.
4. Complete specifications and construction quality assurance/construction quality control (CQAICQC)
requirements for all materials (including but not limited to barrier layer (BL), barrier protection layer (BPL),
gas venting layers, and drainage structures) used in landfill closure, should be submitted to the Department as
part of the RCP or thirty (30) days prior to start of construction activities.
For example the, frequency for testing the barrier layer material before acceptance needs to be provided, and
the use of an on-site test Pad may be recommended to achieve the required optimum moisture content and dry
density for the clay liner.
5. The RCP should include a contingency plan or indicate that a contingency plan will be submitted to the
Department 30 days prior to start of landfill final cover construction. A contingency plan, as required by the
CO Appendix (C1.1 -e), must be provided and approved by the Department, prior to starting the landfill
construction work. The Contingency Plan must provide a detail of the corrective or remedial action to be
taken in the event of:
(1) Equipment breakdown;

(2) Air or water contamination due to closure operations;
(3) fires;
(4) spills or releases of toxic materials.
Section 360-2.10 requires that, the contingency plan must discuss an organized, planned and coordinated,
technically and financially feasible course of action to be taken in responding to contingencies during the
construction and maintenance of the a landfill cover. The plan must address, at a minimum, actions to be
taken with respect to personnel and user safety; on-site personal injury; fires; explosive landfill gases detected
on site; dust; litter; odor; noise; equipment breakdown; unusual traffic conditions; vectors; releases of
hazardous or toxic materials; groundwater and surface water contamination (which may include public and
private water supply contamination).
6. The SCP does not include a Post Closure Monitoring Operations and Maintenance Manual (PC -0&2M). This
manual should addresses the requirements of 360-2.15(i)(7) and be submitted prior to completion of the
landfill final cover.

In response to your April 17, 1996 correspondence regarding the
Castlepoint Landfill Closure Project, please be advised that:
1. The landfill closure and post -closure care requirements
are detailed in a Consent Order between the Town and
the New York State Department of Environmental
Conservation, and are further enumerated in 6NYCRR
Part 360, effective December 31, 1988.
2. The total current (today's) cost of landfill closure
including testing, drilling, analysis and design,
construction, inspection and certification is estimated
at $550,000.00. The cost of post closure care
through the end of the required period is an unknown
variable at this time.
While Part 360 allows for 30 years of post closure
monitoring,many factors may combine to reduce this
period significantly. Frequency and duration of post -
closure testing is also eligible for Mandate Relief, and
the New York State Department of Environmental
Conservation seems to be in the process of evaluating
and establishing guidelines.

Poughkeepsie, New York to the New York State Department of
Environmental Conservation (DEC) dated January 12 & 24, 1996 regarding
the Castle Point Landfill. The correspondence requests modifying the
landfill closure schedule verbally agreed to during our November 1995
meeting due to unanticipated severe winter weather.
The proposed landfill closure schedule modifications are acceptable to
the Department, and the revised landfill closure milestone dates will
be incorporated into the revised draft Order on Consent. The revised
draft Order on Consent will be submitted to you for your review in the
next two weeks and they are listed below for your information.

Installation of the final cover system must begin by July 29, 1996
Installation of the barrier layer portion of the final cover system

As outlined in our recent correspondence of .January 24, 1996, the
Town is scheduled to submit a Revised Closure Plan for the Castlepoint
Landfill to the New York State Department of Environmental
Conservation (N.Y.S.D.E.C.) by March 18, 1996. The most time
consuming task involved with the revisions is the installation,
development and qualitative testing of a monitoring well. Our recent
interaction with the N.Y.S.D.IE.C. has centered on the location and
construction methodology of this well. These items have been finalized,
and the weather is now amenable to drilling operations.
Enclosed please find three quotes from qualified drilling firms to install
the monitor well couplet (one deep bedrock well, one shallow over-
burden well). The quotes give bids in terms of unit prices, since the
exact depth of the wells is unknown. By assuming well depths based
on surrounding conditions, we have estimated the drilling costs as
follows:

documentation to apply for state assistance to accomplish the
Castlepoint Landfill Closure. Under the Environmental Quality Bond Act
(EQBA), as provided for in Title 5 of Article 54 of the Environmental
Conservation Law (ECL), municipalities with a population of 3500 or
more can apply for reimbursement of up to 50% of the approved project
cost.
As part of the application, the Town Board must adopt a formal
Resolution authorizing the submission for assistance, and naming the
Supervisor as the official representative to act in connection with any
actions between the Town and the State.
A sample Resolution is enclosed for your use.
If the enclosed meets with your approval, please consider adopting said
Resolution at your November 27, 1995 Board meeting. Please note that
no application can be made until such a Resolution is adopted.
Please note also that, since the EQBA is a reimbursement program, (ie:
the Town receives no State monies until after the work is completed and
paid for by the Town), this office is pursing Town participation in the
State Revolving Fund (SRF) Short Term Loan Program to provide low or
no interest bridge loans.

Dear Supervisor Smith:
The New York State Department of Environmental Conservation (NYSDEC) has completed a
technical review of the Closure Report (CR) for the Town of Wappinger, Castle Point Landfill.
The CR was submitted to the NYSDEC on February 26 of 1993 as directed by the NYSDEC
letter of July 30, 1992 [ref. 3] and CO [ref. 2] between the Town of Wappinger and NYSDEC
(see Case # 3-143218707). Due to the history and specifics of the site, the Department
comments were not mailed to the Town directly after the review had been completed . In order
to discuss the options available to the Town to close the landfill at our meeting. Based on our
meeting and discussion with the Town representatives on March 1, 1995, there are two options
available to the Town to close the Castle Point Landfill. These two options are:
First Option: to close the Castle Point Landfill in accordance with the CO [ref. 2] and
Part 360, effective December 31, 1988. The Department explained to the Town [see ref.
5], following the aforementioned meeting, that upgrading the closure plan, to meet the
requirements of Part 360, effective December 31, 1988, will provide the Town the
opportunity to apply for a grant (under the State Assistance for Municipal Landfill Closure
Projects Program) and for variances under the Local Government Mandate Relief Initiative
(LGMRI). The NYSDEC transmitted the comments on the CR, related to this option to
the Town on March 22, 1995 [see, Attachment 1 of ref. 5].
Second Option: to close the Castle Point Landfill in accordance with the CO [ref. 2] and
Part 360, effective April 1, 1987. If the Town chooses to select this option, Attachment
summaries the Department's technical comments to be addressed in the RCP of the
landfill. The RCP which addresses the Department 's technical comments must be
submitted to NYSDECISWD by November 22, 1995.

Comments related to the hydrological and environmental monitoring aspects (water -quality
monitoring), related to the CR have been forwarded to the Town on March 22, 1995 [see ref.
5]. Enclosed for your consideration is a copy of the inspection report of Castle Point landfill
conducted on June 8, 1995 by the Department personnel [ Attachment 2].

REVIEW OF THE CR BASED ON THE C
A preliminary report (PR) prepared by Chazen Environmental Services in October 1992 (Ref. 4
& Appendix A Ref. 1] admitted that approximately 1.8 acres of the total 3.2 acre landfill site
does not meet the criteria specified by the NYSDEC [ref. 3] of 2' cover having a permeability of
1x10--' cm/sec and based on the soil boring information, C& D material such as plastic bags and
metal fragments were found within the 24" thickness of the existing partial cap.
Based on this information the CR [ref. 1, page 11 proposes two areas to receive additional cover
to meet the permeability requirements.
The NYSDEC technical review of the CR has determined that the submitted permeability data of
the existing partial cap soil does not meet NYSDEC requirements. Therefore the existing cover
depth and performance standards are unacceptable and the Town is required to submit an integral
final cover design as part of the revised closure plan (RCP) for the landfill in accordance with the
CO [ref. 2] and applicable NYSDEC standards.
Consequent to Mr. P. Paggi's letter of May 1, 1995 [ref. 5] and NYSDEC site inspections, the
Department has prepared a second set of technical comments on the CR. These comments are
based mainly on the CO [ref. 2]. The revised closure plan (RCP) must meet , as a minimum,
the requirements of CO [ref. 2]. The CO Section 5(a) through (c) requires "to submit and
implement a phase-out/closure plan for the landfill in an environmentally sound manner".
Based on our meeting and discussion with the Town representatives on March 1, 1995, the Castle
Point Landfill may be closed in accordance with the CO [ref. 21 and Part 360, effective April 1,
1987. In order to meet the aforementioned requirements, a CR must be revised and a revised
closure plan (RCP) be submitted to address the following comments to the satisfaction of the
Department:
1. The CR (Fig #1&2) does not provide the existing west boundary of the LF. The RCP
must include a map showing the LF boundaries and the total area of the final cover. The
CR provides an approximate landfill footprint which does not clearly define the landfill's
lateral extent. The Town should conduct enough test pits to determine the actual extent of
solid waste being disposed. The RCP must define exactly the landfill footprint and
provide the exact area to be covered. In addition, a discussion about the type, amount and
depth of solid waste disposal must be provided. As a result of the inspection conducted
by NYSDEC personnel at the Castle Point landfill, on June 8, 1995, a drum of waste

(uncovered solid waste ) was found immediately east of the landfill in the adjacent Ball
Field . This drum has to be removed and properly disposed of. Identification of the
landfill footprint may extend beyond the landfill footprint shown on the maps (figs. 1 &2)
in the CR to include adjacent areas, such as the Ball Field.
As part of the RCP provide a map showing site characterization including:
a. Site size, property lines, limits of waste, as required by the CO Appendix B, ILb.
b. Proximity of the LF to surface waters and population centers, as required by the
CO Appendix B, II.c.
2. Page 9 in the CR and fig. 2 provides a final cover design for the municipal solid waste
LF, composed of two layers: the top soil 6". and the barrier Iayer (low permeability layer)
18" with coefficient of permeability (k) < 1 x 10 ' cm/sec, is acceptable to the
Department contingent on meeting the requirements of Appendix D(IV)(D) of the CO
which requires to install a final cover of 2' thickness of soil with a permeability of:
a. 1x10' cm/sec which was acceptable to the Department, based on the information
provided up to 1992 (see ref. 3) and if no contravention of groundwater standards,
required by 703.5, or Department of Health guidance currently exists; whichever is
more stringent
b. 1x10' cm/sec if contravention exists and contamination has been detected
exceeding groundwater standards in down -gradient groundwater monitoring wells,
after reliable water quality data has been collected and the results are reviewed by
the Department.
Attachment A of the CR [ref. 1], Permeability Test Results, Page 4, indicates that the
permeability of the cover layer exceeds 10' cm/sec, as required by the CO [ ref. 3].
Therefore, The Town is required to revise the cap design and to install a final cover of
2' thickness of soil with a permeability meeting either (2.a) or (2.b), as explained above.
The RCP should include a reference to an ASTM method or other alternative method,
approved by NYSDEC, for the in-situ permeability Test.
3. The CR page 3, indicates that "the site will be regraded to permit storm runoff to a drain
in southeasterly direction, away from the LF". NYSDEC standards require that the low
permeability barrier soil cover must be placed on a slope of no less than four percent to
promote positive drainage and at a maximum slope of 33 percent to minimize erosion.

Appendix C(V)(D) of the CO requires the Surface drainage patterns and control structures
be provided.
The RCP has to include drainage control structures which must be designed,
graded, and maintained to prevent ponding and erosion to the cover. The surface
drainage system must be designed and constructed to protect the cover from, at a
minimum, the peak discharge of a 24-hour - 25 year frequency storm.
Provide an estimate or calculations showing the amount of runoff, leachate quantity,
infiltration capacity ..etc.
4. The CR drawings (fig. # 1 and 2) demonstrate partially the existing conditions and final
grading plans. In order to reach the designed final grading contours, a description of the
landfill's preparation for the final cover in terms of method, depth (cut or fill thickness),
location and sequence, using a 100 -foot square grid depicting the existing elevations, and
the projected final elevations of the cover has to be provided, prior to construction,
including:
a. a method of elevation control for the operator including the location and
description of a permanent surveying benchmark, if available at the site.
b. an estimate of the area of the final cover and a total soil volume required for the
area to be covered to reach final grading levels.
5. Appendix D (III) of the CO requires the following for gas venting design:
a. Plan determining the zone of zero gas migration,
b. Location and design of venting systems
C. Schedule of installation and Monitoring
d. Gas diffusion (calculated)
Fig. 2 of the CR shows a gas vent riser of height two feet above the cover. This height is
unacceptable.
The RCP must address the points listed above in 5a, 5b, 5c and 5d and include a design of
a gas venting system (assuming 4 gas vents/acre and risers exposed at least three feet
above the final elevation of the cover system with a minimum depth of penetration of 5
feet through the waste).
6. The RCP must include technical Specifications of all materials used for the landfill final
cover. In addition, installation, compaction methods, constructional quality
assurance/constructional quality control (CQA/CQA) must be provided.

The RCP must include details regarding the quantity and source of landfill cap
components . These components should be tested with the appropriate tests meeting Part
360 requirements . In cases where a test or testing frequency is not appropriate or
inapplicable, the RCP should reflect this and provide alternatives for the Department
approval.
The physical properties, including the coefficient of permeability of the proposed capping
soil at the Trap Rock Quarry site, have to be well known to the Department before
reaching a final decision regarding its suitability to be used as a liner for the landfill final
cap. Appendix C of the CR does not provide all information listed on page 6.
7. 360.8(b)(x) (effective April 1, 1987 ) calls for post- closure monitoring of five years or
longer period as required by the Department.. Provide Post -closure monitoring and
maintenance operations manual. This manual provides personnel with detailed instructions
for assuring efficient monitoring and proper maintenance of all facility components for a
minimum period of thirty (30) years after landfill closure.
This manual must stand as a separate document and be submitted with the RCP. After
five years of monitoring, the Department will evaluate the possibility of reducing the
post -closure monitoring period, based on review of the five years results of groundwater
monitoring and explosive gas monitoring data. The Town will continue monitoring for
longer period after 5 years, unless otherwise approved by the Department.
The manual must include quarterly gas monitoring to quantify and ensure that:
(i) Explosive gas levels do not exceed 25% of the lower explosive limit within any
structure on or off site (except gas control or recovery system components).
(ii) The level of subsurface explosive gas does not exceed the lower explosive limit any
where along the property boundary.
If monitoring shows these levels are exceeded, NYSDEC should be notified and remedial
action taken (such as the construction of gas cut-off trenches). In addition, quarterly
explosive gas monitoring and maintenance should assure that the gas vents are not blocked
and the landfill gas has not damaged the final cover.
Perimeter subsurface monitoring should be performed at maximum intervals of 100 feet, if
a portable explosive gas detector is used. Monitoring with a portable explosive gas
detector when the ground surface has been wet or frozen for several days. Monitoring
should be done below the wet or frozen zone.

Any areas around the waste mass where gas is found to be escaping should be tested with
a portable explosive gas detector to determine whether they indicate pathways by which
explosive gas is migrating off-site. If so, additional measures should be taken to prevent
off-site migration. The percentage of explosive gas emanating from gas vents should be
measured to indicate the effectiveness of the gas vents.
All gas monitoring should be performed when the atmospheric pressure is low (below
29.92 inches of mercury). Atmospheric pressure should be recorded along with the
monitoring results.
Instructions for carrying out all post closure monitoring and maintenance activities should
be included in the facility's post -closure monitoring and maintenance manual.
8. Page 3 of the CR [ref. 1] indicates that "combustible gases were not noted ". Provide
exact dates, methods used for monitoring, frequency, locations, and other parameters such
as meteorological data.
Page 3 of the CR [ref. 11 provides that ""the perimeter wells will be monitored for the
presence of methane gas using combustible gas indicator.... should. the presence of gas be
detected.... etc, additional vents will be installed as necessary". What do you mean by as
necessary? provide concentration of the combustible gas after which the vents will be
necessary to be installed? When and where the additional gas vents, mentioned above,
will be installed and what is the schedule of installation?
Provide an explosive gas investigation as part of the RCP as required by the CO:
(i) identify the presence and concentration;
(ii) extent of migration offsite;
(iii) the system used for monitoring and venting the decomposition gases generated
within the landfill; and
(iv) identify the soil stratigraphy beneath and around the landfill.
9. The CP must include a schedule for each of the closure activities which will be conducted
to accomplish ultimate closure of the LF, including mulching, seeding and vegetation of
the final cover.
10. As part of the RCP, a provision must be included in the property deed indicating the
period of time during which the property has been used as a landfill, a description of the

wastes contained within, and the fact that the records for the facility have been filed with
the department. Said deed shall also reference a map which shall be filed with the county
clerk, and which clearly indicates the limits of the landfilled waste and containment
system. The property deed should also indicate that transfer of, construction on or any
change in use of the property requires prior Department approval.
11. Provide a contingency plan (construction contingency plan), as required by the CO,
detailing corrective or remedial action to be taken in the event of:
(1) Equipment breakdown.
(2) Air or water contamination due to operations.
(3) fires
(4) spills or releases of toxic materials.
This plan must describe procedures for responding to construction deficiencies resulting
from circumstances including, but not limited to, inclement weather, defective materials or
construction inconsistent with specifications as demonstrated by quality control testing.
The plan must provide a description of the criteria to be utilized in evaluating deficiencies,
and selecting and implementing corrective actions.
12. The RCP has to include a statement that upon completion of construction of the landfill
final cover, a written certification report will be prepared by the project engineer
indicates that the construction was conducted in accordance with the terms of the
approved CP. The project engineer must include in the construction certification report a
discussion of all quality assurance and quality control testing. This certification must be
submitted to the Department within 45 days after completion of construction.
14. The RCP has to include a discussion of the future use of the site, including the specific
proposed or alternative uses. Future uses must not adversely affect the final cover system.
