PAYMENT SCHEDULE: Payment contingent on equal access and availability of the ramp's use to all. If a use fee becomes necessary, the rate structure must allow use of the ramp in a non-restrictive manner to non-residents: $8,000 in advance; $2,000 on receipt of final report and verification of expenses. FINAL REPORTS DUE: Final report and verification of expenses due May 1, 2001. The Grantee agrees: 1. To be solely responsible for supervising all activities in the performance of this grant. 2. To use the grant funds solely for the purpose described above and to repay any portion which is not used for the purpose of this grant. 3. To maintain complete and accurate records of receipts and expenditures, to make the books available to the Foundation on request, and, to keep such records for at least four years after the funds are spent. 5. Over recent years we have made improvements to our town dock network and in the process fell short in solving our parking problems and it has caused at times some hardship for some of the local residents. As part of my original request I had asked if we could have our local boaters park their trailers and tow vehicles in your parking lot during the boating season in return for some stipend from the town in the form of rentalandl or parking lot improvements I am at this time asking that you review this idea with your members again and if it is looked upon as a favorable possibility then we would proceed to set up a meeting of both parties to work out all the necessary details, which would include scheduling, town patrol (control /coverage), any new instruction or information signage requirements along with any legal ramifications, such as insurance riders /coverage I look forward, hopefully to a favorable reply from your organization in creating a partnership to solve Chelsea's parking dilemma. Graham Foster's Memo as of 4123/02 The so called problem was initially reported to us soon after the initial installation of the dock design, which eliminated use of support pilings and provided the "I" beam structure (not angle iron). This was initially challenged by Mr. Foster at that time and was given the same answer then as now. The support structure was designed to help protect our asset (dock hardware) from suffering damage from the so called experienced lifetime boaters by backing their trailers into the dock hardware .Prior to this change we did suffer dock damage which required us to have the hardware sent back to the vendors shop to have broken aluminum welds repaired caused by trailers backing into same which had to be done in the off season. I would like to point out several other items that are prevalent to 95% of all boat ramps in use today; 1) Docking surfaces are to be used to load /unload equipment and Passengers or to tie up to when removing /retrieving trailer and tow vehicle, 2) most ramps are located somewhat remote of docks to prevent people from blocking dock surfaces with trailer and tow vehicles in order to allow other boaters to load / unload as a personal courtesy and to save time. Good examples of local ramps that #2 category are White's Marina, Nod State Park, Rhinecliff Public Ramp, West Shore Marina, City of Poughkeepsiejust to mention a few and the list goes on. VALDATI Yesterday, l once again received a complaint of the protruding angle iron structure at the above ramp. Previous complaints by Councilmen Bettina, Valdati and myself have fallen on deaf ears in the Recreation Department. As a lifetime trailer boater, I cannot understand why Recreation persists in ignoring this problem. The angle iron makes it difficult to impossible to launch a boat alone. An experienced trailer boater simply backs his trailer parallel with the dock, walks out the dock, steps on their boat and backs it off the trailer. When pulling the boat out, the process reverses. The angle iron prohibits the trailer from being placed close enough to the dock to step onto the rear of the boat and forces the operator to climb from the trailer onto the front of the boat for launching. This practice is dangerous on a slippery boat and trailer with wet feet or shoes at a height of 6-8 feet,depending on the boat. Since the ramp does not fall under the jurisdiction of my department, I am writing this memo as a concerned boater on behalf of all the trailer boaters who are frustrated by the towns lack of action to this problem. 1. would appreciate the board looking into this matter as soon as possible, especially since Councilmen Bettina and Valdati have previously expressed their concerns on this subject. CYC hereby grants to the Town a license to construct and connect a floating ramp system to a concrete bulkhead adjacent to the Hudson River owned by CYC for interconnection with an existing ramp system owned by the Town as part of a public boat dock, all in accordance with the attached plans, marked and designated as Exhibit "A". 2. Town: The Town will be responsible for any damage or repair to the bulkhead owned by CYC occasioned by the Town's construction of the interconnection or by the Town's use of the bulkhead. b. CYC: Other than damage caused by the Town's use of the bulkhead, CYC will maintain the bulkhead in good condition and repair throughout the terra of this license. 3. Insurance. The Town will name CYC as a certificate holder under its general liability policy, and will provide CYC with a copy of such certificate on or before the first day of May of each year hereafter. 4. Term. The term of this License will be for a period of one (1) year, beginning May 1, 1998, and said license shall be automatically renewed on a yearly basis thereafter for each succeeding year unless CYC gives written Notice of Cancellation of the License to the Town Board and the Town of Wappinger Recreation Committee no later than the first day of November in any succeeding calendar year. CYC may only cancel for reasonable cause with a statement of the causes contained in the Notice of Cancellation. Should CYC experience any difficulties for whatever reason or cause with the public use of the floating ramp system, CYC shall provide the Town Board and the Town of Wappinger Recreation Committee written notice of such difficulties as soon as is practical. The purpose of this written notice is to provide the Town with the opportunity to correct or cure any potential sources of termination of the license granted herein. 5. Recreation Committee. a. The Town of Wappinger Recreation Committee will adopt rules and regulations for the use of the floating ramp system in consultation ' with CYC, and agrees to implement and adopt rules and regulations prior to May 1, 1998. A copy of the rules and regulations will be provided to CYC. b. Environmental Protection Fund Local Waterfront Revitalization Program for improvements to the Chelsea Dock Area. Per the request of Mrs. Buckley, Mr. Ennesser contacted Kevin Millington's Office in Albany on Tuesday, September 3rd regarding the status of the grant. He was informed that the Town of Wappinger was not being considered for this grant because our Town is not a member of the Hudson River Waterfront Revitalization Program. Mr. Millington's office said that they would send us information on becoming a member. We look forward to the receipt of this information and will forward to you our reaction to it. In the meantime, we have counted on receiving financial support ($20,000.) for our Dock enhancements.
