At a Regular Meeting of the Town Board of the Town of Wappinger held
at the Town Hall in the Village of Wappingers Falls, Dutchess County, New
York, on the 5th day of August, 1985 at 8:00 P.M.
IN THE MATTER OF THE REVISION OF BOUNDARIES AND
DESCRIPTIONS OF THE HAMLET CONSERVATION PARK DISTRICT.
WHEREAS, a petition dated November 4, 1982 was presented to the Town
Board of the Town of Wappinger with a map and plan requesting that a Conservation
Park District be established in the Town of Wappinger, and

WHEREAS, Gino M. Pullo had petitioned the Town Board as a condition
for subdivision approval for the creation of a Conservation Park District, and
WHEREAS, the Town Board on 1982 adopted a resolution reciting
in general terms the filing of the said petition and setting forth the
boundaries thereof, and
WHEREAS, a Public Hearing was held on this matter on December 5, 1982
which considered the petition and which set the boundaries of the district, and
WHEREAS, an application has recently been made whereby the description
for the Conservation District is requested to be amended,
it is
NOW, upon motion of Supervisor Versace, seconded by Councilwoman BAllard
RESOLVED, that a Public Hearing shall be held on the 19th day of August
1985 at 7:30 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York,
to consider the application to amend the description of the boundaries of the
Hamlet Conservation Park District as shown on the description of Robert L.
Campbell, L.S., dated July 24, 1985, as follows:

that the request for the buidling permits for a model home

certificate of occupancy until such time as all improvements
have been constructed and/o-- installed in accordance with
Town law and the zoning ordinance of the Town of Wappinger.

the Town Board far approval pursuant to Town Law §281 to cluster homes
within a subdivision to be known as "The Hamlet" and upon giving such
approval, the Town Board by resolution dateddirected
that a conservation park district be created for the open spaces of
said subdivision, and
WHEREAS, on November 8, 1982 the developer duly filed said map
plan and report in the office of the Town Clerk of the Town of
Wappinger, and
WHEREAS, the boundaries of the proposed conservation park
district are described in Schedule A annexed hereto, and
WHEREAS, no improvements are imposed within said park district,
the lands within said district have remained forever undeveloped
and forever wild, and
WHEREAS, the maximum amount proposed to be expended for such
improvement is NO ($0.00) DOLLARS, and

as a natural resource of great importance in studies conducted at
the local, state, and federal levels of government, and lop

3. ALTERATION OF THE NATURAL LANDSCAPE. More specifically,
the permitted uses shall include the construction and maintenance
of facilities necessary and appropriate to providing access to the
land, such as carriage roads, hiking trails, and primitive tent --
sites; the construction and maintenance of facilities which are

necessary and appropriate for the physical maintenance of the land
and the supervisaon of human use of the land; and the construction
and maintenance of facil.ities..which are necessary and appropriate
for historical preservation, ecological research, education, and
the other purposes permitted by this covenant. In each case the
overriding purpose of such facilities shall be to increase the
benefit of the land to human society and such facilities shall never
inure to the benefit of any private corporation or individual. No
substantial fraction of the land shall ever be devoted to developed
facilities of any sort, so that the great majority of the land shall
remain in its wild, natural, and pastoral state for its benefits as
such to human society. The character of any such developed facili-
ties shall be in keeping with the wild, natural, and pastoral state
of the land and shall not draw attention to or glorify the works of
man over the works of nature.
4. MANAGEMENT PRAC;TIC AES. The permitted uses of the land shall
also include forest management, wildlife management, pasturage, and
pastoral agriculture conducted strictly for purposes of research,
education, or esthetics. Such management practices shall never
inure to the benefit of any private corporation or individual. If
timber or other assessable property should ever be sold in connection
with these management practices, 50% (fifty percent) of any net profit
shall be paid over to the Town.
S. TERMINATION OF THE TRUST. In the event that The Mchonk
Trust is terminated, or for ether reasons the Trustees cease tc be
the owners and managers of said land, the land shall be convened to

a non-profit private organization or a public agency which is pre-
pared to own and manage it for the purposes of this covenant. No
property shall ever inure to the benefit of any Trustee, private
corporation, or individual.
6. BOUNDARY ADJUSTMENTS. The Mohonk Trust reserves the
privilege of deeding small areas of land to neighboring owners for
their use outside the terms of this covenant. Such changes in
boundary shall be permitted only to create a more rational property
line, to simplify maintenance and patrol requirements, or in ex-
change for land or benefits of equal or greater value, Lands re-
ceived by the Trust in exchange shall automatically be included in
this covenant. The effect of such boundary adjustments shall always
be to increase the benefits of the Trust lands for the purposes of
this covenant, and the area of land so released shall never exceed
k% (one-half of one percent) of the total Trust acreage in any one
calendar year.
7. SUCCESSORS. The open -space conservation covenants set
forth herein shall be binding in perpetuity not only upon the donor
and Smiley Brothers, inc., but also ;upon any successors in interest
to the donor.
8. PREVIOUS OWNER'S CONSENT. The legal signature of Smiley
Brothers, Inc., the successor to Lake Mohonk Corporation, shall be
affixed to this covenant to indicate that the terms of this covenant
are compatible with restrictions and covenants already placed on
the land at the time it was conveyed to The Mohonk Trust.
9. APPLICAk-L . This 'aper -space covenant is offered by Thi
Mohonk Trust and accepted 1)v the Town of New Paltz for the purpose
of preserving significant- cpen space 'pursuant to Section 247 of the
General Municipal Taw. . 'his co,renant does not infringe or wive the

rights, duties, and Claims of the Town Assessor, The Mohonk Trust,
or succeeding o%jners with respect to the real property tax status
and/or the assessed valuation of the property.
10. AMENDMENT. The terms of this covenant may be amended by
mutual agreement after due notice and a public hearing.

WHEREAS, a petition dated November 4, 1982 was presented
to the Town Board of the Town of Wappinger with a map and
plan requesting that a Conservation Park District be
established in the Town of Wappinger, and
WHEREAS, Gino M. Pullo had petitioned the Town Board as
a condition for subdivision approval for the creation of a
Conservation Park District, and
WHEREAS, the Town Board on November 8, 1982 adopted a
resolution reciting in general terms the filing of the said
petition and setting forth the boundaries thereof, and
WHEREAS, a Public Hearing was held on this matter on
December 6, 1982, which considered the petition and which
set the boundaries of the district, and
WHEREAS, the Town Board did approve the original Hamlet
Conservation Park District subject to execution of the plat
by signature of the Planning Board Chairman which was executed
on December 19, 1983, and
WHEREAS, an application has recently been made whereby
the description for the Conservation Park District is requested
to be amended, and
WHEREAS, a Public Hearing was held on this matter on
August 19, 1985 to consider such revision of boundaries and
hear all persons interested in the subject thereof, and
WHEREAS, the evidence offered at such time and place
requires that the Town Board make the determinations herein-
after made,
NOW, THEREFORE BE IT RESOLVED, that the Town Board does
hereby approve the Revision of Boundaries and Descriptions of
the Hamlet Conservation Park District as shown on the description
of Robert L. Campbell, L.S., dated July 24, 1985 as follows:

THIS INDENTURE, made the day of March, in the year One Thousand Nine Hundred
and Ninety -Two (1992)
BETWEEN the COUNTY OF DUTCHESS, a municipal corporation with offices at 22 Market
Street, Poughkeepsie, New York 12601, party of the first part,
-AND-
TOWN OF WAPPINGER, a municipal corporation with offices at 20 Middlebush Road, P.O.
Box 324, Wappingers Falls, New York 12590, party of the second part.
(1) WHEREAS, property in the Town of Wappinger assessed to Cobrew Realty Corp., for
the year 1985, and described as Grid No. 19-6157-02-943951--00, was sold to Dutchess County
at tax sale on January 7, 1987 for $746.18 for unpaid State, County, Town and School
k< taxes, based on the 1985 tax roll, and not having been redeemed from such sale within the
ems:- time prescribed by law, was deeded to Dutchess County on December 7, 1990, in accordance
with the laws of this State and a Judgment of the Supreme Court of the State of New York,
which deed was filed in the office of the Dutchess County Clerk in Liber 1880 of Deeds at

WHEREAS, the same property was sold to Dutchess County at tax sales on January 7,
1988 for $1,871.57; January 5, 1989 for $2,955.60 and January 5, 1990 for $354.04, based
on the tax levies of 1986, 1987 and 1988, respectively, and
(2) WHEREAS, property in the Town of Wappinger assessed to Cobrew Realty Corp., for
the year 1985, and described as Grid No. 19-6157-02-962933-00, was sold to Dutchess County
at tax sale on January 7, 1987 for $746.18 for unpaid State, County, Town and School
taxes, based on the 1985 tax roll, and not having been redeemed from such sale within the
time prescribed by law, was deeded to Dutchess County on December 7, 1990, in accordance
with the laws of this state and a Judgment of the Supreme Court of the State of New York,
which deed was filed in the office of the Dutchess County Clerk in Liber 1880 of Deeds at
page 620, and
WHEREAS, the same property was sold to Dutchess County at tax sales on January 7,
1988 for $792.32; January 5, 1989 for $1,447.39 and January 5, 1990 for $630.86, based on
the tax levies of 1986, 1987 and 1988, respectively, and
WHEREAS, Constance Smith, Supervisor, on behalf of the Town of Wappinger, tendered to
the Dutchess County commissioner of Finance the sum of $12,500.00 in payment of all right,
title and interest which the County of Dutchess may have acquired in and to said
properties by reason of the hereinbefore mentioned deed and Judgment, and in payment of
all tax sales and unpaid taxes mentioned above and requesting that the above parcels be
quitclaimed to the party of the second part, and
WHEREAS, the County Legislature of the County of Dutchess has adopted Resolution No.
410 of 1991 to the effect "That the County Executive and the Clerk of this County
Legislature be, and they are hereby authorized and empowered to execute deeds covering
the parcels of real property so sold to the purchasers thereof in the name and on behalf
of the County of Dutchess", now, therefore
THIS INDENTURE WITNESSETH, that the party of the first part, in consideration of the
sum of TWELVE THOUSAND FIVE HUNDRED and 00/100 ($12,500.00) DOLLARS lawful money of the
United States, actual consideration, paid by the party of the second part, does hereby
remise, release and quitclaim unto the party of the second part, its successors and
assigns forever
ALL THOSE TRACTS OR PARCELS OF LAND situate in the Town of Wappinger, County of
Dutchess, State of New York, described as follows:
Grid No. 19-6157-02-943951-00 and
Grid No. 19-6157-02-962933-00
TOGETHER with the appurtenances and all the estate and right of the party of the
first part in and to said premises.
THIS CONVEYANCE is subject to the condition and covenant that the County of Dutchess
shall in no event be or become liabile for any defects in title so conveyed for any cause
whatsoever, and no claim or demand of any nature shall ever be made against said County
of Dutchess arising from such sale or proceedings leading thereto.

This letter will confirm that the deed dated November 27, 1991
and recorded on December 20, 1991 only covered the 0.563 acre
parcel, which was located in the cul-de-sac. You should have
received a copy of the original deed into the Town previously
tendered to Tom Wood. I simply recorded the deed that Town Wood
had given to me. That deed had legal descriptions prepared by
Jack Railing's office. The legal descriptions excluded this one-
half acre parcel, and a correction deed was obtained.
By now,you should also have received a copy of the deed from the
CountyIto the Town by virtue of the tax sale.

delivered the check of $12,500.00 to Marc Zylberberg for the
purchase of the lands to be transferred to the Town of Wappinger
on behalf of the Conservation/Park District for the hamlet.
As I explained, the title search has disclosed several
defects to title.
There is a judgment rendered against Cobrew Realty Corp. in
the sum of $1,467.00 which was entered on September 12, 1988.
Additionally, the original deed from Cobrew to the Town
inadvertently excluded the "island". I have prepared a deed for
Cobrew to sign and have forwarded it to Cobrew's attorney, Jerard
Hankin, for signature.
The title company charged $50.00 for the title examination;
however, if the Town wants title insurance, a fee policy in the
sum of $30,000.00 will cost $322.00. 1 believe the $50.00 will
be credited against that charge. The title company also

WHEREAS, a petition dated November 5, 1982 has been duly presented
to the Town Board of the Town of Wappinger, with the necessary map and
plan attached therto according to law, requesting that a conservation
Park District, as herinafter described, be established in the Town of
Wappinger, and
WHEREAS, Gino M. Pullo has petitioned the Town Board of the
Town of Wappinger, as a condition of subdivision approval for the Hamlet,
for the creation of a Conservation Park District, and
WHEREAS, said Town Board duly adopted on November 8, 1982 a
resolution reciting in general terms the filing of said petition, the
Boundaries of said District, that no Improvements are proposed to be made
and no Public Funds will be expended, and specifying that said Town Board
shall meet at the Town Hall, Mill Street, in the Village of Wappingers
Falls, New York on the 6th day of December 1982 at 7.00 P.M. to consider
said petition and hear all persons interested in the subject therof,
concerning thesame, and
WHEREAS, copies of said resolution were duly published and posted

BETWEEN the COUNTY OF DUTCHESS, a municipal corporation with offices at 22'Market
Street, Poughkeepsie, New York 12601, party of the first part,

TOWN OF WAPPINGER, a municipal corporation with offices at 20 Middlebush Road, P.O.
Box 324, Wappingers Falls, New York 12590, party of the second part.
(1) WHEREAS, property in the Town of Wappinger assessed to Cobrew Realty Corp., for
the year 1985, and described as Grid No. 19-6157-02-943951-00, was sold to Dutchess County
at tax sale on January 7, 1987 for $746.18 for unpaid State, County, Town and School
taxes, based on the 1965 tax roll, and not having been redeemed from such sale within the
time prescribed by law, was deeded to Dutchess County on December 7, 1990, in accordance
with the laws of this State and a Judgment of the Supreme Court of the State of New York,
which deed was filed in the office of the Dutchess County Clerk in Liber 1880 of Deeds at
page 620, and
WHEREAS, the same property was sold to Dutchess County at tax sales on January 7,
1988 for $1,871.57; January 5, 1989 for $2,955.60 and January 5, 1990 for $354.04, based
on the tax levies of 1966, 1987 and 1988, respectively, and
(2) WHEREAS, property in the Town of Wappinger assessed to Cobrew Realty Corp., for

1984 when I represented a one, Gino Pullo, a principal and Cobrew Realty Corp. Also be
advised, I have had no further involvement with Mr. Pullo or Cobrew Realty since
approximately 1985.
Paragraph 6 limits the plan approval to a period of 10 years unless the owner shall have
transferred the right of approval to a homeowners association. To my knowledge, that has
not been done. However, a search of the records in the County Clerk's Office will have to
be made to assure that no extension or assignment has been made. However, the other
restrictions as to lot size, set backs, elevation, drainage use etc. would remain in force and
effect.

Dear Town Supervisor:
I am writing to express my concern over a safety situation which I face each winter on Hamlet Court.
During the winter months, the streets are not thoroughly plowed, and as a result, the remaining slush freezes
causing a hazardous walking environment. Without street lights, walking at night from the circle to my
home is dangerous -- especially if there is icc which cannot be seen in the dark.
Also, the parking spaces in the circle are not plowed at all, so while on -street parking is forbidden, an accept-
able alternative is, not provided.
All these situations create a hardship for me which I face on a regular basis each winter, and I would like to
find an alternative solution.
To begin with, I would like to see a more thorough job done by the snow removal crew, including plowing
the parking spaces in the circle. Also, if the intent of the no street parking is for snow removal, why can't
we park there when there obviously will not be snow that night? This creates a safer environment without
jeopardizing the sr -tow rerrioval.
Why is the length of time so exaggerated that we can't park on the street? There is rarely snow before
December or January, just as there is rarely snow during the latter part of March, yet the restriction is in
effect from November - April.
Please contact me to discuss alternative solutions which will make Hamlet court a safer street.

A letter was received from the Deputy Highway Superintendent
recommending that -Hamlet Road be accepted by the Town if the
shimming of the roads and any other difficulty are corrected at a
future date to be determined by the Town Board.
MRS. PAINO moved that the recommendation of the Deputy Highway
Superintendent be accepted and Hamlet Court be accepted as and for
a Public Road in and for the Town of Wappinger.

Motion Unanimously Carried
Ralph Holt, Chairman of the Recreation Commission, wrote to the
Town Board requesting permission to use unexpended funds in the
amount of $15,500 for the purchase of a dump truck. The total cost
he explained would not exceed this amount. The funds were originally
allocated for the salary of the Senior Citizen Director and Instructors
for that program. The funds were provided through the Dutchess County
Consortium funds, therefore leaving a balance in the Recreation account.
MRS. PAINO moved to table this request for further discussion.

Mrs. Paino called for a Special Meeting for Monday, November 21, 1988
for the purpose of adopting the Preliminary Budget for 1989, the
adoption of the Benefit Assessment Roll for the Tall Trees Water
Improvement Area and consideration of the request from the Recreation
Commission for the purchase of a dump truck.
There was no other business to come before the Board.

WHEREAS, a petition dated November 5, 1982 has been duly presented
to the Town Board of the Town of Wappinger, with the necessary map and
plan attached therto according to law, requesting that a conservation
Park District, as herinafter described, be established in the Town of

WHEREAS, Gino M. Pullo has petitioned the Town Board of the
Town of Wappinger, as a condition of subdivision approval for the Hamlet,
for the creation of a Conservation Park District, and
WHEREAS, said Town Board duly adopted on November 8, 1982 a
resolution reciting in general terms the filing of said petition, the
Boundaries of said District, that no Improvements are proposed to be made
and no Public Funds will be expended, and specifying that said Town Board
shall meet at the Town Hall, Mill Street, in the Village of Wappingers
Falls, New York on the 6th day of December 1982 at 7:00 P.M. to consider
said petition and hear all persons interested in the subject therof,
concerning thesame, and
WHEREAS, copies of said resolution were duly published and posted
according to law, and said Town Board did, at the time and place specified
in said Conservation Park District, and hear all persons interested in the

WHEREAS, a Public Hearing was held on this matter on
December 6, 1982, which considered the petition and which
set the boundaries of the district, and
WHEREAS, the Town Board did approve the original Hamlet
Conservation Park District subject to execution of the plat
by signature of the Planning Board Chairman which was executed
on December 19, 1983, and
WHEREAS, an application has recently been made whereby
the description for the Conservation Park District is requested
to be amended, and
WHEREAS, a Public Hearing was held on this matter on
August 19, 1985 to consider such revision of boundaries and
hear all persons interested in the subject thereof, and
WHEREAS, the evidence offered at such time and place
requires that the Town Board make the determinations herein-
after made,

legally come in and take whatever precautions would be
necessary to protect the sanitary sewer easement if they so
desired.

Hamlet Court on May 1, 1989 asking the status of that
proposed work. It would be our opinion that this work
should be done and I would like the Board's opinion as toy z
what manner we should go about it.

As you recall when we were going through the
process of
accepting the roads and sanitary sewer lines
for the above
subdivision, there were some concerns from the
residents of
Number 17 and 18 Hamlet Court regarding the
stability of
their slope in the rear of their property.
Their.concerns had to do with the ability to
utilize that
portion of property and the protection of.the existing
sanitary sewer line that traverses it.
As -'you recall at that time, it was stated that further
discussions will be had once the Town accepts the roads and
utilities and that at that point in time, the Town could
legally come in and take whatever precautions would be
necessary to protect the sanitary sewer easement if they so
desired.

At the November 7, 1988 Town Board meeting, the Board asked
me'to contact your office to discuss acceptance of the roads
in the above Subdivision.
They are aware that there are two spots that need shimming.
However, due to public need, they wish to accept the roads
with these minor deficiencies and then go ' after the
developer. Could you kindly draft an acceptance letter to
the Town Board stating that the Town accepts the roads. You
can state that you are aware of these problems and that your
acceptance recognizes the fact that they need repair.
This letter must be in The Town Board's hand by November 16,
1988.

the official records of the Town and find that we needed new original updated
Deeds from the developer in order to be able to accept both Hamlet Court
and the Conservation land. I have received the new updated Deeds, have reviewed
them and find them to be in proper form, and forward them with a copy of
this memorandum to the Town Clerk.
Also several months ago, I wrote to both the Town Engineer and the
Highway Superintendent requesting their recommendations with respect to
the status of the roadway.
The Town Engineer has responded both in writing and also at your
Workshop Meeting. The Highway Superintendent has not yet made a recommendation.
Therefore, by copy of this memo to the Highway Department, I am asking
that the Deputy Highway Superintendent or the Superintendent himsdlf make
a recommendation to the Town Board.
Therefore, it is my recommendation at your next Board meeting that
you consider the acceptance of both Hamlet Court and the property for the
Conservation Advisory District for acceptance by the Town.

not be recommended to be until this situation and others like
it are re-oaired.

Re: Completion of the Hamlet

Dear Mr. Pullo:
upon review of the approvals for the subdivision I note that
several special requirements were made that either should have
already been done or shall be done before completion of the units.
Perhaps because of my absence for a year or so I am not up to date
on any agreements, bonds or other steps that you have taken with
the town to guarantee completion. Specifically, I note the follow-
ing, from the Planning Boards Approval:
1. Standard street signs to be erected at each intersection
and temporary signs were required during construction.
2. Four off street parking areas around the circle with 10
spaces each, landscaping required between the parking
areas and areas enlarged to permit angle parking.
3. A stop sign was to have been installed at Spook Hill Road
at the start of the development.
4, Street trees to be planted.
5. The barn on the property is to be removed.
6.The larger property access driveway is to lie tied into the
new subdivision road.
7. Payment of the $25.00 per lot conservation litter fee to
be paid.
8. Forty trees are to be planted in the Conservation District
facing Meyers Corners Road, to my satisfaction.
These items as well as the normal road, drainage and landscap-
ing work should already be planned for completion by you at this
point in the project. I would like to have your schedule for com-
pletion of those items prior to my granting the next certificate of
occupancy and if required, an agreement on a bond to guarantee com-
pletion of anything that is not now covered by bond.
