Benjamin Amundson of 73 Losee Road came up with questions regarding Resolutions 2021-100
and 2021-104. The first resolution he addressed was resolution 2021-100. He said, "I see that
this is an insurance policy for various petroleum products, hazardous materials which may
accidentally be spilled causing pollution and environmental damage." He asked if it was stored
at official town buildings or stored on town property. The Supervisor said, "It's only on town
properties, town departments such as the highway department and our buildings and grounds
department." Ben then asked, "This is talking about how accidental spillages of these can cause
pollution and environmental damage, but there was a recent law change in 2019 where the town
board declared themselves the lead agency and said that, allowing gas stations to border residents
districts had zero environmental impact and allowing gas stations to border each other had zero
environmental impact, and I just want to know, if it's saying that there's a potential pollution for
environmental damage for accidental spills that the town is storing, how those two things are
separate or how it doesn't apply both ways." The Supervisor interjected, " No, there's actually no
relationship and we appreciate your comment."
His next question was pertaining to the budget. He asked if the new insurance policy for $32,000
coming from the unallocated fund was over 3 years. The Supervisor affirmed. He asked about
the item for water testing. The Supervisor responded that it was for town testing for the water
wells. The Town Attorney explained the amounts to the corresponding items. He went back to
the Pollution Insurance saying, "The policy only covers the accidental spillage of Town related
storing of these products." The Supervisor said "Storage and use of the products, yes." Mr.
Amundson continued asking "So, is there insurance that like a gas station would be required to
have that would serve the same purpose or what happens if there's a spillage there?" The
Supervisor addressed him saying "That's up to their liability coverage." He then asked about the
workshop that was promised at the last meeting. Dialogue went back and forth. A full account
of the back and forth discussions which ensued can be viewed on the video of the meeting on the
town's website.
The next person who came up to speak was Franca Petrillo of 10 Apple Lane. Ms. Petrillo asked
councilman Beale a question. The Town Supervisor interrupted by saying "No, no questions;
after the meeting you can speak with him". Councilman Beale said, "You can speak to me after
the meeting." Ms. Petrillo then asked "May I address something on the correspondence log, is
that acceptable?" The supervisor said "No that's not an agenda item. That's not an agenda item as
we said at a previous Town Board Meeting. That is not an agenda item."

RESOLUTION: 2021-98
In the Matter of the Establishment of the Chelsea Farms Drainage District
WHEREAS, a written petition has been duly filed with the Town Board of the Town of
Wappinger, Dutchess County, New York, in relation to the establishment of a proposed Drainage
Article 12 of the Town Law, which petition, together with a map, plan and report accompanying the
same and addendum thereto, have been filed in the office of the Town Clerk and are available for
public inspection; and
WHEREAS, said map, plan and report include a map showing the boundaries of the proposed
District, a general plan to serve said District, and a report of the proposed method of operation thereof,
and were prepared by Hudson Land Design Professional Engineering, P.C. competent engineers duly
licensed by the State of New York; and
WHEREAS, the boundaries of said District shall be as described in Exhibit A attached hereto
and hereby incorporated herein; and
WHEREAS, the improvements proposed for said District consist of the construction of a
stormwater treatment pond and other associated drainage improvements, all as more fully described in
the map, plan and report hereinbefore described; and
WHEREAS, the maximum estimated cost of said improvements is $_____________; and
WHEREAS, the cost of said improvements shall be paid by the owner of the properties therein
and no serial bonds of said Town shall be issued therefor; and
WHEREAS, the estimated cost of said District to the typical property therein is $102.00 in the
first year in which operation, maintenance, debt service and other charges and expenses are to be paid
and $102.00 to a one or two family house therein, all properties in the District being single family
houses; and
WHEREAS, a detailed explanation of the manner by which were computed said estimated first-
year costs to the typical property has been filed in the office of the Town Clerk where the same are
available during regular office hours for examination by any person interested in the subject manner
thereof; and
WHEREAS, the establishment of the District was determined to be an Unlisted Action
pursuant to the regulations of the New York State Department of Environmental Conservation
promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as
proposed, the Planning Board has determined will not result in a significant environmental effect; and

WHEREAS, it is now desired to call a public hearing upon the question of the establishment of
said District, the petition therefor, and the improvements proposed therefor, all pursuant to Section 193
of the Town Law; NOW, THEREFORE, BE IT
ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as
follows:
Section 1. A meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, shall be held at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York, in said
holding a public hearing to consider the establishment of the District in said Town as described in the
preambles hereof, to be known as the Chelsea Farms Drainage District, the petition therefor, and the
improvements proposed therefor, and to consider the map, plan and report filed in relation thereto, and
to hear all persons interested in the subject matter thereof concerning the same, and for such other
action on the part of said Town Board as may be required by law or shall be proper in the premises.
Section 2. The Town Clerk is hereby authorized and directed to cause a copy of this order
to be published once in the official newspaper(s) of said Town, the first publication thereof to be not
less than ten nor more than twenty days before the day set herein for the hearing as aforesaid, and said
Town Clerk shall also cause a copy thereof to be posted on the sign-board of the Town maintained
pursuant to subdivision 6 of Section 30 of the Town Law not less than ten nor more than twenty days
before the day set for the hearing as aforesaid.
Section 3. This Order shall take effect immediately.

Resolution Authorizing A Contract For Integration Of Cable Tv Audio And Video
Equipment With Compute
WHEREAS, the Town of Wappinger owns audio and video equipment to broadcast its meetings to
the public over its Municipal Access Channel on Cable TV; and
WHEREAS, the Town Board wishes to utilize this equipment to provide audio and visual data to a
computer interface so that it may be livestreamed to the public on zoom and other streaming
services; and
WHEREAS, the Town has received a proposal from Salemsys.net, Inc. to perform the necessary
integration at a cost of $1,188.00;

NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby authorizes a contract with Salemsys.net, Inc. for the system

2. The Town Board hereby authorizes the Supervisor to sign the proposal on behalf of the
Town.
3. The Town Board hereby authorizes the following budget line transfer for the contract:

Resolution Authorizing Acquisition Of Environmental And Pollution Prevention Insurance
Coverage
WHEREAS, as part of its day-to-day operations, the Town of Wappinger stores and uses
various petroleum products and hazardous materials which may accidentally be spilled causing
pollution and environmental damage; and
WHEREAS, it is fiscally prudent for the Town of Wappinger to obtain sufficient
insurance to protect the financial interests of the taxpayers should such accidental spill occur;
and
WHEREAS,
ascertain the most financially effective way to insure the Town against such hazards; and
WHEREAS, the Town Board determines that it is in the best interest of the Town to
obtain additional insurance for such risks.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby determines
that the Town shall obtain a Premises Pollution Liability Insurance Policy from Chubb Insurance
in the amount on $1,000,000 dollars with a retention of $10,000; and
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes the payment of
a three-year insurance premium in the amount of $32,000 from 2021 Budget Line 1910.400A;
and
BE IT FURTHER RESOLVED, that the portion of the insurance premium that is paid
for 2022, 2023 and part of 2024 shall be treated as prepaid expenses in future budget years; and
BE IT FURTHER RESOLVED, that the Town Supervisor and Town Comptroller are
authorized to execute any necessary documents on behalf of the Town of Wappinger to
effectuate the terms of this Resolution.

Resolution Authorizing Water Tenancy Agreement For 641 Wheeler Hill Road
WHEREAS, 641 Wheeler Hill Road is supplied with water from a spring on an adjoining property;
and
WHEREAS, the spring house is in disrepair which compromises the quality of the spring water and
occasionally the spring runs dry; and
WHEREAS, the Owners have requested to enter into a tenancy agreement for the supply of water
from the United
Road until such time as the United Wappinger Water District is extended to include their property;
and
WHEREAS, the connection of the Property to the UWWD water main located in Wheeler Hill
Road is a Type II action under the State Environmental Quality Review Act (SEQRA) pursuant to 6
NYCRR 617.5(c)(11); and

WHEREAS, the Attorneys to the Town drafted a Water Tenancy Agreement to supply water to the
property;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby finds and determines
that:
1) The Project is a Type II action under the State Environmental Quality Review Act (SEQRA)
pursuant to 6 NYCRR 617.5(c)(11).
2) The Town Board hereby approves the Water Tenancy Agreement with the Owners in the
form attached hereto.
3) The Town Board hereby authorizes and directs a majority of the Town Board to sign the
Water Tenancy Agreement on behalf of the UWWD pursuant to Town Law §198(11).
4) The Town Board hereby directs that a copy of the executed Water Tenancy Agreement be
filed in the records of the Town Clerk.

Resolution Awarding Demolition Contract For Rockingham Park Pump Building And
Asbestos Abatement
WHEREAS, the Town Board authorized the Engineer to the Town to prepare bid specifications
and contract documents for the Asbestos Abatement and Demolition for the Rockingham Park
Pump Building; and
WHEREAS, the contract documents and bid information were duly advertised and bids were
solicited for the work to be done and one bid was received by the Town Clerk and publicly opened
on July 22, 2021; and
WHEREAS, the following bids were received:

WHEREAS, by letter dated July ___, 2021, the Engineers to the Town advised that the lowest
bidder Jupiter Environmental Services, Inc. has submitted a bid that conforms to the contract
documents; and
WHEREAS, the Engineer to the Town has investigated the contracting history of Jupiter
Environmental Services, Inc. and determines that it is a responsible bidder; and
WHEREAS, the Engineer to the Town recommends that the Town Board should award the
contract to Jupiter Environmental Services, Inc. in the total contract amount of $36,900 all as set
forth in the aforementioned recommendation letter, a copy of which is affixed hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town of Wappinger hereby awards the CONTRACT FOR DEMOLITION
CONTRACT FOR ROCKINGHAM PARK PUMP BUILDING AND ASBESTOS
ABATEMENT to Jupiter Environmental Services, Inc., 323 Changebridge Rd, Suite 100,
Pine Brook, NJ 07058 in the amount of $36,900.00.
2. In accordance with the authorized bid specifications, the Town Board hereby authorizes the
Supervisor to execute the contract documents as prepared by the Engineers to the Town
including the Notice of Award and Notice to Proceed and forward a copy to Jupiter
Environmental Services, Inc., after the Attorney to the Town has confirmed that Jupiter
Environmental Services, Inc. has duly executed the contract documents, has supplied the
necessary Performance Bond, Payment Bond and provided insurance certificates as required
by the bid specifications.
3. This project shall be funded from the United Wappinger Water District Fund Balance.

municipalities as a shared service; and
WHEREAS, bulk printing of the Town Guides by County Central Services would result

needed to satisfy the demand of the public;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes the
printing of an additional 2,000 copies of the Town of Wappinger Guide; and
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes and directs the
Town Supervisor to sign a printing proposal from Dutchess County Central Services for printing
said guide; and

Steve Fraizer mentioned that the new truck for buildings and grounds has arrived. Part of the
funding for this truck would come from the surplus sale of the old truck that was replaced. The
line that was used to purchase the truck was $7,000 short which will be made up by the surplus

Resolution Authorizing A Memorandum Of Agreement With Teamsters Union Local 445
For Employee To Perform Website And It Services

WHEREAS, the Town of Wappinger requires the services of a person to maintain the content on
with the hosting of virtual meetings for various boards and officers
of the Town as well as other IT services; and
WHEREAS, Tom Bahr is employed with the Town as a Real Property Data Lister and has the
necessary experience to perform the required services; and
WHEREAS, Tom Bahr is part of the Collective Bargaining Unit represented by Teamsters Union
WHEREAS, the Town, the Union and Bahr have negotiated a Memorandum of Agreement which
establishes the services to be provided by Bahr outside of his normal job duties and the manner by
which he will be compensated for those services; and
WHEREAS, the Union and Bahr have agreed to the terms of the MOA and request that the Town
Board also approve the MOA;
WHEREAS, the Town Board agrees that the MOA is appropriate and should be approved;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town of Wappinger hereby approves the MOA dated July 14, 2021 attached hereto.
2. The Town Board hereby authorizes the Supervisor to execute the MOA on behalf of the
Town and to deliver signed agreements to the Union and to the Employee.
3. The Supervisor is directed to provide a copy of the MOA signed by all the parties to the
Town Clerk to maintain in his files with the other contracts with the Union.
4. This resolution shall take effect immediately.

1.0 INTRODUCTION
The project has frontage on Chelsea Road (CR 92) and River Road North within the Town of
WappingerÓs R40/80 Residential Zoning District, consists of approximately 186.8 acres total,
and is identified as Tax #s 6056-01-190688 and 6056-01-138527 on the Town of Wappinger Tax
Maps. The terrain can be described as flat to rolling along Chelsea Road, and steep adjacent to
River Road North. The property is currently vacant, and the majority of the site currently drains
toward Chelsea Road and eventually in the direction of the Hudson River.
The project involves the subdivision of the property into seventeen (17) building lots. A
stormwater pollution prevention plan has been prepared that includes stormwater management
features including individual stormwater management practices (rain gardens, drywells,
bioretention), catch basins, swales, piping, bioretention areas, and a stormwater pond. This
system is intended to provide water quality and quantity treatment in order to be compliant with
New York State requirements.
This map, plan and report describes the proposed drainage district and offers recommended
annual benefit assessments against the owners of the subdivision lots to maintain and repair the
stormwater management facilities as necessary. Accordant with Planning Board review, the
drainage district will encompass thirteen (13) of the seventeen (17) lots, generally those lots that
are accessed through the proposed subdivision road. Refer to condition (h)(4) of the Resolution
of Final Subdivision Plat and Wetlands Permit Approvals, as provided in Appendix A.
The Town of Wappinger has directed the preparation of this map, plan and report in order to
present the information necessary to adopt the Chelsea Farm Residential Subdivision Drainage
District as required by Town Law Article 12-A of the New York State Consolidated Laws.
2.0 BENEFIT AREA
The Final Subdivision Plat (sheet 3 of 16 of the plan set) showing the proposed Chelsea Farm
Residential Subdivision Drainage District is included in Appendix B of this report, and a metes
and bounds description of said District is provided in Appendix C, with a metes and bounds
description of Easement #1 is provided in Appendix D. Thirteen (13) of the lots (lot numbers 1
through 13) will be included in the District and will be assessed equally (i.e., one benefit unit per
residential lot) for the on-going maintenance and repair to the stormwater management facilities
that become necessary. The developer will pay all of the capital costs associated with the
construction of the drainage improvements. Upon formation of the drainage district, the Town of
Wappinger will be responsible for the maintenance of the stormwater management features as
well as any required sediment and erosion control measures related to the stormwater
management features.
3.0 PROPOSED FACILITIES
The proposed improvements within the drainage district generally include a network of catch

basins, drainage manholes, flared ends, culvertpipes and surface swales that convey stormwater
to plunge pools (that discharge to bioretention areas) ora stormwater management pond located
near Chelsea Road. For a detailed description of the facilities, please refer to the project
Stormwater Pollution Prevention Plan (SWPPP).Individual stormwater management features on
the lots within or outside the drainage district are the responsibility of the individual homeowner.
These include drywells with pre-treatment yard drains, infiltration trenches with pre-treatment
yard drains, rain gardens, and bioretention areas (on lots 16 & 17). In the event of a failure of the
homeowner to properly maintain the individual stormwater management features on his or her
own lot, as ordered by the Stormwater Management Officer, the District may either perform the
required maintenance or contract to have thework done. The District may charge such
maintenance costs to the individual property benefitted ,and will have the option, if those charges
are not paid, to levy the costs against the benefitted property.
The improvements are to be completed by the Owner/Developer prior to any building permits
being issued, and a performance bond for the estimated total plus all other road improvements
must be provided to the Town prior to any construction activity beginning. When deemed
complete by the Town, the Owner/Developer shall dedicate the facilities to the Town at no cost
to the Town.
3.1 Annual Maintenance Program
The site will be required to have an annual inspection of the stormwater management system
conducted by a qualified person. Any required maintenance or repair items as a result of the
inspection are to be completed within one (1) month of notification, with inspections expected to
take place anytime between the beginning of April through the end of September. Items to be
inspected include catch basins, drainage manholes, flared ends, culvert pipes, surface swales,
plunge pools, bioretention areas, and the stormwater management pond. Appendix P of the
referenced SWPPP provides checklists for inspections.
4.0 OPINION OF PROBABLE COSTS OF OPERATION
The estimated annual operation and maintenance costs for the Chelsea Farm Subdivision are
based upon the cost to inspect the common drainage facilities and to maintain the stormwater
management facilities within the proposed road and within the area delineated as Easement #1.
The estimated operation and maintenance cost of the drainage district shall be established
annually by the Town of Wappinger Town Board. The estimated annual operation and
maintenance cost (in the first year of operation) is $1,325. Each parcel within the drainage
district will be assigned one benefit unit, and each benefit unit will be billed 1/13 of the annual
costs, or $102 in the first year.
