COMMENTS -Current Meeting:
George Schmidt, manager of the NYC department for the Delaware Aqueduct, appeared to
explain and provide a PowerPoint Presentation to the audience detailing the construction of the
tunnel that began in January 2013, the upcoming work, and the pre-shutdown work expected to
be completed by February 2022. The tunnel goes 700 feet deep and is 12,500 feet or 2.5 miles.
Included in the shutdown will be the pumping of infiltration water to the Hudson River with final
work that will be 24/7 work expected from October 2022 through April 2023. Closeout work is
expected to be complete by the end of 2023.
Councilwoman Bettina asked for traffic, noise, and road damage to be addressed. Supervisor
Thurston pointed out that the agreement to deliver water to failing wells along the route to get
people in Chelsea to be connected. A letter needs to be prepared by the attorney that can allow a
tie in; and, to sit down and discuss the price of water should the town want to access the NYC
water supply.

Resolution Appointing Deputy Building Inspector
WHEREAS, the Town of Wappinger has a need for a Deputy Building Inspector to assist in the
enforcement of the New York State Uniform Code; and
WHEREAS, the Dutchess County Department of Human Resources has established Job Class
Specifications for the Civil Service Position of Deputy Building Inspector; and
WHEREAS, the Dutchess County Department of Human Resources has given a competitive
examination and created and certified to the Town of Wappinger a current list of eligibles for the
Title of Deputy Building Inspector; and

WHEREAS, the Town has canvassed the certified eligible list for Deputy Building Inspector and no
candidate on the list would accept employment with the Town of Wappinger; and
WHEREAS, Keith Bligh has applied for the position and the Town Board has determined that he
meets the qualifications set forth in the job specification; and
WHEREAS, the position of Deputy Building Inspector is funded in the Fiscal Year 2021 Town
Budget; and
WHEREAS, the position of a Deputy Building Inspector is subject to the terms of the Collective
WHEREAS, the Town of Wappinger requires the services of a Deputy Building Inspector who is
certified as a New York State Code Enforcement Officer to conduct the business of the Building
Department;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. Keith Bligh is hereby provisionally appointed to the full-time civil service job title Deputy
Building Inspector for the Town of Wappinger, effective Sept 7th, 2021.
2. Keith Bligh is hereby appointed as a Code Enforcement Officer of the Town of Wappinger
in accordance with the provisions of §85-3 of the Town of Wappinger Code.
3. Keith Bligh shall be compensated at the hourly rate of $27.47 per hour which shall be paid
weekly, in accordance with the CBA.
4. The appointment is subject to the approval of the Dutchess County Department of Human
Resources and is further subject to Civil Service Law and the Rules of New York State and
the Dutchess County Department of Human Resources.
5. The appointment of Keith Bligh is subject to his successful Certification as a New York
State Code Enforcement Official pursuant to 19 NYCRR Part 1208 within eighteen months
of his date of appointment.
6. The appointment is subject to a probationary term of not less than eight nor more than
twenty-six weeks and those of a provisional appointment in accordance with the rules of the
Dutchess County Department of Human Resources.

RESOLUTION: 2021-111
In the Matter of The Establishment of the CHELSEA FARMS DRAINAGE DISTRICT in
the Town of Wappinger, Dutchess County, New York
WHEREAS, Chelsea Farms, LLC, the owner of 100% of the real property in the proposed Drainage
District, submitted a written Petition dated July 14, 2021, to the Town Clerk, together with a Map,
Plan & Report for the proposed district prepared by Hudson Land Design Professional Engineering,
P.C., competent engineers duly licensed by the State of New York, in accordance with the
requirements of Article 12 of the Town Law; and
WHEREAS, an Order Calling a Public Hearing was duly adopted by this Town Board on July 26,
2021, reciting the filing of said Petition, Map, Plan and Report, the improvements proposed, the
boundaries of the proposed district, the proposed method of financing, the fact that the Map, Plan
inspection, and
stating all other matters required by law to be stated, and specifying August 23, 2021 as the date, at
7:00 in the evening of said day as the time, at the Town of Wappinger Town Hall, 20 Middlebush
Road, Wappingers Falls, New York as the place where this Town Board would meet and consider
said Map, Plan and Report, and to hear all persons interested in the subject thereof, concerning the
same, and to take such action therein as is required or authorized by law; and
WHEREAS, such Order was duly published and posted as required by law, and proof of publication
and posting has been duly presented to the Town Board; and
WHEREAS, a public hearing on said matter was duly held by said Town Board on August 23, 2021,
at 7:00 p.m. in the afternoon on said day, in the Town of Wappinger Town Hall, 20 Middlebush
Road, Wappingers Falls, New York, and no person appearing in opposition to and the Petitioners
appearing in favor of the petition; and
WHEREAS, pursuant to said petition, it is the intention of the Petitioner, Chelsea Farms, LLC., as
owner, to construct the improvements set forth in the Map, Plan and Report solely at its own cost
and expense; and
WHEREAS, the Planning Board previously adopted a Negative Declaration under SEQRA for
creation of the Drainage District as part of the review of the subdivision application;
NOW, AFTER DUE DELIBERATION, IT IS HEREBY RESOLVED AND DETERMINED
AS FOLLOWS:
a) The notice of public hearing was published and posted as required by law and is otherwise
sufficient.
b) The Petition presented to this Board for the establishment of the CHELSEA FARMS
DRAINAGE DISTRICT was signed by 100% of the property owners within the proposed
district and acknowledged as required by law and is otherwise sufficient.
c) All the properties and property owners within the proposed district are benefited thereby.
d) All the properties and property owners benefited thereby are included within the limits of
the proposed district.
e) There will be no hook-up fees for any of the properties within the district.
f) There will be no capital costs assessed to the properties within the district for the
improvements proposed to be constructed within the first year of operation.

g)The estimated annual operation cost in the first year that charges will be paid by the
benefitted parcels will be approximately $1,325.00 which shall be divided equally among the
thirteen (13) lots resulting in an estimated annual cost of $102 per lot for a typical property
within the district.
h) It is in the public interest to establish the CHELSEA FARMS DRAINAGE DISTRICT.
BE IT FURTHER ORDERED AND DETERMINED that the establishment of the proposed
district as set forth in said Map, Plan and Report is hereby approved; that the improvements therein
mentioned be constructed by the Petitioner; and such district shall be known and designated as the
CHELSEA FARMS DRAINAGE DISTRICT, and shall be bounded and described as set forth in
BE IT FURTHER, ORDERED AND DETERMINED that the improvements for the said
drainage district be constructed by Chelsea Farms, LLC, owner of the premises described in Exhibit
A, wholly at its own expense, and it has agreed to convey such improvements without cost to the
Town of Wappinger on behalf of the CHELSEA FARMS DRAINAGE DISTRICT free and clear
of any liens or encumbrances; and
BE IT FURTHER ORDERED AND DETERMINED that once the drainage improvement as set
forth in the Map, Plan and Report have been constructed by the Petitioner and turned over to the
Town, the cost for maintaining the district shall be assessed, levied and collected from the several
lots and parcels of land within the said district in proportion as nearly may be to the benefit which
each lot or parcel of land in said district will derive therefrom, unless said costs shall be covered by
any maintenance bond; and
BE IT FURTHER ORDERED AND DETERMINED that the Town of Wappinger shall be
reimbursed by the Petitioner for any fees or expenses paid for the preparation of the Map, Plan and
Report or in the formation of this district from the escrow account established for such purpose;
and
BE IT FURTHER ORDERED that the Town Clerk be, and hereby is, authorized and directed to
file a certified copy of this Order in the office of the Clerk of the County of Dutchess, and another
certified copy in the Office of the State Comptroller, within ten days after the adoption of this
Order, pursuant to §195 of the Town Law.

VIII. Discussions
1. Obercreek Farms -Dutchess Land Conservancy- Alex Reese, Karin Roux
Alex Reese appeared before the board to explain his plan to keep as much as his land called
Obercreek open. Assistant Karin Roux explained that a proposed conservation easement that
will designate areas of the land that can be developed and used for various other operations
which will include a donation to the town. This will include the submission of an application for
a grant to get a portion of the development rights, usually 75%. There are a total of 144 acres
with 4 separate farms for various uses. The details are available on the town website video and
the handout is attached to the resolution. The timing is approximately 18 months. Easement
limits commercial use to forestry and agriculture.
RESOLUTION: 2021-112
Resolution In Support Of Application Of Farmland Protection Program Application Of
Dutchess Land Conservancy And Obercreek
WHEREAS, Obercreek Farm is located in the western portion of the Town of Wappinger at the
confluence of the Wappinger Creek and the Hudson River; and
WHEREAS, Obercreek Farm contains important farmland soils which can be seen in the highly
productive farm fields and critical natural resources; and

WHEREAS, the Reese Family controls Obercreek Farm through various legal entities and the Reese
Family desires to insure that Obercreek Farm remains as productive farmland and remind the
Wappinger Community of its agricultural heritage; and
WHEREAS, the preservation of Obercreek Farm as farmland is in harmony with the Town of
Wapping
WHEREAS, the Obercreek Entities have partnered with the Dutchess Land Conservancy to make
application to the New York State Department of Agriculture and Markets Farmland Protection
Implementation Grants Program for financial assistance to purchase the development rights for the
Obercreek Farm; and
WHEREAS, the Town Board of the Town of Wappinger fully supports the application for the
protection of Obercreek Farm as continuing viable farmland;
NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger does
hereby express its full support of the application of the Dutchess Land Conservancy and Obercreek
Farm to the New York State Department of Agriculture and Markets Farmland Protection
Implementation Grants Program and directs the Town Supervisor to draft and sign a letter of
support on behalf of the Town of Wappinger which shall be annexed to the application, together
with a copy of this resolution, and
BE IT FURTHER RESOLVED that this Resolution shall take effect immediately.

3. Application For A Change Of Zone-Buckley
Zoning administrator Roberti introduced a Text amendment to 169 and 165 Myers Corners Road
or Laerdal for a zone amendment to the COP zone to allow for indoor self-storage. This would
involve a text amendment to the COP zone. It simply adds the use to the COP zone. The
discussion was to get the feeling of the board. Councilman Beale and Bettina expressed their
support.
4. Parkland Trust Fees Derived from Developers of Apartments & Condos - Roberti
Started at 8:50
Zoning Administrator Roberti pointed out that developers of apartment project pay a fee to the
Parkland Trust of $5,000 per unit despite the number of bedrooms. A developer making a one
bedroom apartment would cost $5,000, creating a studio apartment would also cost $5,000.
Roberti suggested to facilitate the building of apartments, the board could create a scaled
approach to the fee to save developers money that they pay into the Parkland Trust. Attorney

Horan acknowledged and suggested the margins on some of the apartment complexes are razor
thin and could use the help.
5. Public Burning- Roberti
Started at 8:53
Zoning Administrator Roberti suggested adding to the code fire burning for consistency with the
DEC requirement that a fire be no larger than 4 feet in diameter and 3 feet in height. Proper
verbiage into the code can administer handouts that the fire inspector can handout.
6. Updates on Veterans Affairs

A discussion ensued that updated the board on Veteran's Affairs banners. A document was
handed out to the board, but Nothing Was Given to the Town Clerk for Recording in these
minutes.
7. Buildings & Grounds Update On Pending Park Projects(Rockingham, Spookhill, Robinson
Lane)-Casella/Frazier/Beale/Bettina/Phillips

Steve Frazier provided an update of Buildings and Grounds projects. The details are available on
the Town Video on the website.
Steve asked that $2,500 be transferred from the surplus sales to the expenditure line for the full
amount of the truck. The balance was just under $7,000.
A resolution will be prepared at the next meeting.
8. CPL Updates (Demolition,Highway Garage, Sgt. Palmateer Parking),Moot, Beale, Bettina,
Phillips, Casella

Engineer Moot remoted in to update various projects. He suggested 2 days to abate the asbestos
at Rockingham Park that should be complete by the end of this week. Spook Hill Park may
experience an 8% increase on the price of the playground equipment. He suggested to consider
another Spook Hill Park committee meeting.
The Highway Garage plan has been sitting idle for a year. He wants to break it into 2 phases.
9. Mesier Map Grant- Beale, Cavaccini

Beth Devine presented a copy of a map of the Town of Wappinger from 1800 with the hope that
the town can get a $5,000 grant for the original map to be preserved at the Mesier Homestead.
The issue arose that the town could not give money to a private organization. It was asked to be
put on the agenda for the September 13th meeting.

a parcel of real property located at 183-185 New Hackensack Road in the Town of Wappinger
designated as Tax Parcels 6158-02-
approval by the Town of Wappinger Planning Board on July 1, 2019; and
WHEREAS, the Applicant/Owner has completed some, but not all, of the work required
by the Site Plan Approval and wishes to receive a certificate of compliance for the site work that has
been completed and wishes to amended the prior site plan approval to remove the items which will
deferred to the future; and
WHEREAS, the Applicant/Owner has agreed to deliver to the Town a Cash Deposit in the
form of a Bank Check(s) in the amount of $10,000.00 as security to guarantee that the Owner will
pursue a site plan application to cure the necessary issues; and
WHEREAS, the terms of the Undertaking authorize the Town of Wappinger to draw
against the aforementioned Cash Deposit in the event the Applicant/Owner does not submit an
amended site plan;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby determines that
the Cash Deposit in the form of a Bank Check(s) in the amount of $10,00.00 is acceptable and
sufficient as a guarantee for the Applicant/Owner to fulfill its obligations as provided in the
Undertaking; and
BE IT FURTHER RESOLVED, that the Town Board hereby accepts the Cash Deposit in
the total sum of $10,00.00, as security for the faithful performance for the completion of the
obligations set forth in the Undertaking; and
BE IT FURTHER RESOLVED, that the Town Supervisor is directed to deposit the
aforementioned Cash Deposit in a bank account maintained by the Town, to be held in escrow until

Resolution Authorizing A Memorandum Of Agreement With Teamsters Union Local 445

WHEREAS, the Town of Wappinger needs to adjust the salaries of building inspectors under the
collective bargaining agreement to make the Town more competitive in the retention and hiring
of qualified employees; and
WHEREAS, the Collective Bargaining Unit representing the Building Inspectors is Teamsters
WHEREAS, the Town and the Union have negotiated a Memorandum of Agreement which sets
forth a revised compensation scheme for Building Inspectors, Deputy Building Inspectors and
other Code Certified Personnel within the bargaining unit; and
WHEREAS, the Union has agreed to the terms of the MOA; and
WHEREAS, the Town Board agrees that the MOA is appropriate and should be approved;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town of Wappinger hereby approves the MOA dated August 23, 2021 attached
hereto.
2. The Town Board hereby authorizes the Supervisor to execute the MOA on behalf of the
Town and to deliver signed agreements to the Union and to the Employee.
3. The Supervisor is directed to provide a copy of the MOA signed by all the parties to the
Town Clerk to maintain in his files with the other contracts with the Union.
4. This resolution shall take effect immediately and retroactive back to July 1st..

RESOLUTION: 2021-113
Resolution Authorizing The Execution Of The Agreement For Operation Of Carnival,
Rides, Concessions And Amusements For Town Of Wappinger Fall Festival
WHEREAS, the Town of Wappinger Recreation Department sponsors the Town of Wappinger
Fall Festival; and
WHEREAS, the Town Board previously authorized the use of Schlathaus Park for Town of
Wappinger Fall Festival; and
WHEREAS, the Town of Wappinger Fall Festival consists of a carnival which includes
rides, games and concessions; and
WHEREAS, the Town of Wappinger Recreation Department requested proposals from
various vendors for the operation of carnival rides, games and concessions; and
WHEREAS, proposals were received and reviewed by the Town of Wappinger
Recreation Department and it was determined that McDaniel Brothers, Inc. t/a McDaniel
Brothers Shows is the lowest responsible proposal and the most qualified with the necessary
skills and experiences to perform quality work as required by the Town; and
WHEREAS, the Town Board, in consultation with the Director of Recreation, finds that
it is in the best interests of the Town to enter into an Agreement with McDaniel Brothers, Inc. t/a
McDaniel Brothers Shows to provide for the operation of carnival rides, games and concessions;
and
WHEREAS, the Attorney to the Town, in consultation with the Director of Recreation,
has negotiated the terms of a proposed Agreement, a copy of which is attached hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board Members acknowledge they have reviewed the terms and
conditions of the proposed Agreement and find the terms contained therein reasonable and
acceptable.
2. The Town Board hereby authorizes the Town Supervisor to execute said
Agreement with McDaniel Brothers, Inc. t/a McDaniel Brothers Shows in accordance with the
terms and conditions contained therein, to provide carnival rides, games and concessions in
accordance with the Agreement.

3. Supervisor Richard L. Thurston is hereby authorized and directed to execute the
Agreement between the Town of Wappinger and McDaniel Brothers, Inc. t/a McDaniel Brothers
