IV. Supervisors Comments
Supervisor Thurston honored William Bill Dengler who recently passed away. He updated the
board on the current COVID statistics which will be posted on the website. Councilman Beale
updated the FEMA reimbursement from the recent storm related to hurricane "Ida". He
explained Public Assistance, Individual Assistance, and Small Business Assistance. Application
for assistance can be accomplished at the County website disaster portal on Dutchessny.gov.

Lastly, he updated the board with the recent bond rating for the town by Standard and Poors
which is AA+.

Phillip Grafertone, the owner of 169 Myers Corners Corners Road with 225,000 square feet
which has been vacant for 5 years. There has been a poor rental history. There was a 30-40%
occupancy until the last tennant moved out a few years ago . He is Seeking a text amendment to
allow a climate controlled indoor self storage.
Dan Polland appeared to discuss 29 Myers Corners Road to propose a text amendment to the
same resolution to allow single family usage of the property. He handed out a document to the
town board but gave nothing to the Town Clerk for filing in these minutes.

VI. Discussions
1. TR Welding - 1090 Route 376 Wappingers- Roberti
Tom Rashingkill is looking for a text amendment to the zoning to allow for a welding business
so that he can move his welding business to the "Castle" on Route 376 and Myers Corners Road.
Currently this type of business is not allowed at that location. This would also require an
amendment to the CC zone. This would be a fabrication type business and is only permitted in
COP and AI. The town code does not have a light industrial designation.
2. Motion To: Refund of the Square. Footage Charge for a Deck in the Amount of $147
Nothing was given to the Town Clerk at the time of publishing of these minutes.

VII. Resolutions
RESOLUTION: 2021-124
Zoning Code In The Conservation Commercial District And Conservation Office Park
WHEREAS, the Zoning Code of the Town of Wappinger has established the Conservation
-
residential districts that permit certain commercial uses in environmentally sensitive areas of the
Town; and
WHEREAS, the Conservation Commercial District has numerous existing single family
residences which are not a permitted use with the CC District except as non-conforming uses;
and
WHEREAS, permitting single family residences within the CC District will not substantially
change the nature of the district and the permitted uses in the CC District will not cause
substantial adverse impact to single family residences in the district; and
WHEREAS, general warehousing is permitted in the COP district so the addition of self-storage
warehousing is consistent with current uses permitted in the zone;
WHEREAS, the Town Board is considering the adoption of a Local Law to amend the Town
Zoning Code to permit single family residences with accessory uses in the CC District and self-
storage warehouses in the COP District; and
WHEREAS, the Town Board has determined that the proposed adoption of the aforementioned
Local Law is a Type I action pursuant to 6 NYCRR § 617.4 and it is the only agency having
approval jurisdiction over the action therefore it is established as the lead agency;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Town Board hereby introduces for adoption proposed Local Law #4 of the Year
CONSERVATION COMMERCIAL DISTRICT AND CONSERVATION OFFICE
2. That the Town Board hereby schedules a Public Hearing on the proposed adoption of
CODE IN THE CONSERVATION COMMERCIAL DISTRICT AND
Road, Wappingers Falls, New York on the 12th day of October, 2021, at 7:00 p.m., and
the Town Clerk is directed to post the Notice of the Public Hearing in the form annexed
hereto and to publish same in the Southern Dutchess News and Poughkeepsie Journal as
required by law
3. The Town Board hereby directs the Town Clerk to act as follows with respect to the
proposed Local Law:

a. To serve a copy of this resolution, the annexed proposed Local Law, the Full

Environmental Assessment Form and the public hearing notice to the Dutchess County
Department of Planning and Development for advisory review in accordance with
Section 239 of the New York State General Municipal Law; and

hearing notice to the Town of Wappinger Planning Board for its review and
recommendation prior to said public hearing.

WHEREAS, the Town CAP Assessor has prepared a Certificate of Base Percentages,
Current Percentages, Current Base Proportions and Certificate of Adjusted Base Proportions for
the 2022 Assessment Roll for submission to the New York State Office of Real Property
WHEREAS, the Town CAP Assessor has attested to the accuracy of the aforementioned
Certificate which has been prepared pursuant to RPTL Article 19 and shall be used for the levy
of taxes on the 2022 Assessment Roll, a copy of said Certificate is attached hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby accepts and adopts the base percentages, current
percentages and current base proportions as set forth in the Certificate, a copy of which is
attached hereto and has been provided to the Town Board in support of this Resolution.

WHEREAS, the Town Board annually establishes budgets for the financing of capital
improvements of all Special Improvement Districts and Special Improvement Areas within the
Town of Wappinger for the ensuing year, and as part of the budget process the Town Board
establishes Operation and Maintenance Charges (O&M Charges), Rates and/or Rents, to be
charged against those properties within said Special Improvement Districts or Special
Improvement Areas; and
WHEREAS, the Town Board will have completed the proposed budgets for the
financing of capital improvements for the proposed quarterly O&M Charges, Rates and Rents to
be charged against those properties within said Special Improvement Districts and Special
Improvements Areas for Fiscal Year 2022 no later than October 1, 2021; and

Proclamation of Columbus Day as Italian American Heritage Day in the Town of
Wappinger
WHEREAS, America has been continually renewed and enriched by the many different people
who choose to come here and become our fellow citizens; and
WHEREAS, each person brings a part of his or her own heritage, which over time becomes part
of our common heritage; and
WHEREAS, many generations of Italian Americans have helped make America the cultural
melting pot it is today; and
WHEREAS, there are over 17,757,310 or 6% Italian Americans in the United States; and
WHEREAS, Italian Americans have succeeded as successful and notable artists, Nobel Laureate
scientists, researchers, business leaders, human rights activists and community leaders; and
WHEREAS, Italian Americans are very proud of their roots and of their vital role in the
continued growth of our nation; and
WHEREAS, Italian American Heritage Day or Columbus Day observance provides an
opportunity for all Americans to learn more about the contributions of men and women from Italy have
made to our nation and to the world at large.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger does
citizens to recognize our Italian Americans and the many contributions they have had made to our

Resolution Appointing Deputy Building Inspector
WHEREAS, the Town of Wappinger has a need for a Deputy Building Inspector to assist in the
enforcement of the New York State Uniform Code; and
WHEREAS, the Dutchess County Department of Human Resources has established Job Class
Specifications for the Civil Service Position of Deputy Building Inspector; and
WHEREAS, the Dutchess County Department of Human Resources has given a competitive
examination and created and certified to the Town of Wappinger a current list of eligibles for the
Title of Deputy Building Inspector; and
WHEREAS, the Town has canvassed the certified eligible list for Deputy Building Inspector and no
candidate on the list would accept employment with the Town of Wappinger; and
WHEREAS, __________________________ has applied for the position and Human Resources
has determined that she meets the qualifications set forth in the job specification; and
WHEREAS, the position of Deputy Building Inspector is funded in the Fiscal Year 2021 Town
Budget; and
WHEREAS, the position of a Deputy Building Inspector is subject to the terms of the Collective
WHEREAS, the Town of Wappinger requires the services of a Deputy Building Inspector who is
certified as a New York State Code Enforcement Officer to conduct the business of the Building
Department;
NOW, THEREFORE, BE IT RESOLVED, as follows:

service job title Deputy Building Inspector for the Town of Wappinger, effective _______,
2021.
2. __________________________ is hereby appointed as a Code Enforcement Officer of the
Town of Wappinger in accordance with the provisions of §85-3 of the Town of Wappinger
Code.
3. __________________________ shall be compensated at the hourly rate of $27.47 per hour
which shall be paid weekly, in accordance with the CBA.
4. The appointment is subject to the approval of the Dutchess County Department of Human
Resources and is further subject to Civil Service Law and the Rules of New York State and
the Dutchess County Department of Human Resources.
5. The appointment of __________________________ is subject to his successful
Certification as a New York State Code Enforcement Official pursuant to 19 NYCRR Part
1208 within eighteen months of his date of appointment.

Court Assistance Program (JCAP) Grant
WHEREAS, the Town of Wappinger Justice Court is eligible for a grant from the State
of New York Unified Court System through the Justice Court Assistance Program; and
WHEREAS, Town of Wappinger Justices, Carl S. Wolfson and Heather L. Kitchen, and
Justice Court Chief Clerk, Kriss Thomas, have recommended an application for such grant be
made; and
WHEREAS, Town Justices, Carl S. Wolfson and Heather L. Kitchen, and Justice Court
Chief Clerk, Kriss Thomas have prepared an application to the Justice Court Assistance Program
Grant; and
WHEREAS, the application is required to be submitted to the New York State Office of
Court Administration by October 7, 2021; now, therefore
BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby authorizes
the Town of Wappinger Justice Court to apply for a Justice Court Assistance Program (JCAP)
Grant in the 2021-2022 grant cycle up to $30,000; and
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes said
application to be signed by Supervisor Richard L. Thurston as well as Town Justices Carl S.
Wolfson and Heather L. Kitchen, by and on behalf of the Town of Wappinger Justice Court, and

Resolution Introducing Proposed Local Law #4 Entitled
Conservation Commercial District And Conservation Office
WHEREAS, the Zoning Code of the Town of Wappinger has established the Conservation
Com-
residential districts that permit certain commercial uses in environmentally sensitive areas of the
Town; and
WHEREAS, the Conservation Commercial District has numerous existing single family
residences which are not a permitted use with the CC District except as non-conforming uses;
and
WHEREAS, permitting single family residences within the CC District will not substantially
change the nature of the district and the permitted uses in the CC District will not cause
substantial adverse impact to single family residences in the district; and
WHEREAS, general warehousing is permitted in the COP district so the addition of self-storage
warehousing is consistent with current uses permitted in the zone;
WHEREAS, the Town Board is considering the adoption of a Local Law to amend the Town
Zoning Code to permit single family residences with accessory uses in the CC District and self-
storage warehouses in the COP District; and
WHEREAS, the Town Board has determined that the proposed adoption of the aforementioned
Local Law is a Type I action pursuant to 6 NYCRR § 617.4 and it is the only agency having
approval jurisdiction over the action therefore it is established as the lead agency;
NOW, THEREFORE, BE IT RESOLVED:

Proposed Amendments
The proposed zoning amendments permit single family residences and their accessory uses in the
Conservation Commercial District and the addition of self-storage facilities as a specially permitted
use in the Conservation Office Park District.
Potential Impacts
The proposed amendments create no adverseenvironmental impacts.
The Conservation Commercial District has many existing single family residences and other
buildings that were constructed as single family residences and converted to commercial uses like
offices. Permitting single family residences within the district will not adversely impact the character
of the district and the adverse environmental impact of single family residences is less than that of the
other uses permitted in the CC District.
Commercial Warehouse Facilities are permitted in the Conservation Office Park District. Self-
storage warehouse facilities have less adverse environmental impacts than commercial warehouse
facilities and would not change the character of the zoning district.

Section -III: Numbering for Codification:
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions
of this Local Law shall be included in the Code of the Town of Wappinger; that the sections and
sub-sections of this Local Law may be re-numbered or re-lettered to accomplish such intention;
such rearranging of the numbering and editing shall not effect the validity of this Local Law or
the provisions of the Code effected thereby.
Section -IV: Separability:
The provisions of this Local Law are separable and if any provision, clause, sentence, subsection,
word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or
circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or
impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this local
law or their application to other persons or circumstances. It is hereby declared to be the legislative
intent of the Town Board of the Town of Wappinger that this Local Law would have been adopted if
such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or part had not
been included therein, and if such person or circumstance to which the Local Law or part thereof is
held inapplicable had been specifically exempt therefrom.
Section -V: Effective Date:
This Local Law shall become effective immediately upon filing with the Secretary of State as
provided by law Municipal Home Rule Law.

WHEREAS, the Town Board annually establishes budgets for the financing of capital
improvements of all Special Improvement Districts and Special Improvement Areas within the
Town of Wappinger for the ensuing year, and as part of the budget process the Town Board
establishes Operation and Maintenance Charges (O&M Charges), Rates and/or Rents, to be
charged against those properties within said Special Improvement Districts or Special
Improvement Areas; and
WHEREAS, the Town Board will have completed the proposed budgets for the
financing of capital improvements for the proposed quarterly O&M Charges, Rates and Rents to
be charged against those properties within said Special Improvement Districts and Special
Improvements Areas for Fiscal Year 2022 no later than October 1, 2021; and
WHEREAS, the Town Board, as required by Town Law, hereby schedules and orders a
Public Hearing to be held on October 25, 2021 for the purposes of hearing and considering any
objections which may be made to the aforementioned proposed budgets, and the proposed

WHEREAS, America has been continually renewed and enriched by the many different people

WHEREAS, many generations of Italian Americans have helped make America the cultural
melting pot it is today; and
WHEREAS, there are over 17,757,310 or 6% Italian Americans in the United States; and
WHEREAS, Italian Americans have succeeded as successful and notable artists, Nobel Laureate
scientists, researchers, business leaders, human rights activists and community leaders; and
WHEREAS, Italian Americans are very proud of their roots and of their vital role in the
continued growth of our nation; and
WHEREAS, Italian American Heritage Day or Columbus Day observance provides an
opportunity for all Americans to learn more about the contributions of men and women from Italy have
made to our nation and to the world at large.

enforcement of the New York State Uniform Code; and
WHEREAS, the Dutchess County Department of Human Resources has established Job Class
Specifications for the Civil Service Position of Deputy Building Inspector; and
WHEREAS, the Dutchess County Department of Human Resources has given a competitive
examination and created and certified to the Town of Wappinger a current list of eligibles for the
Title of Deputy Building Inspector; and
WHEREAS, the Town has canvassed the certified eligible list for Deputy Building Inspector and no
candidate on the list would accept employment with the Town of Wappinger; and
WHEREAS, __________________________ has applied for the position and Human Resources
has determined that she meets the qualifications set forth in the job specification; and

WHEREAS, the Town of Wappinger Justice Court is eligible for a grant from the State
of New York Unified Court System through the Justice Court Assistance Program; and
WHEREAS, Town of Wappinger Justices, Carl S. Wolfson and Heather L. Kitchen, and
Justice Court Chief Clerk, Kriss Thomas, have recommended an application for such grant be
made; and
WHEREAS, Town Justices, Carl S. Wolfson and Heather L. Kitchen, and Justice Court
Chief Clerk, Kriss Thomas have prepared an application to the Justice Court Assistance Program
Grant; and
WHEREAS, the application is required to be submitted to the New York State Office of
Court Administration by October 7, 2021; now, therefore
BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby authorizes
the Town of Wappinger Justice Court to apply for a Justice Court Assistance Program (JCAP)
Grant in the 2021-2022 grant cycle up to $30,000; and
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes said
application to be signed by Supervisor Richard L. Thurston as well as Town Justices Carl S.
Wolfson and Heather L. Kitchen, by and on behalf of the Town of Wappinger Justice Court, and
further authorizes Justice Court Chief Clerk Kriss Thomas to submit the application to the New
York State Office of Court Administration to comply with the October 7, 2021 submission date.
