Dear Lou.:
I have your recent letter and amusing the same to seek a
court order to force payment of the bond pending the appeal. I
would strongly recommend that the town defer for one month any
action on the road in view of the motion.
I would also note that an opinion of the state comptroller
exists which indicates that the town may not take any action
until payment on the bond is made (see enclosed) . At the same
time, we are working to obtain a quitclaim deed to the roads
as at the .present time, those roads . theoreti.call.y are still owned
by Serenity Missions, Inc.

RE: Roads in Serenity Missz'`on Development (Enclosed letter from Jane
Fredrickson)..
Gentlemen:
As you know we have attempted to resolve thru legal action with Bonding
Company the financial responsibility of completing these roads , due to
the fact the :responsible developer has vanished, bankrupt or whatever.
The past few years we . (the Town) have done emergency pot hole repairs
in an attempt to hold and preserve base. Last year (19.81) communications
with professionals at highway department agreed that completion of finish
coat must be instituted to hold the base. To delay another year the base
could be completely gone, increasing cost double, plus the fact yearly
plowing of highways by outside contractors continue to escalate.
Now that we are in the road construction season, I recommend the
Highway Superintendent provide necessary declaration of emergency and
the Town take steps to finance the project by borrowing and certainly
save the base, thereby saving Town dollars.
Cer,tai,nly., continuation of legal action to recoup money from developer' s
Bonding Agent should be pursued.

RE. Serenity Mission Roads - School Bus Service

1) Effective Wednesday, September 12, 1979, Mr. Paul Adams,
WC$D, advised me school bus service was put in operation.
2) On Tuesday, September 11, 1979, Mr. Horton and myself
inspected the condition of roads in Serenity Mission Development..
Observation confirms approximately 7 dangerous, pot holes, average
size 1 foot or more into the gravel base, plus at entrance
(center of road) the shut off water riser is approximately la inches
above initial road base and conditions show water riser being
damaged by traffic and at any time can create non-performance
of water.
On the basis of holes in highway, creating damage not only to
individual vehicles but emergency vehicles as well, this could
create a serious accident and inability of emergency services to
perform. Said holes in highway now present could create freezing
of lateral water lines in the dead of winter, creating a long
delay in putting water lines back in service.
it would appear to me this creates a serious problem and with
present conditions the town .must, through emergency condition, make
immediate necessary repairs. Please advise if it is within our legal
rights to correct the above conditions immediately.

RE: My enclosed letter to Mr. Adams of the WCSD
Dear Board Members:
Be advised that I have pledged to Mr. Adams and residents of
Serenity Mission Development that roads will be made safe, if
necessary by emergency action of the town this corning winter.
As you know, the sole authority to declare an emergency is
with Mr. Horton, Superintendent of Highways, and I am sure
he would agree to this action. In any event, to assure the
residents of the town's good faith, I urge a resolution to
pledge the good faith of the town in providing this necessary
service of safe entry and exit to their homes, subject to
conditions related to in my letter to Mr. Adams of the Wappinger
Central School Distract.
Again, I urge that a resolution for this action be introduced
at the September Town Board Meeting and confirmation of Highway
Superintendent to perform said services. I am well aware that
this emergency action must be declared by the Highway Superintendent,
but I am also aware that the Town and I must provide safety for
the residents and on this basis, I pledge the town to the school
and all concerned.

because town, has not accepted roads and there is no guarantee
that roads will be plowed and/or sanded for safety of school.

In the event that the roads will not be accepted (and it is very
possible} by winter, the Town of Wappinger will by emergency action
declare the roads unsafe for residents and the toitin will provide
the necessary services through the Town of i4appinger Highway
Superintendent and Department to provide safe travel conditions for.
residents, Fire Equipment, Ambulance and: School Bus service.
This action will then be back-charged to the responsible individuals
and any and all action necessary will be instituted to recoup town's
expenditures.
I hope this will immediately expedite school bus service to the
development to :include the entry to at least S/4 of the development
for pick--up of school children.
