Dutchess County, New York, shown on a map entitled "Lookout Point Subdivision"

Gray & Railing Engineers and Surveyors, P.C. and is dated March 28, 1985 and was
last revised on February 25, 1988, which map received final approval by the Town
of Wappinger Planning Board on August 12, 1985, and was filed in the Dutchess

a County Clerk's Office on May 17, 1988, as Filed Map No. 8389, and
WHEREAS, said Developer has elected to declare certain covenants and
restrictions with regard to Lot No. "1 " as shown on said map, and to impose the same
on the use thereof;
NOW, THEREFORE, said Developer does hereby establish the following
covenants, conditions, reservations and restrictions upon which and subject to which
Lot No_ "1 " shown on said map shall be improved and sold, said covenants and
restrictions being deemed for the benefit of the Town of Wappinger. They shall enure
to and bind the successors and assigns of the Developer and the owner(s) of said Lot

1 . There will be no placement of any buildings, structures, other
obstructions or plantings over two (2) feet high on that portion of Lot

of the Town of Wappinger Planning Board shall have been obtained.

structures or any other obstruction or plantings over two (2) feet high on

the above-described area and further agrees to maintain any plantings
thereon so that the same shall not be over two (2) feet high in height.
4. Each and every owner of said Lot No. "1 " further agrees that in the
event such owner or owners fail to comply with the aforesaid restriction,
the Town of Wappinger or its agents, is hereby authorized to enter upon
the above-described area for the purpose of trimming the plantings or
undertaking whatever steps may be necessary to see that the above
restriction is complied with and that the cost incurred thereby will be
chargeable by the Town of Wappinger against said Lot No. "1 " as in the
same manner as the collection of real property taxes.

5. The area described in Schedule "A" shall be cleared by the owner of the
lot prior to the issuance of any building permit.

r.ry lying and being in the Town of Wappinger, County of Dutchess and State of
New York, as shown. on Schedule "A" "attached hereto and made apart
hereof, including the. right, without obligation. to exercise such'
right, to discharge surface 'and' subsurface waiters onto and through
such property for. drainage purpo.ses and•,to,construct,. maintain,
and repair drainage improvements therein .and. the' right to carry,
transport, .install and maintain utility lines above or below
ground within the easement area.
it is understood that the developer will be 'const-ructing a drainage
improvement within the easement area.:. Until,- such time, as the work
is accepted by the Town, the developer is .fully responsible for
all maintenance and repairs and proper functioning of the drainage
easement and will indemnify and hold the Town of Wappinger harmless
for any claims, losses, damages or suits arising out of the
operation and use of said drainage easement prior to acceptance of
the work by the Town of .Wappinger.
The grantor shall neither block nor obstruct the easement premises
above or below grade and no trees or substantial- shrubs shall be
planted thereon..
THIS CONVEYANCE IS NOT SUBJECT TO THE LIEN OF A CREDIT LINE
MORTGAGE.
