Mandy Zhang appeared to explain her Student Climate Smart Project where they are creating a 6

1. Motion To: Open Public Portion
Matthew Notaro from 51 Theresa Blvd expressed his concern about putting that number of
homes in such a rural area. He doesn't know how it fits into the master plan.
John Gorman of 6 Thompson Terrace moved here to get away of city. He felt that these
apartment are not necessary. He cited the extreme traffic and the oversaturation of developments
and apartments.
Bernadette Bode from 12 Winfield Terrace, a 30-year resident, said these projects on this
property are not suited for this type of development. There are many hills and rocks with a very
steep grade. She was told that Winfield Terrace would not be an access road. She cited that the
property is R-40, so why throw away the master plan for the sake of this developer. She read
from the law citing the definition of spot zoning and declared this as spot zoning. She added that
once natural resouces are gone, they cannot come back.
Ralph Hafner of 334 Cedar Hill Road, a 61-year resident, opposed clear and cutting forests
which leads to floods. He warned, let's not make the same mistake twice.
Michael Tierney, from 10 Thompson Terrace, spoke on all the projects that are in front of the
town stating that they are impermiscible. He said that the 3 projects in the Cedar Hill area
should be lookded at together. He would like access to town water because the water is in that
area is diminished as more development has come in. He cited the traffic congestion is horrible.
Don from the Cedar Hill area has a well that is 980 feet deep. They are having problems with
water and there are bottlenecks on all surrounding roads.
Timothy Hunt from 113 Stonykill Road said, "Mr. O'Donnell always does the right thing. He's a
stand up guy.
Brad Cliff from wheeler hill road, supported Craig O'Donnel. He is a 5-year resident. He is
looking for a place for senior people to rent.
Dave Harrington from 66 Wenliss Terrace Supports projects.
Tracy from North River Road supports the projects.

Elizabeth Takacs from 110 Van Voorhis Terrace who lives in a 200-year old historical house
with a country setting, loves wildlife and is concerened about their habitat. She doesn't want
trees cut and the increased traffic. Their water is private and needs to be preserved.
Mr.Benehill of 224 Cedar Hill Road supports quality of life. He said this is a detriment to the
town and not something this town needs.
Steve Carinci, from 389 Cedar Hill Road, warned of the increase in salready too high school
taxes.
John Levett from Ketchamtown road supports the project.
Doug Laperche of 312 Old Hopewell Road who owns a Horse Farm does not support project and
will not subdivide or develop his property.
Louise Basso of 116 Van Voorhis Terrace whose property abuts proposed project does not want
people coming into her yard .
John Anderson talked about all the infrastructure needs being at risk The town cannot handle the
proposed 600 units that are planned. This will effect police, fire, school needs. He said our
quality of life is being threatened. The increased supply will eventually cause our house values
to drop.
Ann Marie Bybel from 53 Moccasin View Road cited the alreadt crowded schools particularly
the junior high. Eventually you will need a newer extremely expensive school. She said, that
you can't keep building all these units without new schools.
Ms.Tiernry from Cedar Hill Road was concerned about traffic and Quality of life.
Chris Morley of 276 Cedar Hill Road said the water table is only getting worse. Also traffic cut
through Cedar Hill Road at 55-65 miles per hour on 30 MPH roadis not good for the community.
Cut throughs are speeding and disregarding animals and pedestrians.
Joe Camilleri of Truffle Ridge Road is concerned about the increase in the largest component of
taxes, our school taxes.

VII. Discussions
1. Deer Ridge Conceptual Introduction
COMMENTS - Current Meeting:
Craig O'Donnel of 640 Wheeler Hill Road came to explain his 244 apartment complex project
near Pine Ridge Drive and Old Hopewell Road. He also requested inclusion into the Umited
Wappinger Water District (UWWD) and the United Wappinger Sewer District (UWSD) for the
R-40 property. He argued that the project will be bringing water and sewer to the property that
borders the Pine Ridge section making water and sewer more accessible to the that area by
bringing it up to the property lines. The estimate on taxes would be $5,000 per parcel per year
revenue split between school, county, and town taxes.. The project proposed which is similar a
Shaefe Road project would have no school children. The project would remain private,
indicating no plowing no highway maintenance, no variances. He claimed, if built the fees from
building would bring hundreds of thousands to the town and would make the necessary repairs to
the UWSD infrastructure at the Tri-Municipal plant. He also said, "The town has accepted the
water and sewer and the town has adequate water." If built as zoned the town would have 35
houses to take care of. He argued that, if built as is without the re-zone, the project would need
to submit to the Architectural Review Board, a duty passed onto the planning board in 2004. Mr.
O' Donnel said, "There will be No section 8 housing on this project". He would carve the
buildings into the property and scattered throughout the property and build fewer buildings. He
claimed that he spoke to Dutchess Department of Transportation who said the roads can handle it
and it will not have an impact. The project has abandoned the idea of an egress on Winfield
Terrace. The entries will be on Old Hopwell Road and Pine Ridge Drive. The County says they
are short of housing and county needs more rental units. He expressed the need of people who
cannot afford a house and the need for an apartment. He said that 350 new Public School
children from this project would not have an impact on the schools. He said renters would range
from 18-28 year olds estimated to live here and for retirees that do not want a house.
2. Chelsea Farms Subdivision Bond Acceptance
Barbara Roberti discussed the Chelsea River Road to accept the bond.
RESOLUTION: 2022-52
Resolution Accepting Undertaking Secured By Cash Deposit For Restoration In
Connection With Chelsea Farm, LLC
WHEREAS,
parcels of real property totaling 186.8 acres located on Chelsea Road and River Road North in the
Town of Wappinger designated as Tax Parcels 6056-01-138527 and 6056-01-190688 (the
of Wappinger Planning Board; and

WHEREAS, the Applicant/Owner has made a request, pursuant to § 217-28 of the Code
of the Town of Wappinger, to allow for limited tree clearing and grading on the Property, prior to
the signing of the Final Subdivision Plat in order to have the trees cut within the allowable season to
avoid impacts to Indiana Bats; and
WHEREAS, the Applicant/Owner has delivered to the Town a Cash Deposit in the form
of a Bank Check in the amount of $19,778 as security for the restoration of the property in the event
that Final Approval is not granted; and
WHEREAS, the terms of the Undertaking authorize the Town of Wappinger to draw
against the aforementioned Cash Deposit in the event the Applicant/Owner does not receive Final
Approval and the project site is not restored in accordance with the terms of the Undertaking.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby determines that
the Cash Deposit in the form of a Bank Check in the amount of $19,778 is acceptable and sufficient
as a guarantee to secure the obligation to restore the project site in the event the Applicant/Owner
does not fulfill its obligations as provided in the Undertaking; and
BE IT FURTHER RESOLVED, that the Town Board hereby accepts the Cash Deposit in
the total sum of $19,778, as security for the faithful performance for the completion of the
obligations set forth in the Undertaking; and
BE IT FURTHER RESOLVED, that the Town Supervisor is directed to deposit the
aforementioned Cash Deposit in a bank account maintained by the Town, to be held in escrow,
pending compliance with the terms of the Undertaking.

4. Code Changes Introduction Part II
COMMENTS - Current Meeting:
Barbara Roberti discussed the attached zoning changes. The board fine tuned some of the
suggestions.
5. Alpine Commons - Introductory Overview
COMMENTS - Current Meeting:
Malcom addressed the project as a text amendment to the Shopping Center District (SC) which
would allow residential. As previously presented, there are not 6 different sites as presented at
the January 24th meeting. There are now one lot. The previous document submitted as a rezone
was in error and would NOT rezone the properties to R-20 and HB as the original document as
displayed, it would allow residential in a Shopping Center zone to allow more uses to bring in

more opportunity to put the site to use. They spoke about having a conceptual plan to
accompany this text amendment. SC zones include supermarket, restaurants, salons, offices,
retail offices, auto services, etc... There is a proposal to make it RMF-5 from RMF-3 and allow
for 4-5 stories or 55 feet high and to revise the parking regulations for the property. They are
looking to have shared parking with the apartments. Diamond properties are working on a more
detailed conceptual site plan.

BE IT RESOLVED, that CPL Management be, and hereby is employed and retained for
professional engineering advice and services as may be required by the Town, its departments
and agencies, from time to time, during calendar year 2022; and
BE IT FURTHER RESOLVED, that CPL Management shall be paid in accordance
with the fee schedule set forth in the engagement letter submitted to the Town Board dated
December 31, 2021.
