Resolution Authorizing Revocable License For Community Garden
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on June 13, 2022.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll being called, the
following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by Casella.
WHEREAS, the Town of Wappinger owns 99.5 acres of real property located on Wheeler Hill Road in
the Town of Wappinger known as Carnwath Farms; and
WHEREAS, Agriculture and Markets Law §31-i permits the use of vacant Town property for community
gardens; and
WHEREAS, a portion of the Carnwath Farms was fenced for the creation of a Community Garden but has
since remained untended; and
WHEREAS, Brian and Courtney Kolb are experienced gardeners and wish to cultivate the Community
Garden, improve the soils and make it suitable for the establishment of a Community Garden where plots can be
made available to interested members of the public; and
WHEREAS, the Town Board believes that it is appropriate to grant a revocable license at this time so that
productive use of the garden can be made in the 2022 growing season; and
WHEREAS, in the future the Kolbs shall submit a future plan for the operation of a community garden
for approval by the Town Board;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby authorizes the Kolbs to use the community garden property in accordance with the
terms of the license agreement annexed hereto.
2. This resolution and the license agreement may be modified by further resolution of the Town Board.
The foregoing was put to a vote which resulted as follows:
