Town Car Replacement- Thurston Supervisor Thurston spoke about replacing a car primarily used by the Assessor department's data collector. The board asked Steve Frazier to look for a vehicle. No documents were given to the Town Clerk for recording in these minutes. 4. Mental Health Awareness Month -Renee Tancin Renee Tancin came to Town Hall to speak on Mental Health awareness month. She handed out documents to the board, but gave nothing to the Town Clerk for recording in these minutes. Her organization has various classes for individuals who are living with mental health conditions. They go into schools to help students deal with issues with mental health. In addition, they have a program for Veterans. They participate with crisis intervention with partnership with police officers. She expressed a need for Mental Health housing and encouraged the board to consider such development. Councilwoman Bettina recommended reaching out to the county as well. She recommended the empty facility at the Downstate Medical Center. RESOLUTION: 2022-99 Resolution Declaring May "Mental Health Month" In The Town Of Wappinger Town of Wappinger Page 4 Printed 511912022 Regular Meeting Minutes May 9, 2022 WHEREAS, mental illness is a medical condition that disrupts a person's thinking, feeling, mood, ability to relate to others, and daily functioning; WHEREAS, regardless of race, nationality, age, religion, or economic status, mental illness impacts at least one in four adults and one in five young folks aged 13-18 and one in seventeen people live with serious and chronic mental health condition such as schizophrenia, bipolar disorder; and major depression; and WHEREAS, an estimated 22 veterans die by suicide each day; and WHEREAS, all Americans experience times of difficulty and stress in their lives, and mental illnesses often result in diminished capacity for coping with the ordinary demands of life; and WHEREAS, medical and other treatments through medical action and counseling is an effective way to reduce the burden of mental health illnesses (90% of all mental illness is treatable); and WHEREAS, there is strong research that animal companionship, humor, spirituality, religion, recreation, social connections, and work-life balance can help all Americans protect their health and well-being; and WHEREAS, each business, school, government agency, healthcare provider, organization, and resident shares the burden of mental health problems and has a responsibility to promote mental wellness and support prevention efforts; and WHEREAS, it is time to take action for individuals and families living with mental health conditions and to provide support and educate our peers and to DO OUR PART; THEREFORE, the Town of Wappinger hereby proclaims May 2020 as Mental Health Month and calls upon the citizens, government agencies, public and private institutions, businesses, and schools in Wappinger to recommit our community to increasing awareness and understanding of mental health, the steps our citizens can take to protect their mental health, and the need for appropriate and accessible services for all people with mental health conditions. RESOLUTION: 2022-101 Resolution Approving Compromise And Settlement Of Claim Against Town For Damages From Water Main Break WHEREAS, Jeremy and Rose Tullo are the owners of 10 Gabriella Road in the Town of Wappinger; and WHEREAS, on April 24, 2021, a water main owned and operated by the United Wappinger Water District located within Gabriella Road broke cause flooding into the Tullos's home which resulted in damages to the home; and WHEREAS, on June 21, 2021, the Tullo submitted a notice of claim to the Town requesting that they be compensated for damages to their home that was not covered by their homeowners insurance by reason of their deductible; and WHEREAS, the operator of the United Wappinger Water District and the Town Attorney have investigated the claim and recommend that the claim be settled and compromised in exchange for a general release from the Tullos; NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes a payment of $4,427.82 from the funds of the United Wappinger Water District to Jeremy and Rose Tullo to satisfy all outstanding claims in exchange for an executed general release from the Tullos; and BE IT FURTHER RESOLVED that the Supervisor and the Attorney to the Town are authorized to sign and prepare any necessary documents including general releases which are necessary to effectuate the purposes of this resolution. The properties would need to be rezoned or make it an allowable use. The zoning is different among the surrounding parcels. Councilman Beale supports the application along with Supervisor Thurston who cited similar uses in Japan. Councilman Beale suggested recommending it to the planning board. If it were rezoned to Office park, then it would require the least amount of SEQRA review. Sam said there is no expectation to replace the panels. Councilman Casella asked where else is this done. Sam said that they have done solar farms but this a new venture with regard to doing with agriculture. Councilman Casella asked about the destruction of the view shed along Myers Corners road. N N In the residential zoning districts, the outdoor storage of lawn-mowing and yard equipment, tractors, materials, debris, garbage and refuse, whether contained or not, is prohibited 4 between the dwelling and any street line, except that garbage and refuse if properly contained in authorized private receptacles pursuant to §§ 210-12 and 210-14C of this Code are permitted along the street line, but only on days in which such garbage and refuse is E collected, twenty four (24) hours prior to that day, and twenty four (24) hours after that day. Exempt from this prohibition are seasonal decorations, lawn ornaments, picnic/patio/lawn U tables and chairs, and customary lawn games. The intent and purpose of this section is to provide standards for outdoor lighting in order to maintain and protect the scenic and aesthetic character of ti the Town; to encourage conservation of energy while providing safety, utility and security; to minimize glare; to avoid impacts on and to protect the privacy of nearby residences; to reduce atmospheric light pollution; to ensure that development fits into its surroundings rather than being superimposed upon the existing environment; and N to enhance the Town's nighttime ambience and character. The following standards shall apply to all of the zoning districts in the Town. U B. All exterior lighting. All exterior lighting in connection with all buildings, signs or other uses shall be directed away from adjoining streets and properties, and shall have such shielding as will prevent unreasonable or objectionable glare observable from a such streets or properties. All fixtures shall be downlit, full cut-off, and dark-sky compliant as identified and updated by the International Dark-sky Association. J 7E U 0 C. ATM lighting. Unless accessory to a bank, all ATM banking machines shall be installed indoors so that the New York State ATM Safety Act design requirements 0 shall not be applicable. The Planning Board remains responsible for ensuring that a outdoor ATM banking machines accessory to a bank do not cause glare or other T_ unwanted light spillage affecting residential areas and uses. o N D. Hours of lighting. Hours of lighting may be limited by the Planning Board in acting on CO W any site development plan. All nonessential lighting shall be turned off after business hours, leaving only the necessary lighting for site security, which shall be reduced to E the minimum level necessary. "Nonessential lighting" applies to display, aesthetic, parking and sign lighting. Motion-sensor security lighting may be used to promote safety and reduce the amount of night lighting in the Town, as determined by the N Planning Board. It4 E. Intensity of lighting. No use shall produce glare so as to cause illumination beyond � the property on which it is located in excess of 0.0 footcandles or lumens at the C property line. Parking lots shall have an average lighting level at or below one E footcandle. High-security areas shall have lighting levels of no more than five footcandles, and two to five footcandles is the suitable range. Footcandle levels U greater that 5.0 are considered excessive and shall be avoided. N F. Pole heights. A photometric lighting plan shall be provided for all - proposed lighting or for the retro-fitting of existing light fixtures with Light Emitting o Diode (LED)fixtures. The photometric plan shall provide specifications for all lighting y proposed. The color temperature of all LED lighting shall be 3,000 Kelvin (K) or less. The lighting specifications shall also include Backlight, Uplight and Glare (BUG) ratings for all proposed fixtures. ti N H. Adjustment of lighting levels. The Planning Board may require that dimmers be installed on a site's lighting, in which case the Zoning Administrator shall have ongoing jurisdiction over the site's lighting and the authority to require that the N property's owner or operator lessen the illumination of the site if the Zoning Q Administrator finds that the site is not in compliance with its approved site plan and/or is otherwise inconsistent with the intent, purposes or other standards of this section. L, I. Gas stations. The standards contained in this section shall apply to all uses in the 4) Town, including gas stations. In approving a lighting plan for a gas station, the a Planning Board shall take into account the context of the gas station and its relationship to all residential development which has a view of the gas station in order J to reasonably minimize adverse visual impact of the gas station on said residential o development. The Planning Board shall also consider the context of the surrounding Q land uses and the anticipated future surrounding land uses when determining the 0 appropriate lighting level of the gas station. Island canopy ceiling fixtures shall be a recessed into the canopy ceiling so that the bottom of the fixture is flush with the T- ceiling. Every person who is an owner, lessee or T- occupant of any residence, building, premises or place of business within the Town N CD shall provide or cause to be provided and at all times keep suitable and sufficient N authorized private receptacles for receiving and containing garbage or refuse that W may accumulate or be used upon said premises. No such receptacle shall be kept near any public place, including roadways, longer than may be necessary for the E removal of the contents thereof. Within the same day that receptacles have been emptied by the carter, including twenty four (24) hours prior to the day of collection and twenty four (24) hours after the day of collection, they shall be relocated and N stored no closer than 20 feet from the front lot line or edge of roadway pavement. All It- receptacles used for the reception of garbage or refuse shall be provided with proper 4 covers, and such receptacles shall at all times be securely closed and watertight. C 0 2. We previously provided ;n comments on this proposed law in a letter dated December 7, 2021.The law has since been revised, especially Q regarding electric vehicle charging stations. _ U COMMENTS = We find the revised EV charging station section to be confusingly worded. If we understand correctly, E applicants who wish to install charging stations will be required to add an additional 10%to their off-street Q parking requirement.They would be required to install conduit at the time of parking lot construction, banking J the additional spaces if they intend to actually install the stations later (which would preclude them from using that space for anything else). If we are correct in our interpretation this provision would serve to discourage o charging stations by substantially increasing the applicant's parking burden.The provision also seems to J 0. indicate that the applicant would be required to lay conduit under the Iandbanked area, even though that area 0 would presumably remain undeveloped. Finally, as we noted in our last letter, the signage requirement should Q specify that signage is only required once charging stations are actually installed. We recognize and appreciate that members of the Board have concerns about governmental overreach with N EV charging station-related requirements. We support local laws that require or encourage laying the N groundwork for future installation of these stations, particularly in multifamily housing developments, for two W basic reasons: W 0 - Avoiding disruption down the line. Charging stations are not a priority for many developers right now, o It- who don't see a lot of immediate demand. In 10 years,though, demand is likely to be much higher, N N and it may become necessary to add them.That can be an expensive and disruptive process when the N parking lot is already there, since it may involve trenching, resurfacing, etc. We believe it is in the best interests of our residents that local governments, who generally take a longer view than developers, head off those future headaches by encouraging conduit to be laid during parking lot construction. We are not insistent that the actual stations be installed right away(stations are relatively expensive to install, but conduit is not). We simply believe that it is good planning to lay the groundwork now for Q future installation. - Equal access. As EVs become more popular, it will be straightforward for single-family homeowners to install chargers in their garages. Not so for residents in condos or apartments. RECOMMENDATION J 0 The Department recommends that the board condition approval of the law on removal of the 10% increase in o the required parking minimum for developers that wish to install charging stations. It o resulted in a 3-inch flood throughout our downstairs living space which includes our bathroom and our E garage. additionally, our entire property including our lawn, our garden, and our driveway became victim to v 0 the water's destruction.Camo Pollution, the Police Department and the Fire [department were called = immediately after noticing the major problem and needed an hour and a half to completely shut off the ° Q water valves in the neighborhood. 8y that time, the flood had already done its damage. With the help of Q neighbors, including Wappingers Councilman Al Casella, hours were spent cleaning, removing the o unwanted water and in attempting to dry out our house. State Farm, our insurance company, was also N called and they recommended us to use Servpro on Monday, April 2 to fully clean out the damaged items N and to prevent the spread of mold. The Servpro team needed to immediately demolish and take away all of w our finished flooring and remove our radiators. They also needed to cut out the lower two feet of all of our first floor walls. On Tuesday, April 27t"`, they came back to finish the demolition and to install 30 industrial ` fans that were supposed to be in our house until Saturday. However, by the end of the day on Tuesday, the N main water pipe broke again within feet of the previously repaired pipe of days earlier and the nightmare was relived. We had to clean up all of the water once again and ServPro needed to return to address the E same flooding issues both inside and outside of the house. Clean up and construction has pushed our L family into living upstairs for nearly 3 months and our day to day lives have been immeasurably disrupted. a� We received $15,134.18 from our insurance company for the indoor reparations but after subtracting our deductible which was $2,781.00, we received a total of$12,353.18 to reestablish our downstairs. 0 Cour entrusted contractor completed' the job to our satisfaction with a total cost of$19,780. � m As of today, we have paid our contractor $16,500, which included the $12,353.18 that was received from �° State Farm. The remaining balance came from out of our own pocket. Subtracting the $12,353.18 from our Contractor's bill has left a difference of$7,426.82. State farm has given us $6,250 to have a company begin the job and they will N give us another$6,250 after the work has been fully completed. However, the two estimates that we were given came to a total of$14,000 to complete the job, so we ask for this $1,500 difference as well. Q E Our contractor and his crew did terrific work getting our house repaired by the damage caused by v the o separate floodings.As we were not responsible for this destructive setback,we believe that we p should not have to pay any money out of pocket. The 2 flood incidents wracked havoc to our family's day a to day functioning, and we look forward to putting the last 3 stressful months behind us.
