V. Community Interest Presentation
1. Report to the Town -Dutchess County Sheriffs Department
Sargent Neil Stuart, & John Watterson presented some of the challenges of the Wappinger
Patrol. They mainly deal with patrolling traffic. They write 1,500 to 2,000 tickets per year and
many more traffic stops. The DC Sheriffs office spends approximately 4 hours per day or 56
hours per week in town of Wappinger for vandalism, traffic, and other complaints. The Dutchess
County Sheriff's office agrees that the amount of patrol time in Wappinger should be increase it
to two or three patrols per week especially in the springtime. Councilman Bettina requested
police reports to be sent to the town board because they are currently only going to Fredrick &
Supervisor. The town currently has $257,000 budgeted for police patrol.
2. Question and Answer Period
A resident from 2498 Route.91) addressed unsafe drivers speeding by Reese Park and along 9D.
Supervisor Thurston is interested in creating a Transit District Committee to help with the
speeding vehicles throughout our town including electronic mobile units.

Resolution Introducing Local Law Of 2022 Which Would Amend Chapter 240, Zoning, Of
The Town Code With Respect To The Shopping Center District And Large-Scale Mixed-
Use
Public Hearing Opened by Casella and seconded by Bettina
Resident Marcy Wagman appeared and said that this change in the shopping center zone is pre-
mature. She felt that more time is needed to fully understand the details the plan. She said that
we deserve to have a better understanding of the details, the implications, and the trade-offs. She
said to go from an initial discussion to code changes with no intervening details and the ability to
hear what the board thinks and what the experts think are needed for the public to participate in a
public hearing. Presented with complex legal language without any of the background is not fair
to the residents and misuses the public hearing process. As an example, she expressed that the

code is changed to accommodate a class of citizens, i.e. veterans, for having access to housing.
She asked if they wanted to be segregated from anyone else. Is it for single veterans, married,
veterans with special needs, can they sub-lease, what happens when someone leaves and the
house is put up for re-sale. She asked for more details on the process and to think through all the
details before asking the public to respond so prematurely.
Resident Alex Reese appeared to express the fact that all the amenities are already at these malls
facilitating the building of these units. He agreed to exercise caution in the design and not allow
these malls to go 'darker'.
The board agreed to extend the public hearing until the next meeting to June 13.
Councilman Casella asked for more detail from the applicant before these zones are changed.
Neil Alexander representing Diamond and Dakota Properties appeared. He re-iterated that the
large scale mixed use or 144 units of multi-family housing is the driver that will help everything
more forward. He said, "A lot of this is about getting activity there so that BJs stays." He said
that the empty portion of the mall where Tops was, including parking, referred to as Parcel 2;
and, the unused additional parking lot referred to as parcel 4 cannot be ear-marked for anything
until the 144 large scale multifamily apartments are in place so that potential applicants can be
attracted to that location. He said, "We have had people come forward for uses for the A.C.
Moore and the former supermarket, that we know you are not keen on but they meet the zoning
code and we don't want to come forward with that." He the pointed out that his client is stuck
with having uses that are allowed that town is not exited to see and is looking for occupants that
are here to stay. Councilman Casella asked about the original plan to have a glorified village like
Eastdale in Poughkeepsie. He said that Eastdale is unique and that nobody wants to wait 10
years like it took with Eastdale. He said that a restaurant could go in the additional parking lot
area referred to as parcel 4, or a hotel or some other kind of housing in what is now a wooded
area west of parcel 4.referred to as parcel 6. The vacant mall at parcel 2 is the grand plan where
he wants to activate the frontages. Councilman Beale said that we have investors that have a
model that is going to be phased in with housing that is a solution to feeding the parcel. He said
that the parking lot at BJs is falling apartment. Mr. Alexander said that the change in zone is
allowing him to diversify. Councilwoman Bettina asked about our statistics is with regard to
rentals. She asked the attorney and the planner for the data on the number of apartments in the
town. She said the town of Wappinger has more apartments, condominiums, rental units than
other towns in the county. She cited that many people are moving out of the town and state
because they cannot afford to live here. Supervisor Thurston pointed out that if we chase these
people out, BJs could shut down and we would lose a huge ratable. Councilman Beale said that
we need to re-think these zones. He said that the backyard concept of a mall does not work
because nobody can see these locations. Neil Alexander said that there was not a lot of
capitulation with the town. He said we were knocked down on many aspects. He said we
originally wanted five stories on the vacant mall once occupied by Tops, but were knocked
down. He said we are open to dialogue and has a lot of dialogue.

WHEREAS, the Supervisor of Buildings has advised that the Generator at Town Hall requires
repair; and
WHEREAS, the Supervisor of Buildings and Grounds has obtained a quote from Power Generator
to make the necessary repairs; and
WHEREAS,in sufficient funds are in budget line A.1620.453 HVAC Maintenance and a budget
transfer is required for the necessary repair;
WHEREAS, the Supervisor of Buildings and Grounds has reviewed the contract and agrees that it is
appropriate for the Town to enter into a contract as outlined in the quote;
NOW,THEREFORE, BE IT RESOLVED, that:
1. The Town Board hereby authorizes a contract with Power Generator in the amount of
in accordance with the terms of the proposal attached hereto and directs
the Supervisor to execute the contract documents on behalf of the Town of Wappinger; and
2. The Town Board hereby authorizes a budget transfer from A Fund balance to A.1620.453
HVAC Maintenance in the amount of for the repair.
3. Payment for the repairs shall be made on vouchers duly submitted and approved.

Resolution Authorizing Purchase Of Red Bud Trees For Town Hall
WHEREAS,the Town Board is desirous of beautifying the grounds at Town Hall by
planting some Red Bud Trees; and
WHEREAS, a proposal was received by Lehigh Lawn & Landscaping, Inc. for the
purchase and planting of five (5) Red Bud Trees; and
WHEREAS,the Town Board has agreed that it is in the best interest of the Town to
enter into a contract with Lehigh Lawn & Landscaping, Inc. for the purchase and planting of five
(5)Red Bud Trees; and
WHEREAS, in order to cover the cost of the trees, it will be necessary to transfer funds
between budget lines.
NOW, THEREFORE, BE IT RESOLVED,that the Supervisor is hereby authorized to
enter into a contract with Lehigh Lawn & Landscaping, Inc. for the purchase and planting of five

Resolution Authorizing Revocable License For Community Garden
WHEREAS, the Town of Wappinger owns 99.5 acres of real property located on Wheeler
Hill Road in the Town of Wappinger known as Carnwath Farms; and
WHEREAS, Agriculture and Markets Law §31-1 permits the use of vacant Town property
for community gardens; and
WHEREAS, a portion of the Carnwath Farms was fenced for the creation of a Community
Garden but has since remained untended; and
WHEREAS, Brian and Courtney Kolb are experienced gardeners and wish to cultivate the
Community Garden,improve the soils and make it suitable for the establishment of a Community
Garden where plots can be made available to interested members of the public; and
WHEREAS, the Town Board believes that it is appropriate to grant a revocable license at
this time so that productive use of the garden can be made in the 2022 growing season; and
WHEREAS, in the future the Kolbs shall submit a future plan for the operation of a
community garden for approval by the Town Board;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby authorizes the Kolbs to use the community garden property in
accordance with the terms of the license agreement annexed hereto.
2. This resolution and the license agreement may be modified by further resolution of the
Town Board.

A discussion on codifying the rules of the Recyclecenter took place. The details are available on

WHEREAS, the Town Board wishes to clarify the regulations obtaining a permit for the Recycle
[enter;
NOW THEREFORE BE IT RESOLVED, that a Permit for use of the Recycle Center may only be
issued to a resident of the Town of Wappinger who provides satisfactory proof of such
residency such proof being a valid New York State driver's license issued to said individual
having a mailing address in the Town of Wappinger, that is not a PO Box. If the driver's license
has a PO Box as an address, additional proof of residency such as a current tax bill or utility bill
showing the named individual will besufficient proof ofresidency; and
BE IT FURTHER RESOLVED, that business entities such as corporations or limited liability
companies are not considered to be residents eligible to use the Recycle Center; and
BE IT FURTHER RESOLVED that such regulation shall take effect immediately.

WHEREAS, the Town of Wappinger owns 99.5 acres of real property located on Wheeler
Hill Road in the Town of Wappinger known as Carnwath Farms; and
WHEREAS, Agriculture and Markets Law §31-1 permits the use of vacant Town property
for community gardens; and
WHEREAS, a portion of the Carnwath Farms was fenced for the creation of a Community
Garden but has since remained untended; and
WHEREAS, Brian and Courtney Kolb are experienced gardeners and wish to cultivate the
Community Garden,improve the soils and make it suitable for the establishment of a Community
Garden where plots can be made available to interested members of the public; and
WHEREAS, the Town Board believes that it is appropriate to grant a revocable license at
this time so that productive use of the garden can be made in the 2022 growing season; and
WHEREAS, in the future the Kolbs shall submit a future plan for the operation of a
community garden for approval by the Town Board;
NOW,THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby authorizes the Kolbs to use the community garden property in
accordance with the terms of the license agreement annexed hereto.
2. This resolution and the license agreement may be modified by further resolution of the

6. The Board shall recognize that the map and plans have been prepared by
