Sports Museum of Dutchess County - Bill and Barb Ponte Bill Ponte, introduced Joey Cavaccini who spoke about the history of the Sport's Museum. He cited that there were over 1,000 visitors this year. He added there has been challenges due to the pipe burst in 2014. In 2020 he applied for $100,000 grant and a MIG grant for $50,000. He requesting a budget line for specialty funding to preserve history &requesting authorization to use the funds from these county grants that require no match. V. Public Portion on VI, and VII Only 1. Motion To: Open Public Portion Brian Logan approached the board on behalf of the school district,to speak on Parks & Recreation, but the Supervisor tabled it. John Gorman appeared to speak on the Deer Ridge proposal and was concerned with traffic, and unnecessary development. Matthew Natoro - suggested that the town is developing too many more homes. Don Manardo - warned of higher taxes, higher water bills, with all the new proposed development. Terri Bertolino - a 49 year resident repeated this will bring too much development; and traffic. Loise Basso - was concerned with all the proposed development and traffic. John Tolliver - was concerned with this proposed development; that there is no recreation planned; and would add too much traffic. Barry Kaufman - a 52 year resident was concerned with the environmental aspect if all the development is approved. He cited traffic, taxes, and new people. Bernadette Boddy - Suggested that development would take away all the benefits that Wappinger claims to offer and was concerned about her existing well. Joseph Cavaccini - Reminded the board that their role includes responsibility to be looking out for the residents best interest that live here and not those that don't. And, to protect their most treasured asset, the value of their home. Over supply does not protect the value of our homes. He also suggested that contrary to the County planning survey that Wappinger has 40% of total residential as apartments. He pointed out that the study only counted those apartments that responded to a survey. When he brought up the point that approving a zone change without a plan in place, is the very definition of'Spot-Zoning', he was cut off as running pat his allotted 3 minutes. Kevin O'Brien- Asked for our residential area to stay as a residential area. Mr. Rumble - a 50 year resident, was concerned with the fact that given that we have zoning rules, why are they being broken? Ricky Dixon - concerned with kids in school that don't have room for more. Lynette Mouer - A resident since 1964, was concerned with wildlife &voiced how so much has been lost already. Motion To: Approval of Chris Mauer's Eagle Scout Project to add a split rail fence at Camwath. Joey Cavaccini spoke for Chris Mauer. Deer Ridge Proposal- Thurston, O'Donnell Craig O' Donnald spoke of all the benefits that this project would offer. He pointed out that he would bring water closer. He added that the schools could handle it. Attorney for Deer Ridge Neil Alexander addressed the board to say that once the rezone takes place and to be included in the water and sewer district; then they will make an application that would have all the studies. He said that he cannot get there without the board approval first. He cited the zoning map that the less than 3% of the land is zoned multi-family which is our Xenophobia and our'False Claims Act'. 3. Water and Sewer Districts and Improvement Areas Mike Tremper handed out a report to the town board, but not to the town clerk for recording in these minutes. He cited that Inflation rates up 8-9 percent. Predicting prices are difficult, especially with Central Hudson. He added that Wappinger has 14 pump stations over 50 years old, with an infrastructures over 50 years old. He is looking at an estimate of$110,000 this year. He added that 3 pump stations very old and needs to get them off line. The proposed budget is to maintain existing infrastructure that we currently have; which includes Baldwin Dr., Old Myers Corners Rd. ($250,000), & Fieldstone Farms (a little more than $250,000)which needs to be addressed. Fleetwood sewer district has a 5% increase. There is currently not enough fund balance to maintain infrastructures. Councilman Beale mentioned that the use of COVID money needs to be discussed, as this could be a possible solution. Councilman suggested a generator(approximately $50,000)to run wells. Mike Tremper said due to time constraints, it would take too long to get one. Mike discussed all the budget increases in each area&why they are needed, as they need to continue to maintain efficiency for the wells including the cost of filters, etc. which have all increased in price. 4. RESOLUTION: 2022-146 Resolution Appointing Recreation Assistant WHEREAS, the position of Recreation Assistant is established on the Civil Service Roster for the Town of Wappinger; and WHEREAS, the Recreation Assistant job tittle is in the Labor Class under the Civil Service Rules of Dutchess County Human Resources with no minimum qualifications; and WHEREAS, the position of Recreation Assistant is within the bargaining unit covered by the Collective Bargaining Agreement between the Town of Wappinger and Teamsters Local 445 ("CBA"); and WHEREAS, the incumbent Recreation Assistant moved to a different position in the Recreation Department; and WHEREAS, the intention to fill the vacancy has been posted in accordance with the CBA; NOW, THEREFORE, BE IT RESOLVED, as follows: 1. RESOLUTION: 2022-149 Resolution Authorizing Entering Into An Order On Consent In Connection With Mid- Point Park Sewer Plant WHEREAS,the Town of Wappinger owns and operates the Mid-Point Park Sewer Plant; and WHEREAS, Mid-Point Park waste water treatment plant treats sewage by a conventional activated sludge process with secondary sedimentation, followed by sand filtration and chlorine disinfection designed to treat an average daily flow of 0.066 mgd; and WHEREAS, the New York State Department of Environmental Conservation (hereinafter "NYS DEC"), has reduced the permitted limits for certain discharges for wastewater treatment facilities which will necessitate the replacement of the Mid-Point Park Sewer Plant; and WHEREAS, the New York State Department of Environmental Conservation (hereinafter "NYS DEC"), issued a Notice of Violation dated August 21, 2019 and determined that the sewer treatment plant exceeded permitted effluent limits 15 times over between 2017 and 2019; and WHEREAS, negotiations ensued between NYS DEC and the Engineers to the Town and the Attorney to the Town to establish a schedule for compliance to remediate the violation; and WHEREAS, the Town of Wappinger has received an Engineering Planning Grant to investigate alternatives to cure the violations and design a replacement for the existing Mid-Point Park Sewer Plant; and WHEREAS, NYS DEC has submitted an Order on Consent which will require the Town to develop a replacement design and complete construction by December 31, 2027; and WHEREAS, pursuant to the Order on Consent, the Town shall be liable to pay a civil penalty in the amount of$25,200.00; and WHEREAS, pursuant to the Order on Consent, $6,000.00 will be payable to NYS DEC upon execution of the Order on Consent with the remaining balance of $19,200.00 being suspended provided that the Town strictly adheres to the terms and conditions of the Order on Consent; and WHEREAS, by compliance with the Order on Consent, the Town would satisfy the violations that are alleged by NYS DEC and the suspended penalty would be waived; and WHEREAS,the Town Board Members have each read the Order on Consent and they collectively concur with the terms and conditions set forth therein, and further determine that it is in the best interest of the Town, especially the residents of the Royal Ridge development, to enter into and be bound by the Order on Consent. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Members of the Town Board of the Town of Wappinger hereby each acknowledge that he or she has read and approves the terms and conditions set forth in the Order on Consent annexed hereto. 2. The Town Board of the Town of Wappinger hereby authorizes and consents to the payment of the civil penalty in the amount of$6,000.00 as set forth in the Order on Consent to be paid from the funds of the Mid-Point Park Sewer District. 3. RESOLUTION: 2022-150 Resolution Authorizing Contract For Tennis Court Resurfacing WHEREAS, the there are six tennis courts at Martz Field which have deteriorated in condition and need to be resurfaced; and WHEREAS, the Supervisor of Buildings and Grounds and the Engineers to the Town have investigated several contractors who resurface tennis courts and received two quotes on cooperative purchase contracts so competitive bidding is not required; and WHEREAS, the Town has received a contract proposal from Crafco, Inc. in the amount of$58,696.00 in the form attached hereto; and WHEREAS, the Engineers to the Town recommend that the Crafco, Inc. proposal be accepted; NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town Board has reviewed the proposal of Crafco, Inc. and authorizes a cooperative purchase contract with Crafco, Inc. in the amount of$58,696.00 and in accordance with the terms of the proposal attached. 2. The Town Board hereby authorizes the Supervisor to execute the contract documents on behalf of the Town. 3. Appropriation for this contract shall be made from Unallocated B Fund Balance and the Comptroller shall amend the budget accordingly. 4. Paoloni Page 1 Packet Pg.22 T.5 Town of Wappinger Meeting: 10/11/22 07:00 PM 20 Middlebush Road Department:Town Clerk Wappingers Falls,NY 12590 Category:Special Districts Prepared By:Joseph P.Paoloni ADOPTED Initiator:MinuteTraq Admin Sponsors:Supervisor Richard Thurston RESOLUTION 2022-149 Doc ID:5864 Resolution Authorizing Entering Into An Order On Consent In Connection With Mid-Point Park Sewer Plant WHEREAS,the Town of Wappinger owns and operates the Mid-Point Park Sewer Plant; and WHEREAS, Mid-Point Park waste water treatment plant treats sewage by a conventional activated sludge process with secondary sedimentation, followed by sand filtration and chlorine disinfection designed to treat an average daily flow of 0.066 mgd; and WHEREAS, the New York State Department of Environmental Conservation (hereinafter "NYS DEC"), has reduced the permitted limits for certain discharges for wastewater treatment facilities which will necessitate the replacement of the Mid-Point Park Sewer Plant; and WHEREAS, the New York State Department of Environmental Conservation (hereinafter "NYS DEC"), issued a Notice of Violation dated August 21, 2019 and determined that the sewer treatment plant exceeded permitted effluent limits 15 times over between 2017 and 2019; and WHEREAS, negotiations ensued between NYS DEC and the Engineers to the Town and the Attorney to the Town to establish a schedule for compliance to remediate the violation; and WHEREAS, the Town of Wappinger has received an Engineering Planning Grant to investigate alternatives to cure the violations and design a replacement for the existing Mid-Point Park Sewer Plant; and WHEREAS, NYS DEC has submitted an Order on Consent which will require the Town to develop a replacement design and complete construction by December 31, 2027; and WHEREAS, pursuant to the Order on Consent, the Town shall be liable to pay a civil penalty in the amount of$25,200.00; and WHEREAS, pursuant to the Order on Consent, $6,000.00 will be payable to NYS DEC upon execution of the Order on Consent with the remaining balance of $19,200.00 being suspended provided that the Town strictly adheres to the terms and conditions of the Order on Consent; and WHEREAS, by compliance with the Order on Consent, the Town would satisfy the violations that are alleged by NYS DEC and the suspended penalty would be waived; and WHEREAS,the Town Board Members have each read the Order on Consent and they collectively concur with the terms and conditions set forth therein, and further determine that it is in the best interest of the Town, especially the residents of the Royal Ridge development, to enter into and be bound by the Order on Consent. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Members of the Town Board of the Town of Wappinger hereby each acknowledge that he or she has read and approves the terms and conditions set forth in the Order on Consent annexed hereto. 2. Department staff notified the Respondent of the above violation in a Notice N U) of Violation letter dated August 21, 2019. o. 7. Upon reviewing discharge monitoring reports for the period of January 31, ~ 2019 to May 31, 20120, Department staff observed exceedances of permit limits o. regarding effluent flow, biological oxygen demand and total suspended solids.
