Resolution Declaring Lead Agency And Adopting Negative Declaration For Route 9
Extension Of United Wappinger Water District
At a Special Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on
September 6, 2022.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll
being called, the following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by
Councilman Phillips.
WHEREAS, certain properties with wells along the southern portion of Route 9 in the Town of
Wappinger and adjacent areas are faced with water quality issues and require municipal water;
and
WHEREAS, New York State has made available grants in aid for the construction of municipal
water and sewer projects under the Water Infrastructure Improvement Act"WIIA"; and
WHEREAS, the Town of Wappinger is making application for WIIA grants to construct the
ROUTE 9 EXTENSION OF UNITED WAPPINGER WATER DISTRICT "the Project"to serve
properties in the project area; and
WHEREAS, the Town Board of the Town of Wappinger determined that the project is a Type I
action subject to coordinated review for purposes of SEQRA review and circulated its intent to
serve as lead agency to the involved agencies listed in Part 1 of the Full Environmental
Assessment Form together with Part 1 of the Full Environmental Assessment Form for the
Project; and
WHEREAS, 30 calendar days have expired and no involved agencies indicated their intent to
serve as lead agency for SEQRA review of the project; and
WHEREAS, the Town Board has reviewed a Full Environmental Assessment Form ("FEAF")
Part 1 for the Project and caused to be prepared Parts 2 and 3 of the FEAF in the form attached
hereto;
NOW, THEREFORE, BE IT RESOLVED,that the Town Board hereby declares itself as lead
agency pursuant to 6 NYCRR §617.6; and
BE IT FURTHER RESOLVED that the Town Board as Lead Agency finds and determines that:
1) The Town Board has considered the Project, reviewed all parts of the FEAF, assessed the
project against the criteria set forth in 6 NYCRR §617.7(c), thoroughly analyzed the
relevant areas of potential environmental concern, and has duly considered all of the
potential project environmental impacts and their magnitude in connection with the
proposed action;
2) The Town Board finds that the Route 9 Extension of the United Wappinger Water
District will not result in any large and important environmental impacts, and, therefore,
is one which will not have a significant impact on the environment;
3) The reasons supporting this determination are set forth on the attached Part 3 of SEAF (a
copy of which said form is on file in the Office of the Town Clerk of the Town of
Wappinger).
BE IT FURTHER RESOLVED,that the Town Board, as Lead Agency with reference to the
above-described project, hereby adopts a negative declaration pursuant to 6 NYCRR §617.7 with
respect to the project and authorizes the Supervisor of the Town of Wappinger to sign a negative
declaration determination of non-significance with respect to the project; and
BE IT FURTHER RESOLVED,that the Town Clerk is directed to publish a notice in the
Environmental notices bulletin (ENB) and file a copy of said negative declaration determination
of non-significance in the records of the Town.
