Beale RESOLUTION: 2022-154 Resolution Adopting Final Benefit Assessment Rolls For Special Improvement Districts And Special Improvement Areas For Fiscal Year 2023 WHEREAS, the Town Assessor prepared proposed Benefit Assessment Rolls for all Special Improvement Districts and Special Improvement Areas in the Town of Wappinger, assessed on a benefit basis, for Fiscal Year 2023 and said proposed Benefit Assessment Rolls were filed with the Town Clerk as required by Town Law § 239; and WHEREAS, in accordance with Town Law § 239, the Town Board duly noticed and held a Public Hearing on October 24, 2022, to hear and consider any objections to said Benefit Assessment Rolls within the Town for use in Fiscal Year 2023; and WHEREAS, all interested persons were given the opportunity at the Public Hearing to challenge or contest such benefit assessment determinations; and WHEREAS, the Town Board has reviewed the proposed benefit assessment rolls within the Town for use in Fiscal Year 2023 and has determined that they were prepared in proper order. Beale RESOLUTION: 2022-155 Resolution Adopting Capital Budgets, O&M Charges And Water/Sewer Rates And Rents For Special Districts And Special Improvement Areas For Fiscal Year 2023 WHEREAS, on September 26, 2022, the Town Board, pursuant to and in accordance with the provisions of Sections 198 and 202-a of the Town Law and other applicable provisions of law, scheduled a Public Hearing on the Proposed Capital Budgets and Proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and Special Improvement Areas for Fiscal Year 2023; and WHEREAS, the Town Board conducted a Public Hearing on October 24, 2022 at 7:30 p.m. and all parties in attendance were permitted an opportunity to speak on behalf or in opposition to the proposed Capital Budgets and proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and Special Improvement Areas for the fiscal year 2023; and WHEREAS, the Town Board has taken into consideration the comments made by the public at the Public Hearing. Wrap Up Councilman Casella summarized the budget speaking of future revenue shortfalls and ever increasing inflation in the price of goods. VIII. Resolutions RESOLUTION: 2022-151 Resolution Authorizing Contract For Appraisal Services For Potential Purchase Of Real Estate WHEREAS, the Town of Wappinger is in negotiations to purchase real property and requires an appraisal to justify the purchase price; and WHEREAS, the Town has received a proposal from a duly licensed appraiser, to conduct an appraisal of the property; and WHEREAS, the professional services of an appraiser is not subject to competitive bidding; and NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town Board has reviewed the proposal of and authorizes a contract with in the amount of and in accordance with the terms of the proposal attached. 2. The Town Board hereby authorizes the Supervisor to execute the contract documents on behalf of the Town. 3. Appropriation for this contract shall be made from Unallocated B Fund Balance and the Comptroller shall amend the budget accordingly. 4. Payment shall be made upon vouchers reviewed and approved as required by law. 5. This Resolution shall take effect immediately. RESOLUTION: 2022-156 Resolution Introducing Local Law No. 7 Of 2022 For The Purpose Of Amending Chapter 240,Zoning, Of The Town Code With Respect To A Variety Of Matters." WHEREAS, the Town Board is considering the adoption of Local Law No. 7 of 2022 which would abolish Chapter 240, § 240-50 Designed Residential Development, of the Town Code; and WHEREAS, for the purposes of the New York State Environmental Quality Review Act (SEQRA), the Proposed Action is as defined above; and WHEREAS, the Town Board has determined that the Proposed Action is a Type I action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA"); and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action; and WHEREAS, a Determination of Significance has not yet been made with respect to the Proposed Action. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town of Wappinger hereby determines that the contract for the replacement of fences at Robison Lane Fields shall include Alternates 2. This is the L) second email I have sent to the Board on the Deer Ridge proposal. I do realize that only the Deer Ridge proposal was on the agenda, but you must consider the Cedar Ridge proposal along with the Deer Ridge proposal. However, because only the Deer Ridge proposal was on the agenda, I will focus this letter on that subject. N N O N I moved from Peekskill and purchased my home in Wappingers Falls in 1994 for the zoning. So many of our residents co live here specifically for the open spaces, quiet neighborhoods, and the privacy our current zoning allows. I implore you W not to change our way of life. Please do not turn Wappingers Fails into a more crowded, more urban community by changing our zoning. N 0 At the meeting Mr. O'Donnell (as you can see on the video) spoke in generalizations when addressing the concerns of our N residents. He offers no absolutes. He gives empty promises, tailing people what he thinks they want to hear to get his o proposal passed. He says "probably", and "I can't see that happening". He mentioned the Superintendent of WCSD said N the schools could handle the influx of new students. That's because he told the Superintendent it would be "about" 35 students. He said in the video that there would be approximately 160-2 bedroom units, At a conservative estimate, at 2 E people per bedroom that is 640 new residents. If half of them are students, that's 320 new students. This will stretch U already limited resources and tremendously increase class size when studies show smaller class sizes are much more ;a beneficial for students. Also, once school quality deteriorates, this will become a less desirable place to live, which in turn Q lowers our property values, which will lower tax assessments. Another problem is the increase in traffic patterns. The Deer Ridge proposal has a connecting road to Winfield Terrace. This will lead to a tremendous increase in traffic on the residential streets of Dorothy Lane, Rosewood Drive, and Pine Ridge Drive as people use them as shortcuts to Cedar Hill, Rt. 52, and All Angels (94). These roads are already stressed from people cutting through our neighborhoods at speeds much higher than the posted speed limit. I personally have witnessed accidents caused by speeding on Dorothy Lane. Along with more housing will come an increase in online deliveries. Dorothy Bane has already seen this happen. It cannot handle an increase. Amazon, UPS, FedEx, and the USPS all race up and down our roads to make their delivery deadlines. It is not a safe situation.There are no sidewalks on any of these roads and people are already in danger from the traffic as the try to walk and bike. Please do not exacerbate this problem and create a more unsafe situation. Changing our zoning laws to accommodate these proposals will also have a tremendous impact on our emergency services. We cannot stretch our emergency services any further. Having to increase them will drive up our taxes at a time when our economy is slowing down, inflation is rising, and many of us are struggling just to pay for gas, groceries, and how we are going to heat our homes this winter. Packet Pg.36 With regards to Mr. Alexander, by calling the Board "Xenophobes" and saying "xenophobia rests here", he has demonstrated a condescending and disrespectful attitude to our community, which he merely wishes to exploit for profit. He wants to overdevelop our land and shame us into letting him do it. I am disgusted by his transparent attempt to denigrate us as a community to get his way. So far I've attended the 3 public hearings regarding this project, and as of yet have I L heard anyone in the community that thinks this is a good idea. The only people who 0 publicly affirmed their support for the project were Mr Odonnell and the 3 or 4 employees of his who spoke at first planning board meeting. Although Mr O'Donnell has W one of his homes —7 miles away, none of the others people that voiced support even N lived in Wappinger. N 2..Mr O'Donnel stated at the first two meetings that he had already got the OK to tie in w to water and sewer, who gave him that OK 3. Developer stated at the planning board meeting that there would be no sliding glass doors or patios on any of N any kind on these units, is there any recreation area/community center for these families. All outside areas It- o appear to be as the developer stated "heavily wooded" or parking lots. So families would congregate in the N heavily wooded areas, parking lot, or the street during nice weather? Or is the expectation that they would all N just stay inside? 4. How would construction affect the aquafers that supply our wells? As many residents mentioned at the town E board meeting, wells have had to go deeper and deeper as construction has blossomed in this area. With this U new construction, what would be done to protect the current residents water supply? Would the developer or Q town be liable for any detrimental effects on the well that this project might cause? 5, Mr Beale truthfully stated at the most recent meeting that the town board represents the people in the community, so if the community is opposed to it, who in the community supports it? 6. Are there any areas in Wappinger(such as those occupied or previously occupied by public buildings)which are not in any zone at all, or wouldn't require rezoning? Like the RTES corridor 7. What trumps the zoning law? Wasn't it part of larger community plan? It seems silly to have plans in place if they are ignored because someone bought it because he got it at a good price, knowing it was zoned a particular way when he bought it, and he could mold it to his needs? 8. Traffic, the developer has mentioned a few times about the "Improved.
