Bernette Belie thanked Councilman Phillips and Councilman Casella for bringing this law forward. Matt Nataro asked a question regarding local law tightening up the code. Robin Licari asked how the process would be different if this was not approved. This elimination would give town more leeway to control housing development. In the past,this would require a County Road or State road, not a town road. Cedar Hill road is a Town Road and could not be considered for a designed development. The area does not have a collector road running through it. If Cedar Hill were a county road then the developer would seek a special permit versus rezoning by the town board. Ricky Dickson 240 Cedar Hill road thanked Councilman Casella and Councilman Phillips for their efforts to protect the people of the town who live here and their support in striking down the antiquated code. Don Denardo of 21 Maple Pass said the town needs to look into water for existing residents instead of providing housing with town water for people who don't live here. John Gormon of 6 Thompson Terrace thanked Councilman Casella and Councilman Phillips for tightening up the code. Linda Rabbit asked what she would have to do to do this. The applicant has the authority but not necessarily the capacity to build 90-1 acre lots. Thom Cripano pointed out that the applicant applied after the Introduction, but before the adoption of the law and could result in a lawsuit. Greg Halderman of 15 Lenny Court supports change to the code. Teresa Baker of 123 Edgehill Drive asked about the Tri-Municipal upgrade that would result. It was said that the applicant will provide well water and septic. Rich Johnson of 19 Scotse asked about special use permit. Attorney Horan stated that a Special Use Permit is a permitted use under zoning code and if applicant conforms, they can get it. Ken Stenger spoke as the attorney for the applicant. Engineering firm employee for the project, Amy Bomadieri , suggested that on the 139-acre parcel, 90 single family lots were allowed; but, using a higher density of apartments and denser housing; more open space would be preserved. Chris Morley of 276 Cedar Hill Rd suggested that the Town Board needs to represent people who live here now; and, not those that do not live here. Steve Corencia suggested going forward and closing the loophole in the code. Local Law Adoption RESOLUTION: 2022-168 Resolution Adopting Negative Declaration For Local Law No. 7 Of The Year 2022 Entitled "A Local Law To Eliminate The Authority For Designed Residential Developments In The Town Of Wappinger" WHEREAS, the Town Board is considering the adoption of a Local Law entitled "A LOCAL LAW TO ELIMINATE THE AUTHORITY FOR DESIGNED RESIDENTIAL DEVELOPMENTS IN THE TOWN OF WAPPINGER" and WHEREAS, the Town Board has determined that the Proposed Action is a Type I action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA"); and WHEREAS, the Town Board is the sole agency having authority to approve the Local Law and as such is the lead agency; and Town of Wappinger Page 3 Printed 1/5/2023 Regular Meeting Minutes December 12, 2022 WHEREAS, the Attorney to the Town has prepared a Full Environmental Assessment Form (FEAF) regarding the proposed Local Laws, which FEAF analyzes the potential environmental impacts regarding said Local Laws; and WHEREAS, the Town Board has reviewed the Local Laws and the Full Environmental Assessment Form Parts 1, 2 and 3; NOW, THEREFORE, BE IT RESOLVED,that the Town Board of the Town of Wappinger hereby adopts the attached Negative Declaration, for the reasons stated therein, thereby finding that the proposed Local Law entitled "A LOCAL LAW TO ELIMINATE THE AUTHORITY FOR DESIGNED RESIDENTIAL DEVELOPMENTS IN THE TOWN OF WAPPINGER" will have no significant adverse impact upon the environment, and thereby ending the SEQRA process with respect to said Local Law. Recreation Transfer of Funds RESOLUTION: 2022-151 Resolution Authorizing Contract For Appraisal Services For Potential Purchase Of Real Estate WHEREAS, the Town of Wappinger is in negotiations to purchase real property and requires an appraisal to justify the purchase price; and WHEREAS, the Town has received a proposal from a duly licensed appraiser, to conduct an appraisal of the property; and WHEREAS, the professional services of an appraiser is not subject to competitive bidding; and NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The appointment of Julian Price is effective December 13, 2022. 3. Julian Price shall be compensated at the hourly rate of$22.39 for 35 hours per week which shall be paid out of budget line A.1315.102 in weekly installments in accordance with the CBA. 4. RESOLUTION: 2022-171 Resolution Accepting Furnia Court And Related Easements For Furnia Subdivision Together With Maintenance Agreement Secured By Letter Of Credit WHEREAS, Rieger Homes, Inc. (hereinafter "RIEGER HOMES") owns a parcel of real property located on the northwesterly side of New Hackensack Road, and WHEREAS, Hybridhomedevelopers, LLC filed an application for subdivision plat approval with the Town of Wappinger Planning Board for a certain parcel in the Town of Wappinger designated as Lot No. 5 of a certain Subdivision Plat entitled "Swenson Subdivision" filed in the office of the Dutchess County Clerk on October 15, 1986 as Filed Map Number 7771 ("Premises"); and WHEREAS, on March 18, 2019, the Town of Wappinger Planning Board issued a resolution of Final Subdivision Plat Approval for the Furnia Subdivision which depicts a road,water main, drainage improvements and other infrastructure which will be dedicated to the Town of Wappinger; and WHEREAS, the final subdivision plat was filed in the Office of the Dutchess County Clerk on August 1, 2019 as Filed Map 7771A which is subject to an Offer of Cession and Dedication dated July 29, 2019 and recorded in the Office of the Dutchess County Clerk on August 1, 2019 as Document No. 02-2019-5010; (the "Plat") and WHEREAS, by letter dated December 7, 2022, the Engineers to the Town have advised that the construction of Furnia Court and the related improvements have been completed in accordance with the construction documents for the subdivision; and WHEREAS, pursuant to §214-43 of the Town of Wappinger Code, RIEGER HOMES is required to post a highway construction guaranty in the form of a bond or performance guarantee in an amount equal to $52,128.00,which is 20% of the cost of construction, to be held for a period of two years to guarantee that any defects of the type described in §214-76(B) shall be cured but RIEGER HOMES has been unable to do so and said Maintenance Bond has been provided; and WHEREAS, RIEGER HOMES tendered to the Town of Wappinger a deed for the right of way for Furnia Court from RIEGER HOMES together with the associated transfer documents all in recordable form and approved by the Attorney to the Town,James P. Horan, Esq.; and WHEREAS, the Superintendent of Town Highways and the Engineer to the Town have recommended that the Town Board accept Furnia Court as a town highway; NOW,THEREFORE,BE IT RESOLVED, as follows: 1. The Town Board hereby determines that it is in the best interest of the residents of the Town of Wappinger to accept Furnia Court as a Town Highway together with the drainage facilities and other public improvements located in and around the highway right of way, except those specifically excepted by the subdivision plat. The Maintenance Agreement executed by RIEGER HOMES, as Obligor,in favor of the Town of Wappinger, as Obligee,is accepted as the guarantee that the quality and workmanship of the road and other public improvements will be free from defects in materials and workmanship for a period of two years from the date of acceptance by the Town as required by§214-43. 3. The Town Board hereby accepts an Irrevocable Letter of Credit bearing Letter of Credit No. issued by Salisbury Bank to the Town of Wappinger in the amount of Fifty-two Thousand One Hundred twenty-eight& 00/100 ($52,128.00,) as a highway construction guaranty in accordance with §214-43 of the Town of Wappinger Code which shall be held for a period of two years to guarantee that any defects of the type described in §214-76(B) shall be cured. 4. This acceptance is expressly conditioned upon RIEGER HOMES delivering the right of way and the public improvements to the Town free and clear of any liens or encumbrances, and upon payment by TOLL of all outstanding fees and escrow reimbursements due to the Town. 5. The Town Supervisor and the Attorney to the Town are authorized to execute any and all documents necessary for the recording of the deed and easements from RIEGER HOMES. 6. The Attorney to the Town is directed to cause the deed and easements to be filed in the property records of the Dutchess County Clerk. 7. Upon its return from the County Clerk, the Town Clerk is directed to file the deed for the town highway in his files as required by Highway Law §171(1). 8. Upon the tender of the Amended Standby Letter of Credit to the Town Clerk, the original Irrevocable Standby Letter of Credit effective June 21, 2019 issued by Salisbury Bank in favor of the Town of Wappinger in the sum of$260,640.00 as security for the Performance Agreement to construct the roadway and associated drainage required for the project shall be released to RIEGER HOMES. Resolutions Passed After Executive Session RESOLUTION: 2022-146 Resolution Appointing Recreation Assistant WHEREAS, the position of Recreation Assistant is established on the Civil Service Roster for the Town of Wappinger; and WHEREAS, the Recreation Assistant job tittle is in the Labor Class under the Civil Service Rules of Dutchess County Human Resources with no minimum qualifications; and WHEREAS, the position of Recreation Assistant is within the bargaining unit covered by the Collective Bargaining Agreement between the Town of Wappinger and Teamsters Local 445 ("CBA"); and WHEREAS, the incumbent Recreation Assistant moved to a different position in the Recreation Department; and WHEREAS, the intention to fill the vacancy has been posted in accordance with the CBA; NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town Board hereby appoints to the full-time civil service title Recreation Assistant and program specialist, effective ' 2022. 2. The appointment is subject to the approval of the Dutchess County Department of Human Resources and is further subject to Civil Service Law and the Rules of New York State and the Dutchess County Department of Human Resources. 3. The Town Human Resources Department shall file the paperwork necessary to effectuate this appointment with the Dutchess County Department of Human Resources and any other required agency. 4. The Town Board hereby appoints to the full-time civil service title Recreation Assistant and program specialist, effective ' 2022. 2. The appointment is subject to the approval of the Dutchess County Department of Human Resources and is further subject to Civil Service Law and the Rules of New York State and the Dutchess County Department of Human Resources. 3. The Town Human Resources Department shall file the paperwork necessary to effectuate this appointment with the Dutchess County Department of Human Resources and any other required agency. 4. The appointment is subject to a probationary term of not less than eight nor more than twenty-six weeks in accordance with the rules of the Dutchess County Department of Human Resources. 5. Compensation for the Recreation Assistant shall be at a rate of$19.50 per hour and paid in accordance with the terms of the Collective Bargaining Agreement between the Town of Wappinger and Teamsters Local 445.
