COMMENTS-Current Meeting:
Munistat Debt profile update appeared before the board present their analysis of our bonds. A
capital needs list was handed out to the board, but, Again, this was not given to the Town Clerk
for publishing in these minutes.
5. Report on Dutchess County Transportation Initiatives - Thurston/Mark Debald
Mark Debald from Dutchess County Transportation Council came to speak on the county
transportation system. They work with the state, MTA, and local towns to provide assistance.

CPL engineers promised to put together a time frame with electrical and band stage with
preference. No action was taken by the board.
2. Veteran's Update Banners & Bricks - Hathorn/Thurston
Kevin Hathorn rose to talk about veterans activities. No action was taken by the board.
3. Motion To: Raise Robinson Lane Field fee to $50 - Fulton/Thurston
Jessica Fulton handed out a document to the board, but gave nothing to the town clerk for

4. Recreation Department Fee Schedule Field Use, Community Day Contract -
Fulton/Thurston
Community Day Contract was handed out to the board but gave nothing to the town clerk for
recording in these minutes. No resolution was given to the Town Clerk. Details can be used on
the town's website video.
The board agreed to vote for the contract resolution that was handed to the board after executive
session.
5. Rezone 90 Smithtown Road - Thurston/Roberti
An escrow was suggested to be $3,000,none was collected. A re-submittal of the rezone
application submitted in December of 2022 will be reproduced.
6. Pole Barn Extension - Frazier/Thurston
Steve Frazier offered to do the pole barn extension in-house. Steve had no detail on the costs.
CPL will put an estimate on costs to do by a vendor and in-house.

7. Town Hall HVAC - Frazier/Casella
Steve gave an update on the HVAC at town hall.
8. CDGB Grant Issues - Moot/Thurston
No update. CPL is looking to use the $150,000 grant money that was allocated under "Carnwath
Senior Center". The attorney suggested that the grant money could be used for the 'Town Hall'
Senior Center, but not a'Carnwath' Community center!!
9. Tri Municipal Upgrade of$1.31 million of which 49.55% is our cost.
Jim Horan talked about sludge digestors at the Tri-Mini plant. Total cost to the Tri-Municipal
plant will be $1.31 Million 49.55% of it is our cost which comes to $650,000.
VI. Resolutions
RESOLUTION: 2023-9
Resolution To Authorize The Town Supervisor, Town Highway Superintendent And Town
Board To Execute The Agreement For The Expenditure Of Highway Moneys
WHEREAS, pursuant to Section 284 of the Highway Law, the Town Board and the
Town Highway Superintendent are required to enter into a written Agreement stating the places
and manner in which the Highway fund appropriation for repairs and improvements are to be
expended; and
NOW, THEREFORE BE IT RESOLVED, that the Town Highway Superintendent and
the Town Board agree that the monies levied and collected in the Town for repair and
improvement of highways, and received from New York State for State Aid for the repair and
improvement of Highways shall be expended in accordance with the annexed Agreement for the
Expenditure of Highway Moneys; and
BE IT FURTHER RESOLVED, that the Supervisor and the Town Board are hereby
authorized and directed to execute the attached AGREEMENT FOR THE EXPENDITURES OF
HIGHWAY MONEYS in duplicate and file said agreement with the Town Clerk; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to forward one
executed Agreement to the Dutchess County Commissioner of Public Works in his capacity as
County Superintendent of Highways.

RESOLUTION: 2023-37
Resolution Authorizing Refund Of Unused Escrow For 26 Myers Corners Road Rezone
(Account 22-0002)
WHEREAS, on or about March 7, 2022, Patrick Buckley and Anna Buckley (hereinafter
the "Applicants") submitted a rezone petition for 26 Myers Comers Road under Account
Number 22-0002; and
WHEREAS, a total escrow deposit in the amount of$2,500 was received from the
Applicants for payment of the fees of the Town's professionals to review the petition; and
WHEREAS,the review of the rezone process has been completed; and
WHEREAS, all professional fees incurred during the review of the petition have been
paid and there remains a balance of$2,148.50 in escrow account 22-0002 and the Applicants
have requested a refund; and
WHEREAS,the Town Comptroller has audited the escrow account and reviewed the

amount due to be refunded; now, therefore
BE IT RESOLVED,that the Town Board hereby authorizes a refund to Patrick Buckley

Superintendent And Town Board To Execute The Agreement
For The Expenditure Of Highway Moneys
WHEREAS, pursuant to Section 284 of the Highway Law, the Town Board and the
Town Highway Superintendent are required to enter into a written Agreement stating the places
and manner in which the Highway fund appropriation for repairs and improvements are to be
expended; and
NOW, THEREFORE BE IT RESOLVED, that the Town Highway Superintendent and
the Town Board agree that the monies levied and collected in the Town for repair and
improvement of highways, and received from New York State for State Aid for the repair and
improvement of Highways shall be expended in accordance with the annexed Agreement for the
Expenditure of Highway Moneys; and
BE IT FURTHER RESOLVED, that the Supervisor and the Town Board are hereby
authorized and directed to execute the attached AGREEMENT FOR THE EXPENDITURES OF
HIGHWAY MONEYS in duplicate and file said agreement with the Town Clerk; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to forward one
executed Agreement to the Dutchess County Commissioner of Public Works in his capacity as
County Superintendent of Highways.

Unfortunately I am away and and was unable to attend, which I have attended and spoken at, at last nights
meeting. I reside at 51 Theresa Blvd. (25 years)and am opposed to the EXTREME proposed
developement in my area, I'm realistic and realize that when there are parcels of property in the area they
may be developed. Please just keep the current residents in mind. If one developer gets a variance or
exception the other two parcels will want the same. The amount of traffic would be horrendous.
Not to mention the impact on the neighborhood feel. Thank you for listening, Look forward to your

After attending yesterday's informational meeting conducted by MHDC it has become clear the
Town Board would be making a mistake by repealing 240.50. The proposed development
provides a mixture of housing types which is something the Town of Wappinger is in severe need
of. The process the code requires seems to provide all of the oversight any other residential
development would require. The proposed development, in accordance with 240.50, provides o
substantially more open space and eliminates 75%of the disturbance an as-of-right development m
will require. _

appropriately used I believe this can be a thoughtful project where all parties involved can derive benefit without an
advesarly tone with benefit to the community.
Action on code 240-50 and the proposed development should be given more time and information before any votes are
registered.

(Please See Attached).We are also proposing infrastructure improvements that would provide immediate access to 0

municipal water for approximately 30 homes along Cedar Hill Rd. We are also proposing to dedicate a portion of land to
the Town for a future water tower which would allow for a greater expansion of the water district to residents in need. o

I do not believe an As Of Right conventional subdivision mandates the inclusion of Open Space into the site plan (Please M
See Attached).The repeal of 240-50 will ultimately cause a much greater environmental Impact when developing our
parcel. I hope the Town Board members takes the aforesaid into consideration when making their final decision. N

official taped to various posts and gates around our property on February 2,2023 ordering work to 0

On July 7,2021 the Dutchess County Legislature with the recommendation of the Agricultural and
Farmland Protection Board granted our 23.49 acres known as parcel 96257-03-267342 inclusion
in Agricultural District 4-22 of Dutchess County and as such provides us the rights and protection of
being "agriculturally zoned."New Yorks Agricultural District Law(ADL)has created safeguards for
those of us within a legally appointcd Agricultural District.

"To safeguard against localities which inhibit farming,§305-a of the ADL prohibits the enactment
and administration of comprehensive plans,laws,ordinances,rules or regulations by local
governments which would unreasonably restrict or regulate farm operations within an agricultural

There has been no known health or safety risk to the public that we have been made aware of.
Besides the Town code enforcement officer that chose to enter the property without notice,we had
visits from CHGI?and the NYPA,both agencies which we have already had ongoing discussions
with in regard to the work within their respective easements.Both agencies reported receiving a call
from Town officials citing we were were improperly performing work within their respective

easements.Both agencies after visiting the site have agreed there were no such issues with our 0

engineers,forestcrs,wetland specialist,the experts from Cornell Cooperative extension and many M

far as to pre-order enough tree's to replace those that are being killed off by the emerald ash borer N

We have consulted with our attorney and we are within our rights to continue the work we are

WHEREAS, on or about March 7, 2022, Patrick Buckley and Anna Buckley (hereinafter
the "Applicants") submitted a rezone petition for 26 Myers Corners Road under Account
Number 22-0002; and
WHEREAS, a total escrow deposit in the amount of$2,500 was received from the
Applicants for payment of the fees of the Town's professionals to review the petition; and
WHEREAS,the review of the rezone process has been completed; and
WHEREAS, all professional fees incurred during the review of the petition have been
