RESOLUTION: 2023-38 Resolution Introducing "Local Law No. 2 Of The Year 2023, Amending Chapter 221 Of The Code Of The Town Of Wappinger To Enact A Property Tax Exemption For Volunteer Firefighters And Ambulance Workers Pursuant To Section 466-A Of The Real Property Tax Law" WHEREAS, on December 9, 2022, the State of New York enacted Real Property Tax Law (RPTL) § 466-a, which empowers all local governments with an to provide a property tax exemption to volunteer firefighters and volunteer ambulance workers; and WHEREAS, volunteer firefighters and volunteer ambulance workers provide critically vital lifesaving services to the Town of Wappinger while reducing the tax burden on the taxpayers of the Town; and WHEREAS, the Town Board of the Town of Wappinger desires to enact this exemption to thank the volunteer firefighters for their service, encourage retention of volunteer firefighters and ambulance workers and to provide incentive for future volunteers to join; and WHEREAS, the enabling legislation enacted by the State Legislature requires that local governments adopt a local law in order to afford those volunteers such exemption, and hold a public hearing prior to its adoption; and WHEREAS, the Town Board has determined that this action does not affect the environment and is not subject to SEQRA; NOW THEREFORE BE IT RESOLVED,that the Town Board hereby introduces for consideration of its adoption a proposed Local Law entitled "Amending Chapter 221 of the Code of the Town of Wappinger to Enact a Property Tax Exemption for Volunteer Firefighters and Ambulance Workers Pursuant to Section 466-a of the Real Property Tax Law", in the form annexed hereto; and Town of Wappinger Page 3 Printed 3/21/2023 Regular Meeting Minutes March 13, 2023 BE IT FURTHER RESOLVED,that the Town Board hereby schedules a Public Hearing on the adoption of the proposed Local Law to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 10th day of April, 2023, at 7:00 p.m., and the Town Clerk is directed to post the Notice of the Public Hearing in the form annexed hereto and to publish same in the Southern Dutchess News and Poughkeepsie Journal as required by law. RESOLUTION: 2023-40 In the Matter of The Establishment of the Myers Run Drainage District in the Town of Wappinger, Dutchess County, New York WHEREAS, Myers Run, LLC, the owner of 100% of the real property in the proposed Drainage District, submitted a written Petition dated August 5, 2021, to the Town Clerk, together with a Map, Plan & Report for the proposed district prepared by Clark Patterson Lee, P.C., competent engineers duly licensed by the State of New York, in accordance with the requirements of Article 12 of the Town Law; and WHEREAS, an Order Calling a Public Hearing was duly adopted by this Town Board on January 23, 2023, reciting the filing of said Petition, Map, Plan and Report, the improvements proposed, the boundaries of the proposed district, the proposed method of financing, the fact that the Map, Plan and Report describing the same were on file in the Town Clerk's Office for public inspection, and stating all other matters required by law to be stated, and specifying February 27, 2023 as the date, at 7:00 in the evening of said day as the time, at the Town of Wappinger Town Hall, 20 Middlebush Road, Wappingers Falls, New York as the place where this Town Board would meet and consider said Map, Plan and Report, and to hear all persons interested in the subject thereof, concerning the same, and to take such action therein as is required or authorized by law; and WHEREAS, such Order was duly published and posted as required by law, and proof of publication and posting has been duly presented to the Town Board; and WHEREAS, a public hearing on said matter was duly held by said Town Board on February 27, 2023, at 7:00 p.m. in the afternoon on said day, in the Town of Wappinger Town Hall, 20 Middlebush Road, Wappingers Falls, New York, and no person appearing in opposition to and the Petitioners appearing in favor of the petition; and WHEREAS, pursuant to said petition, it is the intention of the Petitioner, Myers Run, LLC., as owner, to construct the improvements set forth in the Map, Plan and Report solely at its own cost and expense; and WHEREAS, the Planning Board previously adopted a Negative Declaration under SEQRA for creation of the Drainage District as part of the review of the subdivision application; NOW,AFTER DUE DELIBERATION,IT IS HEREBY RESOLVED AND DETERMINED AS FOLLOWS: a) The notice of public hearing was published and posted as required by law and is otherwise sufficient. b) The Petition presented to this Board for the establishment of the MYERS RUN DRAINAGE DISTRICT was signed by 100% of the property owners within the proposed district and acknowledged as required by law and is otherwise sufficient. c) All the properties and property owners within the proposed district are benefited thereby. d) All the properties and property owners benefited thereby are included within the limits of the proposed district. e) There will be no hook-up fees for any of the properties within the district. There will be no capital costs assessed to the properties within the district for the improvements proposed to be constructed within the first year of operation. g) The estimated annual operation cost in the first year that charges will be paid by the benefitted parcels will be approximately$2,563.00 which shall be divided equally among the Town of Wappinger Page 5 Printed 3/21/2023 Regular Meeting Minutes March 13, 2023 twelve (12) lots resulting in an estimated annual cost of$213.60 per lot for a typical property within the district. h) It is in the public interest to establish the MYERS RUN DRAINAGE DISTRICT. BE IT FURTHER ORDERED AND DETERMINED that the establishment of the proposed district as set forth in said Map, Plan and Report is hereby approved; that the improvements therein mentioned be constructed by the Petitioner; and such district shall be known and designated as the MYERS RUN DRAINAGE DISTRICT, and shall be bounded and described as set forth in Exhibit "A" attached hereto and made part hereof; and BE IT FURTHER, ORDERED AND DETERMINED that the improvements for the said drainage district be constructed by Myers Run, LLC, owner of the premises described in Exhibit A, wholly at its own expense, and it has agreed to convey such improvements without cost to the Town of Wappinger on behalf of the MYERS RUN DRAINAGE DISTRICT free and clear of any liens or encumbrances; and BE IT FURTHER ORDERED AND DETERMINED that once the drainage improvement as set forth in the Map, Plan and Report have been constructed by the Petitioner and turned over to the Town, the cost for maintaining the district shall be assessed, levied and collected from the several lots and parcels of land within the said district in proportion as nearly may be to the benefit which each lot or parcel of land in said district will derive therefrom, unless said costs shall be covered by any maintenance bond; and BE IT FURTHER ORDERED AND DETERMINED that the Town of Wappinger shall be reimbursed by the Petitioner for any fees or expenses paid for the preparation of the Map, Plan and Report or in the formation of this district from the escrow account established for such purpose; and BE IT FURTHER ORDERED that the Town Clerk be, and hereby is, authorized and directed to file a certified copy of this Order in the office of the Clerk of the County of Dutchess, and another certified copy in the Office of the State Comptroller, within ten days after the adoption of this Order,pursuant to §195 of the Town Law. RESOLUTION: 2023-41 Purchase of Vactor For Highway Department WHEREAS, the Town of Wappinger Board recognizes the need for a reliable Vactor to be used by the Highway Department, and WHEREAS, the current vehicle used by Highway Department is in need of frequent repairs and Town of Wappinger Page 6 Printed 3/21/2023 Regular Meeting Minutes March 13, 2023 maintenance, resulting in increased costs and decreased efficiency, and WHEREAS, the Highway Department has identified a suitable replacement vehicle that meets the needs of the department and is within the budget allocated for the purchase of a new vehicle, and WHEREAS, the Highway Department we can move unused funds from salt budget this winter in the $200,000 range. It looks like they will be able to sell the used unit for $100,000 vs trade in for $50,000 in lieu of the purchase of the replacement vehicle and has selected this most cost- effective option, NOW, THEREFORE, BE IT RESOLVED,that the Town of Wappinger Board approves the purchase of a new Vactor for approximately $479,000 for use by the Highway Department at a cost not to exceed $500,000. The vendor is Joe Johnson Equipment - Contract 4101221-VTR BE IT FURTHER RESOLVED,that the Highway Department is authorized to proceed with the purchase and take any necessary steps to complete the transaction, including but not limited to obtaining financing and arranging for delivery. BE IT FURTHER RESOLVED,that the Highway Department is authorized to dispose of the current vehicle in a manner consistent with Town of Wappinger policy and applicable laws. Grant of exemption. U- An enrolled member of an incorporated volunteer fire company, fire department or incorporated o voluntary ambulance service, or such enrolled member and their spouse, is hereby granted a partial 3 exemption from real property taxes of the Town of Wappinger of ten percent (10%) of the assessed value, excluding special assessments, provided that the eligibility requirements are met. o J § 221-20 Eligibility requirements. Such exemption shall be granted to an enrolled member of an incorporated volunteer fire company, fire department, or incorporated voluntary ambulance service provided that: A. The property is owned by the volunteer firefighter or volunteer ambulance worker; Q B. The property is the primary residence of the volunteer firefighter or volunteer ambulance Packet Pg 20 6.2.b C. The volunteer firefighter or volunteer ambulance worker is certified by the authority having 0 jurisdiction for the incorporated volunteer fire company, fire department, or voluntary ambulance X service as duly enrolled member of such incorporated volunteer fire company, fire department, or incorporated voluntary ambulance service; and Q E. The volunteer firefighter or volunteer ambulance worker meets the minimum service requirement ° o. established by the Town of Wappinger, which is hereby established as 2 years. W § 221-21. Application. i°0 A volunteer firefighter or volunteer ambulance worker must annually, on or before the applicable taxable status date, file an application for such property tax exemption with the assessor responsible for preparing the assessment roll for the Town of Wappinger, on a form as prescribed by the New York � State Commissioner of Taxation and Finance. The Town of Wappinger must maintain written r- U guidelines, available upon request, as to the requirements of an enrolled volunteer member relating to .0 0 this exemption. § 221-22. Certification. °? M The governing body of each incorporated volunteer fire company, fire department or incorporated voluntary o N ambulance service in the Town of Wappinger must annually file with the assessor, prior to the applicable U) W taxable status date, a list of the active volunteer members who are certified to meet the minimum service requirement. Such list must provide, as of the applicable taxable status date, the number of years of o service served by each such enrolled member and such enrolled member's address of residence. a) X § 221-23. No diminution of benefits. w L An applicant who is receiving any benefit pursuant to Article 4 of the Real Property Tax Law, other than a benefit granted pursuant to Real Property Tax Law §466-c, as of the effective date of this article shall � not have any of those benefits diminished because of this article. U § 221-24. Grant of lifetime exemption. E Any eligible enrolled member who accrues more than 20 years of active volunteer service (as certified by the authority having jurisdiction) shall be granted the 10% exemption as authorized by this article for M the remainder of his or her life as long as he or she owns their primary residence within the Town of 2u Wappinger. § 221-25. More detail about the CPU can be found by perusing the CPU document,which listed in the list of appendices at the end of this DGEIS.The CPU and appendices can be found on the Town of Fishkill website. The INTRODUCTION of the Comprehensive Plan Update, the CPU, provides a view of the Town of Fishkill as expressed by the CPU Committee, who are all members of the community. It emphasizes that Fishkill 6 is an established, developed and lively community with the Hudson Highlands, the Hudson River and ° J many neighborhoods, parks, business and cultural/historical areas that shape its scenery and natural 0 and community character. The implementation of the goals, objectives and strategies in CPU sections A. through K.,would have primarily beneficial impacts to the Town of Fishkill. The CPU section PROMOTE GOOD DESIGN OF THE BUILT ENVIRONMENT points out that certain areas of town may be limited for development of needed residential development due to limitations of existing water supply and sewage treatments systems.This section of the CPU also examines and presents aspects of Fishkill's landscape to identify larger parcels of vacant land,which may be available for o development or redevelopment, potentially for mixed-use development.While better design and land development may be desired, this section points to the need for supporting water and sewer m r_ infrastructure. Graphic depictions of the Town are provided in the CPU Maps listed in section VII of this DGEIS, below, showing Fishkill's extensive aquatic systems of wetlands,floodplains, creeks, streams and waterbodies; aquifer areas; community resources such as cultural resources, parkland,government, recreational and religious facilities; historical and cultural places and resources, including historical markers; and the type 0 and layout of zoning districts. _J 0 U The primary transportation routes are depicted on each of the maps noted above serving as a framework for the Town and connections between Fishkill and its neighboring municipalities: the Towns o of Wappinger, East Fishkill, and Philipstown; and the City of Beacon; and the Village of Fishkill.These N routes include U.S. Route 9 and New York State Routes 9D and 52; Interstate Route 84; and Dutchess County Routes 34 (Baxtertown Road), 35 (Osborne Hill Road) and 36 (Red Schoolhouse Road).. L) �t Because the CPU maps are based on tax parcel mapping, each depicts the layout of more open and less M intensively developed lands in much of the southern and southeastern portions of the Town.This is o because these areas of Fishkill are mountainous and very hilly,yet with a low corridor along the `V co southern half of Route 9, and the southeastern tip of Fishkill sloping down to the Hudson River. W Corridors of blended nonresidential, mixed use and residential development are assembled along the ti southern half of Route 9, and the southeastern tip of Fishkill. C' N O In contrast, numerous closely arranged neighborhoods and clusters of business development are found N in the central and northern areas of the Town of Fishkill including the Village of Fishkill.These more N densely developed hamlet areas, including: Brinckerhoff, Castle Point, Dutchess Junction, Dutchess Park, Glenham, Lomola, Merritt Boulevard, Rombout, and others are interspersed with parks and open space = lands.Several of the neighborhood and business areas are served by well-utilized public water supply U and sewage treatment systems. Q The population estimate of the United States Census Bureau of July 1, 2022 of Fishkill town is 24, 513, up from 22,107 people as of the April 1, 2010 Census. Persons under 18 years old make up approximately 15.5%of the population, with those 65 years old and over making up 20.8%, with the remaining 63.7%of the population between the ages of 19 and 64. Female persons make up 46.5%of the Town's population. In terms of race and Hispanic origin, 71.7%of the community is recorded by the US Census as "White alone", 12.8%is"Black or African American alone",4.2% is "Asian alone" and 14.3% is "Hispanic or Latino"; and 7.4%of Fishkill is"Two or more races". GOAL: PROMOTE GOOD DESIGN OF THE BUILT ENVIRONMENT (smart growth, better design, and compact, mixed-use development; explore existing capacity and possible connections with the existing sewer/wastewater systems; review current land use, development potential, underutilized lands and reframing future potential use, new use designations, reclamation needs) This CPU section recognizes that there are zoning provisions for mixed-use and compact development, and that the encouragement of small-scale, neighborhood businesses would involve examination of existing zoning to identify potential sites or to determine o whether zoning revisions would be needed. However, there are limits to compact or _J m cluster development as many areas of the Town of Fishkill do not have public sewer = facilities or insufficient additional sewer capacity. Similarly, many areas of the Town of Fishkill do not have available public water facilities or have insufficient additional public o water supply capacity. The Town would have to explore and create new water sources, and fund, design and build new treatment and transmission facilities. Please refer to the o appendices for information about the Town of Fishkill's water and sewer districts. t) The CPU recommends that the Town explore possible connections with the existing sewer/wastewater systems: M i. Village of Fishkill Wastewater Treatment Facility (WWTF) located on the south N end of Jackson Street; co ii. the closest Town of East Fishkill Sewer District(s); w iii. the City of Beacon Wastewater Treatment Facility, which is associated with the DCWWA and receives all the wastewater produced in the City of Beacon and the N Dutchess Park area of Fishkill;and M iv. the NYS Matteawan property has a private sewage treatment facility. o v. Additionally,the Tri-Municipal Sewer Commission includes Town of `V Poughkeepsie,Town of Wappinger, and Village of Wappinger Falls. vi. Also, there may be a vacant site or a site available for redevelopment that = would accommodate a wastewater treatment system. Q Exploration of new water sources,the funding, design and construction of water supply and sewer treatment facilities, and the exploration of connections with the existing sewer/wastewater systems of neighboring municipalities would have primarily beneficial impacts,Any impacts related to cost could be offset by pursuing funding for the design and construction of such facilities.The design and approval of such facilities would incorporate mitigation for related construction impacts. This section of the CPU also examines the Town of Fishkill's landscape to identify larger parcels of vacant land, which may be available for development or redevelopment. It provides information about large vacant, or underutilized or lands for potential redevelopment, yet does not propose any specific land development project or any amendment to the Code of the Town of Fishkill. GOAL: PRESERVE SPECIAL, SIGNIFICANT ENVIRONMENTAL RESOURCES (adopt and implement the Town of Fishkill proposed New York State Drinking Water Source o Protection Program (DWSP2), protect groundwater and surface water; and improve _J W stormwater quality) U m This CPU section would commit the Town to follow several objectives and strategies to: o 0. "Review, adopt and fully implement the objectives of the Town of Fishkill that are set forth in the proposed New York State (NYS) Drinking Water Source Protection Program o (DWSP2),";-and to protect surface water quality and natural drainage areas;-and the t) quality and quantity of groundwater; and to improve stormwater quality; reduce d impacts of development on steep slopes; protect areas rich in biodiversity; encourage M the use of native plant species; and preserve existing trees and plant new trees. Whether or not the proposed CPU is adopted, land development would continue to be guided and governed by the current code provisions, since no code amendments are proposed. Yet if the CPU is not adopted, then all of the insights and intensive work by the CPU Committee, all members of the community, would not be considered for implementation. As noted herein, the Draft CPU focuses on transportation (pedestrian, rail trail, transit and road), recreation (a park for children of all abilities; and needed community gathering, cultural and recreational facilities); and water and wastewater improvements, and other facilities and amenities needed to improve the quality of life and environmental quality of a substantially developed community. This would delay o creation of the identified, needed improvements and facilities. _J m U The CPU Committee's recommendation to prepare and adopt "a Local Waterfront Revitalization Program (LWRP) focused on the Town of Fishkill's Hudson River shoreline, o including public access to the river" is a key aspect of Fishkill that requires the Q community's attention. Other water quality recommendations, such as the adoption of °'- - the DWSP2, related to drinking water protection, would not -be -considered or L) implemented.
