2023-53 2023-53 Resolution Setting Public Hearing For Enforcement Action In Connection With 1397 Route 376 At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 10, 2023. WHEREAS, an Order to Remedy has been issued for property located at 1397 Route 376 in the Town of Wappinger pursuant to Chapter 185 of the Town of Wappinger Code; and WHEREAS, said Order to Remedy has not been complied with; now, therefore BE IT RESOLVED, that the Town Board of the Town of Wappinger does hereby set the 24th day of April, 2023 at 7:00 p.m. at the Town Hall, Town of Wappinger, 20 Middlebush Road, Wappingers Falls, New York as and for the time, date and place of a public hearing to determine whether the property is in compliance with the standards of the Property Maintenance Law of the Town of Wappinger (Chapter 185 of the Town Code); and BE IT FURTHER RESOLVED, that the owner, lessee, tenant, occupant or other person having charge of the property has an opportunity to appear and be heard at said public hearing to offer proof that the property is in compliance with the standards of Chapter 185; and BE IT FURTHER RESOLVED, that if the property owner, lessee, tenant, occupant or other person having charge of the property does not comply with this Order to Remedy, the Town of Wappinger intends to enter onto the property, take corrective action and assess the costs of the corrective action as a lien against the property and levy such lien on the Town tax bill, if not paid; and BE IT FURTHER RESOLVED, that if the owner, lessee, tenant, occupant or other person having charge of the property does not comply with this Order to Remedy, the Town of Wappinger intends to enter onto the property and remove the vehicles listed in the Order to Remedy and dispose of them; and BE IT FURTHER RESOLVED, that the corrective actions listed in the Order to Remedy are in addition to any enforcement actions that are pending or may be brought in any court of competent jurisdiction; and BE IT FURTHER RESOLVED, that this Resolution shall take effect immediately.
