Beth Devine and the Wappinger Historical Society came to the podium to speak with the board.
She thanked the board for their support particularly the recent restoration of a map.
4. Dwight Bonk WCSD Superintendent of Schools Annual Budget Report
COMMENTS - Current Meeting:
Superintendent of Schools Dr. Bonk addressed the Town Board. The business manager came
unprepared to present her PowerPoint presentation, so they asked to have the presentation
attached to the minutes.

The following presentation details the presentation:
The proposition one is a $287 million budget. The goal is to provide the support for children.
This the second year that the proposed budget in under the tax cap. He cites a 1.67% increase.
The increase is $20 million of which some came from NY State who advocates to our schools.
The board has monies in reserve to avoid a volatility in rates. He proposed a K8 special
education plan which will be paid by the fund balance. The plan will be offered district wide and
will use $500K of fund balance to improve the landscaping throughout the district. The road
connecting Middlebush Road to South Mesier Avenue will be paved this summer and will
probably be shut down this summer to repair the WJHS roundabout. Many items throughout the
district will be paid for out of fund balance. Six positions will be converted by replacing
contractors with teachers at no cost. They will increase funding for instructional supplies.
Plumbing, electrical and welding will be enhanced to prepare students for tomorrow's jobs. 64%
comes from taxpayers the rest from NY State. The district has 2,000 employees and 10,000
students. He said the last school built in the district was John Jay High School paid for with
1969 dollars. He warned that over development would result in the need for another school or
addition to the Junior High Schools.
Proposition 2 is Diesel and gasoline bus replacements. Retirement of 12 years. Budget vote is
May 16 7:30 until 9PM

Resolution Introducing Local Law No. 3 Of The Year 2023, "Amending Chapter 122 Of
The Code Of The Town Of Wappinger To Update Fees And Fines"
COMMENTS - Current Meeting:
Barbara Roberti said the only change to residential fees and fines are fire inspectors and expired
building permits which place a fine of up to 50% of the cost of the project by the property owner.
Councilman Casella mentioned an amnesty for only the first year.

1. Re -Introduction 9-Element Plans For Wappinger Creek and Sprout Creek - Thurston
Supervisor Thurston explained the 9 part plan. The plan was over 400 pages long and could not
attach it to the agenda.
2. Motion To: Spend up to $50,000 from the A -Fund to Repair the Carnwath Administration
Building Roof Replacement
COMMENTS - Current Meeting:
Steve Frazier addressed the board regarding the quote from Vanguard. No quote was given to
the Town Clerk for recording in these minutes. The amount was said to be $47,170. Al Casella
suggested up to $50,000 out of the A -Fund to get this done.

4. Frazier/Casella Project Update
Discussions included but no action was taken:
* Paving of Regency Park
* Update on Martz tennis court re -surfacing - when are they coming to do the work.
* Al Casella asked, can we set up a second pickle ball court now since we have the nets and
polls. Residents would like a 3" court as well so we need to address . More people are
playing pickle ball then tennis. I know we have to order another set of nets and poles to
make a third quart. Steve suggested pricing from a few months ago. Steve has the
funds in his line and will purchase and will get a date.
* Light on a shed was also discussed at Rockingham Park. Steve will change the light and
get a sensor.

Mr. MacGregor came to the podium to address the board. The Town Clerk swore Judith Subrize
in. Craig Wallace explained the procedure to testify under Chapter 185. Judith provided the
Town Clerk with a flash drive. Craig Wallace asked questions that are detailed on the Town's
website video.
Mr. MacGregor appeared to refute the claims of Judith Subrize. He stated that the remedy is
being taken care of at this moment. The details of his discussion is on the Town's website video.

Resolution Declaring May 2023 to be Older Americans Month
in the Town of Wappinger
WHEREAS, older adults, considered to be of the age of 65 and older, have always been a vital source of strength
and resilience in Dutchess County and especially in the Town of Wappinger, and
WHEREAS, older Americans contribute their time and wisdom to make our community stronger, more informed,
and better connected. They are our loved ones, friends, mentors, essential workers, volunteers, and neighbors.
WHEREAS, our older persons are diverse, respected residents who continue to contribute to our Town's social and
economic well-being as they live longer, healthier, and more productive lives, many even starting second careers,
and
WHEREAS, the older residents of the Town of Wappinger are representative of an unprecedented trend in the
nation's demographic makeup, and
WHEREAS, our community is stronger when people of all ages, abilities, identities, and background are included
and encouraged to make their mark, and
WHEREAS, our older adults may need additional or adapted recreation, transportation, housing, healthcare, civic,
and communication services in order to maintain their physical, mental and emotional health and live fully and
joyfully, and
WHEREAS, our community can support older adults by promoting inclusion, independence, and innovation
through ongoing awareness and education efforts, and
WHEREAS, moving forward, we must ensure that our older Americans have the appropriate resources to maintain
their independence and stay connected to our community, and
WHEREAS, as America grows older, our community must strive to understand and address the evolving challenges
and needs of our older citizens and the people who care for them. We celebrate their achievements and recommit to
providing our elders with the support and services they need to thrive and age with dignity, and
WHEREAS, the opportunities and challenges that lie ahead require us to "think differently' about health and long
term care, and work together to ensure that older Americans can age strong, long and with dignity, and.
WHEREAS , during Older Americans Month, May 2023, and every month of every year, let us pay tribute to the
seniors who raised and guided us throughout our lives, and let us renew our commitment to honoring their
contributions by giving them the fullest care, support, and respect they deserve.

Declaring May 2023 to be Mental Health Month in the Town of
Wappinger
WHEREAS, mental illness is a medical condition that disrupts a person's thinking, feeling, mood, ability to
relate to others, and daily functioning;
WHEREAS, regardless of race, nationality, age, religion, or economic status, mental illness impacts at least
one in four adults and one in five young folks aged 13-18, and one in seventeen people live with serious and
chronic mental health conditions such as schizophrenia, bipolar disorder; and major depression; and
WHEREAS, an estimated 22 veterans die by suicide each day; and
WHEREAS, all Americans experience times of difficulty and stress in their lives, and mental illnesses often
result in a diminished capacity for coping with the ordinary demands of life; and
WHEREAS, medical and other treatments through medical action and counseling is an effective way to reduce
the burden of mental health illnesses (90% of all mental illness is treatable); and
WHEREAS, there is strong research that animal companionship, humor, spirituality, religion, recreation, social
connections, and work -life balance can help all Americans protect their health and well-being; and
WHEREAS, each business, school, government agency, healthcare provider, organization, and resident shares
the burden of mental health problems and has a responsibility to promote mental wellness and support
prevention efforts; and
WHEREAS, it is time to take action for individuals and families living with mental health conditions and to
provide support and educate our peers, and to DO OUR PART; and
THEREFORE BE IT RESOLVED the members of the Board of the Town of Wappinger, do
hereby proclaim the month of May 2023 as Mental Health Month and calls upon the citizens,
government agencies, public and private institutions, businesses, and schools in Wappinger to
recommit our community to increasing awareness and understanding of mental health, the steps
our citizens can take to protect their mental health, and the need for appropriate and accessible
services for all people with mental health conditions.

Resolution Making SEQRA Determination For Fleetwood
Sewer District Planning Study
WHEREAS, the Environmental Facilities Corporation (EFC) awarded a $30,000
Engineering Planning Grant (EPG) to the Town of Wappinger for an engineering report to
identify sources of inflow and infiltration in the Fleetwood Sewer District, evaluate alternatives,
and recommend improvements to the Town of Wappinger's wastewater collection system; and
WHEREAS, Title 6 of the New York Code of Rules and Regulations (6 NYCRR)
Section 617.5 under the State Environmental Quality Review Act (SEQRA) provides that certain
actions identified in subdivision (c) of that section are not subject to environmental review under
the Environmental Conservation Law; now, therefore
BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby determines
that the proposed engineering study to identify sources of inflow and infiltration in the
Fleetwood Sewer District, evaluate alternatives, and recommend improvements to the Town of
Wappinger's wastewater collection system is a Type II action in accordance with 6 NYCRR
Section 617.5(c) (27) which provides that "conducting concurrent environmental, engineering,
economic, feasibility and other studies and preliminary planning and budgetary processes
necessary to the formulation of a proposal for action, provided those activities do not commit the
agency to commence, engage in or approve such action;" is a Type II action and is therefore not
subject to further review under 6 NYCRR Part 617; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to provide a

WHEREAS, the Environmental Facilities Corporation awarded a $30,000 Engineering

WHEREAS, the conditions of the EPG program require the Town of Wappinger to
appropriate 20% matching funds for the project; now, therefore
BE IT RESOLVED, that the Town of Wappinger Town Board authorizes and
appropriates a minimum of 20% local match as required by the Engineering Planning Grant
Program (EPG) for the Fleetwood Sewer District Study. Under the EPG program, this local match
must be at least 20% of the EPG grant award of $30,000. The source of the local match, and any
amount in excess of the required match, shall be funded through the unallocated fund balance of the
Fleetwood Sewer District and the General Fund. The maximum local match shall not exceed $6,000
based upon a total estimated maximum project cost of $30,000.00. The Town Supervisor may
increase this local match through the use of in -kind services without further approval from the
Town of Wappinger Town Board; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to provide a

WHEREAS, certain infrastructure funding programs distributing state and federal funds require
that contracts for all engineering or architecture contracts such programs be procured through a
qualified Request for Qualifications process that meets certain standards; and
WHEREAS, the Town of Wappinger is seeking grants and loans for such projects from NYS
Environmental Facilities Corporation which require an RFQ process and it is foreseeable that
other funding sources requiring an RFQ process may become available; and
WHEREAS, the Town has prepared a Request for Qualifications in the attached form to solicit
the qualifications of acceptable engineering firms;
NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger
hereby adopts the attached Request for Qualifications to solicit qualified engineers for
infrastructure projects; and
BE IT FURTHER RESOLVED, that the Town Board authorizes and directs the Town Clerk to
publish the annexed RFQ and open all documents received by of May 15, 2023 at 4 PM upon the
opening date at and forward the Qualifications to the Town Board for further action; and
BE IT FURTHER RESOLVED, that the Town Board designates the Town Board to review the

ARCHITECTURAL/ENGINEERING SERVICES PROCUREMENT FOR
EFC FUNDED PROJECTS
Municipalities requesting financing for architectural/engineering ("A/E") services must
procure A/E services in accordance with certain qualifications -based requirements. This
guidance document describes the types of services that are considered A/E services and
how these A/E services must be procured.
Please Note: This guidance document applies to all projects financed by the
Environmental Facilities Corporation ("EFC') whose A/E services are procured after
10/1/2022.1
If a municipality is seeking project financing for A/E services that were not procured
pursuant to this guidance document, EFC will only finance such A/E services if:
1. The procurement occurred before 10/1/2022;
2. A financing application is submitted for the project prior to June 16, 2023;
and
3. A project finance agreement is entered into for the financing of such project
prior to October 1, 2024.
What types of services are covered A/E services?
Contracts for program management, construction management, feasibility studies,
preliminary engineering, design, engineering, surveying, mapping, or A/E services as
defined in 40 U.S.C. 1102(2)(A-C):
(A) professional services of an architectural or engineering nature, as defined
by state law, if applicable, that are required to be performed or approved by a
person licensed, registered, or certified to provide the services described in this
paragraph,
(8) professional services of an architectural or engineering nature performed
by contract that are associated with research, planning, development, design,
construction, alteration, or repair of real property, and
(C) other professional services of an architectural or engineering nature, or
incidental services, which members of the architectural and engineering
professions (and individuals in their employ) may logically or justifiably perform,
including studies, investigations, surveying and mapping, tests, evaluations,
consultations, comprehensive planning, program management, conceptual
designs, plans and specifications, value engineering, construction phase
services, soils engineering, drawing reviews, preparation of operating and
maintenance manuals, and other related services.

A municipality that entered into a project finance agreement with EFC before October 1, 2022 should
reach out to EFC to discuss any new procurement of A/E services. Q

How must A/E services be procured?
Municipalities must procure A/E services pursuant to the provisions of 40 U.S.C. 1101
et seq. In general, these require-
(i) Public announcement of the solicitation (e.g., a Request for Qualifications);
(ii) Evaluation and ranking of the submitted qualifications statements based on
established, publicly available criteria (e.g., identified in the solicitation).
Evaluation criteria should be based on demonstrated competence and
qualification for the type of professional services required (e.g., past
performance, specialized experience, and technical competence in the type of
work required);
(iii) Discussion with at least three firms to consider anticipated concepts and
compare alternative methods for furnishing services;
(iv) Selection of at least three firms considered to be the most highly qualified to
provide the required services; and
(v) Contract negotiation with the most highly qualified firm to determine
compensation that is fair and reasonable based on a clear understanding of the
project scope, complexity, professional nature, and the estimated value of the
services to be rendered. In the event that a contract cannot be negotiated with
the most highly qualified firm, negotiation continues in order of qualification.
How does the municipality show compliance with the federal A/E procurement
requirements?
Municipalities will be required to execute an Environmental Facilities Corporation
Certification for Architectural/Engineering Services Procurement for Federally Funded
Projects in the form attached to this guidance. The Certification must be signed by an
authorized representative of the municipality. It cannot be signed by a hired contractor or
consultant.
What A/E documentation does a municipality need to keep?
The Certification for Architectural/Engineering Services Procurement for Federally
Funded Projects and documentation evidencing completion of the procurement steps
outlined above are required to be kept on file by the municipality and be made available
for inspection upon EFC's request. These documents must be kept for the term of the
EFC financing plus 6 years consistent with the other records required to be kept pursuant
to the Project Financing Agreement for the project.
Are contract amendments subject to federal A/E procurement requirements?
Significant contractual amendments are subject to this requirement. Significant
contractual amendments are amendments to existing contracts that have a value greater
than $100,000 AND introduce a new scope of work or task.

Engineering Services for the
Town of Wappinger
The Town of Wappinger (Town) is seeking Qualifications Statements for Engineering
Services. This RFQ is for consulting services related to an awarded Engineering Planning
Grant (EPG) for the Town Wappinger. Please submit four (4) bound copies of your
qualification's statements to Joe Paoloni, Town Clerk, Town of Wappinger, 20 Middlebush
Road, Wappingers Falls, NY 12590 on or before 4 pm on , 2023.
Reference your submittals as "Engineering Services for the Town of Wappinger". The
Statements of Qualifications in its entirety shall not exceed five (5) pages (excluding a
one -page cover letter); double sided; not smaller than size 12 font. The proposal shall
include a clear table of contents addressing all the requirements of the RFQ. These
requirements will be strictly enforced.
The Town reserves the right to reject any or all Statements of Qualifications. This
invitation does not commit the Town to accept any Statements of Qualifications and does
not obligate the Town for any cost associated with the preparation of the same.

Purpose
It is the intention of this RFQ to provide the Town with a list of pre -qualified firms to be
assigned engineering and consulting tasks related to a recently awarded EPG. This RFQ
will also serve as the Town's compliance with the New York State Environmental Facilities
Cooperation ("NYSEFC") Certification for A/E Services Procurement for Federally
Funded Projects.
Evaluation
The Town will evaluate all the Statements of Qualifications to select at a consultant team.
The qualifications will be comparatively evaluated based upon the requirements stated in
the body of this RFQ. After reviewing the Statement of Qualifications, the consultants will
be ranked on their:
• Demonstrate the ability to meet (or exceed) MWBE and SDVOB goals with projects
— 15%
• Familiarity of the service area/region and history of similar relationships with
communities, utilities, and/or municipalities — 20%
• Staff/Firm expertise — 35%
• Ability to provide a wide range of services consistent with the list under the
"Professional Service" Heading — 30%
Agreements and Project Assignments
It should be noted that the consultant team will be selected based on the evaluation
criteria. The scope of services, fee proposal, and negotiations will occur as the specific
project is assigned to a consultant. Once a scope of services and fee is successfully
negotiated, the Town shall issue a purchase order authorizing the consultant to proceed.
The selection of a consultant will be valid for a period of one (1) year from the date of
Town Board approval and the Town reserves the right to renew the selected consultant
for additional time if necessary.
Professional Service
The following is a general framework of services that could be provided by the Consultant.
Services should not be limited by this framework. Instead, the scope of services will be
tailored to the individual project, its budget, schedule, and nature of work. Consultant
teams submitting responses to this RFQ shall consider the following as potential projects.
• Assessment of Existing Conditions and Infrastructure
• Project initiation reports (feasibility analysis, master planning, alternative
conceptual design options with order of magnitude cost implication, consideration
to future expansion, etc.)
• Schematic design
• Design Development (Draft Design Reports, Preparation of Final Design Reports)
• Structural /Civil Engineering
• Architectural Services
• Environmental permitting
• Surveying services including ROW surveys
• Project Cost and monitoring Control
• CAD/Mapping/drafting Services
• Design and Manage Water and Sewer Capital Improvement Projects
Statement of Qualifications Content
• A statement is required of each firm submitting qualifications that best describes
the firm's understanding of this undertaking, their unique qualifications, their
knowledge of government/public utility projects, and flexibility in implementing
projects of varied scope and nature.
• A list of communities/clients and dates where you have provided similar services.
• Provide the following information:
o A statement clearly indicating that your firm has the capacity to enter into
the Services Agreement should you be selected for the specific project.
o Indicate the primary location of the offices where the work would be
performed.
o An organizational chart indicating the staff that may be assigned to the
contract and their responsibilities.
o Demonstrate the ability to perform small projects (less than $50,000) in a
timely manner.
General Information
To be selected, the Consultant needs to be a licensed and authorized by the State of New
York to practice Engineering.
The chosen consultant shall not be permitted to subcontract any or all the work performed
without first obtaining written permission from the Town.

Resolution Ordering The Abatement Of Property Maintenance
Violations At 1397 Route 376
WHEREAS, the JULIET S. MCGREGOR LIVING TRUST is the last known owners of
real property shown on the tax records and the tax map of the Town of Wappinger as Tax Parcel
ID 4 6259-04-947067, having a street address of 1397 Route 376 ("Property"); and
WHEREAS, the Town of Wappinger received complaints that debris, garbage, rubbish,
and junked cars had accumulated on the Property; and
WHEREAS, an Enforcement Official of the Town of Wappinger observed the existence
debris, garbage, rubbish, and junked cars on the property in violation of §§185-3(D), §185-3(E),
and § 185-3(G). of the Town of Wappinger Code on April 4, 2023, and thereafter issued a
Notice of Violation & Order to Remedy dated April 14, 2023 a (copy attached as Exhibit "A" ),
which informed any person in control of the property that they had an opportunity to appear and
be heard at this meeting of the Town Board to offer proof that the property is in compliance with
the standards of Chapter 185 of the Town Code or that additional time is needed to take
corrective action to cure the violation; and
WHEREAS, an Enforcement Official of the Town of Wappinger filed a written report
with the Town Board of the Town of Wappinger noting that he/she had inspected the Property
and found that garbage, rubbish and junked cars accumulated on the Property in violation of
§§185-3(D), §185-3(E), and § 185 3(G) and the Property was not in compliance with the
property maintenance requirements of Chapter 185 of the Town Code; and
WHEREAS, a Public Hearing was held on April 24, 2023, and all parties in attendance
were permitted an opportunity to speak regarding the maintenance conditions of the Property;
and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that
Property is not in compliance with the property maintenance requirements of Chapter 185 of the
Town Code because garbage, rubbish and junked cars accumulated on the Property in violation
of §§185-3(D), §185-3(E), and § 185 3(G) and such condition has continued after the Order to
Remedy was duly issued and it is determined that abatement of the accumulation of garbage,
rubbish and junked cars on the Property is now required;
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board of the Town of Wappinger hereby authorizes and directs the Town Board,
a licensed tow truck operator, to dispatch its tow trucks and workers to the Property to remove the
junked vehicles listed in the attached order of abatement as soon as possible and to store such
vehicles until such time that they are redeemed or disposed of in accordance with the attached
schedule of charges.
3. The Town Board of the Town of Wappinger hereby authorizes and directs 1-800-GOT-
JUNK to dispatch its vehicles and equipment to the property to remove the rubbish and debris and
to dispose of the same.

4. The contractors shall keep accurate records of the labor and material costs required to
perform the abatement work at the Property and submit them to the Town so that they can be
assessed and levied against the Property as permitted by law.
5. Claims for all work performed on the property shall be audited and approved in accordance
with Article 8 of the Town Law.
6. A notice stating the total amount due and the nature of the charge shall be mailed by the
Town to the last known address of the person whose name appears on the records in the office of
the Town Assessor as being the owner or agent or as the person designated by the owner to receive
tax bills or, where no name appears, to the premises, addressed to either the owner or the agent.
Such notice shall have stamped or printed thereon a reference to Section 185-6 of the Town Code.
The property owner shall have 10 days, after a copy of the notice establishing the costs and expenses
is received to challenge any of the costs incurred by the Town.
7. After expiration of the time period to challenge the determination of costs and expenses, the
amounts thereof shall be reported to the Assessor to the Town to be levied and assessed against the
property, and the expense so assessed shall constitute a lien and charge on the property on which it
is levied until paid or otherwise satisfied or discharged and shall otherwise be collected in the same
manner and at the same time as other Town charges.
8. The Town Clerk is directed to mail the annexed Order of Abatement (copy attached as
Exhibit `B") within two (2) days hereof to the Property Owner at the addresses shown on said
Order.
Work will begin on or after May 2 and be stayed until close of busines May 3. The newly
registered car will be kept on the driveway. The newly registered boat will be kept 25 feet from
the property border.

PLEASE TAKE NOTICE that the Deputy Zoning Administrator ("Enforcement Official") of the Town
of Wappinger observed the accumulation of debris, garbage, rubbish, and junked cars on the property in
violation of §§185-3(D), §185-3(E), and § 185 3(G) of the Town of Wappinger Code on April 4, 2023,
and thereafter issued a Notice of Violation & Order to Remedy dated April 14, 2023 which directed that
the violation on your property be cured on or before April 24, 2023.
In accordance with Chapter 185 of the Town Code, the Enforcement Official filed a written report with
the Town Board of the Town of Wappinger noting that he/she has inspected the Property and found that
accumulation of debris, garbage, rubbish, and junked cars on the property was in violation of
§§185-3(D), §185-3(E), and § 185 3(G) of the Town of Wappinger Code and the Property was not in
compliance with the property maintenance requirements of Chapter 185.
At its April 24, 2023 meeting, the Town Board of the Town of Wappinger considered the report of the
Enforcement Official and any evidence presented at the meeting and, pursuant to the provisions of
Chapter 185 of the Town Code, duly adopted a resolution that determined that the Property was not in
compliance with the property maintenance requirements of Chapter 185 because of an accumulation of
debris, garbage, rubbish, and junked cars on the property and said Property was in violation of
§§185-3(D), §185-3(E), and § 185 3(G) of the Town of Wappinger Code.
PLEASE TAKE FURTHER NOTICE that the Town Board authorized to enter
onto the Property to remove the following vehicles that are in violation of the Town Code to a secure
location for storage until such time as they are redeemed by the owner or otherwise disposed of:

PLEASE TAKE FURTHER NOTICE that these proceedings have no effect on any other enforcement
proceedings that the Town has brought in Justice Court.
If the vehicles, debris, garbage, and rubbish have been removed from the Property, please notify the
Town of Wappinger Code Enforcement Department immediately at (845) 297-6256.
