This is a real issue. The leading case came out of the Town of LaGrange. � am sure you are famiiliar with it.
This escrow demand appears tobacalculated onaper lot basis. That does not meet constitutional muster,
We are looking to proceed on sketch �an basis until we get a lot count with which we can go back to the Town
Board. The Town Board will then act in accordance with its representation in its repeal message of January 23, or it will
not. Until that decision is made, we will not have any idea of the scope or nature of the issues confronting the
applicant. At that point we will know what is in front of us, and can plan an appropriate escrow.
My suggestion is that we set an escrow that is rationally related to the task of concluding sketch plan review and
establishing sketch plan lot count. VVetake ittothe Town Board. Based onwhat they do, ordom^t,w/ecome back and
establish second escrow tmgVforward with the application. Ufweagree nnthe number, there will bemoreason to
examine the constitutionality ofthe means bxwhich itwas calculated.
VVewant tobeimfront ofthe Planning Board atthe next meeting. \Neare not paying $52Kfor that right unless you can
convince me that the per lot calculation, presently employed by the Town, is constitutional. |fyou cannot doso, and if

Please advise as to how this amount was calculated.
I have been involved in recent litigation over this issue in other townships and Villages on this issue. There are very strict
guidelines for setting the escrow. I have looked at the Town's statute and I don't see those standards.
I think this needs to start with a break down of the escrow with projected itemized costs, including the hourly rates of
the professionals, projection of time for reviews, and who did the calculation.
I assume these calculations are in hand in support of the $52K. Please advise.

Dear Ms. Ogunti,
Please advise as to how this amount was calculated.
I have been involved in recent litigation over this issue in other townships and Villages on this issue. There are very strict
guidelines for setting the escrow. I have looked at the Town's statute and I don't see those standards.
I think this needs to start with a break down of the escrow with projected itemized costs, including the hourly rates of
the professionals, projection of time for reviews, and who did the calculation.
I assume these calculations are in hand in support of the $52K. Please advise.
