RESOLUTION: 2024-49 Resolution Accepting American Rescue Plan Funds WHEREAS, the United States Congress adopted the "American Rescue Plan Act of 2021" ("ARPA"), and it has become law, and WHEREAS, the "ARPA" provides for financial assistance for state and local governments for eligible expenses authorized by the Act, and WHEREAS, the Town of Wappinger has received $2,267,275.23 and never formally accepted these funds, and WHEREAS, the Federal Treasury has issued guidance on how the County can utilize the funding, with funds having to be obligated by the end of 2024 and spent by the end of 2026. HLD currently serves as the Consulting Engineer to the Town of Beekman, and in that capacity, oversees the MS4 program there. In addition, we provided MS4 assistance to the Town of Fishkill when they were issued a notice of violation. Further, Eric Rogge, P.E. of our firm also oversaw MS4 programs for seven municipalities with his prior firm. Therefore, HLD is well suited to assist the Town of Wappinger with its MS4 program. As you are aware, the New York State Department of Environmental Conservation issued General Permit GP -0-24-001 for stormwater discharges from Municipal Separate Storm Sewer Systems, effective January 3, 2024. As the GP was only issued on December 13, 2023, HLD has not completely reviewed the permit requirements. One item that is due in the immediate future is submittal of a Notice of Intent (NOI) within 45 days of the effective date of coverage, or February 17, 2024. Therefore, the Town of Wappinger will need to submit the electronic NOI by that date. HLD anticipates preparing a calendar of events, paying particular attention to first year compliance with the GP in the coming days. We believe that this will help set goals, and better understand effort involved to meet compliance. The next Annual Report showing the Town's compliance would be due April 1, 2025. Following preparation of the calendar, we expect that we can estimate effort and budget to provide compliance for the coming year. In the meantime, attached is our proposed rate schedule for your information, which is similar to our current agreement with the Town of Beekman. Private developers typically establish an escrow for during construction inspections, and are billed in accordance with our standard rates. We offer the Town of Wappinger the discounted billable rates for work associated with all non -escrow work being completed for the Town. To submit a qualifying application for the program, the Department of Agriculture and Markets requires a letter of endorsement from the municipality in which the proposed project is located. Dutchess Land Conservancy respectfully requests a letter of endorsement from the Town of Wappinger to support our application. Proposal Summary: The property is utilized by Emerald Creek farm as a commercial equine operation which includes boarding, foaling, and training of horses and horse -riding instruction. Majority of the property is engaged in agricultural use all of the farm consists of high-quality farm soils. The property contains six acres of federal wetlands, and is part of two watersheds — the Fishkill Creek and the Wappinger Creek. This property is located within a critical mass of over 440 acres of active farmland within the Town, all within Agricultural District 22 and receiving the agricultural exemption. The property is also located within Priority Areas identified in the 2015 Dutchess County Agriculture and Farmland Protection Plan. Project fits with Town Priorities: In discussing "Community Appearance and Character", the Comprehensive Plan identifies farms and open spaces as making Wappinger an attractive place to live (page 48) and includes the objective to, "Protect important landscapes through open space and farmland conservation." The Comprehensive Plan further recommends that the Town should consider making use of the New York Agricultural and Farmland Protection Program, the Dutchess County Partnership for Manageable Growth, and/or other farmland and open space protection programs and funding sources. (page 55). Most of the property is located within the R -3A Residential Area zoning district which is described in the Town's zoning code as a sensitive area to be developed only at very low density because of its scenic values, slopes and/or wetlands. The Comprehensive Plan describes the intention of this district as being, "...to help preserve open space in the areas furthest from central sewer service and in areas with clusters of protected forest and parkland and working farms." (page 91). The Comprehensive Plan also identifies an objective of preserving the quality and quantity of the Town's biodiversity through protection of endangered species to achieve the goal of encouraging the preservation of environmentally significant features. This property falls within Known Important Areas for Rare Wetland Animals and an Important Bat Foraging Area as identified by the New York Natural Heritage Program. This conservation easement would directly preserve a site the town has identified as having significance and make perpetual an intention described in the Town's zoning, and this request for endorsement will enable the DLC and landowners to apply to a funding source identified in the Comprehensive Plan. Property protected by conservation easement remains in private ownership. All structures built on the property are subject to town zoning laws.
