RESOLUTION: 2024-71
Resolution Accepting Undertaking Secured By Decommissioning Bond In Connection With
Old Myers NY LLC
WHEREAS, Old Myers NY, LLC ("Owner") is the owner of a 38.09 acre parcel of real property located at 22
Old Myers Corners Road in the Town of Wappinger designated as Tax Parcel 135689-6258-03-376432
(the "Property"), and
WHEREAS, the Owner has entered into an agreement with the Town of Wappinger whereby the owner
agrees to completed decommissioning in accordance with the Decomissioning and Site Restoration Plan
dated March 2023, and
WHEREAS, the Owner has delivered to the Town a surety bond from Harco National Insurance Company,
an Illinois corporation duly authorized under the laws of the State of New York, in the amount of
$81,030.00 as security for the restoration of the property and the decommissioning of the solar farm,
and
WHEREAS, the terms of the Undertaking and the bond authorize the Town of Wappinger to draw against
the aforementioned Decommissioning Bond in the event the Owner does not receive site plan approval
and the project site is not restored in accordance with the terms of the Undertaking.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby determines that the Surety Bond of Harco National Insurance
Company in the amount of $81,030.00 (the "Bond") is acceptable and sufficient as a guarantee to secure
the obligation to restore the project site in the event the Owner does not fulfill its obligations as
provided in the Undertaking.
2. The Town Board hereby accepts (the "Bond") in the total sum of $81,030.00, as security for the
faithful performance for the completion of the obligations set forth in the Undertaking.
3. The Town Clerk is directed to file the bond in his office until such time as the Bond is called
upon or returned.

Brian Kolb from Carnwath community farming approached the board to update on their second
season of farming at Carnwath.

RESOLUTION: 2024-65
Resolution Approving Full Salaries For Town Of Wappinger Employees
WHEREAS, salaries for two Town of Wappinger employees were fully budgeted but not reflected in
Resolution 2024-32, and
WHEREAS, it is the is the intent of the Town Board to approve the full salary which includes the amounts
budgeted for in the water/sewer funds, and
NOW THEREFORE BE IT RESOLVED, that the Town Board approves the budgeted salaries as follows:
Christian Harkins - $116,745.81 (50% paid by the Town of Fishkill)
Lee Anne Freno - $86,898.00

Resolution Promoting Employee To Junior Accountant
WHEREAS, Graceanna Overton has been employed in the Comptroller's Office as a full-time provisional
Account Clerk, and
WHEREAS, the Town Supervisor Joseph D. Cavaccini and Town Comptroller Jessica Servidio advises that
Ms. Overton exhibits an excellent work ethic and eagerness to learn and she is an asset to the operation
and function of the Town government, and

WHEREAS, the Town has identified the Junior Accountant position to best place Ms. Overton as a part of
the restructuring of the Comptroller's Office, and
WHEREAS, the full time Junior Accountant position is a competitive position under Civil Service Law
which is subject to competitive examination, and
WHEREAS, the full-time Junior Accountant position is a confidential appointment and is not subject to
the terms of any Collective Bargaining Agreement between the Town of Wappinger and its Collective
Bargaining units, and
NOW, THEREFORE, BE IT RESOLVED:
1. Graceanna Overton is hereby appointed to the full-time civil service job title Junior Accountant,
effective January 22, 2024.
2. Graceanna Overton shall be retroactively compensated at the salary of $70,000.00 for the 2024
fiscal year which shall be paid in bi-weekly installments.
3. The appointment is subject to the approval of the Dutchess County Department of Human
Resources and is further subject to Civil Service Law and the Rules of New York State and the Dutchess
County Department of Human Resources. The appointment is subject to a probationary term of not less
than eight nor more than twenty-six weeks in accordance with the rules of the Dutchess County
Department of Human Resources.

Metropolitan Transportation Authority

Resolution Authorizing MJM Television And Video Productions To Record The Dutchess
County St. Patric
WHEREAS, the Town of Wappinger wishes to enhance the quality of life of its residents through
celebrations and special events, and
WHEREAS, the Dutchess County St. Patrick's Parade (parade) is a time honored tradition in the Town of
Wappinger and it is has been the precedent of the Town to cover the cost to record and produce a video
of the parade for those who cannot attend and for prosperity, and
NOW THEREFORE BE IT RESOLVED, that the Town Board does hereby accepts the estimate from MJM
Television and Video Productions dated February 5, 2024 of $2,600.00 to record and produce a video of
the parade on March 2, 2024.

WHEREAS, an abandoned vehicle was left at Wappinger Town Hall, and
WHEREAS, in an effort to identify the owner, the vehicle was towed to the Town Buildings and Grounds
Facility, and

RESOLUTION: 2024-70
Resolution Authorizing Installation Of Street Lighting Throughout The Town of
Wappinger
WHEREAS, Town Supervisor Joseph D. Cavaccini has identified areas in Town that are poorly lit, and
WHEREAS, it is necessary to install street lighting along the roadway to provide drivers at night visibility
of vehicles entering into intersections and to be aware of pedestrians, and
WHEREAS, the "t -intersections" where Stonewall Drive, Padasana Court, Astor Hill Drive, Lane Gate
Road, Old All Angels Hill Road, and Brown Road meet All Angels Hill Road have been identified as areas
of need for street lighting, and
WHEREAS, the "t -intersections" where Furnia Drive and the main entrance of the Hudson
Valley Regional Airport meets New Hackensack Road have also been identified as areas of
need for street lighting, and
WHEREAS, along the roadway in front of 48 Top O Hill Road has also been identified, and
WHEREAS, the locations of the proposed street lights are outside the boundaries of any lighting district
established in the Town of Wappinger, and
WHEREAS, pursuant to the authority granted by Town Law §64(19), the Town Board may contract for
street lighting on highways in the Town, and
WHEREAS, Central Hudson Gas & Electric Corporation ("CHGE") provides street lighting within its service
area pursuant to a Tariff Approved by the New York State Public Service Commission, and
WHEREAS, CHGE has provided the attached Street Lighting Authority Order which sets forth the rental
costs for the street lights and poles, and

WHEREAS, the Town Comptroller has advised that a budget modification is required to pay for the rental
fees for the new lights, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
The Town Board hereby accepts the terms of the Street Lighting Order which provides for a monthly
rental fee of $1,691.28 for nine LED luminaires plus the cost of electricity and authorizes the Town
Supervisor to sign the Street Lighting Order on behalf of the Town, and
BE IT FURTHER RESOLVED that the Town Board hereby authorizes the following budget line transfers for
the rental of the Street Lighting & electric service:

Resolution Honoring Black History Month In The Town Of Wappinger
WHEREAS, each February, Black History Month celebrates the many achievements and contributions
made by African Americans to our economic, cultural, spiritual, and political development and is
deserving of recognition and honor, and
WHEREAS, Black History Month grew out of the work of prominent African Americans including noted
historian Carter G. Woodson, who founded what is known today as the Association for the Study of
African American Life and History, and who founded an initial commemorative week that inspired
schools and communities nationwide to organize local festivities, establish history clubs and, host
performances and lectures that have since morphed into a month-long celebration, and
WHEREAS, in 1976, President Gerald R. Ford officially recognized Black History Month and called upon
the public to "seize the opportunity to honor the too -often neglected accomplishments of black
Americans in every area of endeavor throughout our history;", and

WHEREAS, a key element of dialogue on Race, Equity, Diversity and Inclusion is celebrating the diversity
of cultures that we are proud to have as part of our community, and promoting an inclusive community

NOW, THEREFORE, BE IT RESOLVED, that I, Joseph D. Cavaccini, Town Supervisor of the Town of
Wappinger, and the members of the Town Board of the Town of Wappinger, do hereby acknowledge
Black History Month in the Town of Wappinger, and encourage our residents to honor and
commemorate the history of African Americans in our community, state and nation.

Whereas, the Principal and Obligee have entered into an agreement whereby principal agrees to
complete decommissioning in accordance with the Decomissioning & Site Restoration Plan,
which said agreement, dated March 2023, is hereby referred to and made a part hereof; and
Whereas, said Principal is required under the terms of said agreement to furnish a bond for the
faithful performance of the decommissioning referred to in said agreement.
Now, Therefore, the condition of this obligation is such that if the above bounded Principal, his or
its heirs, executors, administrators, successors or assigns, shall in all thing stand to and abide by, and
well and truly keep and perform the decommissioning provisions in the said agreement and any
alteration thereof made as therein provided, on his or their part, to be kept and performed at the
time and in the manner therein specified, and in all respects according to their true intent and
meaning, and shall indemnify and save harmless the Obligee, its officers, agents and employees, as
therein stipulated, then this obligation shall become null and void; otherwise it shall be and remain in
full force and effect.
Provided further, that if the Principal fails to respond to the Obligee's notice of default or fails to
perform its Decommissioning responsibilities as outlined in said agreement the Surety shall promptly
and at the Surety's election and expense take one of the following actions:
1. Arrange for the Principal, with consent of the Obligee, to perform and complete the
Decommissioning; or
2. Undertake to perform and complete the Decommissioning itself though its agents or
through independent contractors; or
3. Waive its right to perform the Decommissioning and forfeit the full bond penalty to the
Obligee.
The surety may cancel this bond at any time by giving the Obligee sixty (60) days written notice of
its desire to be relieved of Liability. Should the Principal fail to provide a replacement bond or
alternate financial assurance acceptable to the Obligee within thirty (30) days of the receipt by the
Obligee of the Notice of Cancellation, the surety may choose to reinstate this bond, otherwise the
Surety will be in default and shall forfeit the full- Penal Sun of this Bond to Obligee.

2. Graceanna Overton shall be retroactively compensated at the salary of $70,000.00 for the 2024
fiscal year which shall be paid in bi-weekly installments.
3. The appointment is subject to the approval of the Dutchess County Department of Human
Resources and is further subject to Civil Service Law and the Rules of New York State and the Dutchess
County Department of Human Resources. The appointment is subject to a probationary term of not less
than eight nor more than twenty-six weeks in accordance with the rules of the Dutchess County
Department of Human Resources.

Resolution Authorizing Installation Of Street Lighting
Throughout The Town of Wappinger
WHEREAS, Town Supervisor Joseph D. Cavaccini has identified areas in Town that are poorly lit, and
WHEREAS, it is necessary to install street lighting along the roadway to provide drivers at night visibility
of vehicles entering into intersections and to be aware of pedestrians, and
WHEREAS, the "t -intersections" where Stonewall Drive, Padasana Court, Astor Hill Drive, Lane Gate
Road, Old All Angels Hill Road, and Brown Road meet All Angels Hill Road have been identified as areas
of need for street lighting, and
WHEREAS, the "t -intersections" where Furnia Drive and the main entrance of the Hudson
Valley Regional Airport meets New Hackensack Road have also been identified as areas of
need for street lighting, and
WHEREAS, along the roadway in front of 48 Top O Hill Road has also been identified, and
WHEREAS, the locations of the proposed street lights are outside the boundaries of any lighting district
established in the Town of Wappinger, and
WHEREAS, pursuant to the authority granted by Town Law §64(19), the Town Board may contract for
street lighting on highways in the Town, and
WHEREAS, Central Hudson Gas & Electric Corporation ("CHGE") provides street lighting within its service
area pursuant to a Tariff Approved by the New York State Public Service Commission, and
WHEREAS, CHGE has provided the attached Street Lighting Authority Order which sets forth the rental
costs for the street lights and poles, and
WHEREAS, the Town Comptroller has advised that a budget modification is required to pay for the rental
fees for the new lights, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
The Town Board hereby accepts the terms of the Street Lighting Order which provides for a monthly
rental fee of $1,691.28 for nine LED luminaires plus the cost of electricity and authorizes the Town
Supervisor to sign the Street Lighting Order on behalf of the Town, and
BE IT FURTHER RESOLVED that the Town Board hereby authorizes the following budget line transfers for
the rental of the Street Lighting & electric service:

WHEREAS, each February, Black History Month celebrates the many achievements and contributions
made by African Americans to our economic, cultural, spiritual, and political development and is
deserving of recognition and honor, and
WHEREAS, Black History Month grew out of the work of prominent African Americans including noted
historian Carter G. Woodson, who founded what is known today as the Association for the Study of
African American Life and History, and who founded an initial commemorative week that inspired
schools and communities nationwide to organize local festivities, establish history clubs and, host
performances and lectures that have since morphed into a month-long celebration, and
WHEREAS, in 1976, President Gerald R. Ford officially recognized Black History Month and called upon
the public to "seize the opportunity to honor the too -often neglected accomplishments of black
Americans in every area of endeavor throughout our history;", and
WHEREAS, a key element of dialogue on Race, Equity, Diversity and Inclusion is celebrating the diversity
of cultures that we are proud to have as part of our community, and promoting an inclusive community
in which all residents -past, present, and future -are respected and treated equally, and
NOW, THEREFORE, BE IT RESOLVED, that I, Joseph D. Cavaccini, Town Supervisor of the Town of

While traveling on Osborne hill Road in the evening of ,Saturday, o

November 4, 2023, our client struck several potholes and his
vehicle was severely damaged. E

Attached are copies of repair receipts incurred and paid Q
confirming the damages amount along with photo of the potholes
at the scene of the occurrence.
The Township has a duty to keep the main roads in a
reasonably sound state of repair, this failure to do so .requires
the Township to reimburse our client for damages sustained as
this condition on the roadway has persisted for quite some time.
Please advise us of the Township's position on this matter
upon your receipt of this correspondence.
