The Verbatim Transcript is as follows: We have one discussion item on for the agenda this evening and that is processing the application and starting that process for Joey Estates and Arcadia place. Pm gonna refer this over to attorney -to -the town, Michael Liguori and engineer -to -the town, Larry Paggi. Town of Wappinger Page 2 Printed 4/4/2024 Regular Meeting Minutes March 25, 2024 Michael Liguori: Larry and I just want to bring the board up to speed. Recently the Cedar Hills project was before the board where the applicant's attorney and engineer made a presentation for a project proposed under 240-50 which is a planned development section of the zoning code and between that meeting and now the planning board had determined the lot count for the Joey estates or the Mid -Hudson project with the count of 66 units and at the last town board meeting where the Cedar Hills or Acadia project was discussed we had given the applicants representative some direction to satisfy themselves for purposes of water and sewer and just prior to this board meeting, Larry, myself, Mike Tremper, Mike is obviously runs Camo pollution control and operates the town's water facilities. We met with Amy Bombadieri, who is the engineer for those two applications, to get an idea where we stand for purposes of water and sewer for the town. Those projects in concept propose municipal sewer and municipal water. The Cedar Hills/Acadia project is located in both the sewer and the water district. The Joey Estates or Mid - Hudson project is located in the sewer district, but not the water district. Some of the items that we discussed were what we know, as far as the current state of affairs of the Tri -Muni or what is either available or not available to the best of our knowledge, as of today, which it's our belief that there are concerns about sewer availability, concern of what capacity is there? Is there any capacity as of today? Is there capacity available in the future? We don't know those answers, but we do have concerns about whether or not there is based on recent meetings that board members have had. Larry and I are actually gonna be meeting with the O&M representatives, the operation maintenance portion of that board tomorrow just to bring ourselves up to speed so that we have an understand what's going on for purposes of our existing town residents that are connected to sewer and water. Where this all goes in the context of these two projects is; both of those projects require the discretion of the board. Joey, Mid- Hudson is a request under 240-19 for an average density subdivision and under that criteria the town board would be permitted to authorize the planning board to lessen the zoning requirements. It wouldn't allow them to change the units, but it would allow the planning board to lessen those requirements to have a more consolidated or condensed type subdivision. For Cedar Hills/Acadia, under 240-50, that's a planned development district and that also requires discretion of the board under a special permit they'd have to satisfy a number of criteria; and, if they satisfy those criteria then the board would contemplate either to grant or deny the special permit. One of the things that Larry and I wanted to be able to do was to be able to give the applicant some direction as to what preferences the board they have as to what they would like to see out on those particular properties, whether it was apartments, townhouses, single-family residential, as of right now both projects contemplate a mix of either townhouse or condo and single-family so we'd like to be able to provide some insight for the board and give them some direction as to whatever preferences the town board may have. I know I've spoken to a number of you guys off-line individually to attempt to get some sort of polling as to whether or not there's a preference but we've never had a point at least with Larry and I and then the board is it's currently comprised as to know what that is so as of today, what I can glean and I guess I just be asking the board to confirm this is what I've gleaned from the board members is a preference to stick as close as possible to the zoning code as it's currently configured without the use of these two sections as a some form of direction as a preference for single-family residential homes on individual parcels and if that's something that if I have correct and I would just ask you guys to say hey, that is something that we know that's our preference for what we would like to see and that would be based on that Larry and I would be able to give some direction to the applicant, his representatives as to what the preference is and then we can those move this forward, however, that looks like. In the context of Joey Estates or Mid -Hudson -that's the application coming in under 240 -19 -you know if the direction is, you Town of Wappinger Page 3 Printed 4/4/2024 Regular Meeting Minutes March 25, 2024 know, if you want to use that section of the code and you wanna come back with some alternatives for us to look at then, do so. Come back and present us you know something that we could look at that is a difference between what is a single-family home context under 240-19 and then potentially a single-family home context under 240-50. So, if that's the preference of the board then I just ask you to confirm that and Larry and I as your representative will communicate effectively and get that word across to the applicant and his representatives. Joseph Cavaccini: As I've stated on the record numerous times, and in other conversations, I have extreme reservations and approach these topics with some caution and concern that we don't have all the information. But, yes what you just summed up was the way I feel, if anything we need to be sticking to these Zoning Code, we need to be sticking to that as closely as possible, the projected plan that's shown in the comprehensive plan of medium density, single family homes, detached I believe that that is the consensus of the board of course sticking to that as much as possible. But again, I have extreme concerns when it comes to water and sewer capabilities, and the overall impact on the community but yes, you summarize that very well. Attorney Liguori: And, I just wanna have one thing where we are in the current state of affairs of the water district. We have a requirement from the health department to provide a source analysis and Larry, do I have this correct so we have, they require the updated source report and is there any other... Engineer Paggi: So, right now the situation with the water system is that the town has one well down. I should say one well has been taken off-line because of unacceptable levels of PFOS or PFOA, one of those two. Other wells are carrying the supplies where it needs to be throughout the course of the year, the wells are meeting those requirements, but there's a couple of other wells, I believe three other wells, that are also off-line for other treatment issues, turbidity, and other sediment problems with plugging that require frequent maintenance and in the summer higher use times those well are put back on-line but they're very intensive maintenance requirements. So, the health department has requested the town to evaluate those situations prior to the health department determining that the system is really capable of continuing to supply what it needs to supply, much less any additional supply. So, when Mike and I met with the applicant, we tried to be very frank and laying out what the real situation is and that there may be some time where additional improvements may need to be made to the existing water supply prior to bringing projects of this magnitude on-line. Attorney Liguori: I just want to add where that falls in the context of the two applications for the Joey Estates, Mid - Hudson project that is not in the water district so the guidance to the applicant would be, whatever project you propose, you're not in the district, you may consider proposing a project that has its own water. And if that's digging individual wells, then you're gonna have to dig individual wells. The Cedar Hills Acadia project is in the water and sewer system so it's also very relevant to be aware of what these concerns are because even if you're in the system there are hurdles that we're gonna have to get over. And, that's the advice and the guidance that we want to be able to provide that's real time data and how it affects each of these particular projects. Councilwoman Bettina: Thank you. I think that's being very transparent and I think it a win-win for both the town and Town of Wappinger Page 4 Printed 4/4/2024 Regular Meeting Minutes March 25, 2024 any developers that they have this information. Supervisor Cavaccini: And, to echo Councilwoman Bettina's comments, again this is moving it forward, we are processing this, and we are being as transparent as possible to the residents as well, as the current conditions here in the town facing us whether it's Tri -Municipal sewer commission, or our own water supply. This is, to be quite frank, is our way of notifying people, and then being as transparent and looking out for those who live here. Attorney Liguori: And then obviously, Larry and I will report back after tomorrow's meeting so that there is just a public awareness. Councilwoman Bettina: Thank you, thank you. Sheehan in a letter to the Town Board dated January 3, 2024 has recommended ten (10) roads be repaved and reconstructed for 2024; and WHEREAS, the Supervisor of Buildings and Grounds has identified that Soccerfield Drive in Rockingham Park is in need of resurfacing; and WHEREAS, an estimate for $56,690.00 from Clove Excavators was provided; and WHEREAS, the funding for repaving Soccerfield Drive would come from B -Fund balance; and NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2.
