Resolution To Declare Intent For Lead Agency For Mid Point Park Sewer District
Improvement Project And Classify Project As An Unlisted Action
WHEREAS, the Town of Wappinger is proposing to undertake improvements to the existing sewer
lines and the replacement of the Wastewater Treat ment Facility located at 63 Martin Drive in a
project called Mid -Point Sewer District Project, hereafter referred to as the "Project'; and
WHEREAS, the Town of Wappinger (hereinafter "Town") proposes to apply for financing through the
New York State Water Infrastructure Improvement Act (WIIA) through New York State Environmental
Facilities Corporation (EFC) to complete the Town of Wappinger Mid -Point Sewer District Project;
and
WHEREAS, pursuant to 6 NYCRR 617.6 the Town Board seeks to be established as Lead Agency as
part of undertaking a coordinated review of this action with any Involved and Interested Agencies;
and
WHEREAS. the Town Board considers the proposed Project to be an Unlisted action, pursuant to
the New York State Environmental Quality Review Act (SEQRA) 6 NYCRR Part 617 and an Unlisted
Action pursuant to NEPA 24 CFR, and

In The Matter Of The Increase And Improvement Of The Facilities Of Mid -Point Park
Sewer District, In The Town Of Wappinger, Dutchess County, New York
WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, has caused to
be prepared am a p, plan and report, including an estimate of cost, pursuant to Section 202-b of the
Town Law, relating to the increase and improvement of the facilities of Mid -Point Park Sewer
District, in the Town of Wappinger, Dutchess County, New York (the "Sewer District"), being the
construction of a new wastewater treatment plant at the existing plant site, located at 63 Martin
Drive, in Wappinger Falls, New York, together with improvements to the sewer collection system,
including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental
improvements and expenses in connection therewith as applicable, at a maximum estimated cost
of $10,116,000; and
WHEREAS, said capital project hereinafter described, as proposed, has been determined to be an
Unlisted Action pursuant to the regulations of the New York State Department of Environmental
Conservation promulgated pursuant to the State Environmental Quality Review Act ("SEQRA"), the
implementation of which as proposed is expected to be determined will not result in any significant
environmental impact; and
WHEREAS, it is now desired to call a public hearing on the question of the increase and
improvement of the facilities of said Sewer District, in the matter described above, and to hear all
persons interested in the subjectthereof, concerningthe same, in accordance with the provisions
of Section 202 b of the Town Law; NOW, THEREFORE, IT IS HEREBY
ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows:
Section 1. A public hearingwill be held in the Town Hall, in Wappingers Falls, New York, in said
Town, on May 28, 2024, at 7:00 o'clock P.M., Prevailing Time, on the question of the increase and
improvement of the facilities of Mid -Point Park Sewer District, in the Town of Wappinger, Dutchess
County, New York, in the manner described in the preambles hereof, and to hear all persons
interested in the subject thereof, concerning the same, and to take such action thereon as is
required or authorized bylaw.
Section 2. The Town Clerk is hereby authorized and directed to cause a copy of the Notice of
Public Hearing hereinafter provided to be published once in the official newspaper, and also to
cause a copy thereof to be posted on the sign board of the Town, such publication and posting to be
made not less than ten, nor more than twenty, days before the date designated for the hearing.
Section 3. The notice of public hearing shall be in substantially the form attached hereto as
Exhibit A and hereby made a part hereof.
Section 4. This Order shall take effect immediately.

RESOLUTION: 2024-117
Resolution Authorizing Purchase Of Tractor For Robinson Lane Baseball Complex
WHEREAS, Town of Wappinger Little League, Inc. (Little League) and the Town of Wappinger (Town)
have a contractual relationship on operation and maintenance of Robinson Lane Baseball
Complex, and
WHEREAS, per the contract between the Town and Little League, the Town is to provide a tractor for
the purposes of mowing the in -fields at Robinson Lane Baseball Complex and in return Little
League volunteers mow the grass and maintain said infields, and
WHEREAS, the Town owned tractor recently became inoperable and has exhausted its useful
lifespan, and
WHEREAS, the Town obtained three quotes for the replacement of the tractor, and
WHEREAS, SSR Equipment, was the lowest quote at $11,124.11, and
WHEREAS, as the replacement of this tractorwas not anticipated for in the 2024 Annual Budget
and the mowing of the infields at Robinson Lane Baseball Complex is time sensitive, the purchase
of such tractor shall be funded out of B -Fund Balance in order to cover the cost of the tractor, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board does hereby accept the quote for a SCEW 52'28 HP Vanguard EFI
Tractor from SSR Equipment for the cost of $11,124.11 to be funded from B -Fund
Balance.
The Town Board does hereby authorize Town of Wappinger Little League, Inc. to purchase said
tractor at a cost not to exceed $11,124.11.

Park for an additional $5,000 and resume field activity, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this resolution as if fully set forth and
adopted herein.
2. The Town Board hereby authorizes the amount of $10,500.00 payable to Waverly Pest
Control from 67110.200.
3. Town Supervisor Joseph D. Cavaccini is hereby authorized and directed to execute any and

Brief Description of Proposed Action (include purpose or need):
The Mid -Point Wastewater Treatment Plant (WWTP) serves approximately 150 single-family units in a residential development. It was constructed nearly
50 years ago and is nearing the end of its useful life. A recent modification to the SPDES
permit for the facility proposes lower ammonia and dissolved
oxygen limits and will make it difficult for the existing facility to consistently meet the proposed permit conditions. In addition, average daily flows into the
plant (100,000 gpd) exceed the current SPDES permit limit of 66,000 gallons per day.

The project seeks to take corrective actions by improving the treatment system in several phases. Phase I of the sewer system rehabilitation prioritizes the
resolution of leaking laterals and joint leakage/collapses to minimize flows to the WWTP.
Phase 2 of the project will replace the Mid Point WWTP with a
new Membrane Bio -Reactor (MBR) style activated sludge treatment system.

WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, has caused to
be prepared am a p, plan and report, including an estimate of cost, pursuant to Section 202-b of the
Town Law, relating to the increase and improvement of the facilities of Mid -Point Park Sewer
District, in the Town of Wappinger, Dutchess County, New York (the "Sewer District"), being the
construction of a new wastewater treatment plant at the existing plant site, located at 63 Martin
Drive, in Wappinger Falls, New York, together with improvements to the sewer collection system,
including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental
improvements and expenses in connection therewith as applicable, at a maximum estimated cost
of $10,116,000; and
WHEREAS, said capital project hereinafter described, as proposed, has been determined to be an
Unlisted Action pursuant to the regulations of the New York State Department of Environmental
Conservation promulgated pursuant to the State Environmental Quality Review Act ("SEQRA"), the
implementation of which as proposed is expected to be determined will not result in any significant
environmental impact; and
WHEREAS, it is now desired to call a public hearing on the question of the increase and
improvement of the facilities of said Sewer District, in the matter described above, and to hear all
persons interested in the subjectthereof, concerningthe same, in accordance with the provisions
of Section 202 b of the Town Law; NOW, THEREFORE, IT IS HEREBY
ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows:
Section 1. A public hearingwill be held in the Town Hall, in Wappingers Falls, New York, in said
Town, on May 28, 2024, at 7:00 o'clock P.M., Prevailing Time, on the question of the increase and
improvement of the facilities of Mid -Point Park Sewer District, in the Town of Wappinger, Dutchess
County, New York, in the manner described in the preambles hereof, and to hear all persons
interested in the subject thereof, concerning the same, and to take such action thereon as is
required or authorized bylaw.
Section 2. The Town Clerk is hereby authorized and directed to cause a copy of the Notice of
Public Hearing hereinafter provided to be published once in the official newspaper, and also to
cause a copy thereof to be posted on the sign board of the Town, such publication and posting to be
made not less than ten, nor more than twenty, days before the date designated for the hearing.
Section 3. The notice of public hearing shall be in substantially the form attached hereto as
Exhibit A and hereby made a part hereof.
Section 4. This Order shall take effect immediately.

Resolution Authorizing Purchase Of Tractor For Robinson
Lane Baseball Complex
WHEREAS, Town of Wappinger Little League, Inc. (Little League) and the Town of Wappinger (Town)
have a contractual relationship on operation and maintenance of Robinson Lane Baseball
Complex, and
WHEREAS, per the contract between the Town and Little League, the Town is to provide a tractor for
the purposes of mowing the in -fields at Robinson Lane Baseball Complex and in return Little
League volunteers mow the grass and maintain said infields, and
WHEREAS, the Town owned tractor recently became inoperable and has exhausted its useful
lifespan, and
WHEREAS, the Town obtained three quotes for the replacement of the tractor, and
WHEREAS, SSR Equipment, was the lowest quote at $11,124.11, and
WHEREAS, as the replacement of this tractorwas not anticipated for in the 2024 Annual Budget
and the mowing of the infields at Robinson Lane Baseball Complex is time sensitive, the purchase
of such tractor shall be funded out of B -Fund Balance in order to cover the cost of the tractor, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board does hereby accept the quote for a SCEW 52'28 HP Vanguard EFI
Tractor from SSR Equipment for the cost of $11,124.11 to be funded from B -Fund
Balance.
The Town Board does hereby authorize Town of Wappinger Little League, Inc. to purchase said
tractor at a cost not to exceed $11,124.11.

WHEREAS, the Town of Wappinger Little League, Inc. has suspended play at the Robinson Lane
Baseball Complex due to a caterpillar landing on children and parents, and
WHEREAS, the Supervisor of Buildings and Grounds received a quote from Waverly Pest Control, a
Town of Wappinger business, to remedy the situation at Robinson Lane Baseball Complex for
$5,500.
WHEREAS, the Town Board agreed to treat two other parks, Rockingham Soccer Park, and Airport
Park for an additional $5,000 and resume field activity, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this resolution as if fully set forth and
adopted herein.
2. The Town Board hereby authorizes the amount of $10,500.00 payable to Waverly Pest
