Resolution Accepting Donation To Parks And Recreation Department - Senior Center
Division
WHEREAS, the Town of Wappinger hosts a variety of senior citizen and recreational programs and
events throughout the year including monthly birthday parties for Wappinger residents who are
senior citizens, and
WHEREAS, the Pines at Poughkeepsie has graciously donated one check totaling $1,800.00 dated
to offer the monthly Senior Center birthday parties at no cost to any and all Senior Citizen in the
Town of Wappinger, and
NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger does hereby
accept the following donation to offer the monthly Senior Center birthday parties at no cost to any
and all Senior Citizen in the Town of Wappinger:
Pines at Poughkeepsie 1 $1,800.00

RESOLUTION: 2024-131
Resolution For Approval Of Empress Lease Agreement
WHEREAS, the Town and Empress Ambulance Service, Inc. ("Empress") are parties to an
Ambulance Service Agreement whereby Empress provides ambulance service to the Town; and
WHEREAS, the Town has agreed to lease a portion of the Emergency Services Building
located at 16 Middlebush Road, Wappingers Falls, New York to Empress in accordance with the
Lease Agreement to be executed by the parties; and
WHEREAS, the pertinent material terms of the Lease Agreement include a $4,000.00
per month rental fee for two garage bays, four main rooms and two restrooms within the
aforementioned Emergency Service Building of the Town; and
WHEREAS, the term of that Lease Agreement will be from June 1, 2024 to December
31, 2026.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.

2. The Town Board hereby agrees to execute and enter into that certain Lease Agreement
attached hereto with Empress with the terms aforesaid of $4,000.00 per month rental fee for
designated bays and offices and incremental increases in rent through the lease term and option
period.
3. Supervisor Joseph D. Cavaccini is hereby authorized to execute the attached Lease
Agreement between the Town of Wappinger and Empress, said Lease Agreement having been
subsequently reviewed and approved by the Town Attorney.
4. This Resolution is subject to a permissive referendum.

The Resolution is hereby duly declared Adopted.
RESOLUTION: 2024-105
Resolution Directing The Removal Of Unsafe Structure
WHEREAS, the Town Board of the Town of Wappinger has been advised by its Building
Department that a certain unsafe structure exists at 16 Dogwood Hill, Wappingers Falls, New
York; and
WHEREAS, in response, the Town Board caused its structural engineer to review and report on
the condition, which was culminated in the June 29, 2023 letter of Larry Werts, P.E. of CPL,
wherein it was confirmed that the structure was unsafe and directed the Building Department to
take efforts to cause the Owner to remove the structure; and
WHEREAS, the Building Department has made numerous attempts to cause the Owner to
remove the structure, including providing the required notices in accordance with Chapter 93-7
of the Wappinger Town Code, which attempts have been unsuccessful; and
WHEREAS, the unsafe structure is now an emergency condition and the Building Inspector has
requested that the Town Board authorize its removal pursuant to Chapter 93-11 of the Wappinger
Town Code.
NOW, THEREFORE, BE IT RESOLVED, that based on the information provided to it from its
structural engineer and Building Department, the Town Board hereby authorizes and directs the
Building Department to have the unsafe structure removed. All costs for same shall be assessed
to the Owner pursuant to Chapter 93-10 of the Wappinger Town Code.
BE IT FURTHER RESOLVED, prior to said removal, the Town Attorney is hereby directed to
file a copy of the notice provided to the Owner pursuant Chapter 93-7 of the Wappinger Town
Code with the Dutchess County Clerk.

Resolution Approving The Purchase Of Bleachers For The Town Of Wappinger Parks
System
WHEREAS, the Town of Wappinger provides bleachers for residents to watch sporting events in
various Town parks, and
WHEREAS, the Town Board of the Town of Wappinger identified the desire to purchase four tier
aluminum bleachers, and
WHEREAS, the sole provider that met the specifications of the Town Board was Kay Park
Recreation, and
WHEREAS, the Supervisor of Buildings and Grounds provided the Town Board with an estimate for
(13) thirteen bleachers for the cost of $31,101.04, and
NOW THEREFORE BE IT RESOLVED, that the Town of Wappinger Town Board hereby accepts the
estimate from Kay Park Recreation and authorizes the purchase of 13 bleachers for the total cost of
$31,101.04 to be funded out of the Parkland Trust.

WHEREAS, Richard Meddaugh has been employed in the Buildings and Grounds Department as a
Senior Groundskeeper, and
WHEREAS, the Supervisor of Buildings and Grounds advises that Richard Meddaugh exhibits the
work of running the grounds division of the Buildings and Grounds Department, and
WHEREAS, the position of Head Groundskeeper is appropriate for Richard Meddaugh through his
duties in directingwork crews in the Buildings and Grounds Department, and
WHEREAS, the full time Head Groundskeeper position is a Labor position under Civil Service Law
which is not subject to competitive examination, and

WHEREAS, the full-time Head Groundskeeper position is subject to the terms of the Collective
Bargaining Agreement between the Town of Wappinger and Teamsters Local 445 ("CBA"),
NOW, THEREFORE, BE IT RESOLVED:
1. Richard Meddaugh is hereby appointed to the full-time civil service job title Head
Groundskeeper, effective May 29, 2024.
2. Richard Meddaugh shall be compensated at the hourly rate of $25.81 which shall be paid
in weekly installments, in accordance with the CBA.
3. The appointment is subject to the approval of the Dutchess County Department of Human
Resources and is further subject to Civil Service Law and the Rules of New York State and the
Dutchess County Department of Human Resources.
The appointment is subject to a probationary term of not less than eight nor more than twenty-six
weeks in accordance with the rules of the Dutchess County Department of Human Resources.

Resolution Authorizing Retainer Agreement With Labor Counsel For A Special
Investigation Into A Work
WHEREAS, an incident occurred that may be in violation of certain employment policies of the
Town of Wappinger, and
WHEREAS, the Town Board has determined to ascertain the facts of the incident that an
independent and confidential investigation should be conducted while preserving the privacy and
due process rights of all parties involved, and
WHEREAS, the Town Board directs Labor Counsel to the Town to prepare a report after its
investigation, subject to attorney-client privilege, describingthe results of its investigation together
with any recommendations to the Town Board, and
NOW THEREFORE BE IT RESOLVED, that Labor Counsel to the Town, Roemer Wallens Gold &
Mineaux LLP, be retained to investigate, render factual findings regarding and make, if appropriate,
remedial recommendations addressing complaints of violations of certain employment policies of
the Town, and
BE IT FURTHER RESOLVED, that upon the conclusion of its investigation, Roemer Wallens Gold &
Mineaux LLP is directed to prepare a confidential, written attorney-client privileged report to the
Town Board memorializing such investigation, related factual findings and suggested remedial
actions, and

BE IT FURTHER RESOLVED, that the rates for the services forth is investigation are those
established in the retainer agreement for Labor Counsel to the Town between the Town of

BE IT FURTHER RESOLVED, the Town Supervisor is hereby authorized and directed to execute the
above described agreement with such changes as the Supervisor may deem advisable in
consultation with the Town Attorney.

Ambulance Service Agreement which commenced on January 1, 2021 and expired on December
31, 2023; and
WHEREAS, Ambulance Service Agreement has continued on a month-to-month basis
since its expiration and the Town and Empress desire to formalize a new Agreement in the form
attached hereto for the continued provision of ambulance services through December 31, 2026,
with a one-year option for 2027.
NOW, THEREFORE, BE IT RESOLVED, as follows:

PLEASE TAKE NOTICE that the Town Board of the Town of Wappinger adopted a Resolution
authorizing the lease of a portion of a building known as the Emergency Services Building located
as 16 Middlebush Road to Empress Ambulance Service in exchange for the sum of $48,000 per
year for a term of 30 months.
PLEASE TAKE FURTHER NOTICE that the aforesaid Resolution, adopted on May 28, 2024, is
subject to a permissive referendum and will not take effect for 30 days from the date of publication
or until a referendum is held in the event the requisite number of petitions subscribed and
acknowledged by electors of the Town in opposition to such conveyance is submitted to the Town
Clerk within 30 days of the date of the adoption of said Resolution. A copy of the Resolution is
available at Town Hall, 20 Middlebush Road, Wappingers Falls, New York 12590

Resolution Directing The Removal Of Unsafe Structure
WHEREAS, the Town Board of the Town of Wappinger has been advised by its Building
Department that a certain unsafe structure exists at 16 Dogwood Hill, Wappingers Falls, New
York; and
WHEREAS, in response, the Town Board caused its structural engineer to review and report on
the condition, which was culminated in the June 29, 2023 letter of Larry Werts, P.E. of CPL,
wherein it was confirmed that the structure was unsafe and directed the Building Department to
take efforts to cause the Owner to remove the structure; and
WHEREAS, the Building Department has made numerous attempts to cause the Owner to
remove the structure, including providing the required notices in accordance with Chapter 93-7
of the Wappinger Town Code, which attempts have been unsuccessful; and
WHEREAS, the unsafe structure is now an emergency condition and the Building Inspector has
requested that the Town Board authorize its removal pursuant to Chapter 93-11 of the Wappinger
Town Code.
NOW, THEREFORE, BE IT RESOLVED, that based on the information provided to it from its
structural engineer and Building Department, the Town Board hereby authorizes and directs the
Building Department to have the unsafe structure removed. All costs for same shall be assessed
to the Owner pursuant to Chapter 93-10 of the Wappinger Town Code.
BE IT FURTHER RESOLVED, prior to said removal, the Town Attorney is hereby directed to
file a copy of the notice provided to the Owner pursuant Chapter 93-7 of the Wappinger Town
Code with the Dutchess County Clerk.

Dear Board Members,
CPL was requested to conduct a site visit for a visual inspection and provide our opinion of the
condition of the residence at 16 Dogwood Hills located in the Town of Wappinger. This site visit
occurred on Thursday, April 13, 2023. Our site visit was limited to the exterior of the residence. The
interior portions of the home were inaccessible at the time of the inspection.
Briefly, the property consists of a single-family residence, originally built in 1969. The house is
constructed of conventional wood framed floor, wall, and roof systems with a masonry block
foundation. The property also has accessory structures, a camper and site features associated with the
residence.
It is our opinion that the current condition of the residence is not structurally safe and should not be
entered by anyone, nor should anyone be allowed adjacent to the structure. Due to the observed
serious deterioration and prolonged exposure, the structural systems are in a condition that is beyond
repair. Some of the observed conditions include, but are not limited to, numerous locations of large
roof penetrations and failed roofing, exposed interior framing, failed cladding, severe moisture
infiltration locations, and deficient roof framing conditions. Access to the home and surrounding areas
may be an attraction for pests/rodents and people, including vandals. The residence should be
demolished by a qualified contractor and upon completion the property and surrounding site should
be left in a safe and stable condition.
Based on the limited visual inspection of the Property it is our opinion that the following items relate
to code deficiencies and/or hazardous conditions:
• Numerous holes in roof- PMCoNYS 107.1.3 Structure unfit for human occupancy, PMCoNYS 107.1.1
Unsafe structures, FCoNYS 108.1.1 Unsafe structures, and FCoNYS 108.2 Structure unfit for human
occupancy
• Hole in chimney- PMCoNYS 107.1.2 Unsafe equipment
• Soffit at west side missing - PMCoNYS 107.1.3 Structure unfit for human occupancy

Resolution Approving The Purchase Of Bleachers For The
Town Of Wappinger Parks System
WHEREAS, the Town of Wappinger provides bleachers for residents to watch sporting events in
various Town parks, and
WHEREAS, the Town Board of the Town of Wappinger identified the desire to purchase four tier
aluminum bleachers, and
WHEREAS, the sole provider that met the specifications of the Town Board was Kay Park
Recreation, and
WHEREAS, the Supervisor of Buildings and Grounds provided the Town Board with an estimate for
(13) thirteen bleachers for the cost of $31,101.04, and
NOW THEREFORE BE IT RESOLVED, that the Town of Wappinger Town Board hereby accepts the
estimate from Kay Park Recreation and authorizes the purchase of 13 bleachers for the total cost of
$31,101.04 to be funded out of the Parkland Trust.

WHEREAS, the Supervisor of Buildings and Grounds advises that Richard Meddaugh exhibits the

WHEREAS, the position of Head Groundskeeper is appropriate for Richard Meddaugh through his
duties in directingwork crews in the Buildings and Grounds Department, and
WHEREAS, the full time Head Groundskeeper position is a Labor position under Civil Service Law
which is not subject to competitive examination, and
WHEREAS, the full-time Head Groundskeeper position is subject to the terms of the Collective
Bargaining Agreement between the Town of Wappinger and Teamsters Local 445 ("CBA"),
NOW, THEREFORE, BE IT RESOLVED:
1. Richard Meddaugh is hereby appointed to the full-time civil service job title Head
Groundskeeper, effective May 29, 2024.
2. Richard Meddaugh shall be compensated at the hourly rate of $25.81 which shall be paid
in weekly installments, in accordance with the CBA.
3. The appointment is subject to the approval of the Dutchess County Department of Human
Resources and is further subject to Civil Service Law and the Rules of New York State and the
Dutchess County Department of Human Resources.
The appointment is subject to a probationary term of not less than eight nor more than twenty-six
weeks in accordance with the rules of the Dutchess County Department of Human Resources.

Counsel For A Special Investigation Into A Work
WHEREAS, an incident occurred that may be in violation of certain employment policies of the
Town of Wappinger, and
WHEREAS, the Town Board has determined to ascertain the facts of the incident that an
independent and confidential investigation should be conducted while preserving the privacy and
due process rights of all parties involved, and
WHEREAS, the Town Board directs Labor Counsel to the Town to prepare a report after its
investigation, subject to attorney-client privilege, describingthe results of its investigation together
with any recommendations to the Town Board, and
NOW THEREFORE BE IT RESOLVED, that Labor Counsel to the Town, Roemer Wallens Gold &
Mineaux LLP, be retained to investigate, render factual findings regarding and make, if appropriate,
remedial recommendations addressing complaints of violations of certain employment policies of
the Town, and
BE IT FURTHER RESOLVED, that upon the conclusion of its investigation, Roemer Wallens Gold &
Mineaux LLP is directed to prepare a confidential, written attorney-client privileged report to the
Town Board memorializing such investigation, related factual findings and suggested remedial
actions, and
BE IT FURTHER RESOLVED, that the rates for the services for this investigation are those
established in the retainer agreement for Labor Counsel to the Town between the Town of
Wappinger and Roemer Wallens Gold & Mineaux LLP, and
BE IT FURTHER RESOLVED, the Town Supervisor is hereby authorized and directed to execute the
above described agreement with such changes as the Supervisor may deem advisable in
consultation with the Town Attorney.

Resolution For Approval Of Ambulance Service Agreement
WHEREAS, the Town and Empress Ambulance Service, Inc. ("Empress") are parties to a certain
Ambulance Service Agreement which commenced on January 1, 2021 and expired on December
31, 2023; and
WHEREAS, Ambulance Service Agreement has continued on a month-to-month basis
since its expiration and the Town and Empress desire to formalize a new Agreement in the form
attached hereto for the continued provision of ambulance services through December 31, 2026,
with a one-year option for 2027.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board hereby agrees to execute and enter into the attached Ambulance
Service Agreement.
3. Supervisor Joseph D. Cavaccini is hereby authorized to execute the attached
Ambulance Service Agreement between the Town of Wappinger and Empress, said Ambulance
Service Agreement having been subsequently reviewed and approved by the Town Attorney.
