COMMENTS - Current Meeting:
Marcy Wagman addressed the board with her discontent of the revised local law that removed
the restrictions for gas stations.
Grace Martin addressed the board to show her dis-agreement with removing the gas station
restrictions from Local Law 3.
Melissa Meligan of 7 Marlorville Road explained her dis-pleasure for the removal of the gas
station restrictions from Local Law 3.
Ellen Korz, of 41 Helen Drive came to ask the board to explain why they removed the
restrictions of proximity of gas stations.
Mr. Evangelista addressed the board and also asked them to also explain why the town board not
the planning board took out the gas stations restrictions. He cited the fact that only 2
municipalities in New York do not have restrictions on gas stations.
Ilene Chatwick of 8 Amhearst Lane explained her distrust on how this has been taken out in the
first place back in 2019 when it was never mentioned and again now in 2024. Additionally, she
asked about the removal of the buffer zone being removed.
Franca Petrillo of 10 Apple Lane in Hughsonville appeared to show her unhappiness of the
removal of the gas station restrictions. She thanked Supervisor Cavaccini for attempting to re-
instate the gas station restrictions that were removed in 2019 by the board.
Katie of 647 Wheeler Hill Road read a letter from Edgar Hartman which read as an appeal to the
town board to re -consider the restrictions.
Linda Ibrahim from Sherwood Heights read another letter form resident Darrelyn Brennen at 30
Carmel Heights in support of Local Law 3 'with' the gas station restrictions. She pointed out that
the gas -station restrictions would have no effect on the pending litigation at the Hughsonville gas
station.

RESOLUTION: 2024-158
A Local Law No. 3 Of 2024 Which Would Amend Chapters 85, 213, 214, and 240 Of the
Town Code With Respect To A Variety Of Definitions, and Zoning Codes Regarding
Businesses, and Planning
WHEREAS, the Town Board is considering the adoption of Local Law No. 3 of 2024 which
would Chapters 85, 213, 214, and 240, of the Town Code With Respect To A Variety Of Definitions,
and Zoning Codes Regarding Businesses, and Planning; and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was held on August 19, 2024 and all parties in attendance
were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or
any part thereof; and
WHEREAS, for the purposes of the New York State Environmental Quality Review Act
(SEQRA), the Proposed Action is the amendment of Chapters 85, 213, 214, and 240, of the Town
Code With Respect To A Variety Of Definitions, and Zoning Codes Regarding Businesses, and
Planning; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for which
there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead
Agency for this action; and
WHEREAS, the Town Board referred the proposed Local Law to the Town Planning Board
for its advisory opinion; and

WHEREAS, as in accordance with Section 239 of the New York State General Municipal
Law, the Town Board referred the proposed Local Law to the Dutchess County Department of
Planning and Development (DCDPD) for its advisory opinion; and
WHEREAS, in response to said referral the DCDPD responded and stated whose
comments were duly added; and
WHEREAS, the Town Board has given due consideration to the comments of the Town
Planning Board and the DCDPD; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least ten (10) days prior to the adoption of this resolution.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set forth
above as if fully set forth and resolved herein.
2. The Town Board, after due deliberation, finds that it is in the best interest of the Town to
adopt said Local Law, and the Town Board hereby adopts Local Law No.3 of 2024, a copy of
which is attached hereto and made a part of this Resolution; except as specifically modified
by the amendments contained therein, the Town Code, as originally adopted and amended
from time to time thereafter, is to remain in full force and effect.
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting into the
Local Law book for the Town of Wappinger and to give due notice of the adoption of said Local
Law to the Secretary of State of New York.

COMMENTS - Current Meeting:
Ms. Santonio of 1 Doyle Drive explained the benefits of Carnwath Park and support of
Resolution 2024-173
Elen Korz appeared to show support to partner with this company to support the free complete
restoration of the mansion at no cost to the town and with the $120,000 per years lease payment
income stream to the town.
Hayden Wayne explained the history of the park. He said that we are getting someone to repair
our mansion entirely on their dime and pay us rent for many years. Why wouldn't we do it?
Grace Martin explained the wealth of Carnwath and the benefit of making the deal with these
investors and encouraged the board to sign the lease.
Stach Cutler of 777 Wheeler Hill road asked questions about future development. Supervisor
Cavaccini explained that only the manor will be effected. The park will always allow access to
the park and the manor. The use will be only 3 days per week. We will receive $10,000 per
month or $120,000 per year for 25 years into the Parkland Trust. Their use would be of the
Mansion and Chapel room only. Anything else will be a re -approval of the Town Board.
Rhonda Dunahue explained that she loves the park and wants to protect the land.
John Webber explained that the WCSD is waiting to use the property.

VIII. Consent Resolutions
RESOLUTION: 2024-174
Resolution Authorizing Settlement Of The Tax Certiorari Proceeding In The Matter Of
The Application Of L&M Wappingers Falls Housing Development Fund Corporation
WHEREAS, the Town of Wappinger is a parry respondent in a certain tax certiorari proceeding
entitled In the Matter of the Application of L&M Wappingers Falls Housing Development Fund
Corporation v. The Assessor of the Town of Wappinger, The Board of Review of the Town of
Wappinger and Town of Wappinger, currently pending in the Supreme Court, State of New
York, County of Dutchess, in which the total assessed valuation of certain real property located
in the Town of Wappinger, New York and designated as Tax Map No. 135601-6158-19-646130-
0000 on the official assessment map of the Town of Wappinger for the 2023 and 2024
Assessment Roll are being contested; and
WHEREAS, the Assessor of the Town of Wappinger and the Petitioner have agreed to settle the
proceeding; and
WHEREAS, the parties agree to reduce the assessed valuation as follows:

WHEREAS, the Petitioner has agreed to waive any and all refunds from the Town and Town
Special Districts based on the reduction of the 2023 Assessment; and

not be subject to challenge for three years following this settlement; and
WHEREAS, the Town Assessor and Town Counsel have recommended that the Town Board
accept the settlement proposal as set forth above.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby approves and ratifies the settlement of the above-described
proceeding as recommended by the Town Assessor.
2. The Town Board hereby authorizes the Town Supervisor, Hogan, Rossi & Liguori, as
Town Attorney, and/or the Town Assessor to execute any and all documents necessary to give
effect to this resolution.

IX. Non Consent Resolutions

Resolution Authorizing The Lease Of The Carnwath Manor And Portion Of The
Carnwath Chapel

WHEREAS, the Town of Wappinger owns 99.5 acres of real property on Wheeler Hill Road known as
Carnwath Farms Historic Site & Park (Carnwath Farms); and
WHEREAS, the Town prepared a comprehensive master plan for the development of Carnwath
Farms; and
WHEREAS, the Carnwath Farms Master Plan was adopted bythe Town Board on October 15, 2007,
and calls for the adaptive reuse of the Carnwath Farms property including a boutique hotel,
restaurants, event spaces, cultural spaces, museums, and other related activities through public-
private partnerships; and
WHEREAS, Carnwath Farms contains a number of buildings, including an 1850 pre -restoration
Victorian era 3 story Italianate former residence known as the "Carnwath Manor" and a 1950 two
story former Chapel; and
WHEREAS, the Carnwath Manor has entered into a state of disrepair following early investments
made by the Town as costs are far too high for the Town to consider as the structure serves no
governmental, quasi -governmental, non-profit, and charitable purposes; and
WHEREAS, the Carnwath Manor is no longer a functioning building and has long satvacant for over
two decades and has fallen into a state of disrepair and is otherwise suitable for use by a third -party
public-private partnership as called for in the adopted Carnwath Farms Master Plan; and
WHEREAS, the Chapel is no longer a functioning building and is vacant with no present
governmental purposes and is otherwise suitable for use by a third -party public-private partnership
as called for in the adopted Carnwath Farms Master Plan; and
WHEREAS, Carnwath Farms Lane LLC, has requested permission from the Town Board to
lease the Carnwath Manor and a portion of the Chapel for the purposes of operating a boutique
style hotel, cafe, and event space; and
WHEREAS, the Town Board hereby determines that the proposal to lease the Carnwath
Manor and a portion of the Chapel for the purposes of operating a boutique style hotel, cafe, and
event space at Carnwath Farms is consistent with the uses and objectives outlined in the adopted
comprehensive master plan for Carnwath Farms and that the lease the Carnwath Manor and a
portion of the Chapel to be occupied by Carnwath Farms LLC is not otherwise needed for other
governmental purposes of the Town; and
WHEREAS, the TENANT may upon written request of the LANDLORD, rent and utilize the
public retained spaces of Carnwath Farms Historic Site & Park separate from the portion of
Carnwath Farms Historic Site & Park for additional fees that are outlined in this agreement; and
WHEREAS, the LANDLORD has agreed to lease the Carnwath Manor and a portion of the
Chapel for the purposes of operating a boutique style hotel, cafe, and event space to the TENANT in
accordance with the terms set forth herein.
NOW, THEREFORE, the Town Board of the Town of Wappinger does hereby approve and that
Town Supervisor Joseph D. Cavaccini is hereby authorized and directed to execute the above-
described agreement in the form annexed hereto with such changes as the Town Supervisor may
deem advisable in consultation with the Town Attorney."

RESOLUTION: 2024-175
Resolution Approving Collective Bargaining Agreements With CSEA Local 1000 AFSCME
AFL-CIO (CSEA)
WHEREAS, the Town of Wappinger ("Town") and CSEA Local 1000 AFSCME AFL-CIO ("CSEA") are
parties to a Collective Bargain ingAgree ment ("CBA") for the term January 1, 2013 to December 31,
2015, which was extended by a Memorandum of Agreement ("MOA') executed by the parties to the
CBA in November 2016, which 2016 MOA was replaced by a Revised Memorandum of Agreement
executed by the parties in January 2017, which was subsequentially replaced by a Memorandum of
Agreement executed by the parties for a term commencing January 1, 2018 and ending December
31, 2020, and
WHEREAS, the parties further agree to fix the term for the forthcoming CBA to take effect from
January 1, 2018 and to end on December 31, 2025, as well as to adopt a CBA to take effect from
January 1, 2016 and to end on December 31, 2017 that would comprise of the MOA that was
previously adopted and not ratified as a CBA, to reflect what was implemented previously, subject
to the consent of the Town Board and the membership of the Highway Department employees'
bargaining unit ("CBU"), and
WHEREAS, the MOA provides that it is subject to ratification by the Town Board and the CSEA, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The 2018-2025 Collective Bargaining Agreement between the Town and CSEA dated
September 9, 2024, is hereby ratified and approved, subject to the approval of the CSEA.
2. The 2016-2017 Collective Bargaining Agreement between the Town and CSEA dated
September 9, 2024, is hereby ratified and approved, subject to the approval of the CSEA.
3. Town Supervisor Joseph D. Cavaccini is hereby authorized and directed to execute the
2016-2017 CBA to take effect from January 1, 2016 and to end on December 31, 2017, and all its
documents in the form annexed hereto.
4. Town Supervisor Joseph D. Cavaccini is hereby authorized and directed to execute the
2018-2025 CBA to take effect from January 1, 2018 and to end on December 31, 2025, and all its
documents in the form annexed hereto.
5. The Town Board hereby approves the funding for such agreement and directs that
compensation be increased in accordance with the CBA and that payments for retroactive
compensation be made by the Town as soon as practicable after ratification by the CSEA.
6. The Town Board hereby directs the Town Comptroller Jessica Servidio or her designee to
calculate the increases in pay that are due in accordance with the CBA and provide a report to the
Town Board of the amounts due and paid. Transfer to be made from B balance to DB Payroll.

RESOLUTION: 2024-177
Authorizing Execution Of Agreement For Professional Real Estate Appraisal Services For
The Purposes
WHEREAS, the Town Board desires the need for professional consulting services for the purposes
of evaluating the benefits of potential public-private partnerships between the Town at Carnwath
Farms Historic Site & Park, and
WHEREAS, Covington Commercial Realty has been identified by members of the Town Board and
determined to be a qualified commercial real estate appraisal firm capable of providing such
consulting services, and
WHEREAS, the Town Board hereby approves Covington Commercial Realty as a qualified
commercial real estate consulting services firm and hereby authorizes and directs the Town
Supervisor to execute any and all documents associated with this consultation, and
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby agrees to authorize and direct the Town Supervisor and Town
Comptroller to execute said agreement and pay Covington Commercial Realty a one-time sum of
$1,000.00 for commercial real estate consulting services, which shall be funded out of B -Fund
Balance.

XI. Resolution and Floor Vote Approved After Executive Session
RESOLUTION: 2024-176
Resolution Authorizing Memorandum Of Understanding With Regency Homeowners'
Association
WHEREAS, Regency at Wappinger Homeowners Association entered into an Agreement with the
United Wappinger Water District ("UWWD") for the use of water for the common areas owned by
the RHOA including for irrigation that expires on December 31, 2024, and
WHEREAS, the RHOA has prepared and implemented a water conservation plan for its irrigation
system to reduce its water usage, and
WHEREAS, Town Supervisor Joseph D. Cavaccini has negotiated between the President of the
RHOA and the UWWD a new Memorandum of Understanding ("MOU") for five (5) years
commencing January 1, 2025 for the use of water for irrigation on a more permanent basis following
the prior agreement and PILOT programs that were successful at the Regency, and
NOW THEREFORE, BE IT RESOLVED:
1) The Town Board hereby approves the Memorandum of Understanding with RHOA in the
form attached hereto.
2) The Town Board hereby authorizes and directs Town Supervisor Joseph D. Cavaccini to sign
the MOU on behalf of the Town Board and the UWWD.
3) The Town Board hereby directs that a copy of the executed Water Tenancy Agreement be
provided to the Water & Sewer Billing Division and Building Department to ensure the proper
accounting for billing purposes.
4) The Town Board hereby directs the Town Clerk to provide a copy of the executed Water
Tenancy Agreement be filed in the records of the Town Clerk, the records of the Town Comptroller,
and the records of the Building Department.
