Resolution Regarding Connection to the United Wappinger Water District for Diamond
Properties (aka Alpine Commons)
WHEREAS, the Town Board is in receipt of a request for the inclusion of Tax Parcel 135689-
6157-02-707773 in the United Wappinger Water District to serve the proposed Alpine Commons
project consisting of 144 residential units which would require approximately 52,308 gpd; and
WHEREAS, the Town Board, at present, is only permitting additions/connections to its water
districts for properties on an emergency basis, if prior commitments for connections were made
by the Town Board related to or in connection with easements granted to the Town, or for de
minimus uses; and
WHEREAS, the Town Board finds that the request is not within the scope of additions
/connections.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby denies the request to
include Tax Parcel 135689-6157-02-707773 in the United Wappinger Water District.

RESOLUTION: 2024-193
Resolution Setting Public Hearing on Proposed Budgets, O&M Charges, Rates and Rents
for Special Improvement Districts and Special Improvement Areas for Fiscal Year 2025
WHEREAS, the Town Board annually establishes budgets for the financing of all capital
improvements of all Special Improvement Districts and Special Improvement Areas within the
Town of Wappinger for the ensuing year, and as part of the budget process the Town Board
establishes Operation and Maintenance Charges (O&M Charges), Rates and/or Rents, to be
charged against those properties within said Special Improvement Districts or Special
Improvement Areas; and
WHEREAS, the Town Board will have completed the proposed budgets for the
financing of capital improvements for the proposed quarterly O&M Charges, Rates and Rents in
accordance with said budget, to be charged against those properties within said for the Special
Improvement Districts and Special Improvements Areas for Fiscal Year 2025; and
WHEREAS, the Town Board, as required by Town Law, hereby schedules and orders a
Public Hearing to be held on October 28, 2024, for the purposes of hearing and considering any
objections which may be made to the aforementioned proposed budgets, and the proposed
quarterly O&M Charges, Rates and Rents for the Special Improvement Districts and Special
Improvement Areas for Fiscal Year 2025.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby schedules a Public
Hearing to be held at a regular meeting of the Town Board on October 28, 2024 at 7:00 p.m. at
Town Hall, 20 Middlebush Road, Wappingers Falls, New York for the purposes of hearing and
considering any objections which may be made to the proposed budgets and the proposed
quarterly O&M Charges, Rates and Rents to be levied against the properties within the Special
Improvement Districts and Special Improvement Areas in the Town of Wappinger, as noted
below, for Fiscal Year 2025.

Resolution Appointing Part -Time Intern
WHEREAS, the Town Comptroller desires to hire Julia Leonetti a Finance Major at Marist College as
a Part -Time Intern to assist in the Town Comptroller's Office with miscellaneous tasks and
functions, and
WHEREAS, the Town Supervisor and Town Comptroller, shall coordinate Julia Leonetti's work
schedule, and
NOW, THEREFORE, BE IT RESOLVED, that the Town Board appoints Julia Leonetti as a Part -
Time Intern at the pay rate of $17.00 per hour, and
BE IT FURTHER RESOLVED, that the hours to be worked by Julia Leonetti as Part -Time Intern
shall be capped at no more than 17.5 hours perweek, and
BE IT FURTHER RESOLVED, that this appointment shall terminate no later than December
31, 2024, and
BE IT FURTHER RESOLVED, that the Comptroller's Office, Personnel Division, is authorized to
complete and file with The Dutchess County Department of Human Resources all paperwork
required bythat office in connection with this appointment.

WHEREAS, the Town Assessor, on behalf of the Town Board, is required to create
preliminary benefit assessment rolls for Special Improvement Districts and Improvement Areas
within the Town of Wappinger each year pursuant to Town Law § 202-a; and
WHEREAS, the Town Board is required by Town Law § 202-a to hold a public hearing
in accordance with the provisions of Town Law § 239 to consider any objections to the annual
benefit assessment roll.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby schedules a
Public Hearing to be held at a Regular Meeting of the Town Board on October 28, 2024 at 7:00

Resolution To Designate A Portion Of The American Rescue Plan Funds And Authorize
Request For Proposals To Construct A New Live Performance Stage At Brexel-Schlathaus

WHEREAS, on March 11, 2021 the American Rescue Plan Act (ABPA) was signed into law and
established fund ingwhich is intended to provide support to State, territorial, local and tribal
governments in response to the economic and public health impacts of COVID, and
WHEREAS, Town Supervisor Joseph D. Cavaccini and the Engineer to the Town have developed a
scope of work and request for proposals (RFP) to construct a new live performance stage at Brexel-
Schlathaus Park, and
NOW THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger authorizes the
Engineer to the Town and or his designee to seek requests for proposals to construct the new live
performance stage at Brexel-Schlathaus Park, and
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Town Board of the Town of Wappinger

RESOLUTION: 2024-173
Resolution Authorizing The Lease Of The Carnwath Manor And Portion Of The
Carnwath Chapel
WHEREAS, the Town of Wappinger owns 99.5 acres of real property on Wheeler Hill Road known as
Carnwath Farms Historic Site & Park (Carnwath Farms); and
WHEREAS, the Town prepared a comprehensive master plan for the development of Carnwath
Farms; and
WHEREAS, the Carnwath Farms Master Plan was adopted by the Town Board on October 15, 2007,
and calls forthe adaptive reuse of the Carnwath Farms property including a boutique hotel,
restaurants, event spaces, cultural spaces, museums, and other related activities through public-
private partnerships; and
WHEREAS, Carnwath Farms contains a number of buildings, including an 1850 pre -restoration
Victorian era 3 story Italianate former residence known as the "Carnwath Manor" and a 1950 two
story former Chapel; and
WHEREAS, the Carnwath Manor has entered into a state of disrepair following early investments
made by the Town as costs are far too high for the Town to consider as the structure serves no
governmental, quasi -governmental, non-profit, and charitable purposes; and
WHEREAS, the Carnwath Manor is no longer a functioning building and has long sat vacant for over
two decades and has fallen into a state of disrepair and is otherwise suitable for use by a third -party
public-private partnership as called for in the adopted Carnwath Farms Master Plan; and
WHEREAS, the Chapel is no longer functioning building and is vacant with no present
governmental purposes and is otherwise suitable for use by a third -party public-private partnership
as called for in the adopted Carnwath Farms Master Plan; and
WHEREAS, Carnwath Farms Lane LLC, has requested permission from the Town Board to
lease the Carnwath Manor and a portion of the Chapel for the purposes of operating a boutique
style hotel, cafe, and event space; and
WHEREAS, the Town Board hereby determines that the proposal to lease the Carnwath
Manor and a portion of the Chapel for the purposes of operating a boutique style hotel, cafe, and
event space at Carnwath Farms is consistent with the uses and objectives outlined in the adopted
comprehensive master plan for Carnwath Farms and that the lease the Carnwath Manor and a
portion of the Chapel to be occupied by Carnwath Farms LLC is not otherwise needed for other
governmental purposes of the Town; and
WHEREAS, the TENANT may upon written request of the LANDLORD, rent and utilize the
public retained spaces of Carnwath Farms Historic Site & Park separate from the portion of
Carnwath Farms Historic Site & Park for additional fees that are outlined in this agreement; and
WHEREAS, the LANDLORD has agreed to lease the Carnwath Manor and a portion of the
Chapel for the purposes of operating a boutique style hotel, cafe, and event space to the TENANT in
accordance with the terms set forth herein.
NOW, THEREFORE, the Town Board of the Town of Wappinger does hereby approve and that
Town Supervisor Joseph D. Cavaccini is hereby authorized and directed to execute the above-
described agreement in the form annexed hereto with such changes as the Town Supervisor may
deem advisable in consultation with the Town Attorney."

RESOLUTION: 2024-186
Resolution Adopting Local Law No. —Of The Year 2024 Entitled "Regulating Hazardous
Pollution Sources In Proximity To Public Water Supply Sources, Aquifers And Wetlands"
WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger
introducing a proposed Local Law entitled, "Regulating Hazardous Pollution Sources In
Proximity To Public Water Supply Sources, Aquifers And Wetlands" for consideration by the
Town Board; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News and the
Poughkeepsie Journal as required by law; and
WHEREAS, the Town Board determined that the proposed action does not affect the
environment and is not subject to SEQRA; and
WHEREAS, a Public Hearing was held on October 15, 2024, and all parties in attendance were
permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or
any part thereof, and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that it is in
the best interest of the Town to adopt said Local Law; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of the
Town of Wappinger for at least seven (7) days exclusive of Sunday prior to the adoption of this
Resolution.
NOW, THEREFORE, be it resolved, that the Town Board of the Town of Wappinger hereby
adopts the Local Law entitled, "Regulating Hazardous Pollution Sources In Proximity To Public
Water Supply Sources, Aquifers And Wetlands", as Local Law _ of 2024 a copy of which is
attached hereto and made a part of this Resolution; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to enter said Local Law in the
minutes of this meeting into the Local Law book for the Town of Wappinger and shall file the
Local Law with the Secretary of State of New York as provided by law and the Zoning Map of
the Town shall be amended to reflect the change; and
BE IT FURTHER RESOLVED, that this Local Law shall become effective immediately upon
filing with the Secretary of State as provided by law.

240, Zoning, of the Town Code with Respect to Tattoo Parlors" for consideration by the Town
Board; and

RESOLUTION: 2024-198
Resolution Granting Permission For The Town Of Wappinger To Apply For A Justice
Court Assistance Program (JCAP) Grant
WHEREAS, the Town of Wappinger Justice Court is eligible for a grant from the State
of New York Unified Court System through the Justice Court Assistance Program; and
WHEREAS, Town of Wappinger Justices, Nicholas C. Maselli and Heather L. Kitchen,
and Justice Court Chief Clerk, Kriss Thomas, have recommended an application for such grant
be made; and
WHEREAS, Town Justices, Nicholas C. Maselli and Heather L. Kitchen, and Justice
Court Chief Clerk, Kriss Thomas have prepared an application to the Justice Court Assistance
Program Grant; and
WHEREAS, the application that was required to be submitted to the New York State
Office of Court Administration by October 11, 2024; now, therefore
BE IT RESOLVED, that the Town Board of the Town of Wappinger authorizes the
Wappinger Town Court to apply for a Justice Court Assistance Program (JCAP) Grant in the
2024-2025 grant cycle up to $30,000; and
BE IT FURTHER RESOLVED, that
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes said application to be signed by Supervisor
Joseph D. Cavaccini as well as Town Justices Nicholas C. Maselli and Heather L. Kitchen, by
and on behalf of the Town of Wappinger Justice Court, and further authorizes Justice Court
Chief Clerk Kriss Thomas to submit the application to the New York State Office of Court
Administration to comply with the October 11, 2024 submission date.
