The following Resolution was introduced by Supervisor Cavaccini and seconded by
Councilman Phillips.
WHEREAS, the Town Board is considering the adoption of Local Law No. of 2024
which would amend Chapter 230-45 of the Town Code with respect to Schedule XI to add a
weight limit of 10,000lbs for vehicles traversing Dean Avenue (the "Proposed Action"); and
WHEREAS, for the purposes of the New York State Environmental Quality Review Act
(SEQRA), the Proposed Action is as defined above; and
WHEREAS, the Town Board has determined that the Proposed Action is an Unlisted
Action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR
(commonly known as "SEQRA"); and
WHEREAS, the Town Board has determined that the proposed Local Law is an action
for which there are no other Involved Agencies and that the Town Board is therefore, by default,
the Lead Agency for this action; and
WHEREAS, a Determination of Significance has not yet been made with respect to the
Proposed Action.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board hereby introduces for consideration of its adoption proposed Local
Law No. of 2024 in the form annexed hereto.
3. The Town Board hereby schedules a Public Hearing regarding the adoption of the
annexed proposed Local Law No. 5 of 2024 for 7:00 PM on the 9th day of December, 2024 and
the Town Clerk is hereby directed to post the notice of the Public Hearing in the form annexed
hereto and to publish same in the Southern Dutchess News and the Poughkeepsie Journal not less
than ten (10) days prior to said Public Hearing date.
4. The Town Board hereby directs the Town Clerk to act as follows with respect to the
proposed Local Law:
a. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the municipal clerk of each abutting municipality not less than ten (10)
days prior to said public hearing;
b. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the Dutchess County Department of Planning and Development for
advisory review in accordance with Section 239 of the New York State General Municipal Law.

BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section 1. Title
This Local Law shall be known and cited as "Local Law No. _ of 2024 for the Purpose of Amending
Chapter 230-45 of the Town Code to Amend Schedule XI"
Section 2. Legislative Intent
The Town Board believes that it is reasonable and appropriate to amend Chapter 230-45 of the Town
Code to amend Schedule XI" in order exclude trucks over the weight of five (5) tons or 10,000 lbs
from Dean Avenue, except for local deliveries only. Dean Avenue is a short, narrow road with limited
sight distances at its intersections which was designed to serve a limited number of residences but
instead has become a cut through street for vehicles avoiding the intersection of Old Hopewell Road
and New York State Route 9D. A weight limitation will limit the amount of traffic on Dean Avenue
by reducing the number of vehicles that would be permitted to use it, particularly vehicles over five
tons. This local law is determined to be an exercise of the police powers of the Town to protect the
public health, safety and welfare of its residents.

Part 3 Determination of Significance
For every question in Part 2 that was answered "moderate to large impact may occur", or if there is a need to explain why a
particular element of the proposed action may or will not result in a significant adverse environmental impact, please
complete Part 3. Part 3 should, in sufficient detail, identify the impact, including any measures or design elements that
have been included by the project sponsor to avoid or reduce impacts. Part 3 should also explain how the lead agency
determined that the impact may or will not be significant. Each potential impact should be assessed considering its setting,

Due to the location of Dean Avenue between the signalized intersection of Old Hopewell Road and Route 9D, it has
become a cut through street for vehicles seeking to avoid the signal. This Local Law was prepared to amend Sectior
230-45, Schedule XI, to add a weight limit to Dean Avenue to prevent cut through truck traffic, which in addition to
passenger car traffic, was having a significant impact on the road itself as well as the residential character of the
neighborhood. Dean Avenue was not designed for truck traffic. It is narrow in width and has poor line of sight at the
Route 9D intersection.
