Consent Agenda RESOLUTION: 2024-199 Resolution Adopting Final Benefit Assessment Rolls For Special Improvement Districts And Special Improvement Areas For Fiscal Year 2025 WHEREAS, the Town Assessor prepared proposed Benefit Assessment Rolls for all Special Improvement Districts and Special Improvement Areas in the Town of Wappinger, assessed on a benefit basis, for Fiscal Year 2025 and said proposed Benefit Assessment Rolls were filed with the Town Clerk as required by Town Law § 239; and WHEREAS, in accordance with Town Law § 239, the Town Board duly noted and held a Public Hearing on October 28, 2024, to hear and consider any objections to said Benefit Assessment Rolls within the Town for use in Fiscal Year 2025; and WHEREAS, all interested persons were given the opportunity at the Public Hearing to challenge or contest such benefit assessment determinations; and WHEREAS, the Town Board has reviewed the proposed benefit assessment rolls within the Town for use in Fiscal Year 2025 and has determined that they were prepared in proper order. NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby adopts the Benefit Assessment Rolls as prepared by the Assessor subject to any corrections made by this Board, as the final benefit assessment rolls for the Special Improvement Districts and Special Improvement Areas in the Town of Wappinger for Fiscal Year 2025. RESOLUTION: 2024-200 Resolution Adopting Capital Budgets, O&M Charges And Water/Sewer Rates And Rents For Special Districts And Special Improvement Areas For Fiscal Year 2025 WHEREAS, on October 15, 2024, the Town Board, pursuant to and in accordance with the provisions of Sections 198 and 202-a of the Town Law and other applicable provisions of law, scheduled a Public Hearing on the Proposed Capital Budgets and Proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and Special Improvement Areas for Fiscal Year 2025; and WHEREAS, the Town Board conducted a Public Hearing on October 28, 2024 at 7:00 p.m. and all parties in attendance were permitted an opportunity to speak on behalf or in opposition to the proposed Capital Budgets and proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and Special Improvement Areas for the fiscal year 2025; and WHEREAS, the Town Board has taken into consideration the comments made by the public at the Public Hearing. RESOLUTION: 2024-205 Resolution Authorizing Installation Of Street Lighting Throughout The Town Of Wappinger WHEREAS, Town Supervisor Joseph D. Cavaccini has identified areas in Town that are poorly lit, and WHEREAS, it is necessary to install street lighting along the roadway to provide drivers at night visibility of vehicles entering into intersections and to be aware of pedestrians, and WHEREAS, where Losee Road, Miracle Circle, Lormar Court respectively meets Myers Corners Road have been identified as an area of need for street lighting, and WHEREAS, when the entrance to Cedar Hill Road was moved a new street light was not added at its current terminus where it meets Old Hopewell Road and has been identified as an area of need for street lighting, and WHEREAS, the location of the proposed street lights is outside the boundaries of any lighting district established in the Town of Wappinger, and WHEREAS, pursuant to the authority granted by Town Law §64(19), the Town Board may contract for street lighting on highways in the Town, and WHEREAS, Central Hudson Gas & Electric Corporation ("CHGE") provides street lighting within its service area pursuant to a Tariff Approved by the New York State Public Service Commission, and WHEREAS, CHGE has provided a Street Lighting Authority Order which sets forth the rental costs for the street lights and poles, and WHEREAS, Town Comptroller Jessica Servidio has advised that a budget modification is required to pay for the rental fees for the new lights, and NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town Board hereby accepts the terms of the Street Lighting Order which provides for a rental fee of $751.68 for four LED luminaries plus the cost of electricity and authorizes the Town Supervisor to sign the Street Lighting Order on behalf of the Town. 2. RESOLUTION: 2024-203 Resolution Authorizing the Revision of The Town of Wappinger Comprehensive Plan WHEREAS, the existing Master Plan was adopted in 2010 and contains goals for large scale multifamily residential development that are no longer consistent with the current goals and desires of the Town Board; and WHEREAS, the existing Master Plan also does not reflect existing conditions in the Town of Wappinger related to water and sewer capacity, traffic, population, as well as other factors that affect the qualify of life of the residents; and WHERAS, as a corollary, the Zoning Code, contains certain provisions that support the goal of the existing Master Plan, particularly as it relates to large scale multifamily residential development, which are also not consistent with current goals and desires of the Town Board and the capability of the Town's existing infrastructure; and WHEREAS, the Town Board desires to cause its planners, the Laberge Group, to propose amendments to the Comprehensive Plan that identify the Town Board's current goals and the current status of the Town's infrastructure and to propose amendments to both the Master Plan and Zoning Code that are consistent therewith. NOW, THEREFORE, BE IT RESOLVED, that Laberge Group is hereby authorized to prepare updates to the Master Plan consistent with this Resolution and thereafter to propose amendments to the Zoning Code consistent therewith and to guide the Town Board through the Master Plan and Zoning Code update process including compliance with the State Environmental Quality Review Act and any other applicable rules and regulations. RESOLUTION: 2024-204 Resolution Introducing Local Law Of 2024 Amendment To Chapter 230-45, Schedule Xi Dean Avenue Weight Limit WHEREAS, the Town Board is considering the adoption of Local Law No. of 2024 which would amend Chapter 230-45 of the Town Code with respect to Schedule XI to add a weight limit of 10,000lbs for vehicles traversing Dean Avenue (the "Proposed Action"); and WHEREAS, for the purposes of the New York State Environmental Quality Review Act (SEQRA), the Proposed Action is as defined above; and WHEREAS, the Town Board has determined that the Proposed Action is an Unlisted Action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA"); and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action; and WHEREAS, a Determination of Significance has not yet been made with respect to the Proposed Action.
