Consent Resolutions RESOLUTION: 2025-1 Resolution Accepting Resignation Of A Town Of Wappinger Employee WHEREAS, Jessica Servidio has served the Town of Wappinger honorably as the Town Comptroller for one year, and WHEREAS, Jessica Servidio throughout her tenure served as a steward of the people and a fiscal watchdog over the Town's finances, and WHEREAS, Jessica Servidio has submitted her resignation to the Town Supervisor as Town Comptroller effective January 17, 2025, and NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board acknowledges and regretfully accepts the resignation of Jessica Servidio as the Town Comptroller. 3. The Town Board acknowledges that Jessica Servidio has served the Office of Town Comptroller and the people of the Town of Wappingerwith great distinction and dedication and wishes her manyyears of happiness in her future endeavors and commends her for her devoted term of service. 4. RESOLUTION: 2025-3 Resolution To Adjust Town Of Wappinger Mileage Reimbursement Rates For 2025 WHEREAS, pursuant to Town Law §116(1), the Town of Wappinger compensates employees for the use of the employee's personal vehicle whenever the employee utilizes such personal vehicle for Town business; and WHEREAS, the Internal Revenue Service has established the allowable reimbursement rate for 2025 at the rate of $0.70 per mile for business miles driven; now, therefore BE IT RESOLVED, that the Town Board hereby establishes and authorizes the allowable mileage reimbursement rate to a Town employee at $0.70 per mile for business miles driven whenever a Town employee uses his/her personal vehicle for Town business, effective January 1, 2025; and Town of Wappinger Page 3 Printed 1/23/2025 Reorganization Meeting Minutes January 13, 2025 BE IT FURTHER RESOLVED, that this rate shall remain in effect until modified by further Town Board Resolution. Cavaccini as the Budget Officer for the Town of Wappinger, effective January 1, 2025; and WHEREAS, there exists a New York Civil Service job description (BS0102) with enumerated qualifications as provided to the Town Board with this resolution; and NOW, THEREFORE, BE IT RESOLVED, as follows: 1. RESOLUTION: 2025-11 Resolution Authorizing The Submission Of The Supervisor's Annual Report To The State Comptroller WHEREAS, pursuant to Town Law §29(10-a), the Town Board may authorize the Supervisor to submit a copy of the annual update report to the State Comptroller (required by General Municipal Law §30) to the Town Clerk in lieu of preparing an annual financial report accounting for all monies received and disbursed by him, together with certificates of the bank or trust company where Town monies are deposited which show the amount of such monies on deposit; and WHEREAS, the information included in the report under General Municipal Law §30 is the same financial information required by the Supervisor's report so the preparation of two reports results in a duplication of efforts; now, therefore BE IT RESOLVED, that the Town Board hereby authorizes the Supervisor to submit a copy of the annual financial update document for the Town of Wappinger, required by General Municipal Law §30, to the Town Clerk in lieu of the report of the Supervisor required by Town Law §29(10); and BE IT FURTHER RESOLVED, that the Supervisor shall file the copy of the annual financial update document for the Town of Wappinger with the Town Clerk within 60 days after the close of the fiscal year, or within such additional time that is granted by the State Comptroller pursuant to General Municipal Law §30; and BE IT FURTHER RESOLVED, that the Town Clerk is directed to cause notice of the filing of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller, in the official newspapers of the Town; and BE IT FURTHER RESOLVED, that this authorization, pursuant to Town Law §29(10-a) shall continue from year to year unless it shall be rescinded by further action of the Town Board. RESOLUTION: 2025-36 Resolution WHEREAS, the Wappingers Falls Manufactured Home Park (the "MHP"), located at 91-95 New Hackensack Road, Wappingers Falls, New York (the "Premises") is served by a federally designated public water supply system containing three wells which is now experiencing the presence of perfluorooctanesulfonic acid (PFOS) contamination; and WHEREAS, no economically viable alternative exists for the treatment of the wells from the PFOS therefore the owner of the MHP has requested that the Town of Wappinger Town Board permit a Town of Wappinger Page 28 Printed 1/23/2025 Reorganization Meeting Minutes January 13, 2025 connection to the Town of Wappinger United Wappinger Water District (the" UWWD") in order to the MHP to be served by potable water to be supplied by the UWWD; and WHEREAS, correspondingly, the owner of the MHP has also requested that the boundaries of the UWWD be extended to include the Premises and, in support thereof, has caused its engineers to prepare a Map, Plan and Report in accordance with the relevant provisions of Town Law for review by the Town; WHEREAS, the MHP has also requested that the Town Board grant a waiver of conflict for its engineer, Lawrence J. Paggi, P.E., P.C. to continue to work on this project as the design work for the extension of Premises to UWWD commenced before Lawrence J. He pointed out that the warrantees were better with the higher bidder offering 12 years versus 5 years with the lower bid and suggested we award it to the higher bidder, Folkes. The Town Clerk pointed out that the bid details sent to the Town Board, Attorney, Engineers and the Attorney regarding both bidders that Folkes did not provide the minimal requirements for a formal bid, i.e. the Non -Disclosure agreement nor the Bid Bond. The Attorney agreed that that bid be invalid and not a qualifying bid. You need to get it right the first time. The attorney pointed out that there was only one bid. As the only non-voting member, we strive to work amicably with you to make our three - decade long partnership work in the best way possible for all parties involved. However, when past practices and misinterpretations impede our government operations, it is important that I share our concerns with you. The Town of Wappinger has paid in advance for our quarterly billing based on a poor interpretation of our 1991 agreement. We do not contest the method in which we are paying the commission but rather the amounts that we are paying due to estimated payments due to pre -payment. This has caused consistent credits to our account, as we do not have the correct amount due to paying in advance. The 1991 agreement between the Tri -Municipal Sewer Commission and the Town of Wappinger clearly states that "the initial payment far operation and maintenance by the Town shall he made in advance based on estimated flow: This agreement is necessary so that the Commission might ght have in handfiinds to de ftqy the initial cost of treating the 7bwns sewage. This amount shall be paid prior to admitting the Town of Wappinger sflow to the treatmentj" eilities, " Simply, the 1991 agreement does not mandate the Town of Wappinger pay in advance for every quarterly payment, only the first payment prior to connecting in 1991. On the contrary, the agreement states that the method of payment that the Town pays the Commission should be the same as Town of Poughkeepsie and Village of Wappingers Falls. In confinning with both municipalities neither of them pre -pay each quarter. On behalf of the thousands of residents who are tenants to the Tri -Municipal Sewer Commission, I request that the Town of Wappinger be allowed to pay our quarterly bill upon receipt of a bill provided to us showing our actual flows. Cavaccini and Taryn Riley, Personnel Administrator have determined that Salvatore Messale meets the qualifications to fill the position of Supervisor of Buildings and Grounds, and NOW, THEREFORE, BE IT RESOLVED, as follows: 1. Paoloni ADOPTED Initiator: MinuteTraq Admin Sponsors: RESOLUTION 2025-36 Doc ID: 6321 Resolution WHEREAS, the Wappingers Falls Manufactured Home Park (the "MHP"), located at 91-95 New Hackensack Road, Wappingers Falls, New York (the "Premises") is served by a federally designated public water supply system containing three wells which is now experiencing the presence of perfluorooctanesulfonic acid (PFOS) contamination; and WHEREAS, no economically viable alternative exists for the treatment of the wells from the PFOS therefore the owner of the MHP has requested that the Town of Wappinger Town Board permit a connection to the Town of Wappinger United Wappinger Water District (the "UWWD") in order to the MHP to be served by potable water to be supplied by the UWWD; and WHEREAS, correspondingly, the owner of the MHP has also requested that the boundaries of the UWWD be extended to include the Premises and, in support thereof, has caused its engineers to prepare a Map, Plan and Report in accordance with the relevant provisions of Town Law for review by the Town; WHEREAS, the MHP has also requested that the Town Board grant a waiver of conflict for its engineer, Lawrence J. Paggi, P.E., P.C. to continue to work on this project as the design work for the extension of Premises to UWWD commenced before Lawrence J. Paggi, P.E., P.C. was hired by the Town of Wappinger as its engineer. NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby determines as follows: 1. The Town Board hereby waives the conflict with Lawrence J. Paggi, P.E., P.C. in order for it to remain as the project engineer for the MHP; 2. The Town Board hereby acknowledges receipt of the Request to Extend the UWWD and directs the MHP to submit a Petition that conforms to the requirements of Town Law Section 194, Establishment or Extension of Districts togetherwith a Short Form EAF; 3. The Town Board hereby accepts the Map, Plan and Report and refers same to its substitute consulting engineer, Barton & Loquidice, PE for its review on behalf of the Town. Upon receipt of a conforming Petition together with a Short Form EAF, the Town Board directs the Town Attorney to review the Petition for conformance with Town Law and to prepare a resolution setting a public hearing for review for the forthcoming meeting of the Town Board.
