At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on February
10, 2025.

The following Resolution was introduced by Supervisor Cavaccini and seconded by
Councilman Phillips.
WHEREAS, municipal governments, when acting in the interests of the public, have qualified immunity
from the application and enforcement of their own codes, rules and regulations, which includes the
enforcement of the requirement to obtain permits from the Building Department for improvements to
municipal properties;
WHEREAS, notwithstanding its qualified immunity, the Town Board recognizes that obtaining permits
from the Building Department for municipal improvements are in the best interest of the residents of
the Town as the building permit process provides an additional measure of safety and ensured
compliance with the applicable building codes of the State of New York; and
WHEREAS, the Town Board, therefore, desires to establish a policy to obligate all of the departments of
the Town that engage in making physical improvements to municipal buildings and grounds to obtain
permits applicable to said work from the Building Department prior to engaging in such work.
NOW THEREFORE, BE IT RESOLVED, that it is now the policy of the Town of Wappinger that prior to any
improvement to the buildings or grounds of the Town, that the department of the Town making said
improvement shall obtain a permit from the Building Department to the extent that a building permit or
other applicable permit is otherwise required for said work. No fees shall be required to be paid for any
such permit. Following the completion of said work in compliance with all applicable laws, rules and
regulations, the Building Department closeout said permit with a certificate of occupancy or certificate
of compliance.
The foregoing was put to a vote which resulted as follows:
